2. Discussed the dangerous tree on Warren Ave. and stated he had
contacted the owner and the tree has been removed. Urged handling
similar problems by discussion and stated he felt there would be
more cooperation this way. Clerk read letter from Asst. City
Attorney, dated Oct. 25, 1977, which stated BMC 11.16.010 provides
for the removal of vegetation that "obstructs or impairs the free
and full use of the sidewalk or street"; but the tree at 1010 9th
St. does not interfere with the use of the street, sidewalk or
alley. The letter also stated that RCW 7.48, which relates to a
nuisance, is a possible solution to the problem, though it does
involve the initiation of a legal action. Commissioner Stewart
stated there should be an ordinance prepared in regard to dangerous
trees. Also suggested setting up a small group for people to talk
to. A Board could solve a lot of problems that the City is hassled
over now. Stated he feels the first attempt should be verbal com-
munication and then legal action if necessary.
Commissioner Schoneman:
1. Stated he is certainly glad that tree is down and not at Uity's
expense as was thought of doing last week. Would have had a real
problem as far as doing that with other trees.
2. There was a water main break on Kean St. Friday night and it
was repaired on Saturday. Seems to be a lot of water main breaks
lately. One that is presently being repaired is next to Warren
Avenue Bridge and it will be repaired today. Due to the tide action
in and out, the line is moving, so are putting large concrete blocks
on both sides of the pipe to keep it from moving. Should be back
in service by tomorrow.
$. Waiting for sign on Cambrian to be connected. Barrier is com-
pletely installed. Mr. Waring stated it should be done today or
tomorrow.
4. Sheridan is finished and ready for final inspection. Stated the
City agreed to the 46-day extension with Moss Construction.
5. Expecting to hear from the State Highway Dept. this week. Mr.
Waring hand delivered the results of bid opening and asked them to
expedite approval so could have preconstruction conference and start
as soon as possible.
6. Had quite a few problems with the amount of rain and leaves
falling. Had many flooded basements and crews were kept busy.
7. Introduced 4~ Smith, his daughter, Mary, and her daughter,
City Clerk Yeadon:
1. Stated he had a two-week vacation and enjoyed it very much. He
enjoyed the sunshine and was able to be with his youngest son for
his 21st birthday.
2. Stated he has to make a decision whether to retire as of Dec. 1st
or Jan. 1st or whether he would continue until the end of his term
of office. The reason for the uncertainty is the long-range effect
the choosing of a proper retirement and time will have upon his
future. Commissioner Schoneman stated he was looking at proper
retirement time also and then Clerk read letter from Dr. Campbell,
which is on file in the City Clerk's office.
Mayor Jarstad:
Stated ground-breaking ceremony for the new indoor swimming pool
complex has been set for Monday, Oct. 31st at 9:30 A.M. He stated
there is a possibility Congressman Dicks will be in town this week-
end and it would be nice for him to be at the ground-breaking
ceremony. He stated Mr. Dicks' staff helped tremendously in getting
the grant.
Meeting recessed from 10:20 A.M. until 10:35 A.M.
Mr. Ryan left the meeting at this time and Mr. Sexton entered.

GREEN SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT DECISION
Ken Attebery, Planning Director, gave the background or Mr. Green's
request and stated Mr. Green is now proposing to build two duplexes
on this piece of property. Commissioner Stewart asked that Mr.
Walton give his presentation again so Mr. Green knows what was
discussed last week~ and he was informed that Mr. Green received
a copy of the tape of last week's hearing. Mr. Walton did not speak.
PROPONENT:
Robert Green, Architect, read a summary of his arguments in favor
of his pro3ect being located on this property, which summary Mr.
Green promised will be filed with the City Clerk.
Discussion was held concerning whether Mr. Green complied under the
provisions of the new Bremerton Shoreline Management Master Program,
particularly concerning setbacks and Mr. Sexton suggested another
week should be allowed for final research before Council makes a
final decision. However, it is apparent from previous statements
made to the City Council by Mr. Sexton and Mr. Attebery that the
provisions of the Master Program were to be applied. The problem
with Mr. Green's project is that he had applied for a building
permit and he stated he had paid a fee under the nine-units per
acre ordinance. The building permit was never issued because of
the Initiative Ordinance, which was being proposed and the repeal
of the nine-units per acre by the City Council. It was Mr. Sexton's
opinion that he never was vested in his right to a building permit.
Mayor Jarstad felt Council should follow the past recommendations
and deny the application for this project. After further discussion,
the following motion and amendment was made:
Motion by Mayor Jarstad and Commissioner Stewart that the proposal
be denied due to the information that has been received that is
applicable to the Shoreline Master Program which has been adopted,
subject to reversal by the City Attorney's Office.
Amended Motion by Mayor Jarstad and Commissioner Stewart that final
motion will take effect at the closing of the hearing on the notifi-
cation from the City Attorney's Office.
