He stated having a public use area either proposed or put into being by Council action in the future would put a cloud on their title and make it difficult to sell their homes. He stated he had a petition signed by all but two city employees, from the area directly affected to ask the city council to remove from consideration the public use designa- tion. Mr. Machinski filed a photostatic copy of the petition. A lengthy discussion was held and Mayor Jarstad explained the reasons for making this suggestion to the Planning Department and which is to be discussed by the Sheridan neighborhood people; however, Mr. Machinski did not want this discussed by that group because if their houses were removed, the residents on the north side of Lebo Blvd. would have waterfront view and, therefore, suggested they might favor tile public use designation. Clerk stated he had advertised the hearing as required by law; then read Planning Resolution No. 374 which concluded the proposed plan would be consistent with the Comprehensive Plan for the area, and would be develop- ment of a lower density for the site with additional open area. The recommendation of the Planning Commission was to approve the change and adopt the site plan marked "Exhibit A-2" dated Aug,. 17, 1976, and that ingress be off Naval Avenue and egress be to the alley. Clerk stated that only one protest had been received in writing, from Mrs. I. B. Archi- bald of 1935 Gregory Way. Present was Donald L. Warner, Broker, Sunshine Realty Inc., representing property owner Barnharts of 111 Naval Avenue. He gave a letter to the City Clerk for consideration which asked that decision be withheld and the matter tabled until proper notification could be given to Mr. Barnhart who is somewhere between Japan and the Philippines, and answer time be allowed. Mr. Stewart noted that his complaint about the rezone was too late as that has already been done and this matter is only concerning reducing the units from 12 to 10. Mr. Warner stated he did not have power of attorney but would file the letter to keep faith with his client. -3- CITY COUNCIL MINUTES Page four October 13, 1976 Mr. Ken Attebery, Asst.
