MASSEUSE OPERATOR - GALLEGOS - Pearl Sauna Clerk read application for a new sauna parlor to be located on Wheaton Way and a letter from Craig Jac6bs of Bremerton Realty which asked for approval subject to meeting requirements of the city in order that Mr. Jacobs might close his transaction between the property owner and Mr. and Mrs. Gallegos. Mr. Craig Jacobs was present at this time along with Mr. Gallegos. Clerk stated approval had been given by the Health Dept. subject to certain requirements in connection with the plumbing. Police Department memo was read by the Clerk recommending denial because of charges of alleged prostitution against some employees of Mrs. Gallegos in Pierce County and that further charges are pending the results of the proposed trials of the employees. Also, that Mrs. Gallegos was arrested for vagrancy; and more formal charges are pending. Considerable dis- cussion followed with Mr. Gallegos participating. Mr. McCluskey stated that he had gone over the reports; there is an automatic denial if there is a conviction and a charge doesn't make a conviction. Commissioner Schoneman asked if it is possible to determine whether any trial is forthcoming. Mayor Jarstad stated the City Attorney Asst. McCluskey should look over the reports; that there needs to be more information before City Council for decision. Motion by Commissioner Stewart and Mayor Jarstad to approve providing all other provisions are met. Further discussion was held concerning whether this was the proper procedure. Mr. McCluskey advised this was not an illegal procedure; but the City Council could delay action until further investigation. Mayor Jarstad stated that in light of the memo. which has come from the Police Department he would withdraw his second. Commissioner Schoneman stated he would like to amend the motion to delay for two weeks. Mr. Gallegos stated the seller is unhappy because of holding up a sale. Motion by Commissioner Schoneman and Mayor Jarstad to have a continuance of the hearing of this application and delay for two weeks and obtain further information from the other police department and recommendation from the City Attorney's Office, also; carried unanimously. ARMED FORCES BOAT RACES - KITSAP LAKE Clerk read letter dated July 7, 1976, from Chamber of Commerce asking approval for use of Kitsap Lake for this event, Sunday, Aug. 1, 1976. Motion by Mayor Jarstad and Commissioner Stewart to approve the request subject to approval of the Police Chief, carried unanimously. 10:00 REPORTS: Commissioner Stewart - 1. Reviewed the losses to the transit system; gave a report of ridership on certain lines; recommended eliminating Jackson Park-Erland Point run, Rocky Point run, and taking a severe look at Navy Yard City run. Erland Point and Rocky Point, and Navy Yard City runs are not in the city and not paying their way nor the are~a paying household tax; and the Jackson Park run has very low ridership. After discussion, Mayor Jarstad suggested Commissioner Stewart take action under the authority granted him as transit director. Commissioner Stewart stated he would be announcing shortly what runs are being eliminated. Also, Mr. Stewart commented on a change in the route known as #4, West Sheridan, wherein the bus will not go into the Value Giant and K-Mart areas except to come off the Riddell Road and then proceed on back through the llght. Traffic has impeded the bus and made it lose considerable time. Also, the bus will use Halvorsen -2- City Council Minutes July 14, 1976 Page three instead of Olympus, between Sheridan and Schley, and will go to Riddell Road. This change will take place Monday. Also, a possible long-range solution has been suggested which can reduce from six to three buses a day and still give good service and that is to have a loop bus on either side of the city and one bus running between, using transfers to go downtown. 2. Water and sewer utility showing a big deficit; spoke in behalf of necessity of raising rates; costs have increased since last raise in 1971; has the defense department audit which two years ago showed the water cost was 24~ per 100 C.F. and the city is losing on water sold to the navy; sugges ed raising all water rates to industrial users to 30¢. In other areas, sewers should go up a 5¢ for each 100 C.F. and water should go up 5¢ for every 100 C.F. Motion by CoMissioner Stewart and Mayor Jarstad to raise the navy and other industrial users and raise rates accordingly. Mayor Jarstad stated that it is not unusual to have raises in utilities; people want to keep utilities up and complimented Commissioner Schoneman for the operation of the utilities and that the city compares favorably with rates in other cities in the state; also, that cost to customer for wastewater treatment is much less than any place in the county. Motion carried unanimously. Commissioner Schonoman 1. A letter was submitted to the Dept. of the Navy with regard to their supporting the construction of a two million gallon reservoir in Jackson Park area; that a letter from the city dated April 20, 1976, to the navy had suggested dividing the costs 55% to the city and 45% to the navy. This is in a recreational area and it is necessary to have a dual use of the reservoir. The reservoir will be placed below ground and the top used for an outdoor community theater. Read letter dated July 2, 1976, from the Navy which stated their legal counsel has given an opinion that the Navy would be Justified in participating in the construction costs but not in any recreational facilities; however, would participate in costs of "screening" to a limited degree. Still working on additional developments; BOR has made suggestions for participation on the kind of recreation which would be put on the reservoir. 2. Reported on forestry and logging activities which will bring in about $100,000 this year. So far have received $47,000 for small logs. Due to intensive forest management will probably increase income in five to 10 years to $200,000. 3. Building permits on the increase. Up until in June had a total of $7,000,000 worth of construction going on. 26 permits taken out from July 1 to July 13; $71,381.00 total valuation. 4. Presently involved in program of smoke testing to see where storm water is getting into sanitary sewers. Appreciate news media helping to inform the public. This water will have to be eliminated from entering the wastewater system and owners will be notified to do so at their cost. 5. Only had one flatbed truck and Army surplus has indicated they have two flatbed trucks with low mileage available to the city. These were picked up yesterday; one for the Street Dept. and the other to Water Dist. 6. Have a letter dated July 8, 1976, from Port of Bremerton advising that they are starting to improve the First Street Dock; 1/2 of the dock will be improved and parking will be re-arranged with very little less of parking spaces. There will be fencing around the perimeter and benches for the public. Fishing will be allowed. -3- City Council Minutes July 14, 1976 Page four Discussion with people has been held concerning the possibility of a roadway around the perimeter of the Narrows; next was the possibility of a concrete wall in event start demolishing old buildings downtown and need a place to dump; however, the cost of a retaining wall around the water- front would be too tremendous. Now, there is design in progress for a boardwalk which would allow a connection from Second Street around the waterfront to Pacific Avenue. Possibly boats could be tied up to such an improvement. Mr. Waring, Asst. City Engineer, is well qualified to do the design. Will be coming in with some suggestions to the City Council. 8. Held up somewhat on Sheridan Road for reconstruction of four lanes between Pine and McClain due high-line poles which will have to be adjusted. The power company is proceeding and moving in with new poles and heavy equipment. These will be placed back of the curb. The contractor is standing by ready to pour curbs and gutters. 9.Stairway at north approach Warren Avenue Bridge - construction started this week with steel supposedly on hand. 10. Had a report from Mrs. Setterlund, 323 N. Wycoff, that she had a problem adjacent to her property; had the building and fire inspectors review this site. Read letter from the inspectors which concluded there was no viola- tion of ordinance, the lot is no worse than others in the city, and the complaints were unsubstantiated. Read the ordinance on "noxious weeds" and stated this would require an owner to remove if they were found on his property. Stated he had viewed the property and there is a ground cover like this on similar property; that the ground cover is not a detri- ment when not noxious. Mrs. Setterlurid was present and reviewed her com- plaint and what had been done by various city officials. She read from a letter. Stated the health department had not looked at the property yet. Mr. Schoneman asked that everyone drive by and see the natural growth covering. Mayor Jarstad advised her that he was sure there are enough people checking into to fulfil her complaints. Mayor Jarstad stated a new format will be established so that persons not on the agenda may be heard and so the hearings may be able to start as advertised; that citizens comments will be heard at 10:00 A.M.; that commissioners reports will be given and then continued after the hearings. Meeting recessed at 11:00 A.M. for five minutes. BIDS - Water meters, (cold water & compound) Motion by Mayor Jarstad and Commissioner Stewart to open the bids, carried unanimously. COLD WATER METERS Clerk opened bids and read from the following. All bids had bid deposit. Western Utilities Supply Co., ITT Grinnell, H. D. Fowler Co. Inc. Pacific Water Works Supply Co., Inc., Rockwell International, Neptune Water Meter Company. Motion by Commissioner Schoneman and Mayor Jarstad to refer the bids to the Water Superintendent for tabulation and immediate return with the results. Under discussion: Commissioner Stewart abstained from voting on the motion due to his very small interest in ITT Grinnell. Clerk sug- gested the bidders who were present should go with the Water Supt. so they could check the bids and see the tabulation. Motion carried. COMPOUND WATER METERS Clerk opened bids and read from the following. All bids had deposits. Pacific Water Works Supply Co., Inc., Water Mettics Co., Western Utilities Supply Co. Motion by Commissioner Schoneman and Commissioner Stewart to refer the bids to the Water Supt. for tabulation and immediate return with the results, carried unanimously. -4- City Council Minutes July 14, 1976 Page five REZONE HEARINGS - KINNEY, EMERY ARNOLD Motion by Mayor Jarstad and Commissioner Stewart to open the fezone hearings and hold them in the foilowing order: Kinney, Arnold and Emery carried unanimously. JOE KINNEY REZONE - R-1 to R-2 (Lots 6 &7, Blk 5, Navy Park 1st Addn.) Clerk stated he had mailed letters, posted and published a notice, all as required by the zoning ordinance. Then read Planning Resolution No. 365, which concludes that the reclassification of the property is proper and recommended the City Council approve the fezone with the condition that "the site be developed essentially in accordance with the site plan presented, attached hereto marked Exhibit "A". Clerk read Staff Review dated June 15, 1976 and minutes of the Planning Commission dated June 15, 1976. Ken Attebery, Asst. Planner, spoke about the area, showed a colored map of land uses in adjoining neighborhood; then showed second map as the site plan. Discussed traffic flow and parking. Motion by Commissioner Stewart and Mayor Jarstad that an environmental impact statement is not required, carried unanimously. Difficulty of ingress and egress was discussed by Commissioner Schoneman. Ken Attebery stated parking is planned to be all under the structure and comments of the Police-Traffic are on the old plan; that this plan shown today was presented shortly before the Planning Commmission hearing was held; however, the traffic division was still concerned with the Naval Avenue situation. PROPONENTS Mr. Joe Kinney, Rt. 1, Box 1417-R, Bremerton, discussed the ingress and egress situation; stated some of the tenants Will not have vehicles and some would walk to the navy yard. Houses there are old and need to be replaced and would like to build twelve apartments or whatever is room for there; also, stated there are other apartments in the neighbor- hood. Commissioner Stewart asked if he had any objection to right turn only off Naval Avenue for ingress and he stated he did not and they would have to use the alley for exit. Barry Branch, 307 Great Northwest Building, architect, employed by Mr. Kinney for this project, stated the first site plan was a sketch done by someone other than his firm; that he had prepared a site plan to be sub- stituted for the original site which accompanied the original application and, to his knowledge, the departments had not had opportunity to review the site plan here today. Mr. Branch discussed the site plan; parking under the building, will not be backing into the alley and a solution which will work to traffic is to make Naval Avenue entrance to the property only. Stated this is essentially one building with entrance from central corridor. Will appear as three stories from Naval Avenue because of the fall to the alley. Have allowed for landscaping and planting, although not shown on this plan which was hurriedly prepared, to enhance the apartment. Mr. Kinney does not intend to cater to a childrens' market. OPPONENTS Mrs. I. B. Archibald, 1935 Gregory Way, stated she understood sailors were to be housed there and was opposed to the project because of problems they often pose, such as noisy cars and motorcycles. Said traffic problem was terrible on Naval Avenue and questioned how she and neighbors would get into their property. Stated she would have a loss of view, and she wouldn't object to a low building. Spoke of parking problems now on Gregory Way; also, she has to go the wrong way in the alley to get to her property many times because of navy yard traffic. Commissioner Schoneman discussed the street improvements in the Naval, Burwell and Fourth street areas and that the commissioners were very aware of the traffic situation; also, stated -5- City Council Minutes July 14, 1976 Page six it has been determined that no one in an area buys a view on someone else's land. Mrs. Archibald objected to additional cars, traffic, motorcycles and number of people to be added to the area. Commissioner Stewart commented that these problems will exist whether or not the area is rezoned, and the number of cars to be added will be insignificant as to what goes through the Naval Avenue gate. JAMES CAMPO, 1939 Gregory Way, stated there was no housing shortage in Bremerton according to newspaper; also, discussed traffic problems due to busy Naval Avenue and stated there were enough people living in the area now. Further, that the navy is Just completing a ten-story building in the navy yard nearby for single men; also, that other sailors gather at a single sailor's apartmant and hold parties, which he finds objectionable. Stated not enough parking if there are guests. Said apartments are not always built as plans show and there is no guarantee they will be kept up in the future. Conmissioner Stewart stated he was concerned with traffic but he did not believe twelve apartments would contribute significantly. Mr. Campo claimed children could be put in the apartments and there is no yard and he will put up a fence around his pool to keep children out. He discussed the importance of his view; and objected because of density. Mayor Jarstad stated apartments are well kept up because of the large investment and Commissioner Schoneman stated he felt Mr. Kinney was trying to improve an area that has old shacks. Mayor Jarstad asked the Asst. Planner concerning density. Mr. Attebery stated he thought the Council would be in a position to request the applicant to look at an alternative if the problems raised were great enough. Mayor Jarstad stated he wanted to hear about density and whether it is satisfactory; that parking has been covered and it is more than normal. Mr. Attebery stated he had noticed that Residential II proposals are coming in at more than 30 units per acre and this is for 39; that maybe when multiple family proposals come in it might be well worthwhile to make a study on density at that time. Further, stated that parking in this proposal is to be under the same roof and this site would be much more difficult if parking were not underneath. Plan shows yard areas not untypical of residences. Commissioner Stewart asked if R-1 could go to 30' in building height and Mr. Attebery stated that was true and in R-1 could be from the street higher than this plan. Motion by Commissioner Schoneman and Commissioner Stewart to allo~ the rezone for the construction of the units and that certain restrictions be placed on the egress and ingress on Naval Avenue to be determined by the Traffic Division and according to the site plan presented this morning, carried unanimously. METER BIDS Mr. Moore, Water Supt. reported that Pacific Water Works was low bidder meeting the specifications; that Ho D. Fowler was low but did not meet the specs on the 5/8"x3/4" meters. Pacific was low on the compound meters. Motion by Commissioner Schoneman and Mayor Jarstad to award the meter bids to the low bidder, as recommended, carried unanimously. TIM S. ARNOLD REZONE - R-1 to B-3 Clerk stated he had posted, mailed and advertised as required by the zoning ordinance. Then read Planning Resolution No. 366 recommending denial. Clerk read minutes of Planning Commission dated June 15, 1976. Ken Attebery, Asst. Planning Director, discussed the fezone area using an area map; also, displayed a site plan. 1966 comprehensive plan and View Ridge Neighborhood Plan indicate this area to remain urban residential. -6- City Council Minutes July 14, 1976 Page seven PETITIONER - TIM ARNOLD Stated the Planning Commission vote was not unanimous; that Mr. Hall did not vote in connection with the denial. Said he felt the primary use of the property in that location does not serve as R-l; it is landlocked between residential and business; that he could not secure access from Ivy Road. Stated there is a caretaker's house on the property now and all the residents on Ivy Road showed no objection to the proposal at all. High traffic all around there and high density, also. The proposed mini- warehouses are to be placed in an area where they will not be visible from the other areas. The warehouses are designed to service small personal storage. Stated there is a need for this storage of personal belongings. Also, stated there is no way the area can be used as R-1 sandwiched between R-1 and B-3. OPPONENTS A1 Hanson, Manager, Conifer Development, stated apartments on two sides of the area and this zoning would be to industrial usage, so this proposal is unattractive and unsuitable to an area basically single family and residential. Pointed out that the land is landlocked and has a 15' ease- ment from Wheaton Way and said he felt there were other uses than as pro- posed. Spoke of cooperation with city in designing their apartments and have put in a bicycle path. Stated they would like to keep the residential character and eliminate something like this going in the middle of the area. Mrs. Fannin, 1231 Ivy Road, stated the building would be in her back yard, the access road is very narrow making it very difficult for trucks to enter; against warehouse and should be kept residential. If sewage is ever needed, it would have to be installed through their property. Mayor Jarstad stated this has been turned down by the Planning Commission and this would be an intrusion into an R-1 and R-2 area and the city has been trying to maintain those classifications there. Motion by Mayor Jarstad and Commissioner Stewart to concur with the Planning Commission and deny this application, carried unanimously. Recessed at 12:50 P.M. to 2:00 P.M. Meeting convened at 2:00 P.M. with Mayor Jarstad, presiding. Also present were Commissioner Stewart, Commissioner Schoneman, City Clerk Yeadon, Asst. City Attorney McCluskey and a member of the press. WALTER ~{ERY REZONE - Kitsap Lake Junction Clerk stated he had posted, mailed and advertised as required by the zoning ordinance; then read Planning Resolution No. 359 recommending approval of the rezone from Kitsap County Business to Business-Three; also, read minutes of Planning Commission dated June 15, 1976. Motion by Commissioner Stewart and Mayor Jarstad that an EIS not be required, carried unanimously. Ken Attebery discussed the rezone request; stated there are three acres in the back of the stores w r once there had been mobilehomes but in the city the requirement is three acres so that is out; also, a warehouse had been planned but it didn't materialize. Plan in the neighborhood is that zoning to B-3 is appropriate without a site plan. When annexed it was to come in as the county plan - business. Stated the best information he has is that it is 250' on both sides of the highway and this is the northern triangle which is R-1 but would go to B-3. Stated the movie theater is behind the area; also, there is no proposal now for the use of the property Motion by Commissioner Stewart and Commissioner Schoneman to approve the rezone as approved by the Planning Commission, carried unanimously. -7- City Council Minutes Page eight July 14, 1976 SEPA PROPOSED ORDINANCE - HEARING Clerk stated he had advertised this hearing in the paper and copies had Just been made available yesterday; that someone had called asking for a continuance of the hearing in order to get time to study the proposal. Motion by Mayor Jarstad and Commissioner Stewart to open the hearing, carried unanimously. There was no one from the public sector to testify on the proposal. Motion by Mayor Jarstad and Commissioner Stewart to continue the hearing for two weeks to July 28, 1976, at 10:30 A.M. and give copies to the commissioners, carried unanimously. Ken Attebery, Asst. Planning Director, stated the state law will be followed until the ordinance is adopted. APPEAL (withdrawal) SKIRVING ROCK CRUSHER Clerk read Withdrawal of Appeal signed by Robert M. Morrissey for the Kitsap Lake Environmental Association re: James Skirving Application for Conditional Use Permit. Motion by Mayor Jarstad and Commissioner Stewart to cancel the night meeting of July 28th due to withdrawal, carried unanimously. Commissioner Schoneman mentioned that a California firm is going to set up a redi-mix operation; county may have to restrict movement on roads in winter because of heavy trucks. OFFICE OF COMMUNITY DEVELOPMENT (Special Crime Alert & Bikeway System) Clerk read from copy of letter dated July 8, 1976, which stated Special Crime Alert and Kitsap Lake Interpretive Bikeway System project summaries have been reviewed and found to be consistent with state objectives; formal application to appropriate funding agencies may be completed. LID-320 - Work Force Account Clerk read memo dated July 13, 1976 from City Engineer requesting authoriza- tion for the Street Dept. to do the work on the alley from 12th 13th Street between Warren Ave. and Elizabeth Street, total estimate $3,892.50. Motion by Commissioner Schoneman and Commissioner Stewart to approve the work by city forces as requested, carried unanimously. RIGHT-OF-WAY PURCHASE, SYLVAN AT WHEATON (Firestone) Clerk read memo dated July 13, 1976 from Engineering which stated the City Council had authorized the engineers to negotiate for a six-foot wide strip of right-of-way from the Firestones at the Standard Station south of Sylvan Way on Wheaton, the appraised value at that time being $4,400.00. Recent contact with city appraiser indicates the value of the property required is now $4600, which is acceptable to the Firestones. Memo requested authoriza- tion to go to $4600.00 to be paid from Arterial Street Fund. Motion by Commissioner Schoneman and Commissioner Stewart to approve of the purchase, carried unanimously. ATTORNEY'S OFFICE - Legal Fees Clerk read report of legal department fees for June in total amount $11,493.02. In connection with above resolution Clerk read explanatory memo from Grants Administrator Theroux. SEWER DISTRICT No. 1 Agreement - Sewage Treatment & Disposal Clerk presented signed agreement by the district. Commissioner Stewart urged the city council members not to approve the present form. He discussed -8- City Council Minutes Page Nine July 14, 1976 the terms and stated the terms would call for a low rate forever; that rate should be established until the new treatment plant is built and at that time it should be the end of the rate. Also, there will be costs of programming. Would like to make it a flat rate and only pay the dis- trict the surcharge on a time period other than monthly. After further discussion, the mayor suggested the Asst. City Attorney go back to the district with suggestions from the city council: (1) the city would want this interim contract to be effective only under the current conditions of our current treatment plant, that any update or remodeling would necessi- tate a change in the contract and they would have to be looked upon as automatically customers of the City. (2) The other alternative is that the City Council will have to take the position in the interest of the city residents who elected us, that they will be billed exactly like any county resident, 50% surcharge on the bill. Commissioner Stewart stated if the city and district can't get together he would recommended going to court. Mr. Schoneman pointed out the district owns their lines and keep them up. Motion by Mayor Jarstad and Commissioner Stewart to instruct the city attorney to speak to the sewer district to give them the two alternatives and bring back an answer from them, carried unanimously. AMBULANCE MEETING Mayor Jarstad stated he was disturbed the meeting between the city, ambulance operator and interested citizens had not been held as scheduled.
