Clerk stated that he advertised hearing in the newspaper, mailed notices to
property owners within 250 feet of the property proposed for rezone and posted
property; all at the proper time as required by law.
Clerk read Planning Commission Reselution No. 326 recommending approval from
R-1 to B-2 with the proposed site plan and provided proper bulkhead and
fencing be installed as required for the retaining wall on the north property
line.
Ccmmissioner Stewart stated he owned property on the corner of Wheaton Way and
Cherry which is on a 20-year lease; price being based on the cost of living
index; that he has no control of the property which is over a block away, but
wants to be sure there is no conflict. Asst. City Attorney McCluskey stated
he saw no conflict of interest.
Clerk read Environmental Assessment and Staff Review stating proposed action
would not have a significant adverse impact on the envirorment.
Motion by Commissioner Stewart and Mayor Jarstad to accept the negative
declaration environmental assessment, carried unanimously.
Clerk read Excerpt from Planning Commission Minutes dated January 20, 1976,
and letter dated January 19, 1976, frcm George Booth in opposition to the
rezone. Clerk read letter dated January 12, 1975, frcm Medical Arts Group
stating their only concern was water run off and proper storm sewer drainage
should be required.
Ken Attebery, Asst. Planner, showed location of the property proposed for rezone
on an area map. Commissioner Stewart noted that the property was surrounded
directly by R-1, and Mr. Attebery stated this is correct. Mr. Attebery stated
that proper storm drainage will be taken care of at the Building Department
stage.
Mayor Jarstad stated the property owners were concerned with the height of the
retaining wall on the north property line, and asked what height this is to be.
Mr, Allen Matcalf, Applicant, stated they have been assured by the contractor
that the height will be no higher than eight feet, Mayor Jarstad asked what
the height of the building will be, and Mr. Metcalf stated it will be a one-
story, approximately 13 feet six inches.
Commissioner Stewart stated there is property in the area already zoned for
business, and he didn't understand why they wanted to enter the R-1 areas.
Mr. Metcalf stated this was the only property available to them at a reasonable
price, and if they planned to expand, they would adjoin commercial property.
Mr. Stewart asked the size of the proposed building. Mr. Metcalf showed the
site plan and explained the building will be 1550 sq. ft, plus a small patio
area; stated the structure is quite compatible with the residential area.
Mr. Metcalf stated that the proposed business is a one-man operation.
Mr. Stewart asked how many parking spaces, and Mr. Metcalf stated the City code
will he met allowing 12 parking stalls. Mr. Stewart stated that it didn't
seem as though 12 spaces would be required for a one-man business. Mr. Metcalf
stated there are times when several patients may be waiting and it is better
to have the parking available; also, stated they had to comply with the City
code.
COUNCIL MINUTES
PG. 5 2-11-76
OPPONENTS
Jack Dues, 1421 Sunset Vista, stated he also represents owner of Lot 3, and
their primary objection was to the spot zoning and they feel the property
would eventually go to R-2; also, indicated there are four other adjoining
lots that are vacant and the area would be better off to have one large clinic
over the entire area rather than five separate operations.
John Eurie stated he is located on the corner of Callahan & Wheaton Way and
is also representing Mr. Carrigan. Stated they are opposed to spot zoning
by putting a business zone in the center of an R-1 area that the business
people find it beneficial for them to buy less expensive R-1 property and
then have it rezoned. Stated the traffic is a problem at the intersection of
Wheaton & Sylvan.
Mr. George Booth, 2802 Hemlock, spoke in opposition to the rezone because
he felt it was spot zoning. Explained that the business is moving in on
their residential neighborhood from all sides, piece by piece. Stated he would
favor the area being put at its best use, but comprehensive planning should be
used so property owners can make future plans. Stated they don't know whether
they should improve their homes because they have no idea of the future plans
for the area.
Commissioner Stewart asked if the property owners would be in favor of zoning
the entire area for business; that this property will probably not be purchased
for residential use. No definite answer was given by the property owners.
Mayor Jarstad stated residential development in the area is doubtful and the
Council has a responsibility to allow development which would not detriment the
surrounding residential area. The Mayor stated the property owners should
have some indication whether the area is going to go into a regional medical
building concept; stated the property is vacant at the present time and some-
thing should be worked out that is compatible to the residential neighborhood.
Commissioner Stewart stated this is not the time to do "nothing", that if
something isn't done, the property will lay vacant which is not an asset to
the City. Mr. Stewart stated that hfe could not see anyone building a new home
in this area.
Ken Attebery, Asst. Planner, stated that Comprehensive Planning can be very
difficult causing a very thin line between the property owner's individual
rights.
Mayor Jarstad stated he felt a decision should be delayed until Commissioner
Schoneman can review the testimony and file. Asst Attorney McCluskey stated it
was his opinion this is not spot zoning due the most of area being medical offices.
Motion by Mayor Jarstad and Commissioner Stewart to conclude the hearing and
a decision be made at a later date at which time the property owners will be
notified of the date for the decision, carried unanimously.
SHAW REZONE HEARING
Clerk stated public hearing was advertised in newspaper, letters mailed to

as required by law.

request according to the site plan.
Clerk presented Excerpt of Planning Commission Minutes dated January 20, 1976~
and Environmental Assessment declaring there will be no significant environmental
