Commissioner Stewart stated that he owned the Dairy Queen property further down
on Wheaton Way. ~He asked if anyone wanted him to step down; that owning this
property would have no bearing on his decision. No one was opposed and Commis-
sioner Stewart did not step down.
Ken Attebery, Planning Director, stated the property is located at the NW corner
of Wheaton Way and Callahan Dr. and the parcel includes two existing residential
structures. He stated the applicants plan to remove the existing structures to
develop a 14,000 sq. ft. retail/office facility; that they propose a two-story
structure. He explained that the major concerns of the Planning Commission were:
(1) The rezone is not in accord with the desires of the neighborhood as it is an
encroachment into a residential area; (2) The Comprehensive Plan indicates high
density residential development which would be more compatible to the area; and
(3) The location is a hazardous traffic area and proposed development could be
detrimental to the surrounding residential properties due to the increase in
traffic and activity on the site.
Hearing recessed for bid openings.

ADREVE ASSOCIATES REZONE HEARING (Continued)
Michael Biggs, representing Adreve Associates, stated it will be a professional
office facility only; that there will be no retail businesses. He discussed
the construction of the facility and presented pictures of the site. He stated
that Callahan and Wheaton Way is a very hazardous intersection, but they think
they can improve that situation by putting a parking lot in and excavating the
high bank in that area. He stated they would be amenable to restricting left-
hand turns on Wheaton Way by constructing a barrier to prevent left-hand turns
in and out of the site. He stated the land use in this area is both commercial
and residential; that there has been a substantial change in the character of the
area from what the 1966 Comprehensive Plan indicates. He stated further he f~els
the rezone request is compatible with the change in the character of that area
and is reflective of the type of construction that will occur in the area and he
requested City Council approval of the rezone.
OPPONENTS:
Terry Walker, 2817 Hemlock, stated it is not the bank that cuts a person's view;
it is the curve in the road. He stated that dver 300 cars an hour use Callahan
and ambulances also use Callahan to go to the hospital. He stated he is opposed
to creating more of a traffic hazard in this area; that more office spaces are
not needed because there is office space available for lease further down on
Wheaton Way.
Cheryl Walker, 2817 Hemlock, stated that even though the posted speed limit is
30 mph, many people drive much faster. She stated she is concerned about the
children crossing Wheaton Way on their way to school and she is opposed to the
fezone.

Janet Kennedy, 2810 Hemlock, stated that crossing Wheaton Way is very hazardous
for the children. She stated traffic is the biggest problem and she does not
want more businesses that close to a school. She stated further that if a two-
story building were built at that location, she would lose all her privacy in
her back yard.
Glenn Vockrodt, 1409 Marlow, representing Manette Neighborhood Association, stated
this rezone would be another spot rezone and spot rezones are illegal. He stated
the slope of the street is the reason the corner of Callahan and Wheaton Way is
such a traffic hazard and that intersection cannot stand any more traffic. He
requested denial of the rezone request.
Mayor Jarstad stated that privacy for the neighbors is a factor that must be
considered.
Commissioner Swanson stated that Callahan and Wheaton Way is a dangerous inter-
section. He stated he does not think a development of this type is appropriate
in a residential area.
Motion by Commissioners Stewart and Swanson to follow 'recommendation of Planning
Commission and deny rezone. Under discussion: Commissioner Stewart stated that
sometime in the future consideration should be given to making Wheaton Way one-
way north from Callahan or putting in a no-left turn onto Wheaton Way. Mayor
Jarstad noted that it is a bad situation and stated that a study is being done
on that whole intersection. Motion carried unanimously.

the design. She stated this will be funded through the City's Federally-funded
Block Grant Program.
Jim Root, City Engineer, stated there is $50,000.00 available for the improve-
ments to 17th St. He stated 17th St. will be regraded and a sidewalk will be
installed on the north side from the CENCOM building to Park Ave. He stated
the street will have two 11-ft. driving lanes and there will be very little
change in the profile of the street itself.
Commissioner Swanson complimented the Engineering Dept. for the work done on
this project.
Vernon Higbee, 1302 Broadway, asked if there will be a street coming down through
the college and Mayor Jarstad explained that this project is on the other side of
Warren.
Phyllis McCarthy stated she owns 150 ft. of property on 17th St. and she thinks
this will be a big improvement. She asked if 17th St. would be one-way and Mr.
Root replied that it would not.
Motion by Commissioner Swanson and Mayor Jarstad to approve street and sidewalk
improvements as recommended, carried unanimously.
CITY/COUNTy AGREEMENT FOR TRAFFIC CIRCULATION STUDY
Clerk read memo from City Engineer, dated April 3, 1980, attached to which was a

A lengthy discussion followed regarding hiring a program coordinator for 1/2
year at $10,000.00. Commissioner Stewart stated he felt this was just another
"boondoggle" and he did not feel more staff was necessary. He stated he is in
favor of a grant for signing and street improvements, but not to add more staff
and provide lockers. Mayor Jarstad stated he supports the bicycle committee
in their efforts to make people aware of the energy savings by using bicycles
