AMBULANCE COI~I'RACT
Mr. ~y discussed the amended contract and stated Mr. Leyde is agreeable
to putting a ceiling on it. He stated he felt the appropriate ceiling ~ould be
the sum of $33,000.00 per yr. because of the cost of living increase.
Commissioner Stewart stated he thinks the City should pay only a percentage o~ the
unpaid bills; that there should be an incentive for Mr. Leyde to collect the unpaid
bills. He stated another ambulance company has a proposal to present~ titat the Ci~,
should not have to request ambulance service from only oue coapany.
Mayor Jarstad statc-d that the City now has an existing contract ~ith Mr. Leyde;
that there were no objections regarding the amending contract last week. He stated
everyone agreed that it was an improvement over the existing contract and iF this
amendment is not approved, the City will have to stay with the $30,000.00 subsidy.
Commissioner Stewart stated that tt~e Council should hear from the other company in
light of the new information that is now available.
Motion by Commissioners Stewart and Swanson to hear from the other operator and see
what his intentions are, carried unanimously.
Bill Littlejohn, Sequim, stated he operates Olympic Ambulance Service. He stated
he plans to apply for a license in Bremerton today; that he would hope the City
would either let out proposals for ambulance service or come up with a rotation
system which would make it equitable for both firm, s. He stated he operates seven
ambulances in the Port Angeles, Sequim and Port Townsend areas; that he does not
have a contract with any of these cities. tle stated further tt~at he hopes to be
in operation the first of next week; that he feels confident that there is room
for two ambulance services in Bremerton.

CITY COMMISSIONERS' MINUTES
April 29, 1980

Commissioner Stewart stated the City should get a proposal from both ambulance
companies, rather than enter into a new contract with Mr. Leyde. He stated he
sees nothing wrong with having more service available for the conTnunity.
Motion by Commissioner Stewart to postpone acting on the ambulance contract until
all the facts are in. Motion died for lack of second. Commissioner Stewart
stated the City will undoubtedly have another ambulance company next week and
the City should not enter into an exclusive contractor with only one operator
now.
Mayor Jarstad reiterated that the City has a contract with Mr. Leyde at the present
time; that this contract is only an amendment to the old one. He stated this
amended contract is a great improvement over the existing one; that no matter what
happens in the future, there is a 90-day escape clause which can be exercised.
John Tracy, Evergreen Legal Services, discussed the alleged abuse by Leyde and
asked what had to be done to get the City to cancel its contract with Mr. Leyde.
He stated that last week it was stated that the City is stuck with Leyde because
there was no other alternative; that this week a proposal for another ambulance
company has been presented. He stated that at the very least an investigati<}n
should be made to see if Olympic Ambulance is a valid alternative. He urged the
Council to cancel th8 contract with Mr. Leyde.
Commissioner Swanson explained that the contract has.a gO-day escape clause.
explained that all complaints were investigated by the Police Dept. and turned
over to the prosecutor; that it is a slow process, He stated the immediate issue
is the contract, not the charges filed against Mr. Leyde.
John Livingston, 2127 12th St., questioned which ambulance ordinances are in effect
and Mr. McCluskey explained that 3012 has been repealed and 3535 is in effect.
McCluskey stated there is no lonqer a monopoly for ambulance service and more than
one company can operate in the City.
ClauSetCe Williams~ 1410 12th St., stated she is an employee of the State and she
has d~alt with many people who have been abused by the present ambulance company.
She questioned why the City did not inspect the vehicles and personnel. Mayor
JarsCad explained that with the amended contract, the City will inspect equipment
and personnel. Ms. Williams stated she does not understand how a company like
this can be allowed to remain; that she has clients calling about the treatment
they receive from Leyde. She stated she supports Evergreen Legal Service trying
to get something done. Commissioner Swanson again stated that these complaints
have been investigated and turned over to the prosecutor.
Commissioner Stewart stated that all the City will do by approving the amendment
to the contract is control the personnel and ~quipment for OTle company. He stated
an emergency ordinance should be passed to control both companies. Commissionar
Swanson stated the proposal was to control only that equipment which the City
called; that he does not think it is appropriate to monitor all the equipment in
the City. He stated that the State inspects all equipment and the only thing the
City can control is that equipment which the City calls. Commissioner Stewart
stated that the City should make sure that the equipment and personnel meet the
standards set by the City.
Thomas Camden stated he is one of the victims of over-charging done by Mr. Leyde.
He stated he was charged for materials that the paramedics used. He stated the
paramedics are as fine a team as can be found .in the country.
Chief Devery, Police Chief, stated he objects to someone saying his department is
not doing anything regarding the allegations against Mr. Leyde. He stated two
people have been assigned to this and it has been investigated for over two months.
He stated the information has been turned over tile prosecutor and they are waiting
for due process of law.

CITY CO~,~MISSIONERS' MINUTES
April 29,

Commissioner Swanson stated that Conmissioner Stewart has said the Council has
not taken any action; that any action the City takes should be aimed at takihg
care of the City's responsibility for emergency services. He stated there is
aninitiative to have the Fire Dept. furnish emergency transport.
Motion by Commissioner Swanson that the Council put the emergency transport measure
on the ballot coupled with the tax levy which was rejected not long ago as a joint
proposal that if people are willing to pa3f for this, the City will do their own
emergency transport and let the State handle the ambulance inspections. Commissioner
Swanson stated the City can handle emergency transport if funding and financing is
available. Commissioner Stewart stated he would support that idea when he sees it
in writing. Motion died for lack of second. Commissioner Stewart stated he thinks
the City should inspect all ambulances, just as it does all tow trucks. Commissioner
Swanson stated the City only inspects those tow trdcks that are called out by the
City. Commissioner Stewart stated he would support an issue on the ballot so the
Fire Dept. can provide emergency transport; that he does not think it will hurt
private enterprise. Mayor Jarstad stated he does not think $100,000.00 will
supply the manpo~;er and equipnlent necessary to go into the ambulance business. He
stated the Fire Department's budget is strained to the limit now.
Dale Magnuson stated the City Council is elected by the voice of the people with
that trust that you v~ill make those decisions ~hat are in the best interests of
the people. He stated it would be tragic if the people had to get an initiative
up to tell the Council how th~y F~I.
Mayor Jarstad discussed the taxicab monopoly and towing service. He stated there
has always been more than one towing company in the City and the taxicab service
is a true monopoly since Mr. Maesner bought out Mr. Leyde. Mr. Magnuson stated
that he would hope the citize:~s would have a chance to choose an ambulance con/pany.
He stated any contract should be considered in light of what the people really
want; that City Council should 'look at transport very seriously.
Role~"d a!fred~ 1410 lOth St., discussed ambulance service in Tacoma and s~'ated
therii! are si;: ambulance companies in Pierce County and they worked with absolutely
no problems. He stated more than one company can work together.
Jim Strait, 6530 Harlow Dr., discussed the petition that is being circulated regardi~g
ambulance service and stated most of the people he has contacted have signed it.
He requested that the Council consider stopping the subsidy to Mr. Leyde and provide
adequate transport by the Fire Dept.
Harry Penor stated he bel iew..s the main concern today should be the postpe~e~:!en;.
of the contract with Mr. Leyde. I!e stated Bremerton has not had competii:i~n and
competition is needed. He si:ated that Olympic Ambulance should be given the
opportunity to prove tt'.emseives before action is taken on the amendment to tile
existing contract with Mr. Leyde.
Meeting recessed from 10:40 A.M. until 10:50 A.M.
Irene Burgougle stated she works for the State and Mr. teyde's units have been
inspected by the State. She stated they have been inspected more frequently than
usual and the State will cooperate and inspect at any time. She explained the
inspection process and stated the personnel listings must show that employees are
certified.
Mayor Jarstad stated the basic thing for the Council to make a decision on today
is tire amendment to the existing contract with Leyde. He stated the Ambulance
Committee recommended that this amendment be approved and Ire feels it is a big
improvement over the existing contract.
Motion by Mayor Jarstad and Commissioner Swanson to approve revised contract with
Leyde because it is a vast improvement over the existing contract. Under discus--
sion: Commissioner Stewart asked if a limit would be put on it. Leonard Co:~tello,
attorney for Mr. Leyde, asked what the limit would be and Mr. McCluskey s,~ated i b

would be $33,000.00. Commissioner Stewart stated it is good to have a ceiling en
the amount the City will pay. He stated there are some good things about this
contract, but he is still concerned about charging just one base fee for everyone.
Mr. Penor asked if this amendment will guarantee Mr. Leyde a $3,000.00 raise and
Mayor Jarstad explained that Mr. Leyde will have to absorb any no-pay calls after
reaching the $33,000.00 limit. Mr. Penor asked if this contract will eliminate
the possibilit~ of another cempany coming in and taking over some of tile emergency
transport. Commissioner Swanson replied that approval of the contract does not
eliminate future or continuing consideration for changes. Motion carried as
follows: Mayor Jarstad, Yes; Commissioner Stewart, No; Commissioner Swanson, Yes.
HEARINGS - Amendment to Certain Minimum Off-Street Parking Stall Requirements;
Amendment to Chapter I, Title IV~ Zoning Ordinance; and Change of
Certain Land Use and Other Permit Application Fees
Motion by Mayor Jarstad and Commissioner Swanson to hold hearings in order listed
above, carried unanimously.
TAPE #185 AMENDMENT TO CERTAIN MINIMUM OFF-STREET PARKING STALL R~QUIREMENTS
(A) 437 ~'~"~ated the bearing bad been posted and aevertised as required by law. She
read Planning Con~Hssion Resolution No. 563 recommending approval of amendments
to Section 715 of th~ Zoning Ordinance.
Ken Attebery, Planning Director, summarized the amendments: Hotels = 1 parking
stall for each unit plus the full requirement for accessory uses within the motel
such as newsstands, restaurants and personal service shops; Hospitals - I parking
stall for each 2 beds; Restaurants - (sit-down or standard restaurants) I parking
stall 'For each 100 sq. ft. of gross floor area, (drive-in restaurants) I parking
space for each 30 sq. ft. of gross floor area, and (fast-food restaurants) 1
parking stall for each 75 sq. ft. of gross floor area. Mr. Attebery stated there
are a number of variables which can enter into parking requireinents - location,
adjacent population density, availability of on-street or commercial parking lots,
business cperation practice~ number of employees, etc. He stated that the standards
will be reviewed in more depth in the coining months.
Commissioner Stewart stated he did not want to approve something that would eliminate
investment. He asked if there was any exception to this. Mr. Attebery replied
that there is a procedure for a variance. He stated the ordinance now provides
that parking can be shared with a neighbor or for other kinds of uses that do not
have the salae operating hours.
Greg Branch discussed the parking situation and stated there are many exceptions
to the parking requirements. He stated that some of the factors which n~ust be con-
sidered are the types of users, the types of functions involved and the area fa~.ctors,
He discussed in detail the overlap of difFerenL uses and stated one parking stall
'~or each motel unit is much higher than the City should require. He stated an
economic roadblock is being created that will slow development considerably. He
then discussed in detail the requirements for .par~ing for restaurants and stated
no business is going to cut its own throat by not providing adequate parking for
its .customers.
Commissioner Stewart stated the Planning Dept. and Planning Commission has done
a good job on this, but he does not want to kill the incentive for development.
He stated the City has to provide inves~nent opportunities, but he does not
to put a burden on neighborhoods by allowing businesses to park in residential areas.
Mr. Branch suggested rel!ianding this back to the Planning Commission for further
study. Commissioner Swanson asked Mr. Branch if he would be willing to work wi~h
Mr. ACtebery and his staff to categorize the different factors and Mr. Branch stai'ed
he would.
Motion by Mayor Jarstad and Com. missioner Swanson to table until such time as the Plannil
Director has a recommendation. Under discussion: Mr. Attebery stated it will be
advertised at that time. Motion carried unanilaously.

(A) 1638 Clerk stated the hearing had been posted and advertised as required by law. She
read Planning Commission Resolution No. 562 which recommended approval of a new
section 1306.1 of Ordinance No. 1792.
Ken Attebery, Planning Direc~or, stated from time to time the Planning Con~nissioners
will notice something in the community and bring it in for discussion. He stated
the only power the existing ordinance gives them is to sit in ,judgment and this
addition will allow them to initiate and undertake inves~.igations on the proper
application and interpretation of the zoning ordinance and to Inake findings and
recommendations to the City Council for action.
Moti on "" ' '
~ Commissioners Stewant and Swanson to approve addition of Section 1306.1
as follows: "The Comn/ission shall also be authorized to initiate and undertake
investigations on the proper application and interpretation of the zoning ordinance
and to make findings and recommendations to the City Council for action, if any is
deemed necessary, to correct improper application or interpretation of the zoning
ordinance", carried unanimously.
Mr. Branch stated there should Lie some protective mechanisIii whereby an applicant
can rely upon a judgn, ent from the Planning Dept. so that he does not face a new
set of requirements. He asked whether this aniendment opens it up to reinterpre-
tation to new requirements after the Planning Dept. has rendered a decision.
Attebery explained that this amendment would allow tile Planning Commissioners oli
their own initiative to raise those questions if they see sorilethiog they do not
feel is a proper interpretation of the code. PIe stated this adds another appeal
procedure to the system. He stated interpretation can be a real problem and it
is important that the different bodies discuss and work together regarding inCer-
pretation. He stated that interpretation should be consistent and timely. Con!mis-
sioner Swanson requested that this be held to give ilim an opportunity to discuss
it with the Asst. City Attorney who approved it. He stated he would like Io have
