Will, on approval of the proposal, perform all emergency transport when so requested; (2) The City will acquire one ambulance or one additional R-1 vehicle equipped to transport; (3) The City will.employ additional firefighters as required to support this service without degrading the City's firefighting capability; (4) The people will pay a levy of 25 mil. Emergency transport shall not include any other routine transport not included in the above; and (6) The City shall develop a billing system to recover any additional costs of this service and thus allow those who use the service to pay a portion of the costs. Motion by Commissioners Swanson and Stewart to authorize Fire Chief and City ~'~orney to prepare ambulance levy proposition, study the costs, review the definitions and place on the ballot. Under discussion: Mayor Jarstad stated the costs must be evaluated very carefully. Bill Meigs, Fire Chief, stated he has no problem submitting a levy, but the projected costs must be studied quite carefully. He stated an additional overtime budget will probably have to be approved and it is very important that emergency transport is explained to the public very thoroughly. He stated further that a 25¢ per thousand levy will bring in approximately $110,000.00 and that does not cover the cost of 6 beginning firefighters. He stated he would like to hire a safety engineer to evaluate the parking in that area and determine if it is unsafe. He requested that until this study is done and a report submitted that parking be allowed on the west side of Kitsap Way and a crosswalk be painted to allow safer crossing. He stated he would be willing to pay for painting the crosswalk and for a yellow blinker light to be installed. Con~nissioner Stewart suggested that Engineering and Police/Traffic be allowed to help select the consultant and Mr. Mentor stated he would be willing to consult with Engineering and Police/Traffic regarding the selection of a Safety Engineer. Considerable discussion followed regarding the parking situation and pedestrian safety. Commissioner Swanson stated he feels Mr. Root and Capt. Brown made their recommendation solely on the safety factor and he has confidence in their ability to make the correct recommendation to the Council. Mr. Mentor stated he is interested in public safety; but there is a shortage of parking for his facility. He stated when construction is finished, there will be approximately 500 parking stalls and that will be sufficient for most of the events. Mayor Jarstad suggested that Mr. Mentor try to develop private parking on the west side of Kitsap Way. Capt. Brown stated that a crosswalk is not illuminated at night and it is a very hazardous situation to try and cross Kitsap Way. He recommended that a cross~valk not be installed and that parking on the west side of Kitsap Way be eliminated. Discussion followed regarding a pedestrian-activated signal light and Mr. Root stated a pedestrian-activated signal light would cost approximately $40,000.00. He stated a single-flasher yellow light would cost approximately $5,000.00, but he did not feel a single flasher would be sufficient; that two or three flashers would be necessary so they could be seen. Jim Strait, 6530 Harlow Dr., stated he is'representing Kitsap Lake Neighborhood Association, and the Association feels parkin'g should be eliminated on the west side of Kitsap Way and no crosswalk should be installed. He stated that a decision was made last week and Council should stand by that ruling. Mr. Root stated that Engineering and Police/Traffic recommend that "No Parking" signs be put on the west side of Kitsap Way and that no crosswalk be installed at this time. Mr. Mentor asked that parking be allowed until the results of the traffic study are submitted. After discussion regarding the study, Mr. Root stated the report would take at least a month. CITY COI~ISSIONERS' MINUTES May 6, 1980 Page four Commissioner Swanson stated he felt the only requirement necessary for the Safety Engineer is that the individual is licensed in the State of Washington. He stated he is confident that any responsible engineer will support the City's position to eliminate parking on the west side of Kitsap Way. He stated he feels some of the best safety engineers are employed by the City and he has confidence in their recommendations. Mayor Jarstad stated that Council should'follow the recommendations of the public safety departments and post the west side of Kitsap Way "No Parking". He suggested that Mr. Mentor work with Engineering to work out a feasible solution to allow . parking on the west side of Kitsap Way. Mr. Mentor replied that he needs the parking more now than he will in a month and he asked again that parking be allowed until the study is finished. Commissioner Stewart stated he cannot go against the recommendations of Engineering and Police/Traffic. Discussion followed regarding hiring the safety engineer and Commissioner Stewart suggested that the City pay for half. Commissioner Swanson stated the City's Engineering Dept. is well-qualified and he feels they made the right recommenda- tion. Mr. Mentor stated it is a total waste of time.and money to hire a consultant if Commissioner Swanson feels this is the right decision. Commissioner Swanson stated he does not ~hink the City's Engineering Dept. misses very much, but he is always willing to listen to another side. Mr. Mentor reiterated that it would be a waste of time for him to hire a safety engineer. WINMAR DECISION Mr. Mentor discussed the Winmar decision and stated he hopes the City now has another chance to develop a regional shopping center in downtown Bremerton. He stated determination and cooperation is needed now between the City and downtown businessmen and some tough decisions need to be made. Mayor Jarstad stated that it is a very important situation and Council will take a decision-making role in the future; that the Council has worked with the down- town businessmen and will continue to do so. .Meeting recessed from 10:50 A.M. until 11:10 A.M. TAPE #185 HEARING - Halverson R-2 to R-1 (B) 1461 Clerk stated the hearing had been advertised, posted and letters of notification mailed as required by law. She read letter from Bernard Curley, dated May 6, 1980, in favor of the rezone. She then read letter from Wade L. Lassiter, dated May 1, 1980, in opposition to the rezone. She stated 68 advisory ballots were sent to owners of subject property, 28 returned with 15 agreeing and 13 disagreeing; 62 advisory balldts were sent to owners of property within a 250-ft. radius of subject property, 32 returned all agreeing. She then read Planning Commission Resolution No. 560 recommending approval of rezone from R-2 to R-1. Ken Attebery, Planning Director, stated the Planning Commission initiated the rezone from R-2 to R-1 as a result of a petition from residents and property owners of the area. He discussed the lot sizes and stated that under the R-2 zoning, none of the lots are non-conforming when compared to the minimum lot sizes allowed by ordinance; that under R-1 zoning six of the lots would be non-conforming. He stated that non- conforming status of the six lots of less than minimum size would allow the current use to continue and even be reconstructed provided that the yard setback provisions of the new zone are met; that i f a non-conforming use is discontinued for one year, only a conforming use can be established. Commissioner Stewart stated he did not want to do that; that he felt a provision should be made to allow duplexes to remain. Mr. McCluskey explained that there is a variance procedure that can be used. Commissioner Stewart suggested granting a variance to those lots now. -4- CITY COMMISSIONERS' MINUTES May 6, 1980 Page five Bernaid Curley, 3251Halverson, stated he has lived in the area for nine years and has seen the traffic increase considerably. He urged the City Council to approve the rezone because the streets cannot'handle any more traffic without hurting the property owners in the area. Commissioner Stewart asked if Mr. Curley had any objection to granting permanent rights to those who own duplexes so they can remain duplexes on a small lot if this is approved and Mr. Curley stated he had no objection. John Taylor, 3235 Halverson, discussed the increase in traffic and stated he wants this neighborhood to remain a quiet place to raise his family. He asked the Council cuncur with the Planning Commission and approve this rezone. Allen Frye, 3207 Halverson, stated this area has been developed as R-1 and he feels it should be down-zoned to R-1. He stated he would like to see it remain as a residential area and he has no objection to giving those lots that are non- conforming the right to remain in a non-conforming status. Clara Moore, 3225 Halverson, stated she does not wan~ any higher density than a duplex to be put in this area. She discussed the parking situation and stated parking and traffic .are real problems. Brian Duckard, 3219 Halverson, stated he has lived at this address all of his life and he is in favor of down-zoning the entire area to R-1. He stated he feels R-1 is the best type zoning. He read a letter from his parents, dated May 5, 1980, supporting the recommendation of the Planning Commission to down-zone the area. Mary Ross, 3242 Ward, stated she would like to see the area remain residential; that she is in favor of the rezone. David Russel, 3047 Sanders, stated that if a multi-family structure is put in, it will eliminate the view of the Olympics from Bataan Park. He stated this neighbor- hood is a good place to raise a family and he favors a rezone to R-1. Commissioner Swanson stated this probably is a proper rezone. He discussed property rights and stated he is opposed to zoning anyone into a position where their property cannot be used in the manner which it was bought. He suggested the following language: "Property within the rezone shall not be subject to any minimum lot size requirements other than that required for R~2 zoning". He stated this way those lots can continue to be used in the same manner they are being used now. Mr. Attebery stated this wording would allow some of the single family lots to be developed as duplexes. Mayor Jarstad stated there are only six lots that are being discussed; that those lots should be pi npointed to allow the non-conforming use to continue but that any change in configuration and floor area would have to conform with R-1 zoning. Commissioner Swanson stated he did not want to inflict the necessity to apply for a variance on those property owners. Motion by Mayor Jarstad and Commissioner Stewart to approve down-zone from R-2 to R-1 and to grandfather under R-2 zoning for lot size requirements only those six (6) lots that would be a non-conforming lot size use under R-l, carried unanimously. Under discussion: Commissioner Stewart stated he felt the Planning Commission should be encouraged to investigate. Commissioner Swanson questioned why another amendment is needed to implement another investigative procedure. Mr. Attebery explained that this is only a matter of clarification that the Planning Commission has the authority to bring this to the attention of City Council.
