read letter from Carey Donworth, dated March 20, 1980, which stated that Article III,

new position subsequent to May 1, 1979. These letters are on file in the City
Clerk's office.
Discussion followed and Commissioner Stewart stated he has no objection to Ms.
Hamilton joining the Union if she wants to; that the position is a Union position.
He stated that if a new employee were hired in that position, that individual

DISCUSSION RE: Drug Paraphernalia Ordinance
Clerk read letter from Janice Jones, representing the Bremerton and Central Kitsap
Councils of the PTSA, dated May 21, 1980, requesting that the City consider
adopting an ordinance similar to the County Drug Paraphernalia Ordinance which
was adopted on May 19, 1980. Attached to this letter were copies of the Kitsap
County Ordinance and City of Edmonds Ordinance No. 2127.
Janice Jones, 1440 17th St., stated that PTSA has met with the Bremerton Police
and County Sheriff for sometime regarding the drug paraphernalia issue; that they
are concerned about the open display of this paraphernalia at places like Bay
Records, Budget Tapes, Millies and Import City. She stated this probably is not
a complete list. She felt that the display of drug paraphernalia glamorized
drug use and she stated that PTSA urged the Council to adopt a drug parphernalia
ordinance.
Mayor Jarstad stated the Council is well aware of the problems of drug traffic
and that ordinances similar to this are being adopted in many parts of the country;
that their proposed ordinance will be referred to the City Attorney and Police
for review and recommendation.
Jeanne Forstal explained that PTA strongly supported Senate Bill 2174. She stated
they want to get drug paraphernalia out of the hands of children who are swayed by
what they see. She gave some of the arguments of opponents to a drug paraphernalia
ordinance and urged the Council not to be swayed by these arguments. She stated
this ordinance will protect younger children from the glamorization of drugs.
Commissioner Stewart asked if she had any ideas what can be done to reduce the
drug problem and Ms. Forstal stated the elimination of drug paraphernalia should
help.

the ladies present for the work they are doing to try and eliminate this problem.
Joan Powell stated she concurs with everything that has been said regarding the
Council's endorsing a policy to limit drug paraphernalia. She discussed some of
the magazines that teach children how to use drugs, how to use this paraphernalia
and even how to grow and process marijuana.

TAPE ~187 BREMERTON AREA PLAN HEARING
(A) Recessed City Commissioners' Meeting was called to order at 7;05 P.M. in the
Council Chambers by Mayor Jarstad. Also present were Commissioner Stewart,
Commissioner Swanson, City Clerk Mandio, Asst. Ci~ty Attorney McCluskey and
representatives of the press and radio.
Mayor Jarstad stated the purpose of this hearing is to receive presentation
of the Planning Commission's recommended draft Bremerton Area Plan and to take
public testimony on the draft plan.
Ken Attebery, Planning Director, read Planning Commission Resolution No. 564.
He stated copies of the following are available for review tonight: (1) Planning
Commission's April 1980 Draft Bremerton Area Plan (as revised May 6, 1980); (2)
Bremerton Area Plan Advisory Committee's June 1979 Draft Plan; (3) Annotated
copy of Advisory Committee Plan (showing all changes made by Planning Commission;
(4) Final Environmental Impact Statement on the Plan;.(5) Written testimony on
PLan received by Planning Commissi ~n; and (6) Minutes of Planning Commission
Hearings and Study Meetings. He discussed Volume I-Introduction and stated the
Plan is intened to guide the use of land so that one use does not preclude a
more appropriate use; guide public and private development in a common direction
in order to reduce the long-range public costs of development; help focus public
decision-making and budgeting in a common direction; be a practical tool to aid
the City in making consistent and objective decisions about proposed public and
private activities and developments in an atmosphere of fairness and due process
and make public the policy used for these decisions, thereby increasing accountability
in order to help build confidence in local government and consequently increase
its effectiveness. He then discussed Volume II- Plan Goals, Implementation and
Revision and stated the overall goals provide a framework within which the remaining
goals and policies of the Bremerton Area Plan should be viewed; that they represent
the essence of the people's hopes and desires for the way they would like the
Bremerton area to grow and develop. Volume III-General Land Use Element, Volume V-
Natural Environment and Shorelines Element, Volume XI- Energy Element and Volume
X-Citizen Involvement Element were also discussed by Mr. Attebery.
Kay Wilson, Asst. Planning Director, discussed Volume V-Housing Element and stated
more homes will be built in the 1980's than have been built in any time period;
that inflating housing costs will price most people out of buying single-family
homes. She stated a far greater number of multi-family housing will be needed in
the future. She then discussed Volume VII-Transportation Element and stated the
overall transportation goal is to provide for sale, adequate, flexible, economical
and energy-efficient movement of people and goods while protecting and improving
the quality of life.
Frank Seabeck discussed Volume VI~conomicDevelopment Element and stated this element
contains general and specific goals, policies and action proposals to guide economic
development decisions and provide a framework for balanced growth and economic
development in the Bremerton area. He stated a strong and sincere commitment on
the part of the public officials and private sector is necessary to implement all
these policies.
Bob Duffy, Planning Assistant, discussed Volume VIII-Community Services and Facilities
Element and stated the goals, policies and actions contained in this element will
guide the development of community services and facilities in a coordinated manner
as the area increases in population and economic activity; that coordinated develop-
ment of community services and facilities can provide quality services in a timely,
cost-effective manner consistent with theneeds of the people in the Bremerton area.
Clerk read memo from Asst. City Attorney Haberly regarding conflict of interest and
Mayor Jarstad asked if any member of the Council has a potential conflict of interest
with any provision of the draft plan. All members st.ated they did not.

Mayor Jarstad then asked if any citizen wished to object to participation of any
member of the Council and no one objected.
Gary White, 617 Medical/Dental Bldg., stated he is a land-use consultant. He dis-
cussed Volume V at length and suggested that it be simplified to emphasize housing
density rather than housing type. He stated the PUD ordinance process allows for
definite specific performance standards which would allow compatible changes in
zoning to be made. He stated the density issue is the main crux of the PUD. Commis-
sioner Stewart stated developers can use restrictive convenants. Commissioner
Swanson stated he believes a large number of people are interested in maintaining
single family areas and would like to preserve certain portions of town for single-
family residences only. He discussed a proposed PUD Ordinance and stated he is
concerned about project quality and housing standards. He stated the City has to
make sure adequate housing is provided for the working population; that the PUD
(Planned Unit Development) process allows medium-density housing to be adjacent
to low-density housing. He stated the City has to take a broader look at community
development. He stated in summary that he believes the Plan is a very good plan
and has many good elements and reiterated that it takes a PUD process to implement
the policies set forth in the Plan,
Bob Helm, 3029 Garfield Ave. SE, Port Orchard, stated he was speaking on behalf
of the Homeowner's Association of Kitsap County. He stated he thinks a hearing
examiner not only would provide the legal determination for decisions that would
be based on facts, but it would be a very important step for the City. He dis-
cussed the PUD ordinance process and stated it is basically a method of providing
mixed densities and mixed housing types within a given area. Considerable dis-
cussion followed regarding the concept of a PUD ordinance and Commissioner Swanson
noted that the proposed Plan does not say a PUD provision cannot be provided or
that zoning ordinances cannot be developed and still have low density areas.
Theodore Drake, 2615 East Phinney Bay Dr., stated the Plan as presented is what
the citizens want. He discussed waterfront development. He stated there should
be a statement in the Plan that building codes will be enforced and there will
be penalties for ignoring and failing to obtain permits. He stated further he
thinks that a hearing examiner is subject to abuse and the process that is used
in Bremerton now works fine.
Lance Haynes, 2066 NE Paulson Rd., commended everyone who worked and served on
the committees. He stated a new Plan is needed and he is in favor of a PUD
ordinance. He discussed the Central Business District and stated the traffic
pattern is too bad to have the CBD in the downtown area. He stated some of the
words need to be changed in the Plan, but overall it is a good plan. Mr. Haynes
asked if the City Attorney could decide if the City has some flexibility and if
a PUD is possible. Mr. McCluskey stated he would get a legal opinion from his
staff.
Susan Brown, 1333 East Hope, stated she would like to know more about the PUD
concept and the problems other cities have had.
Maurie Dawkins, 2818 McClain, suggested that the Planning staff take an inventory
of open space in the City so they know what is available. He stated that conco-
miniums are, the thing of the future and he thinks a PUD plan or something on that
order should be implemented in Bremerton.
Charles Collins, 216 S. Lafayette, stated this Plan was put together by 125
citizens on the committees who believe that this is what the taxpayers really
want. He stated he does not agree with everything in it but it is what the
citizens want and he does not think it should be changed. Commissioner Stewart
explained that if the Council changes it, it will be to make it a better document.

Con~nissi6ner Stewart stated he spent some time going over the Plan and most
of it is really good.
Con~issioner Swanson stated this is a comprehensive policy guide and he hopes
that what the City ends up with will reflect what the citizens worked so hard
to put together.
Mayor Jarstad discussed some long-range plans to purchase more land for parks
by Lions Playfield.
Motion by Mayor Jarstad and Commissioner Stewart to accept additional public
testimony at the City Commissioners' Meeting on June 10, 1980 and schedule an
evening meeting two weeks after that for additional testimony and input, carried
unanimously.
