She then read Planning Commission Resolution No. 553 which recommended approval. Ken Attebery, Planning Director, stated the issues before the City Council today are the appeal of the Special Use Permit and Variances which w~re approved by the Planning Commission. He stated that one thing that was brought to his attention today is that the zoning ordinance requires that only 35% of the site be covered by structures; that the site plan indicates that approximately 44% of that area is covered by structures unless the entire site is included (including church, etc.). Mr. McCluskey stated that it is all under the church ownership and it is all inter-related. Mr. Attebery stated that if this were a new development, they would look at the entire area. Mr. McCluskey stated the tax assessor would consider it as one site, not as separate properties. Mr. Attebery stated that parking was the largest problem regarding this proposal; that the Planning Commission spent a great deal of time discusssing the parking Situation. He stated Star of the Sea's policy would be that no other activities would be held while Mass was being cele- brated, so parking should not be a big problem. He stated the Planning Commissi on Resolution was very complete and this resolution is on file in the Planning Dept. STAR OF THE SEA VARIANCE APPEAL (continued) Glenn Vockrodt, 1409 Marlow, stated he does not live in the area of Star of the Sea Church but he is very interested in preserving some sense of development in the City. He stated that this area is R-1 and approval of this variance is tantamount to a fezone. He stated the applicant asked for variances to seven sections of the zoning ordinance. He discussed these items in detail and stated the four pertinent questions that must be answered in the affirmative for a variance approval were not properly addressed and were not answered in the affirmative. He discussed the parking problem and stated that the lease for parking at Noah's is only for Sunday mornings and the lease should be for a minim~ of 30 years instead of only 10 years. He stated further the sheer bulk of the buildings is overwhelming the neighborhood and this is detrimental to the surrounding community. Mr. Attebery explained when an applicant presents a proposal such as this, there are three options: (1) Comply with parking space on his own site; (2) Apply for additional parking in the area; and (3) Apply for a variance. He stated that Star of the Sea chose to apply for a variance, but they also found additional parking in the area. He stated the four questions were answered adequately; that the Planning Commission approved the Special Use Permit and Variances with one negative vote. Stan Cleary, 1516 5th St., discussed the site and stated it used to be a garbage dump; that it would be better to build the gymnasium on 6th St. rather than at this location. He stated it will take thousands of yards of gravel to fill this site properly so they can build there. Ron Van Hollenback stated they are aware of the fill; that they had a soil engineering company come in and test it and they do know what has to be done to build on this property. He stated they can handle the problem; that they want to build on this site because it is closer to the school and the topography is better suited for building. He stated there is difficulty finding gym space in the City, and this proposal will help alleviate that problem. He stated there will not be a conflict of parking because no activities will be taking place during Mass. Jim Leonard, 2333 7th St., explained that the children will be playing inside the gym on rainy days; that there will be 1500 sq. ft. left of the outside play- ground. He discussed the parking situation and stated the peak demand for parking will be at 10:30 A.M. on Sunday mornings; that there is a demand for 125 ~-~ars~nd'lu~ing Noah's parking lot will permit parking for 135 cars. -6- CITY COMMISSIONERS' ~IINUTES March 18, 1980 Page seven A gentleman living at 415 Veneta stated there is a double row of cars parked in the area every Tuesday and Friday night and it is impossible to find a parking space. He stated he feels this variance will devaluate the surrounding property. Barbara Atcheson, 5th & Chester, stated this is a very congested area and sh~ feels this will add more congestion. Stan Cleary stated that 5th and 6th Streets are the worst streets in the City for heavy traffic and there is no place for cars to park in that area. Morrie Dawkins stated the gymnasium is being paid for by private funds; that it is a badly needed facility and will be an asset to the entire City. He stated this will not lower the value of the surrounding property. Mayor Jarstad stated that this facility is needed in this area; that the City purchased the Coontz School site to use as open space and park purposes. He stated he supports the building program for Star of the Sea; that he concurs in the recommendation of the Planning Commission to approve the Special Use Permit and Variances. Commissioner Swanson stated that many individuals in the neighborhood walk to activities at Star of the Sea; that many of the parking problems are caused by Navy Yard workers.
