· PUBLIC RECOGNITION
~'r. Dain C. Nysoe, Executive Director,'Bremerton Area Chamber of
Commerce, requested the Council to amend City Ordinances 3119 and
3594, or any other pertinent Ordinances, to comply with recent
State amendments pertaining to the use of the current room tax
being reimbursed to the City of Bremerton by the State of Washing-
ton. RCW 67.28.210, as established by the 1980 Legislature, allows
those funds to be used not only for the acquisition, construction,
Or operation of public stadium facilities and other convention
centers, but for advertising and other appropriate promotional
activities with regard to tourism and convention solicitation.
Discussion followed b~ the Commissioners regarding the use of the
existing funds.
Mayor Jarstad moved we instruct the City Attorney to amend
existing Ordinances within the State law to allow for promotional
advertising for tourism. Seconded by Commissioner Swanson. Under
discussion: City Attorney McCluskey stated he would review the
ordinances, as they may not need to be amended and will report
back to Council. Mayor Jarstad stated ka thinks the City can
financially support tourism in some limited way. Question called,
carried unanimously-.
· COMMISSIONERS REPORT
Commissioner Stewart discussed the-ferry system and expressed
concern about the high cost of services.
Commissioner Swanson stated that under the Certification Acceptance
program, the City can handle their own bids and inspections on
Federal Aid projects. The requirements for doing this were tightened
up and we were going to loose this ability. However, Senator Jackson
and Congressman Dicks prevailed on our behalf in changing the
requirements back to their original state.
City Attorney McCluskey discussed signs on buses offering a $50
reward to people reporting acts of vandalism, and the contract with
Bremerton CharleSton Transit. McCluskey stated be didn't think
there was an Ordinance, but this was allowed by State law.
Commissioner Stewart moved we authorize this reward to people who
report acts of vandalism. Seconded by Commissioner Swanson, carried
unanimously.

e BREM-AIR CONTRACT FOR GARBAGE COLLECTION
AND DI~POSAL '
Russ Hartman, Attorney representing Brem-Air Disposal, requested
the City Commissioners consider a 10-year contract with Brem-Air
from September 1, 1981 to August 31, 1991. Mr. Hartman distributed
to the Council members a "Comparison of County and City of
Bremerton Garbage Rates". He stated he believed Brem-Air's services
are competitive with other communities in the State. During
December 1979 to November 1980, the City has collected $223,463.22
in francise fees and taxes from Brem-Air. Mr. Hartman requested a
10-year contract rather than a 5-year at the recommendation of Mr.
D.'P. McDaniel, Vice President and Manager, Seattle First National
Bank. Mr. Hartman distributed copies of Mr. McDaniel's letter
which states that the total cost involved for rolling stock,
equipment and modernization of Brem-Air's headquarters building
would be approximately $1½ million. Seattle First would need to
have positive assurance that the contract Brem-Air had with the
City would cover the terms of their loan or that the necessary
extension of that contract was provided to insure the repayment
of the Seattle First loan.
Mr. Kirby Smith, 1515 7th Street, stated he wanted answers from
Mr. Hartman and/or Mr. Don Lindgren, Brem-Air, regarding questions
he had as to the rates being paid to the City versus the County,
how many men are on the truck in the County, if equipment was
leased by a firm in Seattle, if there were any free pickups on
their collections, could the billing be put on the City computer,
and stated the contract should have an escape clause.
Mr. Hartman staled that Don Lindgren purchases ail his own equip-
.ment, that it is not leased. Brem-Air has their own computer
billing system and wanted to be able to deal directly with any
incoming complaints. Mr. Hartman stated the contract must be a
stable legal arrangement. There are no pickups without charge,
only the City's. The only charge to the City is picking up
street litter barrels at a cost of $300/month.
Mr. Smith asked if the City furnished Brem-Air with a list of
addresses. Mr. Hartman said they obtained that list from the
Water Department for a charge. Mr. L indgren answered Mr. Smith's
question regarding the man who was not being charged for services.
That person has been a continual problem and always has been
billed. Mr. Hartman responded to the question regarding City and
County rates. He stated the County rates have not been adjusted
for inflation but that they will be shortly. The City paid less
than the County for 12 years.
Commissioner Stewart discussed the rates and stated that we have
had a good deal to this point paying less than the County, but
now we are starting out at a different base. He stated he was
not sure Mr. Lindgren was using the best CPI. Mayor Jarstad
stated that it is probably more difficult to operate the garbage
service in the City because of the congested streets.
Art Anderson, 7012 Ohio, was against any subsidies, was concerned
about the index being used and the length of the contract.
Mr. Hartman stated the index has been used since 1967 and has
' worked well.
Forest Kern, 320 Whitepine Dr., stated Mr. Lindgren was very respon-
sive when there was damage to his property during garbage pickups
and that he does a good job.

O BREM-AIR CONTRACT FOR GARBAGE COLLECTION
AND DISPOSAL (continued)
~. George Sibitanich, 6813 42nd Ct., N.W., Gig Harbor, Executive
Director, Washington Waste Management Association, stated this is
not a new type of contract. It is used all over the State and
commended the Mayor for seeing the difference between the City
and County pickup. He stated Mr. Lindgren is one of the top three
operators in the Stat6.
Mark Cross, Block Grant Coordinator; Rocky Stone, Secretary/
Treasurer, Lions Club; Claire McQuinn, Secretary, West Side Improve-
ment Club, all expressed their appreciation for Mr. Lindgren's
Tape 206 community concern in supply~ing dumpsters for cleanup projects.
(B) 0000
Bob Mann, Family Pancake House & Ron Karelberg, R&H Market, stated
they have received excellent services and as businessmen they
realized the necessity 'of a 10-year contract.
Dick Bernhart, Bremerton/Kitsap County Health Department, stated
that Mr. Lindgren was very cooperative in handling complaints.
Commissioner Stewart stated he has one amendment which Mr. Lindgren
and his attorney concur with. If the business is sold the City
has the right to approve or reject doing business with the new
owner. He expressed concern about the City and County rates and
stated Mr. Lindgren has done a good job.
Commissioner Swanson stated we have seen what can happen when a
City provides this service and contracting out is not unusual.
Mayor Jarstad stated he appreciates the quality of equipment and
personnel.
Motion by Commissioners Stewart and Swanson to accept contract with
the provision that the City can accept or reject a new owner and
have the City Attorney review, carried unanimously.

® CENTRAL BUSINESS DISTRICT PARKING EXCEPTIONS
Ken Attebery showed primary and secondary areas on the City map
for exemption of parking requirements on new construction or
existing structures. He stated a letter was prepared for property
owners in those areas. Discussion followed regarding increasing
parking requirements and how to provide increased requirements in
the community. Commissioner Stewart stated that the best we can
do for the 'downtown area is to encourage investment. Attebery
asked for input regarding .the boundarys and requested obtaining
a list of names from utilities records for informing property
owners. Commissioner Swanson stated Attebery should talk to
Captain Brown and ask him about parking on 6th and would like the
Council to request from Captain Brown a report regarding this
Tape 206 matter. He expressed his concern about one more bank going in on
(B) 1031 Sixth and the additional problems this would create.
