This billing is a result of poor information received in late 1977 and early 1978 regarding liability for pay- ment of social security contributions during periods of sick leave. One half of this amount, $3,573.55, represents the City's contributions and the other half employee deductions that were not made. A review indicates that approximately 60% of these employees are still working for the City and recovery could be made. Motion by Mayor Jarstad that we continue the services of Olympic Ambulance until a decision is made on those claims against Leyde Enterprises. Under discussion: Commissioner Stewart stated this letter should be a part of the Hearing since it was not read at last weeks Council at his request and reference to this letter was in the newspaper and action should be taken at that Hearing. Mayor Jarstad stated he would hold his motion then until the 10:30 a.m. Ambulance Hearing. Lora Conner, Attorney representing Leyde Enterprises, stated they are willing to have people come forward with their claims and Leyde is willing to cooperate fully and didn't feel it is necessary to continue to harrass Leyde and would like to see this terminated. John Tracey, Attorney, Evergreen Legal Services, stated he is pleased with the proposal Ms. Conner has mentioned, and has every hope it will satisfy complaints people has with Leyde. He said he doesn't insist upon having the aforementioned letter read, but wanted to address it to the Council for consideration and is happy the Leyde Company has responded so well. Mayor Jarstad stated he wanted to make sure processes are completed and until we have justification before this Council, the City will extend Olympic Ambulance to do City transport and claims should be taken care of before we go back into a rotation system. Ms. Conner requested this be phrased as a written settlement to give members of the public time enough to come forth with claims and would not want Leyde prohibited from doing business with the City during that entire period. Motion by Commissioner Stewart that the City Attorney step aside because they have represented Leyde in the past on this issue and secure other counsel because there exists an Appearance of Unfairness. Motion died for lack of a second. Mary Setherland said we should not continue doing business with Leyde. Bob Mussman requested the Council clarify his position of Ombudsman with the City. Under discussion: Commissioner Stewart said we should hold off on motion until letter is read. Clerk read letter dated November 13, 1980 from Mr. John Tracey, Attorney, Evergreen Legal Services. Andy Freeman, 1122 Hayward, questioned why the City was so insistent upon doing business with Leyde. A citizen questioned if any charges ~ 203 regarding towing could be made at this time against Leyde. 0000 Carmen Kyle suggested an unaligned or outside legal counsel be called in to hear this discussion and ask who drew the contract and buy-back clause for Leyde's equipment. Motion by Mayor Jarstad to utilize Olympic Ambulance exclusively for a 30-day period until reports can be received back from the Attorneys working with Leyde Ambulance on the various complaints and billing procedures they are setting up. Seconded by Commissioner Swanson. Under discussion: Stewart said there is no Committee set up to look at this and recommended an impartial Committee be established and it may take longer than 30 days, and until we do the City will always be under suspect. Mrs. Ruth Johnson concurred with Commissioner Stewart's comments and ask why not bring in a disinterested party, we need more repre- sentation. CITY CO~LMISSIONERS' MEETING MINUTES November 25, 1980 Page Eight ~BULANCE HEARING (continued) Mayor Jarstad stated that an excellent job had been done by the Police Department and Mr. Mussman in bringing claims to the City and the Prosecutor and that no towing violations had been brought before the Council concerning Leyde. Swanson questioned whether we should rotate now between Leyde and Olympic or let Olympic do all the service until any problem with Leyde is resolved. He discussed the problems of a monopoly and said he proposed sometime ago that the City set up a city-owned/ city-operated ambulance service but this would require additional property taxes, assesments and if the number of private ambulance companies could be increased, this would be a better route to go. Motion carried as follows: Mayor Jarstad, yes; Commissioner Stewart, yes; Commissioner Swanson, yes. Commissioner Swanson pointed out error on page 5 of the contract and stated that the name "Leyde Enterprises" should be removed. Mr. Littlejohn, Olympic Ambulance, questioned page 2, paragraph 3, whereby said inspections may be conducted in conjunction with a semiannual inspection conducted by the State of Washington. Roy Rainey (filling in for McCluskey) stated that was something that had appeared and was adopted from the original contract and was his understanding that the State did have semiannual inspections and the City's inspection may be conducted at the same time or at another date. Mr. Littlejohn also pointed out page 3, paragraph B, "contractor shall bill at least 6 times within a 6-month period after the ambulance service has been rendered and shall provide City with evidence of such billing". Littlejohn stated he would be willing to go as long as 3 months, but that the deadbeats are long-gone for collection after 6 months. On page 4, paragraph 10, he assumed if Leyde doesn't become party to this contract, someone else may. If a clause is going to be put in that you can't exceed a certain amount, he didn't think you should penalize one company and reward the other if one company handles collections better. Mr. Littlejohn and Commissioner Stewart discussed the matter of subsidy. Littlejohn stated he has been taking calls for the City in good faith with no guarantee of payment since November 11 and wanted to adopt a contract today, and then negotiate since at AMENDMENT made at December 2, 1980 Council meeting as follows: Motion by Commissioner Stewart, seconded by Commissioner Swanson, not to enter into this agreement, carried unanimously. what appropriate procedures under the State of Washington EnV%~on- mental Policy Act must be taken with regard to the 1976 EIS. He is working with the City Attorney's office to determine the steps so the Cit~ would be in a position to forward the annexation proposal to the Boundary Review Board. Following the Board's action, the City could then commence annexation hearings. Motion by Commissioner Stewart and Mayor Jarstad to accept annexation petition, carried unanimously. CITY COMMISSIONER'S MEETING MINUTES November 25, 1980 Page Nine · UNSAFE FLOOR SURFACE Clerk read memo dated 11/24/80 from Chairman Safety Committee stating there have been several instances of people slipping and falling in the City Hall entrance foyer. It appears water collects from rain gear and umbrellas on this surface creating a hazardous condition at times. The changing of carpet fabric and nonskid wax do not appear to have corrected this. It is recommended a suitable non-skid surface be installed in this area. Clerk is to check for prices. · LETTER FROM DEPARTMENT OF REVENUE Clerk read letter from Department of Revenue dated 11/21/80 addressed to Mr. Robert B. Stewart concerning his correspondence of 11/20/80, stating the Dept. of Revenue has not, and will not, request special consideration of paying leasehold tax. As a law enforce- ment agency we are required by State law, and also through exami- nation by the State Examiners, to only pay for legal charges. Since the Legislature enacted the code exempting us, we would be remiss in our responsibilities if payment was made for the Leasehold Tax. This letter is quite lengthly and is on file for review in the Clerk's office. · ASSIGNMENT OF LIGHTED PARKING SPACES FOR GRAVEYARD SHIFT POLICE OFFICERS Mayor Jarstad discussed the parking problem for graveyard shift police officers. Jan LaPrath presented a request for continued funds for subsidized taxi service for the handicapped. (Letter on file in the City Clerks Office). She listed three options in her request: i) Revenue Sharing allocation for subsidized taxi service could be raised to $15,500.00; 2) The subscriber participation rate could be raised to keep costs down; 3) The number of coupons issued to each subscriber could be reduced. Discussion followed regarding raising the amount paid by the participant. Motion By Commissioner Swanson and Stewart to allocate $12,000 of revenue sharing money to the subsidized taxi service for the handicapped; raise the participant contribution to $1.25 and lower the number of coupons issued to each subscriber, carried unanimously.
