this proposal has been discussed with the Washington State Department of
Transportation officials who grant permission for the installation.
Discussion followed and Commissioner Swanson asked if the rumble strip like
those on Navy Yard Highway would help to ~.alert people they are approaching
a hazardous situation.
Mr. Root stated he feels this would be good and would be. in touch with the
State to see if rumble strips are advisable. Commissioner Swanson stated he
feels the rumble strips do as much to warn of existing hazardous situations
as the flashing lights.
Motion by Commissioners Swanson and Stewart to approve an "over the street"
caution flasher, with advance warning signs set in the sidewalks at the
intersection of Wheaton Way and Marlow Ave, carried unanimously.
CROSS-WALK - LEBO BLVD. (BELMONT TERRACE)

All Council members were in agreement a cross walk is needed in this location.
Commissioner Stewart objected to moving the bus shelter due to the expense
involved. Discussion followed regarding best possible safe placement of the

TAPE #197 PUBLIC RECOGNITION
(B) 4607 Fire Chief Bill Meigs stated he may be premature since there is a Resolution
relating to ambulance and medical service on the agenda. He stated last week
Council took action to put an initiative before the voters regarding emergency
medical services. He stated the initiative seems to be one to put the Fire
Dept. in the billing business as the other items on the initiative have been
~re¥iously taken care of. He stated the initiative says the Fire Dept. may
transport, but there's never been a time when the Fire Dept. could not transpcrt,
that in emergency situation they have transported. He stated the additional
expense of runnin~ a paramedic program has been absorbed by the Fire Dept.
budget by the use of firefighters who volunteer, and it is difficult to under-
stand the need to charge for these services. He stated he researched around
the State and failed to find another Fire Dept. who charges for those services,
unless they also provide an ambulance and they transport patients. He stated
that he feels to charge for those services, would not be one to strengthen
the public ~afety. He stated all members of the Fire Dept. staff have worked
very hard to make improvements in the services they provide. He stated they
cannot succeed in their attempts if the voters are being confused. He said
his telephone rang all week with questions of what is being voted on~ what is
on the ballot.
He stated the Fire Dept. has been researching for sometime for areas of income
that wouldn't force billing for services. He said some of those are
attempting to contract with the U.S. Navy regal'ding Jackson Park; attempting
to contract for paramedic service with PSNS; there have been some discussions
for contracting for services with areas adjacent to the City. He stated
through efforts in Olympia in 1979, we now have authority to contract with all
State agencies in the City, that should bring an additional income source in
July 1981.
CITY COMMISSIONERS' MEETING MINUTES
September 16, 1980

He stated in s~ite of the additional paramedic duties, growth in the commercial
areas, some of the deteriorating conditions in the down town area, the Fire
Dept. is operating with the same n~imber of staff, fire stations, and fire
engines that operated 30 years ago. He stated the people at the Fire D~pt.
would continue to do the very best they can, but they would appreciate some
warnin~ that Council is going to take this kind of action, and would allow
the Fire Dept. to have some input.
Commissioner Stewart stated this initiative has been circulating since January.
He stated he felt Chief Meigs had ample time to give his input to it, if he
was cencerned. Chief Meigs stated he felt that once the initiative was printed
and being circulated it was a little late to change the issues. Commissioner
Stewart stated Chief Meigs had plenty of time to tell people not to sign.
Discussion followed regarding the timing of the initiative, buildings that do
not meet fire code, where peoples lives may be in danger, and allowing an
ambulance monopoly.
Chief Meigs stated when it comes to dangerous buildings and public safety he
couldn't agree more and that is the reason he feels they cannot be in the
business of transport. That with the limited manpower, transporting would not
leave them time for the essentials of fire fighting.
Chief Meigs submitted a letter from the paramedics of the Fire Dept. The letter
states the Fire Dept. is incapable of providing emergency transport with the
current amount of manpower and equipment. He stated it is signed by all 9
members of the paramedic program. This letter is on file in the Clerk's office.
Dave Moen, John Randall, Fred Brown, Ken Hughes and Randy Calhoun were some of
the members of the Fire Dept. to speak in opposition to the initiative,
stressing that with the current manpower, it is not possible for the Fire Dept.
to transport; that the purpose of the paramedic program is life safety and
support, and stating that peeple should not be billed for emergency medical
services. It was also stated the initiative is not very clear.
TAPE 197 Harry Penor, of HP Towing and Olympic Ambulance, stated that through his
(B) 5119 insistence in the towing business and fighting for his rights, he achieved what
he set out to do, which was to get part of the City's towing business. He
stated he believes Commissioner Stewart is doing what he feels is right, that
he opened the eyes of the other Commissioners, however, the initiative is very
cloudy. He felt we should Qive the new program, without the subsidy, a chance.
He stated it would be wise if Commissioner Stewart would drop this.
TAPE 198 Commissioner Stewart stated if the people vote the initative in, they will
(A) 0005 never have another ambulance monopoly in the City.
Mayor Jarstad discussed the amount of money necessary to run a paramedic
division. He stated there is enough available business in Bremerton so private
ambulances can be in the transport business. He stated nobody in the Fire Dept.
was asked how to implement this initiative and what effect it would have. This
initiative must follow the legal and proper route to get on the ballot. There
was plenty of time without by-passing proper procedures. It will be on the ballot
next spring if there are enough signatures. All it will do is put the paramedics
in the billing business.
Discussion followed between Commissioner Stewart and Mayor Jarstad about the
initiative process.
Cc. mmissioner Swanson stated the initiativ£ should be voted upon, however, he
would vote against it. Commissioner Stewart made a motion to pass a Resolution
authorizing an Ordinance putting the initiative on the November ballot.
The City Clerk asked if the City Attorney had drawn uF~ this document?
CITY COMMISSIONERS' MEETING MINUTES
September 16, 1980
Page Five
Terry McCluskey stated that Ted Wright and Sherrill Huff are correct, that
a Resolution can be used to put a proposition on the ballot. However, a
Resolution is a statement that a proper Ordinance has been passed, and we have
not passed any Ordinance, so that we can resolve to state that Ordinance to
the County Auditor. He stated the format and wording in this Resolution is a
mess. He stated the first line on the initiative is incorrect. There was
never a monopoly in the City of Bremerton. The master license portion has already
been eliminated; the Bremerton Fire Dept. already is allowed to transport.
Only the last part has any validity. It is improperly drafted and there are
six questions contained in the paragraph.
Mayor Jarstad asked for a second to Commissioner Stewart's motion. Motion
died for lack of a second.
Recess 10:30 to 10:45
HEARING - ROSS ANNEXATION
Clerk read a memo from the Planning Director stating the requirments for the
Hearing as outlined in RCW 35.13.125. City Council must make three determinations:
1. Whether the City will accept the proposed annexation. 2. Whether the City
will require simultaneous adoption of the zoning plan adopted for the area; and
3. Whether the City will require the assumption of all or any portion of
existing City indebtedness by the area to be annexed.
The Planning Dept. finds the proposed annexation in general conformance with
City and Boundary Review Board criteria, policies and plans.
Mr. Attebery presented a site plan and explanation of the area. He stated the
next step is to develop a 75% petition for annexation. This'should be
by the parties involved and returned to the City Council.
Mayor Jarstad asked for public input.
Mrs. James Berry, 3915 Wheaton Way stated that she objects to the annexation.
She said the EIS was not adequate and has not been updated. Mr. McCluskey stated
that is not part of this nearing. Mrs. Berry stated she is objecting to the
whole thing in light of the Supreme Court ruling.
Tom O'Hare, Attorney for the petitioner, stated he is pleased to move forward with
something they began in the fall of 1975. He stated Mr. Bastion, Mrs. Berry's
attorney was given specific notice directed to him of this meeting. Many people
believe the property adjacent to City bounderies on the south and east are
already in the City. He asked the Council to take this action and move forward,
and stated they will acquire the 75% signatures.
James Robinson, 4904 Kitsap Way, and Ike Parker spoke in favor of the annexation.
Mr. Edwards, 4113 Wheaton Way, stated he ownes property in the proposed annexation
area and does not want to be annexed into the City. He does not want to assume
any indebtedness; he has his own water and sewer and maintains his own road.
Neil Ness, 1111E. Riddell Rd, and Howard Burroughs, Lot 13 on Broad St, spoke
in favor of the annexation.
Motion by Mayor Jarstad and Commissioner Stewart to accept the proposed annexation,
carried unanimously.
Discussion followed regarding the Zoning Plan outlined in Ordinance 3357. Mr.
Attebery pointed out the B3 and R1 designations.
Mrs. Berry stated the zoning that was adopted was part of the Supreme Court
decision that was overturned. Mr. McCluskey stated zoming was overturned
in the County, not in the City.
Motion by Mayor Jarstad and Commissioner Stewart to accept the zoning plan out-
lined in Ordinance 3357, carried unanimously.
CITY COMMISSIONERS' MEETING MINUTES
September 16, 1980

Mayor Jarstad stated that when there is an annexation before the City we
require all applicable City indebtedness be assumed by the area to be annexed.
Discussion followed regarding City indebtedness and various bond levies of the
City. North Perry Water District and the surcharge was discussed.
Commissioner Stewart stated what we are talking abc.ut is bond indebtedness on
General Obligation Bonds. Commissioner Swanson discussed replacing a line at
North Perry and he did not believe Mrs. Berry's water service has changed from
No. Perry to Bremerton. He said there will be a certain surcharge, but the basic
water rate will drop substantially because the County rate is higher.
Mayor Jarstad stated the decision is clear. Whatever the law states
will be the indebtedness for the annexation is what will affect those people.
Motion by Mayor Jarstad and Commissioner Stewart to approve that all applicable City
indebtedness be assumed by the area to be annexed, carried unanimously.

CITY COMMISSIONERS' MEETING MINUTES

ORDINANCE - FIRST READING - Community Impact Study
Clerk read a memo from the Planning Dept. requiring amendments to the
Community Impact Ordinance. The amendments will, require City Council to
hear and make a determination whether a business license should be issued to
businesses which are required to file a full Community Impact Statement, And
provide for an appeal to City Council on the Planning Director's decision to
require or not require a full Community Impact Statement. This will require
a once-a-week or so legal ad in the Sun to provide notice of licenses applied
for.
The new Ordinance provides much more clarity to prospective business license
applicants about the check list and impact statement process. He suggested
that section 3 should be reconstructed and possibly be deleted.
Commissioner Stewart expressed concern about these coming to Council. He would
only want to hear them on appeal. Mr. Attebery reviewed the Ordinance section
by section. Commissioner Stewart stated we should decide what the fees will
be and that Mr. Attebery should have the authority to set fees and adjustments.
Mr. Attebery stated that Karen Conoly of the City Attorney's office said we should
not include a renewal statement until it has been clarified. It can be added
later.
Discussion followed regarding the hearing process. Mayor Jarstad felt that
Council should review the Community Impact Statements. There will probably
not be more than a couple each year.
Ken Attebery stated that if a CIS is required, a statement will be made available
to Council, City Clerk and other department heads. Commissioner Stewart stated
he would like the decision made by the Planning Dept. and appeals to Council
only. Ken Attebery stated he will make revisions and bring the Ordinance back
