stated that the Treasurer's report indicates that this fund is in a deficit condi-
tion and he suggested that Mr. Heath discuss it further with Mr. Olney.

to City Auditor's looking at the fund to determine if there is enough money available.
Under discussion: Mayor Jarstad noted that these problems could be worked out much
better with a staff meeting, rather than hearing it on the news. John Livingston

PUBLIC RECOGNITION
Maria Gallagher, High Street, was present and asked if anything was going to be done
regarding the high water and sewer bills. She stated again that she does not object
to paying for what she uses, but it is not fair that she has to pay more for the water
she does use than those who use more water. She asked if the number of people who
are affected by this has bE,en determined and Commissioner Stewart stated that Data
Processing has it on their schedule to make this determination and they might have
the answer next week. Considerable discussion followed regarding the new rates and
it was the consensus of the Council that the rates could not be changed at this time.
Ms. Gallagher reiterated that many people cannot afford an additional $2.00 or $3.00
on their bills; that they want to pay their fair share and pay for what they use, but
it is not fair that they are being penalized for trying to conserve.
Frank Monneset, 146 S. Lafayette, discussed removing brush and trees that block his
view and stated he thinks it is the City's responsibility to see that they are
removed. Ken Brees, Street Superintendent, stated he does not think the City should
cut down trees simply to improve someone's view; that if the trees are a hazard,
they should be removed or topped. He stated that if the trees are removed from
this particular area, it could create an erosion problem. Discussion followed and
Commissioner Swanson requested a week to evaluate the situation and bring a proposal
back to Council next week.
Meeting recessed from 10:25 A.M. until 10:40 A.M.
TAPE #195 KITSAP COMMUNITY ACTION PROGRAM SPECIAL USE PERMIT HEARING
(B) Clerk stated the hearing had been advertised, posted and letters of notification
sent to residents as required by law. She read Planning Commission Resolution No.
577 recommending approval. She stated 39 advisory ballots were sent, 16 returned
with 13 agreeing and 3 disagreeing with the proposal. She then read letter from
KCAP, dated July 25, 1980, appealing the special conditions attached to the Planning
Commission approval of the Special Use Permit.
Commissioner Stewart stated he is concerned about the impact this will have on the
neighborhood; that there will be more cars on the street if this is not approved
and the neighbors will have to apply for a residential parking permit area. He
stated this should be approved to alleviate the parking problem.
Ken Attebery, Planning Director, stated the site is across the street from Smith
School. He stated the ingress will be from Park St. and egress to the alley and
the use of the parking lot will be restricted to KCAP staff only.

Jim Root, City Engineer, stated the Engineering Dept. will be agreeable to gravel
paving with a chemical treatment to keep the dust and stones down. He discussed
a storm detention system and stated a catch basin at the entrance of the parking
lot should ~e installed. He discussed egress from the parking lot and recommended
that the 45 parking angle be removed by the exit and three parallel parking stalls
be put there. He stated this would give vehicles more room and egress would be
easier.
Larry Eyre, Director of KCAP, stated he would like to avoid cutting back on any
of the parking spaces; that they can be marked for compact cars and he does not
think they will have any trouble enforcing it for compact cars only. He stated
the width of the lot will be a full 50 ft. so this will meet the City's standards
for 45 parking. He estimated the cost to tie into the existing storm line to be
approximately $1,200.00 to $1,500.00. He stated he would like to see the catch
basin installed and a line put in where the driveway would be located; that this
would cost about $500.00 to $600.00. He stated further he would like to look at
the sidewalk to determine if it will have to be made thicker; that vehicles driving
over it could weaken it if it is not thick enough.
Discussion was held regarding paving the parking lot and it was the consensus of
the Council that KCAP work wi th the City Engineer to determine adequate surfacing
of the lot. Mayor Jarstad asked that KCAP also work with the City Er~gineer to
come up with a better configuration of the parking lot.
Motion by M~Lyor Jarstad and Commissioner Swanson to approve Special Use Permit
subject to the following conditions: (1) Parking lot sha~ll be developed with
ingress and egress as noted on the site plan presented; (2) Parking lot shall be
surfaced in a manner acceptable to the City Engineer; (3) Parking stalls shall
be marked and appropriate wheel stops provided; (4) Storm drain and a "bubble-up"
at the curb shall be as required by the City Engineer provided that the storm
drainage system be reviewed in two years to determine if complete connection to
the storm sewer would be required; (5) The lot is to be developed in compliance
with the Building Code and Zoning Ordinance No. 1792; and (6) Above conditions
shall be complied with within 90 days of the approval of the Building Permit for
the proposed parking lot or the Special Use Permit ~ill be revoked, carried unanimously.
TAPE #195 BREMERTON AREA PLAN HE2RING
(B 1054 Mayor Jarstad announced that the hearing regarding the Bremerton Area Plan has been
continued from Aug. 12th to take public testimony on the Draft Plan and changes to
the Plan suggested by the City Council and to formulate, consider and possibly act
on a resolution adopting the Plan.
Ken Attebery, Planning Director, announced that there is a sign-up sheet in the
back of the room if anyone wished to testify. He stated copies of the ground
rules for public participation in the City Council review process and City Council
suggested changes are available in the back of the room. He then presented the
proposed changes in Set 7, which are on file in the Clerk's office.
Mayor Jarstad asked if any member of the Council has a potential conflict of interest
with any provision of the Draft Plan and no one did. He then asked if any member
of the public wished to object to participation of any member of the Council in the
discusion or vote on any provision of the Draft Plan on the basis of a potential
conflict of interest and no one objected.
Motion by Mayor Jarstad and Commissioner Stewart to accept proposed changes as set
out in Set 7, carried unanimously.
Discussion was held regarding preparation of the map and Commissioner Stewart asked
if the Planning Dept. felt the old map could be used until a new one is developed.
Mr. Attebery stated that using the old map would make it difficult to determine
which policy statement would be appropriate. He stated that it would ben.difficult
to make a decision using the old map and the new polic9 statements without appearing
to be ambiguous. Commissioner Stewart stated he does not think that using the old
map would be a hindrance to the Council in making a decision. Mr. Attebery stated
that the zoning ordinance and zoning map will remain in effect until a new map is
prepared. He stated further that their immediate next step is to begin preparation
on a new map. Mr. McCluskey stated the comprehensive map has to be deleted as
the controlling comprehensive plan; that the old comprehensive map can be used as
a tool, but it cannot be considered the comprehensive map once the new policy
statements are adopted. It was the consensus of the Council that the old map
used as a tool for reference only.
Motion by Mayor Jarstad and Commissioner Swanson that no further public hearings
on the Bremerton Area Plan are necessary, carried unanimously.

OFF-DUTY POLICE OFFICER AT EVERGREEN PARK
Clerk read letter from Michaele Hosea, Smith Neighborhood Association, dated Aug. 15,
1980, thanking the City Council for their help in acquiring the off-duty police
officers at Evergreen Park. This letter is on file in the Clerk's office.
COMPUTER OPERATOR I REVISED JOB DESCRIPTION AND PAY GRADE CLASSIFICATION
Clerk read memo frcm Personnel Director, dated Aug. 19, 1980, attached to which was
a revised job description for the position classification of Computer Operator. Th(:
letter recommended that the pay grade be classified as Pay Grade 6 ($5.95 to $6.51
per hr.).
Motion by Commissioners Stewart and Swanson to approve revised job description and
pay grade 6 for Computer Operator, carried unanimously.
TIME EXTENSION - Timber Sale (Hahn Logging)
Clerk read memo from Water Superintendent, dated Aug. 18, 1980, which stated that
Mr. Hahn has requested another time extension to Sept. 30, 1980. The memo stated
that if the time extension is granted, it will benefit the City by squaring off the
area covered by this sale and making it better for the reforestation plan; that there
will still be plenty of time for the crews to slash burn, etc. before the reseeding
operation. Mr. McCluskey stated that he had discussed this with Chuck Moore and it
was Mr. Moore's understanding that the penalty would be 10% of the performance bond,
but the contract stipulates that the penalty will be 10% of the contract price which
amounts to $8,043.33. He stated the City does not have to assess a penalty, but if
a penalty is assessed, it has to be at least 10% of the contract price. Commissioner
Stewart stated it was his understanding that the City can no longer assess penalties
and Mr. McCluskey stated that he would investigate that particular situation.
Motion by Commissioners Swanson and Stewart to grant time extension to Sept. 30, 1980,
subject to 10% penalty of the contract price. Under discussion: Mayor Jarstad
stated he is concerned that no one has talked to Mr. Hahn regarding the amount of
the penalty. He stated the penalty negates the recommendation of Mr. Moore, who
thought the penalty would be approximately $2,000.00. He stated further that he
thinks it is to the City's advantage to grant a 30-day extension without the penalty.
Mr. McCluskey noted that Mr. Hahn was agreeable to the $2,000.00 penalty. He stated
that the extension can be granted without a penalty, but if the penalty is less than
10%, the contract would have to be modified. Commissioner Swanson stated that Mr.
Hahn did receive one extension. He suggested approving the extension with the 10%
penalty and requesting Mr. Moore to discuss the amount with Mr. Hahn. Question was
called and motion carried unanimously.

3. Discussed the generator that has been proposed for Casad Dam and stated he
thinks the City should own the generator and the pipe; that he does not think
it should be under dual ownership. Mayor Jarstad explained that the reasoning
behind the proposal for dual ownership considers who is best able to service each
portion of the project. Commissioner Stewart stated it is a better operation if
the City has complete ownership.
Commissioner Swanson:
He stated that DOE is presently reassessing the minimum flow in ~treams; that
hopefully they will not do anything to Union River. He stated he is waiting to
see what their recommendations are and whether the report will have any effect
on available water.

Stated the decision in the Ron Scott case has been upheld and the Court ruled against
Scott.
Mayor Jarstad:
1. He discussed the pool roof and stated it looks like a brand new pool.
2. Discussed the number of arrests made over the weekend and stated most of the
arrests were directly related to the problems caused by cruising. He stated the
police will continue to enforce the laws.
