Commissioner Stewart stated he did not think Bremerton would use the bike racks; that the bus routes are too short to use bike racks on the busses. He stated he has never received a request for a bicycle rider for these racks. Mr; Duffy stated that the Bicycle Committee is not recommending that the City purchase these bike racks. Mayor Jarstad noted that if the City of Seattle has found t~at this type of bike rack is obsolete, the City of Bremerton should not consider purchasing them. It was the consensus of the Council not to bid for the bus bike racks. RATE INCREASE - Nationwide Cablevision Clerk read letter from Lyle Jones, Manager of Nationwide Cablevision, dated Aug. 6, 1980, which requested a rate increase as follows: Connection Charges - Initial Outlet, $25.00; Additional Outlet within same living unit, each, $15.00; Reconnecting of Outlet, $15.00; and Each repositioning of outlet at same location, $15.00 and Monthly Rate - First Outlet, $8.95; Additional Outlet within same living unit, each, $1.90. The letter stated there would be no increase for multiple living units, motels and hotels or disconnections. Mayor Jarstad noted that costs have risen sharply and Nationwide has not requested a rate increase since 1977. Motion by Mayor Jarstad and Commissioner Stewart to approve rate increases as stated above. Under discussion: Commissioner Stewart requested that a study be conducted to determine if th(~ picture meets specifications. He stated that the picture some- times is not as clear as it should be. Mr. Jones stated that it is not possible to get a perfect picture on cable TV and he would welcome any test the City feels is n~cessary. Amended motion by Mayor Jarstad and Commissioner Stewart to contact someone to check the clarity of transmission. Question was. called and both motions carried unanimously. COMPUTER INSURANCE Clerk stated she had met with Bob Hinds regarding insurance coverage for the computer and equipment; that insurance coverage for fire, natural disasters and vandalism has a yearly premium of $538.00 and all-risk insurance, which is specifically formulated for computers, has a yearly premium of $1,627.00. Discussion followed and Commis- sioner Stewart stated he feels the City is over-insuring; that the City has an insurance policy that covers all City assets. He stated he would like to study it to determine the City's needs. Ms. Mandio suggested that he go over it with Bob Hinds and Dick Hurley. CITY COMMISSIONERS' MINUTES August 12, 1980 Page two I.A.C. PROJECT - Lions Playfield Development Clerk explained that the project contract for Lions Community Playfield development was approved, but determination was not made where the funds would come from for the City's matching funds, in the amount of $40,000.00. Motion by Mayor Jarstad and Commissioner Stewart that funds be taken from Cumulative Reserve for General Municipal Purposes Fund, carried unanimously. PUBLIC RECOGNITION The Court for Kitsap County Rodeo and Fair was present and discussed the 1980 Fair and Rodeo. The Fair will be held Aug. 20th - 24th. Mayor Jarstad thanked the girls for coming to Council. Ms. Haberly left the meeting and Mr. Rainey entered at this time. WATER & SEWER BILLS Maria Gallagher, High St., discussed the increase in water and sewer rates and stated she objects strongly to paying for more than she uses. She stated that some- thing has to be done about the sewer rates and the overcharge for people who do not use their full share of water. She requested that those who do not use the minimum amount be given an option so their bills are not so high. She asked what would happen if everyone used at least the minimum amount of water and did not try to conserve. Chuck Moore, Water Superintendent, explained that the City reservoirs have sufficient water to take care of all the water needs for the area. Ms. Gallagher requested a figure for the number of people who use less than the minimum amount of water and Commissioner Stewart stated that request was net on the schedule for Data Processing. He discussed the rates and stated that if the minimum rate for sewer were eliminated, the consumption rate would have to be raised. He stated it could be changed to strictly consumption rates; that it would be much easier for his staff. He stated that he does not think the rates should be changed now because he is negotiating with the Navy. Ms. Gallagher asked why it is necessary to drill a well in Central Kitsap if the reservoirs provide sufficient water and Mayor Jarstad explained that because of the expansion of the Central area, there may be a need for additional water in that area; that this well is just an added insurance for an adequate water supply. Commissioner Swanson noted that one of the reason Bremerton has lower rates is because the City has wells it can rely on if necessary. Ms. Gallagher reiterated that it is necessary that something be done to help people who are trying to conserve water and who are trying to live within their budget without going on public assistance. She stated this group of people should not have to pay higher rates than those who use more water than the minimum; that it is not right that the Council is not treating them fairly. Mayor Jarstad stated that hearings have been held and this issue has been discussed at length for over six months. He stated that the Council is extremely fair; that they are trying to put a fair price on the public's utility and they are trying to arrive at a fair ratio of cost for using this utility. Commissioner Swanson stated that if they went to consumption rate rather than a minimum rate, he feels the people who have paid to have separate storm sewers installed should get some sort of benefit; that they should not have to subsidize those people who have not had separate storm sewers installed. Kathleen Patterson asked about getting their meters changed from 3/4" to 1/2" and Commissioner Swanson explained that it would require an ordinance change to go to 1/2" meters and this would require public hearings. Ms. Patterson then asked why the drain and pipes on Cambrian are not maintained; that the drain is blocked up. Don Proctor, Wastewater Superintendent, stated he is not certain whether that catch basin goes to a combined or separate storm sewer and the sewer line might not be big enough for the storm water. He then discussed the sewer rates and stated there are fixed costs to prepare the bills, whether it is a large amount or a small amount. He stated that the future sewer bills will be increased even more and he does not feel it is appropriate to pay for consumption alone because there are so many fixed costs. Meeting recessed from 10:30 A.M. until 10:40 A.M. Mr. Rainey left and Mr. McCluskey entered the meeting at this time. DOWNTOWN REDEVELOPMENT Gordon Bell, Downtown Redevelopment Consultant, discussed downtown redevelopment and stated he believes the City needs to seriously entertain Joe Mentor's plan and study its feasibility. He stated he will continue to work with Mr. Mentor, along with two other developers who are interested in the downtown redevelopment. He -2- CITY COMMISSIONERS' MINUTES August 12, 1980 P~ge three discussed the Mentor Plan and stated this plan takes maximum advantage of existing buildings and existing retail spaces, involves the least amount of disruption and allows the existing property owners to maintain control of their own property. He stated there is a need to initiate the Urban Renewal Team in order to begin evaluating a variety of public concerns regarding the specific questions and problems concerning this plan. He stated he will send out a memo to the Urban Renewal Team shortly to begin the process of evaluating this plan along with the other two. Commissioner Stewart asked who will prepare the preliminary design and financial feasibility assessment; how much it will cost; who will pay for it; and when will it be done. Mr. Bell replied that if the City is the developer, it will pick up the costs; that it has not been determined how m~ch it will cost. Joe Mentor stated the City has a unique opportunity to redevelop downtown Bremerton. He stated this plan utilized the public streets and all the parking that is currently available plus additional parking. He stated if the City moves ahead with this, it can be developed. He stated that if the City is serious about redeveloping the downtown area, it should notify the Court hearing the Winmar case and advise them of the progress that is being made. He estimated the cost of building the Mall at 3.85 million dollars and stated that mortgage costs will be about 9%. He stated he hopes that the Council will study this plan and finish the review by the first of Sept. so hearings can be held before the Planning Commission. He stated that the City may have to use the condemnation procedure; that the future of the City is based on what is going to happen downtown. He stated further that he thinks the construction of the Mall can be handled through an LID. BID OPENING - Block Grant Street Improvements-17th & Warren M-R Co., bid bond enclosed, $48,787.00. He stated he agrees that this should be a pay grade 10 rather than a 14 as he originally requested. Commissioner Stewart noted that he has an employee who is doing the same thing as this position and he thinks it is a pay grade 8. He questioned adding another position and stated he would hope the City can reduce costs rather than add to the payroll. Commissioner Swanson stated that this position will be under ~he immediate supervision of the Street Superintendent but it will take care of Equipment Rental, Street Dept., Water Dept., Wastewater and hopefully Engineering. He stated that whoever gets the job will travel to these different departments to implement the program. Mr. Tiberio, Personnel Director, stated the position will be reviewed in six months to determine if the position duties, responsibilities and pay grade 10 classification are appropriate. She stated the back leasehold tax amounts to over $5,000.00 for one group and over $6,000.00 for the other. Commissioner Stewart commented that these are both good groups who offer a community service and it would be a shame to lose either one of them. He suggested that the City pay this leasehold tax, rather than let them close. Mayor Jarstad noted that the buildings are public buildings and these are City functions. Mayor Jarstad: 1. Discussed the progress being made on the swimming pool roof and stated both vapor barriers have been installed. He stated they felt it would be better to go ahead and install a vapor barrier on the back steep portion of the roof now so it will all be finished; that it would cost an additional $5,000.00-$6,000.00. Motion by Mayor Jarstad and Commissioner Swanson to include in the repair of the roof the steep roof which at this time does not show any electrolysis, carried unanimously. 2. Discussed the water and sewer bills and stated there are many people in the City who do not use the minimum, but go ahead and pay their bill. He suggested helping the low-income by reducing rates for.them. Meeting recessed from 12:00 noon until 7:00 P.M. FAPE #194 BREMERTON AREA PLAN HEARING (B) Recessed City Commissioners' Meeting was called to order at 7:05 P.M. by Mayor Jarstad. Also present were Commissioner Swanson, City Clerk Mandio and Asst. City Attorney McCluskey. Commissioner Stewart was absent. Mayor Jarstad announced that the purpose of this hearing is to take public testimony on the Draft Bremerton Area Plan and changes to the Plan suggested by the City Council. Ken Attebery, Planning Director, announced that there is a sign-up sheet in the back of the room if anyone wished to testify. He stated copies of the ground rules for public participation in the City Council review process and City Council suggested changes are available in the back of the room. He then presented the proposed changes, which are on file in the City Clerk's office. Meeting recessed from 7:35 P.M. until 7:45 P.M. Commissioner Stewart entered the meeting at this time. Mayor Jarstad asked if any member of the Council has a potential conflict of interest with apy provision of the Draft Plan and no one did. He then asked if any m~mber of the public wished to object to participation of any member of the Council in the discussion or vote on any provision of the Draft Plan on the basis of a potential conflict of interest and no one objected. Clerk announced that no written testimony had been received. Mayor Jarstad then asked for public testimony. Bill ~mo, 238 Willow, stated he has been involved with the Plan for a long time and he has some real fears regarding the Plan. He stated he is concerned that a map will not be adopted at the same time as the policies; that there might as well be no guidance because it will be less than what is available right now. He stated he does net know how it will be possible to determine where a business or an apartment should be located. He asked that the Council consider holding up on adopting the text until the map is completed. He discussed Set 4, New 2C, "A system should be considered to inspect housing at the time of sale to determine that it meets minimum health, safety and energy criteria. This kind of system would ensure that all housing would be brought up to a standard over a period of time". He stated he feels the City is missing the mark and this would be too expensive for the buyer or the seller. Commissioner Stewart stated there is a need foraminimum maintenance ordinance. He stated some of the City is decaying and he asked how to get rid of decay. Mayor Jarstad stated they are trying to ensure that the housing in the City is up- graded; that this policy would ensure that housing is brought up to a certain livable standard before it is sold. Commissioner Stewart stated that the same standards CITY COMMISSIONERS' MINUTES August 12, 1980 Page seven should apply whether someone is living in the house or not; that the City has to have safe buildings for everyone to live in. Mr. McCluskey noted that this will only give the City one more weapon to enforce certain standards for housing. Com- missioner Swanson stated this will only be a tool to help prevent the sale of property from one person to another without upgrading that property. He stated they are trying to amend the dangerous building ordinance and write a minimum maintenance ordinance without putting a real hardship on people who live on a fixed income. Commissioner Stewart stated that a new owner might upgrade that house and if the City kills the sale, this will prevent that house from being improved in the future. He stated the City needs a minimum maintenance ordinance to make sure that these buildings are up to standards. Mr. McCluskey stated that City officials do not have the power to enter someone's home for inspections like electrical wiring or plumbing. He stated with a policy like this one, these houses can be inspected at the time of sale to make sure it is up to standards. Mr. Amo then discussed the PUD and stated he is very much afraid of this. He stated the only thing the PUD can do is increase density; that if an area is suited for high density, then it should be so designated. He stated he is also concerned that all the proposed changes in the Housing Element tended to remove the more restrictive terms for density. Clarence Allison, 1248 8th St., stated that lending institutions inspect houses at the time of sale and the City should not be involved in that. Donald Parkhurst, 2520 Perry Ave., stated he hopes this Plan will not allow a tavern or low-income development to go in right next to a residential area; that an impact like that has to be taken into consideration. He stated the boundary lines of the City need to be changed by annexing some of the adjoining areas to the City. Mayor Jarstad stated the Planning Dept. has been instructed to prepare a map to reflect the policies that have been presented to City Council and they will not be giving anything away during the interim period. Commissioner Swanson stated he does not want to see the whole thing shelved waiting for a map and he feels the Council should take action on the policies as presented. Mr. Amo asked how soon the map would be ready and Mr. Attebery stated they are hopeful the map will be before the Planning Commission within 6 months and it should be presented to Council within a year at the most. Mr. Amo asked if the old comprehensive map will be used as a guideline and Mr. Attebery stated the Planning Commission elected to adopt these new policies in place of the existing map and text and the old map will not be used. Mr. Attebery stated he feels more comfortable going into the mapping process with the knowledge that the policies have been adopted as an appropriate guideline. Clarence Allison, 1248 8th St., stated the Task Forces worked very hard to develop this Plan. He stated some of the policy language is not as strong as the advisory committee and Planning Commission intended. He stated their intent was to stop strip development, not limit it. He stated he is concerned about the economic survival of downtown Bremerton. Mayor Jarstad explained that they are leaving the door open to rationally look at areas for strip development; that some flexibility has to be left in the policy and that is why that change was made. He stated the Council did not go completely against the recommendation of the task force; that there are some areas that are only suitable for commercial use. A lengthy discussion followed regarding commercial development on 6th St. and Wheaton Way. Commissioner Swanson stated that the right commercial developments are not as hazardous as a high- density apartment complex. Mr. Allison stated he did not mean to stop commercial development in certain areas; he meant to stop putting in curb cuts every 100 ft. or so; that he would like to see frontage roads. Commissioner Stewart stated he liked the idea of frontage roads. Mr. Allison stated the residents of Bremerton would like to see a little more foresight and the City and the County should have been working together the last 60 years or so. Mayor Jarstad noted that there are many things the City has done to plan for the future. He discussed various park projects that have made Bremerton a more livable City. He stated there is no way the traffic could have been anticipated or the impact that traffic would have on certain areas. Mr. Allison asked if anything has been done regarding a bridge on Rocky Point and Commissioner Swanson stated Rocky Point is probably the most inappropriate place for a bridge and he does not think a bridge will be built in the near future. He stated if and when a bridge is built, it will have to be built to serve the large users, i.e., Olympic College, PSNS and the ferry system. Meeting recessed from 9:20 P.M. until 9:25 P.M. -7- CITY COMMISSIONERS' MINUTES August 12, 1980 Page eight TAPE #195 BREMERTON AREA PLAN HEARING (continued) (A) Jim Tracy, Port Orchard, stated he owns property on Rocky Point and he is a profes- sional planner. He discussed the form of the Plan and stated he felt the definitions needed to be expanded. He stated that words like compatibility, intensity, neighbor- hood character, etc. do not have a definition but are used numerous times. He then discussed the compatibility test and stated if he could change one thing in the County's comprehensive plan, he would change that te~t. He stated it makes the job of administrator very difficult and he suggested that the Council investigate per- formance standards as a replacement for compatibility test. Mr. Tracy asked if the neighborhood plans will be part of the comprehensive plan or if they will remain unadopted. Considerable discussion followed regarding the flexibility which the City Council will have with the new Plan and Mayor Jarstad asked what is wrong with flexibility and proper guidelines to have the elected representative~ of a City make a decision. Mr. Tracy replied that there is a difference between flexibility and total ambiguity; that the Council will be accused of being capricious and arbitrary if they make a decision that certain neighborhoods do not like. He stated he does nct think the Council realizes what this Plan means without a map and Mayor Jarstad agreed that he does not understand every single word of this Plan even though he does have a concept about it. Commissioner Stewart stated he agrees that without a map, this Plan is just a tool and is much too flexible. Commissioner Swanson stated he does not think the entire Plan should be held up waiting for preparation of the map. Mayor Jarstad stated he thinks the Council should get on with adopting the Plan and preparation of the map. Kay Wilson, Asst. Planner, expressed appreciation to the individuals who came from the County to testify. She stated she urged them to come because they have gone thrcugh this process and she has a great deal of respect for their planning team. Mayor Jarstad closed the hearing to public testimony. Discussion followed regarding Mr. Amo's concern about inspecting housing at the time of sale and Commissioner Stewart stated he felt this should be taken out. It was the consensus of the Council to eliminate the words "... at the time of sale . . .". Motion by Mayor Jarstad and Commissioner Stewart to close hearing and continue it at the regular Council Meeting next week, allow comments from the public in regard to the Plan before reading the Draft Resolution for information for the public and adopt the Resolution at the regular Council Meeting on Aug. 26, 1980, carried unanimously.
