Root recommended that the City not sell this property because of the storm line
which runs from Eastpark to the property. He stated that in 1973 there was a
considerable washout of the property and the City is still faced with the possibility

whether to cancel the current contract the City has with Leyde. He stated they
were unable to come to a decision and they have requested cost figures from both
Mr. Leyde and Mr. Littlejohn. He stated further the committee should have a
recommendation in a couple of weeks.
TAPE #192 DISCUSSION REGARDING PORNOGRAPHY
(A)2326 Clerk read memo from Asst. City Attorney Conoley, dated July 21, 1980, regarding
the Detroit "smut" ordinance. The memo stated the ordinance establishes a method
of dealing with certain regulated uses, including "adult" bookstores and theaters;
that the ordinance is part of the zoning ordinance and is designed to prevent the
"skid-road" type effects which occur as a result of an aggregation of the regulated
uses. Attached to this memo was a copy of the Detroit ordinance, and both memo and
ordinance are on file in the City Clerk's office.
Considerable discussion followed and Commissioner Stewart stated he sees nothing
wrong with sending this to the Planning Commission for evaluation and possible
adoption by the City. He stated that an ordinance has been passed by Council and
it should be enforced.
Motion by Commissioners Stewart and Swanson to submit Detroit ordinance to the
Planning Commission. Under discussion: Mayor Jarstad noted that the Detroit
ordinance has been defended all the way to the Supreme Court. Commissioner Swanson
stated the last thing the City wants is another First St. like Seattle has; that
is what the merchants on Callow are trying to stop. Bob Wright, representing the
West Bremerton merchants, stated he thinks the ordinance that has been passed should
be enforced. He stated that an economic impact statement should be developed so
businesses have to comply with the ordinance. He stated he does not want these
adult book stores to be spread all over the City; that he thinks they should be
eliminated completely. Commissioner Stewart stated the business license applications
have to be designed to show whether a business will have an economic impact and a
renewal also has tc be developed. Ms. Mandio explained that the Planning Director
and City Attorney's office have been working on development of the Economic Impact
Statement, but it is very difficult to draw up guidelines because of constitutional
rights. Mr. Wright stated he would like to see something done as soon as possible.
Mayor Jarstad asked Mr. Wright to set up an appointment with Mr. Attebery to
discuss the guidelines and set up criteria. He stated most of the residents think
of this issue as a moral issue, not an economic issue. Commissioner Stewart stated

he does not want the Council to get into censorship; that the Council should be
concerned only with economic impact. Rose Taylor, 91-B Baer Blvd., discussed the
moral issue and stated she thinks people are seriously affected by adult book
stores. Mr. Wright asked if a moratorium could be put on this type of business
coming into Bremerton. He stated the Detroit ordinance is not what they want;
they don't want this type of business spread all over town. Commissioner Swanson
explained that the City Attorney's office and Planning Director are trying to
develop an ordinance that will hold up in Court. Mayor Jarstad stated that
implementation of the ordinance and the guidelines are in the process of being
worked out now. Question was called and motion carried unanimously.

Commissioner Swanson asked Mr. Root if any sight distance studies had been done
and Mr. Root stated none had been performed, but it is his feeling that there
are no problems with sight distance as long as it is ingress only from Wheaton
Way. Commissioner Swanson stated he would like to have the Engineering Dept.
assist in locating the sewer line on this property so the sewer lateral can be
blocked.
Discussion was held regarding whether to allow Mr. Attebery freedom of choice if
the applicant wants to change the location of the sleeping facility. David
Harkness, the architect for the proposal, stated he has studied the site very
thoroughly and the location of the sleeping facility will not be changed; that
this is the best place for it.
No one was present to speak in opposition to the rezone.
Motion by Mayor Jarstad and Commissioner Stewart to follow recommendation of
Planning Commission and approve rezone from R-1 to B-2 subject to the following

marked as "exit" or "entrance only". Markings shall be so designed and located
to not interfere with driver and pedestrian visibility; (4) Vegetation between
parking areas and streets shall include trees and other vertically growing vegetation
in addition to ground cover and low growing plants. Care shall be taken not to
h~nder vehicle or pedestrian visibility; (~) On-premise signs shall be so designed
and located as to not create adverse effects on neighboring residential uses. Such
effect which should be avoided include unnecessary height, inappropriate location,
light and glare; (6) The triangular area in the northeast corner of the site
adjacent to parking stall #13 and the driveway area shall be lowered to a height
which will ensure adequate sight distance at the Callahan/Wheaton Way intersection;
(7) The 8 "sleeping rooms for patients" shall not be signed or marked or advertised
as motel type units available to the general public. It is not the intent of the
approval to grant the right to develop or advertise a motel type business. The

installed at the owner's expense along Wheaton Way. Motion carried unanimously.

sioner Stewart stated he did not vote three years ago because of his interest in
Land Title. Mr. McCluskey advised him to abstain again.
