She read Planning Commission Resolution No. 571 recommending denial. She stated 59 advisory ballots were sent, 28 returned with 12 agreeing and 16 disagreeing with the proposal. She then read letter from C. F. Jones, dated July 2, 1980, in cpposition to the proposed rezone and letter from H.R. Halvorsen, postmarked June 30, 1980, in favor of the proposed rezone. Ken Attebery, Planning Director, stated the current zoning of the site is B-3; that it was originally rezoned for use as a car sales lot. He stated the current proposal is to allow development of the total area for a mexican restaurant with take-out food facilities and off-street parking area; that 39 parking stalls would be provided. He discussed the surrounding land uses and stated the 1966 Comprehensive Plan indicate~ the area as "Traffic Oriented Commercial" PROPONENTS: Bruce Buskirk, representing NW Taco Time, stated he feels this is a worthwhile project; that the plan is consistent with the Comprehensive Plan and the zoning ordinance. He stated further that a six-ft, fence will be erected behind the structure, which will help eliminate noise. He stated that traffic problems -5- CITY COMMISSIONERS' MINUTES July 15, 1980 Page six can be worked out; that people will not use 5th St. to get to this property. He stated the lighting will be low level and will not bother the neighbors behind the establishment. He discussed the problem of oder and presented affidavits from Mary Nobles and Gordon Esser which stated they have never noticed any offensive odor from the Taco Time on the east side. He urged the City Council to approve this proposal. OPPONENTS: Dave Townsend, 2130 5th St., stated he is representing the neighbors who are opposed to the proposed land use change. He stated they object to the traffic congestion this proposal will create; the noise; the economic impact the proposal will have on their homes and property; and it does not fully comply with the Comprehensive Plan. He stated the neighbors are against another fast-food restaurant in the area and recommended several other locations where this restaurant could be located. He requested that a 9:00 to 5:00 type business be located at this site instead of a traffic-generating business like Taco Time. Mr. Buskirk stated thE~ only neighbors wl]o are complaining are the ones who live on 5th St.; that no one has complained from 4th and 7th. He stated the economic impact on the owner of the property should be considered also; that there are a small number of people who are telling the Council what to do. Mayor Jarstad stated that the City Council would like to see this property cleaned up; b~t it is very difficult to develop a commercial parcel when it is adjacent to R-1. He stated he does not want to divert lraffic through a residential area. Commissioner Swanson stated he does not think this is a proper proposal for this neighborhood. He stated he would like to see this parcel developed and cleaned up, but this particular proposal would generate too much t~affic for the area. M(~tion by Commissioners Stewart and Swanson to follow recommendation of Planning Commission and deny request for Change in Land Use Restrictions, carried unanimously. FAPE #192 BLACKSMITH SHORELINE DEVELOPMENT PERMIT VARIANCE (A) 374 Clerk stated the hearing had been posted and advertised as required by law. She read letter from H.A. Targen, no date, objecting to the proposal to build a roof on the sun deck at 317 Shore Dr. Ken Attebery, Planning Director, presented two aerial photographs of the site and stated the request is to cover a deck which h~s bE~en built out in front of the residence at 317 Shore Dr. He stated that shoreline regulations indicate that there should be a 25-ft. setback with the exception of uncovered or unenclosed structures. He stated the sun deck is 21 ft. from the high water mark; that the staff feels theft the request for variance does not hinder the Shoreline Act itself. He stated the roof would have a low profile and should enhance the neighborhood. Commissioner Stewart asked if the next-door neighbor's view would be restricted if this were approved and Mr. Attebery replied that his view would be restricted somewhat, but it would be limited. PROPONENTS: Stan Blacksmith, 317 Shore Dr., stated Mr. Targen will see only a small portion of the roof and he does not think it will block his view. George Hoffman stated the addition will look nice and the r¢of is of a low profile; that it will enhance the neighborhood. He stated Mr. Blacksmith wants to put the roof on the sun deck for protection from the south winds; that it ~ill be much more comfortable and liveable for him if the roof is on. OPPONENTS: Horton Hackler, President of the Manette Peninsula Neighborhood Association, asked how this structure could be built covering 47% of the lot. Commissioner Stewart explained that it was built before adoption of the Shoreline Master Program. Glenn Vockrodt, 1409 Marlow, stated cars are parked on the front yard setback when they should be parked in the garage. He stated the house is too big for the lot and requested that the request for variance be denied. Mr. Blacksmith stated there is ample room to park on the blacktop and he does not have room for parking in his garage. -6- CITY COMMISSIONERS' MINUTES July 15, 1980 ' · Page seven Commissioner Stewart stated he does not see where covering the deck will hurt anyone; that the roof will shield the property from the southern winds. Considerable discussion followed regarding whether Mr. Blacksmith's own actions caused the need for a variance. Mayor Jarstad stated the need for the variance results from the applicant's building the sun deck. Mr. Attebery stated Mr. Blacksmith needs protection frcm the southern storms and the roof will provide this protection. Commissioner Stewart stated that if it legal to grant this variance, he does not see any harm. Commissioner Swanson stated he thinks Mr. Blacksmith is entitled to have this type of addition to his home; that he does not see where it obstructs anyone's view. Motion by Commissioners Stewart and Swanson to approve variance request based on satisfaction of four conditions required by the Shorelines Management Act. carried unanimously.
