Mr. Serry presented a six month operating budget to council and requested funding starting 0114 the first of July in the amount of $3250 per month. .Commissioner Stewart stated it looked to him like the City was funding the Bureau 100% and he felt that other sources within the County should also be contributing. Mr. Serry stated the funding was to start up the Bureau and they anticipated gaining membership-contributions up to $10,000 the first six months and to use th~se funds for a promotional campaign. Commissioner Stewart stated that another peculiar thing about the amount of the request was that a years' funding of the Bureau amounted to the exact amount of money take'; in last year. Bob Wilson, Bremerton Area Chamber of Commerce, stated he wanted to urge the-Council to fund the Bureau and consider the request before them. Joe Mentor, stated he feels the Chamber of Commerce is sincere and wants to do something for tourism for this town. He would like to see the money go into an effort to promotion of Bremerton and that we do not need the money going into salaries for directors, etc. Mayor Jarstad stated'he has been disappointed in the disruptions in the community dealing with something as needed as the Visitors Bureau in our community. He felt the activity could have been spent promoting visitors to the area. There was no question in his mind that the council has allowed funds to be used for support of the Bureau and that it would be a large enough amount to get them off the ground. Motion by Mayor Jarstad and Commissioner Swanson to approve the amount of'~50 per month for the first six months to help start up the Bureau. Commissioner Swanson stated he feels the Council is using money here that could have been used to develop an activity type center and that he would like to see some results in the way ~f promotion for the area durinG 0920 this time, before he would recommend approval of the next request. Commissioner Stewart feels this is a hastily drawn up request; that he had no objections to promoting Bremerton; but that other cities he had checked with only contribute 20%, and we are being asked to contribute 1050 100%, and that he had not seen. any goals and objectives presented yet by the Bureau. City Commissioners Meeting June 30, 1981 Page Two Mr. Don Serry presented the goals and objectives to the Council indicating the memberships and goals they hoped to reach by the end of the year. ~gry Lou Long, stated she does not feel it is a wise business move to 100% fund the Bureau and indicated she felt it should be of a loan- type nature rather than complete funding. Commissioner Swanson stated he felt we should have monthly input from the Bureau on their progress along with a monthly written report. Mayor Jarstad stated we are taking money generated already by the tourist industry and it is a wise investment in this community and felt they should have a trial period. Clerk raised question on the motion; carried as follows: Mayor Jarstad, yes; Commissioner Stewart, no; Commissioner Swanson yes. 10:00 to 10:10 - RECESS BID OPENING - ASPHALT PAVING PRODUCTS One bid was received - Ace Paving Co. Mr. Harold Nelson, stated that they have been making every effort to comply with the request of the Council by remodeling and sound-proofing the building, keeping the volume down, and they were very surprised to receive the letters of complaints. He felt these letters referred back to the problems of 3-4 months ago and not for the present time. Mayor Jarstad stated people get=tired of calling in complaints and feels 1748 we should set a public hearing for input in this matter. Attorney Sells stated that a license could be issued subject to the results of a public hearing and decision being made at that time. Motion by Mayor Jarstad and Commissioner Swanson to set Tuesday, July 7, for public hearing on the Briarcliff Restaurant License Application; and that a License for Music & Dancing be issued for one week subject to a decision by Council at that time, carried as follows: Mayor Jarstad, yes, Commissioner Swanson, yes, Commissioner Stewart, no. PUBLIC RECOGNITION - BLUE RIBBON PANEL Mr. Amo, stated that a letter had been sent to the Mayor requesting a written charge as to what was expected of the Blue Ribbon Task panel and they had not received a reply yet. Michaele Hosea, stated there was a lot of confusion in the minds of the panel members and that a written letter would give the group something to deal with. Mayor Jarstad stated he thought they had all understood the object of their formation of the group, but that he would be willing to send them a written letter describing the purpose City Commissioners Meeting June 30, 1981 Page Three PUBLIC RECOGNITION CONTINUED: Mary Lou Long, read a letter to council concerning the observance and enforcement of a law in the criminal code concerning the Public Morals, and directed to the City Attorney questions relating to the average moral standards of the City. City Attorney Sells addressed her questions as presented. ORDINANCE RE MASSAGE PARLORS,for first reading Clerk read AN ORDINANCE for first reading, amending Ordinance 3169 Section's 9, 11, and 13 which are codified as Bremerton Municipal Code 5.92.090, 592.110 and 5.92.130 respectively and adding new sections to said ordinance relatinq to Massage Parlors. Page 2 Section ~ Paragraph L, as follows: "All licensed employees doing business shall be fully clothed while working". He quest~oDed Section 2 as it related to records keeping of names and addresses of all patrons, date and type of treatments and person rendering treatment. Also questioned was Section 3, regarding health regulations, stating his clients were ~lready interested in maintaining a healthful place of business as set forth in WAC requirements. At this point Mayor Jarstad interrupted stating we had to go into our regularly scheduled hearings at 10:30 and as it was already 11:05, he could continue his presentation after the hearings. HEARING - ROBERT GREEN, REZONE REQUEST R-1 to R-2, 2442 Snyder Avenue ~mmissioner Swanson stated tha~ being-a ~esident'oh Snyder Avenue, but not within the prescribed distance, he had in the past consistently excused himself from this hearing presentation and would also excuse himself today. Clerk stated that this rezone request had been properly advertised and posted as required by law. There was a discrepancy in the Public Notice posted which stated the hearing would also be for the Shoreline and Variance request, she stated this was done in error and that the neighbor- ing residences had been notified. The hearing today was for the rezone request from R-1 to R-2 only, the Shoreline and Variance hearing would be scheduled for some time in the future. Clerk stated she had received two letters , one from a Mr. Charles Cutting stating he had no objections to the rezone. A letter from Mr. Gary Pod was read stating his object- ions to the rezone request. Mr. Ken Attebery described the property being proposed for rezone. He stated the following conclusions of the Planning Commission: Provisions of adequate off-street parking and consideration should be given to bicycle parking facilities. Without a rezone of R-2 the applicant could construct four units in two structures on the subject property be revising the existing short plat to provide two 5,800 square- foot (land area) lots. Mr. Attebery reviewed the department responses which are contained in the Planning Commission Resolution No. 596, recommending denial. He also referred to the Bremerton Planning Depart- ment Advisory Report and their conclusions set forth: Townhouse Use: recommended consideration of a smaller scale multi-family use. Site Design: Considered consistent if scale of development is reduced to be more in keeping with th~ surrounding area, provision of off street parking; opportunity for public waterfront access; sidewalks; under- ground utilities; adequate site drainage and bicycle parking encouraged. Energy Conservation: proposal approved. Parking: off street necessary. View Blockage: stated single family or duplex unit could block' as 2700 much view as the four-unit townhouse design proposed. City Commissioners Meeting June 30, 1981 Page Four HEARING CONTINUED: Mayor Jarstad stated we note the Planning Commissions main concern was a presumption of a precedent for setting a R-2 zone and that 2787 others would be granted in that area after that. Mr. Robert Green, 3702 Cartier Drive, stated he feels this is the best use of this land, fits in with comprehensive plan, there are other multi use dwellings in the area not keeping with the surrounding neighborhood. The off-street parking is triple that required by Tape code. 221 Side Commissioner Stewart discussed land use cost with Mrs. Green', duplexes 1 vs - Townhouses. 0008 Michaele Hosea, stated she lives in a similar type of neighborhood and feels this is the best use of the land, rather than have single high cost, family dwellings. Barry Branch, Architect for 30 years and long time friend of Bob Green's stated he does not like to see decisions made on land use on surface 0300 interest. He feels neighborhoods are self protective and do not allow change. He stated he could vouch for the character of Mr. Green as a good person and feels his proposal would be an addition to the community. 0410 Felt the rezone was needed to integrate our society ann life styles Bill Egans, Registered Engineer for Art Anderson Associates, stated the structure has all energy concepts and supplies about 30% of its heating. He supports their proposal. David Ford, a neighbor on Cartier, stated the Green's are good neighbors and he was totally impressed with the quality of their proposal- for the site. 0502 M__ary Lou Long, stated she had no objection to townhouses and feels it would upgrade the neighborhood. Norm Walton, 2518 N. Wycoff, stated he did not feel the site plan picture presented showed the true layout of the land; and that he was against it 0708 due to excess noise, traffic, high density etd. Mayor Jarstad commented that he felt that everyone should have a good neighborhood to live in, multi family dwellings as well as single family 0873 dwellings. Mrs. Violet Dale, 2432 Snyder, presented a list of names on a petition who were against the rezone. She stated sometime ago she had shown ' interest in the property and was told it was not large enought to build two homes on it and wondered why all of a sudden it was large enough' to be considered for an R-2 rezone. Frances Fretwell, 2431 Snyder, would rather see a single family dwelling on this property than multi family use. She was concerned about the increase of traffic and related dangers. She opposed the rezone. A1 Fretwell, 2431 Snyder, expressed his concern over adequate notices 1021 being sent, felt this was strictly a spot rezone to start with. He felt if it were passed it would open up the area for other rezone action. Gordon Stenerson, 2441 Snyder, was concerned over the driveway and parkinq situation. City Commissioners Meeting June 30, 1981 Page Five ~HCARING CONTINUED: William Harvey, 2428 Snyder, came to testify against the rezone as he is concerned about the precedent this will set. Ruth Capp, 2449 Snyder, stated she is against rezone as she feels it would open up other requests in the neighborhood. Glen Vockrodt, 1409 Marlowe, stated he is against the request and considers it to be a spot rezone. Mary Lou Long, agrees this is a spot rezone and we cannot have this. We have to have an overall zoning map and stick to it. Myrna Green, 3702 Cartier Drive, stated all they want is four single family dwellings; they are now intending to build on 27% of the land due to all the restrictions placed on it. She asked if we have a Bremerton Area Plan, Buildin~ Codes, Energy Study, etc., and if we do we better use them. She did not feel the parking was a problem and 1765 presented two pictures to the council showing the current usage. Ken Attebery was asked to explain the square footage of the land, stating there is 21,400 square foot of land area. If they repair the existing bulkhead and fill in behind it., the land use would be 14,800 square feet available. Discussion followed regarding variance require- ments on R-1 property and the necessity to be R-2 if they were attached dwellings of a multi family use. He stated the site could be developed into two duplex units, the area can be short-platted and the land large 2105 enough to accomodate them. Mayor Jarstad stated this had been the subject of a lot of hearings throughout the years and it has been difficult for Council to make a determination; the cost of land must be taken into consideration and in this particular rezone today, we have some very strong and well founded concerns by the citizens living in the area, it was almost unanimous in their desire not to have the rezone changed, and this carries a great deal of weight with the Council. Also have another action to consider that has been taken, and it is the unanimous refusal of this proposed rezone when it came before the Planning Commissie He felt that if it is possible for the land to be used for high density 2181 living without a rezone, that possibility should be explored. Commissioner Stewart stated the land has to be used and they must decide the best use for it. Myrna Green, stated when people buy property and want to build on it,' who controls, the City or the neighbors and feels it is unjust to have 2300 her please the neighbors and not to please herself. She referred to severa sections of the Comprehensive Plan. Motion by Mayor Jarstad and Commissioner Stewart, that based on the testimony given, they recommend the rezone request from R-1 to R-2 be denied along with the Planning Commission decision, carried as follows: Mayor Jarstad, yes; Cqmmissioner Stewart, yes; Commissioner Swanson, no vote as he eMcused himself from the hearing. 1:15 - 1:25 P.M. - RECESS HEARING - SHORELINE SUBSTANTIAL DEVELOPMENT PErmIT - Hansen, Hansen and Johnson Clerk stated that this hearin~ had been properly advertised and posted as required by law. Mr. Attebery explained the request and area in question, stating the Planning Commission had recommended denial on the width variance. City Commissioners.Meeting June 30, 1981 Page Six tlEARING CONTINUED - IIansen, Hansen & Johnson At this point, Mayor Jarstad stated he felt this hearing should be continued because of the late hour and many persons interested had left earlier. Mr. Hansen, Architect for the property owners, stated he would be willing to withdraw the variance request and wished just to discuss 2414 the shoreline permit. He wanted to know what rules and regulations the City was using and if he could follow the zoning ordinances for his plan or should he be dealing with the Planning staff. He stated he agreed with all the conditions proposed except the parking and indicated he would work with the staff to resolve this issue before the hearing next week. Tape Motion by Commissioners Stewart and Swanson to set the.hearing for 221 11:30, Tuesday, July 7, 1981, carried unanimously. Side 2 0010 ORDINANCE RE MASSAGE PARLORS CONTINUED: Clerk stated the discussion was open on this Ordinance as it had previously been read into the minutes. Mr. Clay Terry, Attorney representing the International and Pearl Saunas, expressed concern over the ordinance as presented at this time stating he felt it was evident the intent was to eliminate sauna business in Bremerton. He discussed the points of warrantless search, and stated the type of recordkeeping being proposed wduld be an invasion of privacy of the customers and that these records could be subpeonedf by the press as well as law agencies. He also felt the amended proposed paragraph relating to "fully clothed" should be defined more specifically. Attorney Sells stated that he would agree to this and put in specific dress code when it was written up. Attorney Terry stated the massage parlors do.their best business in the later hours of the evening when people are through with work, particularly-late 0813 shift workers, and that a lot of customers chose to come to them instead of a health club due to the better hours and lower cost. Discussion followed regarding possible acts of prostitution at sauna parlors and methods of control, such as control of hours of operation. Attorney Sells stated he would work with Attorney Terry before the next reading. Mayor Jarstad stated that this ordinance is patterned after the one used by the county which has never been contested. Commissioner Stewart stated we are not covering the costs involved in licensing and enforcing sauna parlors, and felt that the B & O Tax 0958 we receive is not accurate. He asked if the owners would be willing to put up a $10,000 bond that would be forfeited if there is any prostitution closures. Attorney Terry stated he would consider that% Clerk raised question to approve the Ordinance as previously amended, and carried as follows: Mayor Jarstad, yes; C6mmissioner Stewart yes; Commissioner Swanson yes. 2:40 P.M. - Mayor Jarstad left the Council meeting for a previous appointment.
