10:20 - 10:30 RECESS
(2608) 10:30 A.M.' REHEARING ON C-21, LARKIN REZONE
~erk reported there had been no further correspondence received
regarding this hearing within the past sixty days. Clerk reread
letter of March 12th from Century 21 written to the neighbors, and it
was reiterated that the Council felt that there should have been a
meeting between the neighbors and developers prior to coming into
Council.
Charles Warner, 4616 Kitsap way stated that five of the neighbors had
met a week ago amongst themselves and stated that they were all waiting
for the developer to contact them for a meeting.
City Commissioners Meeting
April 21, 1981
Page Five
Mayor Jarstad stated there was no question in his mind but that it
had been given to the developer to contact the neighbors and arrange
a meeting with them and return with a mutual proposal.
Mrs. Norma Moon, 4622 Kitsap Way, stated she has 2 1/2 acres of land
adjacent to this property in question and she favored this land being
rezoned commercial and a 9 5 business being established there.
Tape
214 Mr. Lorenz, Broker Larkin Realty stated he was willing to cut down
Side 1 The size of his building so that it was compatible with the size of
0003 a home, with approximately 4000 sq. feet on each floor, leaving trees
surrounding the structure to shield it from the neighbors, but he has
had no input from the neighbors. He stated the heighth of the building
would be 18 feet from ground level and that it was to be a two level
building.
Paul Hockinson, 919'Weslon Place, stated he was in support of the
project and he recommended leaving trees across the front, with no
parking of cars in the rear, and no rear exterior lighting. He felt
that ingress should be from Kitsap Way with egress onto Weslon PlaCe.
Mrs. Betty Uhl, 4610 Kitsap Way, stated she was in sympathy with the
taxes levied to those on waterfront property, but did not feel that
they had to have a commercial rezone to help them out in paying their
taxes.
Mayor Jarstad stated council has had opportunity to follow the reco-
mmendation of the Planning Commission to deny request for rezone, but
did not do so because people would like to have a low keyed use of
that land rather than development of high density. He felt it was
wise to look at the possible uses of the land and have some input into
that by the neighbors. It would be his desire to schedule a mepting
and go over the property tc see what can be worked out with some time
limitations written into it.
Michael Gawenka, 929 Weslon Place, asked if it was necessary to
classify this land B-2 in order to have a business on it or could it
be a lesser zone. She felt that 8000 sq. feet was a lot for two
businesses and thought there might be more than that going to go in
there and a higher use of the area could be possible.
Charles Warner stated he felt the Council had the material necessary now
to make a decision and he referred to his letter of March with a review
of the Comprehensive Plan in relationship to this case.
(1237) Jim Shank, 4604 Kitsap Way felt it would be wise to have a meeting
with the developer.
Ken Attebery stated a copy of Resolution No. 586 can be made available
to anyone who wishes it. He also stated that he felt this matter should
go back before the Planning Commission. There needs to be communication
between Planning and Council when the Council goes against the Planning
Commission recommendation. The Planning Commission is attempting ~o
follow the Comprehensive Plan.
Mrs. Betty Uhl felt the residents need protection and is in favor
of a meeting to get in touch with the developer.
Commissioner Stewart asked if a two week time frame would be adequate to
get together with the developer and recommended coming before the Council
again on May 19. Motion by Commissioners Stewart and Swanson to recess
this hearing until May 19th at 10:30 a.m., carried unanimously.

to have a map to go with the Comprehensive Plan.
~2204) 12:40 P.M. - QUAD 4000 HEARING
Clerk stated this hearing was posted and published as required by
law.
The condition in question involves four small stands of larger trees
on the west side or development side of a solid fence erected along
the Maple Avenue end of the proposed commercial development. The
intent of the original condition to retain these stands of trees was
to provide additional visual screening between the project, the
Wheaton Way traffic, activity and light and the residences along
and east of Maple. The trees will be affected by construction activity.
Planning Department suggests the planting of evergreen trees at
various locations along the west side of the fence line and the south
group of trees at the south east corner of the site be retained.
Mr. Manchester, 3920 Maple stated he was in favor of the trees being
taken down.
Mr. Ferguson, Quad 4000 Corp.stated a fence would be ~xtended along the
south line where necessary to keep the building out of the neighbors
view. Motion by Mayor Jarstad and Commissioner Swanson to approve the
request and change the conditions of the rezone granted by the City
Commissioners on January 20, 1981, as follows:
1. New Condition, 5C: "In addition to b. above, the stand of
large trees marked on the topographic and vegetation survey
attached as Exhibit B shall be retained and so marked for
retention prior to any earth work being undertaken in the area."
.. New Condition, 5E: "The developer shall plant and maintain
grouping of evergreen trees along the west side of the solid
fence mentioned ind. above. These groupings of trees shall be
approved by the Planning Director."
3. New Condition, 16: "The solid fence along the south line
described in 5D above, shall be extended to the west to a
point which will prevent line of sight visibility of the project
buildings from the residents at 3919 Maple Street,
