BRIARCLIFF
Mr. Banghart stated the owners were continuing to change the
glass in the windows to triple pane, replacing the single pane;
switching bands and studying types of music to determine the
area of noise level, They were also continuing to work with
Engineering Department regarding the under-belly of the build-
ing as well. Mayor jarstad stated the question was if we
wanted to keep this out of the court or work with the owners.
It was stated that the owners may have to go to triple pane
glass in the banquet areas as well to help cut down noise level.
Jim Sells addressed the Council re the status of the lawsuit,
which was filed on 2-18-81. Judge Roper had issued a temporary
reshraining order, as owners had shown just cause that there
would be a good possibility of loss to the Briarcliff because
of City Council action. Next step would be a Preliminary
Injunction and then we would have a full hearing on the matter,
and that the way the Court calendars were, that it could be up
(1832) to one year before it would reach the court.
Motion by Mayor Jarstad and Commissioner Swanson to grant the
Briarcliff Restaurant a 60 day suspension to allow the owners
to carry through with their intentions as listed on their letter.
It was stated that the Briarcliff Restaurant has been an asset
to the City of Bremerton and it was hoped the problem could be
(1996) resolved without court action. Motion carried unanimously.

Police Department to correct the situation, stating that the
present police force is up to 63 officers, the highest staff the
City has ever had. Commissioner Swanson stated that perhaps the
Neighborhood Group could ask Chief Devery to attend one of their

in the Park, that the present drug/alcohol problems would diminish.

Barry Branch, Architect, 307 Pacific Avenue, spoke regarding the
storm water retention requirement for a holding tank and to be
discharged into the city storm water collection system, stating
the closest is on Park Avenue, and that'possibly the cost would
become a burden to the project, unless funding has been allocated
for this separately. All other aspects of the Planning Commission
recommendations were acceptable.
Mrs. Maryellen Babbit, 820 Cogean, Bremerton, stated she was
in favor of the project, but wished to express her concern that
the construction vehicles show caution when using the alley
during the project as her property was situated directly behind
the proposed site, and that there was a partial concrete retain-
ing wall on her property.
Mayor Jarstad and CoImmissioner Stewart discussed with Ken
Attebery the advisability of the storm water retention and it
was felt that due to the history of flooding and water retention
on Pacific Avenue, that it would be advisable to take this
opportunity to develop a holding tank and separate run out.
Bill Meigs stated the property was only 45 feet wide, that there
had been a home situated there previously and did not feel
there would be additional run off by utilizing the existing
building space plus pavement. Commissioner Swanson recommended

and there was no problem with water standing.
Ken Attebery stated the Planning Commission did not recommend
any specific requirement regarding surface. The zoning require-
