rAPE 207 LETTER FROM EVERGREEN LEGAL SERVICES
(B) 2078 Clerk read letter from Evergreen Legal Services clarifying their
position regarding the City and its contractual relations with
Leyde Enterprises. Their intent is to have Leyde honor legitimate
'claims and to protect their clients from abusive billing practices.
He stated that the ad placed in the Bremerton Sun by Leyde was
contrary to the agreement reached by Ms~ Connor, Leyde's attorney,
and his office.
Mayor Jarstad stated' that he had met with John Tracy and looked
· at resolving the question of the ads. Mr. McCluskey stated Mr.
Leyde had run an ad and asked Mr. Tracy for his comments. Mr.
Tracy felt the ad was still deficient in several areas. The
intent was to have someone impartial review the claims. Discussion
followed regarding the ad prepared by Mr. Tracy and Mr. McCluskey.
It was agreed to run the ad twice. Mr. Stewart stated that he did
not think they would get much response because the bills are not
that large. The answer in this area is stricter enforcement
when people do not do their job. He felt this should be handled
by Council and not by John Tracy and Ms. Condors. Commissioner
Stewart quoted the Nov. 25th minutes where t]me Mayor wanted claims
satisfied before we went back to rotation.
Commissioner Swanson stated that he fel~ it~ould be appropriate
to route complaints from this ad to the City Clerk and City Auditor.
He stated he objected to allegations that he or anyone else is
unethical when he has not had one word of ir~ut.' He would like
to have the City Clerk handle it from here omout. Mr. Tracy
stated that routing complaints through the City Clerk would not
be a problem. He had discussed an escrow account with Ms. Connors
and could not reach agreements.
9:30 PUBLIC RECOGNITION
Harry Penor wanted to know what was going te be done. The Mayor
stated the agreed upon ad would be put in t~epaper. Mr. Penor
stated he was unhappy with Bremerton Ambula~e being put on the
rotation list. He felt the Commissioners d]~ not-act in good
faith per all previous Council Meetings. Ma~r Jarstad discussed
the December Council Meeting when the rotatien was discussed
thoroughly and stated that it should have be~n no surprise that
Leyde would be put back on rotation in 35 da~s. "In this room,
with you in this room, we decided to leave ~mpic on for the
remaining five days then go back to normal ~{k~tion with Olympic
for 30 days. This decision was made one mom~}and five days
before the Chief sent that normal memo that~s out every 30 days."
Mr. Penor stated he does not dispute that, ~he felt City Ordinance
was violted. He stated that he wants to see~le City put some power
in the new ordinance and enforce it.
TAPE 207 John Ross discussed payments for the crack andsurface sealing of
(B) 2467 the garages. He stated that it was to be paid from parking system
revenue but that the underground garage does ~ generate parking
revenue and should be General Fund.
Motion by Commissioners Stewart and Swanson to pay for the sealing
of the undergound garage from General Fund and the parking garage
from Parking System Revenue, carried unanimouS.
Mr. Ross discussed the deficit of $20,000 on ~]e Fire Station Capital
Project. He stated even with recovery on the~bnd for the fire
pumper there still is a deficit which must be3~vered.
Motion by Commissioners Stewart and Swanson to oover the deficit
from the General Fund, carried unanimously.
Sgt. Dennis Plumb o~ the Police Department pr~nted a letter and
petition protesting Commissioner Stewart's ~t~ement in the Bremerton
Sun regarding "somebody being on the take". ~esaid the statement
TAPE 207 indicates irresponsibility on the part Qf Comri~sioner Stewart and
(A) 0001 calls for a public apology to the Mayor and Fi~ Chief and everyone
who works in public safety. "A comment made lk~ this so flippantly
is without regard to the thought and feeling ~fpeop[e in public
safety.""It is fair to ask for a public apolo~'or short of that"
he suggested"you prove your allegations." Cormi~sioner Stewart stated

PUBLIC RECOGNITION contd
that when you write a letter on Monday to take affect 8:00 on
Tuesday, and we have Council at 9:00 on Tuesday, and the letter
is not distributed till 2:00 in the afternoon, it does not leave
a good feeling.
Commissioner Stewart stated you hear these comments out in the
field and he does not think it is true, but when you do things like
that it does not bring confidence to the City Council. I think I
set the record straight. I don't think anything was wrong, I
think it was a simple mistake. Mayor ~arstad complimented the men
in public safety for their action. We have striven for a level of
excellence so we do not have the bad feeling regarding departments
that other cities have. It is like waving a red flag in the public
safety division, when anyone in Council says someone is on the
take, especially at the Commissioners' level. Commissioner
Stewart stated he did not say that, he said it looks like it.
Fire Chief Meigs stated that he is not sure Sgt. Plumb got an
answer to his question, either a public apology or substantiating
it, and it appears he is not going to get an answer. Commissioner
Stewart asked how can you get a public apology for telling what
happened, it does make people look that way. I'm saying I don'~
think its true. He Hiscussed the issuance of the rotation letter
on Monday, and statedhe's the one that needs an apology, that's
no way to treat the City Council. Mr. Meigs Stated he is sorry
Commissioner Stewart did not voice the same concern when the other
ambulance company was put on the ambulance rotation in the same
manner. "The discussion here led everyone to believe the rotation
would continue after the 35 days. You are very inconsistent. When
you don't object when Olympic and HP T wing are put on rotation,
but you do object to this. They are done in the same manner, at
the same time, by .the same people." Commissioner Stewart quoted
the minutes directing justification of claims being taken care of
before Council, before going back to rotation. Mr. Meigs stated
that Mr. Stewart took accusations to the newspaper and did not
call him. Commissioner Stewart s~ated he did not, they called him.
Mr. Meige stated ~that to this date Commissioner Stewart has not
called him. He stated he does not conduct his business or the
city's business in the newspaper. He stated that Commissioner
Swanson and he listened to the tape of December 23rd meeting. It
did say normal rotation would be established and the Fire Chief
would report back to Council. We did the normal thing in the
normal manner. If2.that did not meet with your intent, I made a
mistake. I feel it did meet with Council's intent and I feel
strongly about that. Commissioner Stewart quoted the motion of the
November 23rd meeting by Mayor Jarstad to utilize Olympic for 30
days until reports can be received back from the attorneys working
with Leyde. Commissioner Stewart stated in that motion it may take
longer than 30 days to review this.
Commissioner Swanson stated he made a motion on December 23 that
we not go back to rotation until we had a report back that
Evergreen had resolved that things were correct. That motion
was not seconded. The final decision was that we would go back
to rotation and that Chief Meigs would come back to Council.
Motion by Commissioner Swanson that we return our business to
Olympic Ambulance until we have a report back that this is being
resolved or within 60 days whichever may come first. "If we do not
get some input from Evergreen, I do no~ want to hear from them in
61 days that I was unethical" Seconded by Commissioner Stewart.

PUBLIC RECOGNITION contd
F~r. McCluskey stated we have Leyde back on rotation and we are
taking action. Mr. Leyde has not done what we thought he would
do and we have given him till March 20th to produce complaints.
How long it will take after that to review I do not know. We
might as well say Leyde is out of business until such time as we.
decide to put him back in, if that is the case. My feeling is
the City should stay out of this complaint process. Leyde has
not cooperated, and Evergreen has not done anything more with this
either. Commissioner Stewart stated the simpler way is to put
this money in escrow. Mr. McCluskey stated he would like to see
this put on Leydes back to have this money put up in trust, but
with this complaint process, we do not get a steady guideline.
Mayor Jarstad stated he thinks it is in error of Council without
ordinance, to take people out of business.. Mr. Tracy stated he
felt that motion was not necessary. He felt that the escrow
account in conjunction with the ad would be more beneficial.
Discussion followed regarding people being able to choose which
ambulance they want to use. Commissioner Swanson withdraw his
motion. Commissioner Stewart withdraw the second.
Motion by Commissioner Stewart that we ask Mr. Leyde to set up a
5~B~escrow account; rotation program will continue; Fire Dept.
to notify people that there are two companies available and ask
them which one they want. Commissioner .Swanson asked for two
· motions.
Motion by Commissioner Stewart that the Fire Dept. notify 'someone,
if there is someone that can be notified, that there are two
companies, and let the customer make the choice. Seconded by~
Commissioner Swanson, with the note that sometimes people are
confused or dO not know, so there will be continuing rotation 'or
those people. Mayor Jarstad questioned "hit or miss" having each
· company geared up 24 hours for immediate response. He wanted the
Fire Chief to talk to the companies.
Ralph Simms, employee of an ambulance company in the City, stated
that in cases of critical care, there may not be enough time to
sit down and discuss which ambulance they would like to have.
Commissioner Stewart stated if there is a problem like that, the
Fire Dept. could transport. Mayor Jarstad expressed concern
about individuals promoting different companies. Mr. Penor
stated it is his opinion that the paramedics currently ask which
company a patient wants. He also expressed his interest in
having the Chief write up the SOP for private axnbulances.
Questioned called and carried unanimously.
Motion by Commissioners Stewart and Swanson to contact Leyde and
['~'ve him set up a $500 escrow account to cover these bills and
that Leyde will get the interest from the account and should be
held untill March 20th. Mayor Jarstad added that the City Clerk
should contact Mr. Leyde to have this set up by Friday or Monday
at the latest. Commissioner Swanson added that he will come off
of rotation if money is not put up by that time, carried
unanimously.
Mr. Penor discussed the elimination of the words "on-duty" from
the new ambulance ordinance. The Commissioners felt that this
was part of the amended ordinance and was published in the paper
correctly. They asked that he check with the City Clerk to see
the original ordinance.
Mayor Jarstad left the meeting at this time because of an emergency
at Westpark.
FAPE 207 LETTER FROM YMCA
(A) 1278 Mr. Godfrey expressed his need for revenue sharing money from the
City for the handicapp·swinnhin~program. Commissioner Stewart
stated that because of the financial crisis for the City, there
are no funds for this project. He stated that we cannot commit
money to a new program when our budget is so tight.

TAPE 207 SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT
(A) 1375 Park Department
Commissioner Stewart stated that he lives adjacent to this area
and asked if anyone objected to him hearing this matter. There
were no objections.
City Clerk read the advisory report and rec~endations of the
Planning Dept., and stated that this hearing was posted and pub-
lished as required by law. The property is located southwest of the
Oak and Lebo intersections. The purpose is for Park and Recreation
improvements. The recommendations were lis~d. City PlaRner,
Ken Attebery explained the site. The proposed additions include
one additional boat ramp, shellfish cleaningstation, and improved
parking facilities, picnic area and ballfiel~. The drainage
problems in the area were discussed extensi~ly. Mr. Attebery
stated that it lies in a potential flood arem. Commissioner
Swanson and Mr. Brees, Street Supt., discus~Ml the need for storm
drainage in the area. It is presently into~anitary lines that
must be blocked. There must be provisions ~r a storm line to
come across there and pick up the street drainage line. Ray Foley,
Parks Supt., stated that the water problemsill be eliminated and
introduced Jim Levy of Anderson-Apperson. ~ stated it will be
regraded somewhat. A small ridge above the existing ground level
will be b~ilt and a small draw below the natural ground level with
perforated drain pipe will be installed. T]~re will be drains in
the parking lot areas. ~ow shurbs will be ~ed; there will be no
trees so as not to obstruct the view. Therewill be a 65 foot
entrance. There will be bicycle parking. ~F. Attebery suggested
that facilities be developed according to ~ Bremerton Flood Plain
Management Ordinance.
Motion by Commissioner Stewart and Swanson~ amend Item 8 of the
recommendations to read that Facilities wit~n the proposed develop-
ment be developed according to Bremerton Flied Plain Management
Ordinance 3544, carried unanimously.
Mr. Attebery stated this is a 75% - 25% 9'ant, the changes
regarding drainage possibly could not come ~om this funding.
Commissioner Swanson stated that the storm~ainage is something
that has to be put in. When the permit is~cessed, this should
· be included. It would not come from the fu~i~ for this project
because it has to be done anyway.
Mayor Jarstad re-entered the meeting at th~time.
Motion by Con~issioner Stewart and Commiss~ner Swanson, based on
~h~ndings of fact, conclusions and exhiB~s, to approve the
