ORDINANCE, AMBULANCE SERVICES AND
LICENSING/REGULATING
~3.76 Chief Meigs reviewed the Ordinance and stated he didn't think
any changes had been made to the Ordinance since last weeks discussion.
Bill Littlejohn, Olympic Ambulance, referenced Page 5, Section 6,
and asked if there were any objections to customers receiving a
discount if their bill was paid in full within a certain date. City
Attorney McC]uskey stated this was not uncommon and didn't see any
problems with this as long as this was posted in the rate schedule.
Bill Littlejohn discussed the inspections fees in Section 12, Page 9.
He could understand the $50 semi-annual inspection fee if done by
the Eire Department, but expressed some concern about the $20 fee for
complaints. Conm~issioner Stewart suggested it just be charged if
the Fire Department Einds something wrong and asked if Mr. Littlejohn
would be willing to leave it to the discretion of the Fire Chief.
He stated he would. Mr.. Penor asked if this section pertained only
to equipment or to other complaints such as overcharging. It was
noted that Section ]_2 refers to "records, equipment and accessories".
Chief Meigs suggested leaving the discretion to the Fire Chief with
appeal to Council.
'Motion by Mayor Jarstad and Commissioner Stewart to approve Ordinance
~nd amend Section 12 to give the Fire Chief discretion over the $20
charges for complaints and appeal to Council. Under discussion:
Commissioner Swanson expressed concern about an individual who may
want to call an ambulance that is not licensed in the City, for
transportto Seattle or Tacoma. He stated the way the ordinance
is now written, you cannot do that. Mr. Littlejohn agreed that a
person should be able to call any ambulance they want. Mr. McCluskey
stated that the language could be changed in Section 1-B. Mayor

BRIARCLIFF RESTAURANT
Clerk read memo from Deputy Chief Shoemaker stating the Police
Dept. has received numerous ccmplaints of noise violations from the
Briarcliff Restaurant over a long period of time. Following the
sale of the business to Mr. Johnson, June 1980, they received an
additional 14 complaints of noise violations from Mr. Simpkins and
Mr. Stewart. Since the opening of the condominjums below the
Briarcliff, they have received complaints from Mr. & Mrs. Forester
concerning noise levels stemming from the Briarcliff. These
residences are in a Class "A" Edna zone as the receiving zone and
bordered on the Briarcliff property line which, as the transinitting
zone, is in a Class "B" Edna. The management of the Briarcliff had
sound level readings taken by an independent agency and submitted
a letter stating they feel that they are in compliance. Subse-
quent testing by Commissioner of Public Works Admin. Asst., Walt
Alloway, indicated similar readings. Both readings by Alloway
and~dne Briarcliff consultant indicate the premises in violation.
An additional reading by Alloway still indicates the noise
pollution level is unacceptable. It is the opinion of Mr. Alloway
and the Bremerton Police Dept. that the Entertainment License of
the Briarcliff Restaurant should be suspended pntil such time as
acceptable soundproofing is accomplished or the license should be
revoked entirely.

gross receipts be the minimum considered acceptable to the City.
For the past three years, five percent has been received wit]] the
concessionaire being the Bremerton Athletic Roundtable.

COMMISSIONERS REPORT
Commissioner Swanson referred to the Proposed Guidelines for the
C~ty Attorney that he presented to the Cit~ Council for consideration
at the December 16 Council meeting. He requested ~he Council state
their position on the Guidelines and asked for comments from the
City Attorney. Commissioner Swanson moved we adopt these Guidelines.
Commissioner Stewart seconded. Under discussion: City Attorney.
McCluskey stated he didn't feel these guidelines were necessary since
there were already guidelines imposed by the State Bar AssociatSDn,
etc., and the defjnition of public service needs re-wording.
McCluskey said we presently have Commissioner Swanson's guidelines
and a request for a Charter amendment. If we do anything we should
do what everyone agrees to. Commissioner Swanson stated public
service is where these people are dealing with the public. It is
a contract with someone to provide a public service. Mayor jarstad
stated that we Could set these rules and that if there are potential
conflicts any outside work could be approved by Council.
Commissioner Stewart asked if this would become part of the Review
Board that Messrs. Robert Mussman and Bill Amo recommended to the
City Council on January 13. Commissioner Swanson stated no, these
guidelines are something he requested sometime ago.
Mr. McCluskey stated public services "generally defined" should be
specific. If we are strictly talking about public service contracts
then we can boil this language down. If we are going to have guide-
lines they should be tight ones and list those contracts. Commissioner
Swanson said tbese could be adopted as Statement of Council policy
and say this list is it until more are added. I£ you have private
attorneys representing the City you cannot interfere with every
client they have or they will not remain long. There are certain
advantages to a private attorney of flexibility and expertise. If
we are going to have that he must have enough clients outside the
City to exist and prosper. My intention is to avoid the appearance
of representing both sides of an issue. I do not want to stop them
from representing someone we buy from once in awhile.
Mayor Jarstad asked that tbis issue be set aside one week.

Clerk stated this hearing had been advertised, posted and letters
of notification sent as required by law. Clerk read Bremertcn
Planning Commission Resolution 581 whereby Dr. Glen A. Gordon
submitted an Application for Rezone from Residential One (R-l)
Business Two (B-2). Subject property is located on the southwest
cornex of 6th Street and High Avenue. The Bremerton Planning
Commission recommended denial of the zoning application because
(1) the entire block is residentially used and zoned, and a
business use could affect the residential character of the neighbor-
hood; (2) the proposed use would increase traffic and safety
hazards, and (3) the lot is too small to provide parking.

O DR. GLEN A. GORDON IIEARING (corxtinued)
Ken Attebery discussed the proposed act'ion, nature of the site,
surrounding area, and development standards. Emergency and Police
Departments have dropped their initial denial. Mr. Attebery stated
the Planning Staff felt the use was appropriate, but that the parking
should be somewhere else. There has to be three parking stalls to
serve this facility. Commissioner Stewart said he didn't think they
would be able to find street parking. Dr. Glen Gordon stated his
parking requirements fully meet the code requirements of the City,
and three parkjng requirements indicate the use of the basement which
he didn't intend to use. He stated all he is asking for is one
variance and allow him street parking. With the setback he felt he
had adequate parking. Dr. Gordon stated the ~ign would be small and
the building would be used by professionals. Attebery stated two
stalls could be accommodated, but would be a tight squeeze, and only
the upper level would be utilized. The use of the basement was
discussed as a storage area, where the copier would be, and an
unloading place. Dr. Gordon stated he was not at the meeting to
represent himself when the Planning Commission denied his request
for a fezone. Mayor Jarstad referenced the comprehensive plan. Mayor
Jarstad said this was a small development and would not be djsruptive
to the residents and would support recommendation of the Planning
Department that the requested rezone from R--1 to B-2 be approved with
the following conditions:
1. This application is subject to the various requirements contained
in the Bremerton Area P.lan, the Bremerton Zoning Ordinance, the
Uniform Building Code and. other applicable regulations. It is
the responsibility of the applicant to assure compliance with'
the various provisions contained in these ordinances arid in
particular those noted in the Development Standards section of
the Staff Review dated November 14, 1980.
2. The use of the property shall be limited to the remodeling and
rouse of the existing structure for professional office space.
Retail sales or other uses normally permitted in a B-2 zone
shall not be allowed. Only the upper or main floor of the
existing structure shall be used for office uses. Use of the
basement area shall be limited to storage and non-customer
related functions.
3. The applicant shall provide two parking stalls on the subject
property or in accordance with Section '712 of the Zoning
Ordinance, which provides for the joint use of parking
facilities. 11o protect the public safety, the existing garage
and drive shall not be used for parking, and such use shall be
blocked.
4. Any changes, revisions or additions which constitute a major
departure from the approved site plan submitted by the
applicant shall be fully processed by the Planning Commission
and City Council in the same manner as a new application for
zone reclassification.
Motion by Mayor Jarstad and Com~nissioner Swanson to approve Rezone
from R-1 to D-2, with the above conditions, for Dr. Glen A. Gordon,
