limitation, and plans and other data submitted for review may thereafter be returned to the applicant or
destroyed by the building official. The building official may extend the time for action by the applicant for a
period not exceeding 180 days on request by the applicant showing that circumstances beyond the control of the
applicant have prevented action from being taken. No application shall be extended more than once. In order to
renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee.

8. Property Description and Access:
The property is a 40 FT wide city lot with one end fronting on Burwell Street and
the other end fronting on an alley (site plan attached). The indicated lot size is
approximately 0.10 acre (4,600 sq. ft.).
9. Purpose & Application of the Special Exception:
As stated in Section 21.02.915 of the Zoning Ordinance, the Special Exception
process is intended to permit relief from zoning requirements that may cause
undue inconvenience or irritation, but are not so severe that they would warrant
a Variance on the basis of hardship.
When this section was drafted, the City was looking for a way to approve
common-sense good ideas in unique situations that were not technically
possible under normal provisions.
10. Requested Special Exception:
The proposed Special Exception asks to allow replacing a rotted porch and
stair with a new enclosed, unheated porch which will serve an existing side
exit from the house. This porch will be connected to a rear deck with stair
and serve as the secondary means of egress for the residence. The porch
wall and a portion of new deck would project into the side setback 3 FT 3
IN from the property line (see attached site plan). The porch roof would
overhang an additional 1 FT 4 IN. into the setback, within 1 FT 5 IN of the
property line.

The application was routed for review and comment to various city departments.

CRITERIA FOR APPROVAL
Bremerton ZoninQ Ordinance Section 21.02.915 SPECIAL EXCEPTIONS
(c) Procedure: A Special Exception is processed in accordance with the
procedures outlined in section 21.02.880 and the notice requirements of section
21.02.905 and is approved administratively as a Type II decision.
(d) Criteria for Approval:
1. Will the proposal avoid conflicts with the Citv's Comprehensive
Plan?
YES. This site is designated Low Density Residential on the
Comprehensive Plan Map. Replacing the side porch and extending the
deck within 3 FT 3 IN of the side yard property line will not compromise
the Plan.
2. Will the Special Exception benefit the surroundinQ neiQhborhood
and/or avoid siQnificant adverse impacts on other properties and
residents?
YES. The setback reduction would avoid significant adverse impact on
other properties. There are no other structures on this side of the street.
Access along the road with not change for any of the neighbors. No
neighbors made comment on this application.
3. Will the Special Exception. alonQ with any proposed mitiQation
measures or conditions of approval, minimize adverse environmental
impacts?
YES. The Special Exception would create no significant, adverse
environmental impacts and require no additional mitigation measures for
approval of a setback reduction in the side yard setback.
4. Will the Special Exception result in the enhanced use of the site for a
development. expansion of an existinQ structure, or other innovative
improvement that will be clearlv beneficial to the subiect property
and neiQhborhood?
YES. The setback reduction will allow the continued use of the side exit
door and weather protection for the enclosed new porch.

5. Will the resultinq improvements be compatible with the desiQn and
development characteristics of similar properties in the
neiQhborhood and zone?
YES. The improvement would be compatible in design and development
characteristics with other existing structures in the neighborhood. There
are other building conditions in the neighborhood that fall within the side
yard setback.
6. Have other solutions, uses or desiQn options that miqht achieve a
similar result without the need for a Special Exception been
evaluated and reiected?
YES. Other design solutions would compromise the interior and exterior
spaces of the residence. The site is restricted by the narrow lot width and
the existing floor plan layout.
7. Is the Special Exception needed to solve a desiqn problem or to
allow a unique or innovative desiqn. and not to qrant relief of a
personal or financial nature?
YES. The proposed design would solve a design problem to this
particular site condition. It would allow the continued use of a second exit
to the house that the owner indicates has existed since 1919. The porch
and deck are well suited to maintaining the original character of this
historic residential property. The enclosed porch matches the existing
roof slope and provides an attractive solution to the design problem.
CONCLUSIONS
1. Allowing this reduction in side yard setback would have little, if any,
adverse impact in this single-family residential zone (CBR).
2. Special circumstances justifying approval have been demonstrated by the
limitations of the site and the unique conditions.
3. The application meets all seven criteria necessary for approval of a
Zoning Ordinance Special Exception.

DECISION
Based on review of the above findings and conclusions, I, the Director of
Community Development, and the duly appointed Zoning Ordinance Special
Exception Official, hereby APPROVE this request for an Administrative Zoning
Ordinance Special Exception at 1733 Burwell Street to allow a reduction in
the side yard setback, as shown on the attached site plan.
