Mayor Jarstad stated that the property being considered was highly qualified and zoned for this facility but that he felt in view of the petitions being submitted, that it would be best to evaluate other sights before making a final determination. Commissioner Swanson stated he felt this would be appropraite action, but that he also felt the use of this land for this facility was more appropriate than the present usage as storage of gravel and waste material. This had been forwarded to the Police Depart- ment for their recommendations and it was their recommendation that an Officer be posted at Sylvan Way and Pine Road and a Sheriff's Deputy be posted at Riddell and Pine. They felt that this was necessary as both Riddell Road and Pine Road are heavily traveled main thoroughfares. RESOLUTION RE CITY CHARTER -BALLOT PROPOSITION Clerk read A RESOLUTION requesting the Kitsap County Auditor to call a special election to be held with the general election on November 3, 1981, for submission to the qualified voters of the City for approval or rejection of a proposed amendment to the Bremerton City Charter. She stated she had been given some statistics from Mr. Ullock, Chairman of the proposed Charter Amendment, and he stated that 1911 signatures were required, 1941 signatures had been checked and out of that number 1595 were validated at a reject rate of 17.8%. If the remainder of the Q43 signatures were rejected at a 30% rate, there would be an additional 660 valid signatures, for a total of 2255 certified signatures. City Attorney Terry McCluskev stated that the p~tition had been prepared by Attorney Phil Best, representative for the Committee, and that he had aoproved its form. He also stated that he had been in contact with Dr. Camnbell of Municipal Research Department regarding this proposal and it appears the petitioners have split up the different precincts and used it as nine different districts in the city. In doing so, there is an unequal number of registered voters in each district, ranging from 654 voters to another district with over 2300 voters, or over three times the amount of the lowest district, thereby unequal representation and thus is unconstitutional and left set up this way would be invalid. He stated there were two courses available, to let t~e voters dec~de, or ' ' ' council could turn ~t down now. He felt there would be a court case either way, sometime in the future. Also Precinct #35 had been left out entirely. City Commissioners Meeting September 15, 1981 Page Four RESOLUTI©N RE CITY CHARTER- BALLOT PROPOSITI'ON CONTINUED Mr. Phil Best, Attorney, stated he felt the proposed resolution cites the State law, and in that it must be submitted to the voters. He doesn't feel it wise to withhold from the voters to make this determina- tion. Mayor Jarstad stated his concern in that if the people want a change in the government, that they do so with proper elections, public hearings etc., prior to coming before council. Further discussion centered on the wording of the Ballot and a motion by Commissioners Stewart and Swanson to pass the resolution as presented, and have it placed on the November ballot, with addition of "nine separate districts voted only by those qualified voters of that district", added to the'ballot title, ca~rried unanimously.
