It was recommended that each department be assessed for their share and the remainder to be paid from General Fund. Leo Olney, City Treasurer, discussed the merits of having a Capitol Asset Inventory System and he stated he had spoke with city officials from Anacortes and Richland who had used the services of Marshall & Stevens, and that this firm came very highly recommended. Commissioner Stewart stated that the City had tried to do this with in-house personnel last year and it was not effective. It was the recommendation of the council to authorize the job to be done by an outside source at the best price and asked City Clerk to make recommenda- tions to the council. Heather Gatima, Keyport, asked council the justification for wanting to have this work done and it was explained we would be able to have a better financial statement and better insurance coverage and bond sales. Mary Lou Long, asked council how many different companies have been contacted to do provide the inventory system and it was reported this had been the only one. City Commissioners Meeting August 4, 1981 Page Two 9:30 A.M. PUBLIC REC©GNITION Mr. Don Serry, introduced Ms. Laurel Gallagher as the new director of the Visitors & Convention Bureau. She addressed council on the (2476) activities over the last week and stated they had enrolled twenty new members for over $1800 and had contacted two convention groups. Mary Lou Long, spoke on her concern over high city attorney costs and the effectiveness of this type of service over in-house attorneys. She was assured that the Blue Ribbon Task Force was working on this situation and would be making recommendations. She spoke on the sauna parlors as well as her concern over outside utility agree- ments being added to our present system. Commissioner Stewart stated he would like to be able to limit hookups too, but when federal grant Tape monies were involved there were other requirements to be fulfilled~ 225 Side 1 APPLICATION FOR DANCING PERMIT - BRIARCLIFF 0008 Clerk stated that letters had been received from Helen Anderson, Madeline Bridget and Margaret Fousten all wanting to be on record as opposing granting the dancing permit. Commissioner Stewart stated he had received a telephone call from Bonnie Loop who wanted to be on record as living in the Condo's below and that the music does not bother her at all. 400 Mrs. Nelson of the Briarcliff stated that on July 7 she had been denied a cabaret license, then she applied for a dancing license, and it would be the same as a cabaret license with the same fee. She wss before the council today asking for the full license at this time. She stated the noise levels were reduced after they came into the establishment and the City had received no complaints during that time. She has talked to the condo owners and they did not object. They have had no live entertainment there for about a month now, their business is down and there is still bottles and garbage being dumped that is not theirs. She stated they have not broken any laws and would like to request full license with a stipulation of no rock bands. 480 Mr. Earl Owney, 11541 Hwy 106, Union, Washington, stated he was the owner of the Belfair Cafe and that he and that he and his son were working with the Nelson at this time to operate the Briarcliff. They were now serving a luncheon menu but without music the lounge was definitely losing money. He felt the Nelson's had been mistreated and thought the city should give them a license on a trial period of 60-90 days, as they need the license to survive. Don Thom~kins, 4997 Sandra Lane, owner of Brother Don's, stated he also felt the Nelson's were getting an unfair shake as they were willing to work with the property owners and the council and felt a temporary license would be appropriate. Ralph Erickson, stated he had a financial interest in the condos below the Briarcliff, and the zoning for the condos was made before the Briarcliff. He felt the acoustics and parking does not meet require- ments, the building owner has not taken care of building deficiencies as previously required. He stated there is water leaking from the back of the building and that there have been health hazards with un- 765 covered garbage and rats in the area. Don Thom~kins, stated the running water in the back of the building is from the ice machine overflow only, and doesn't feel the Briarcliff or his business is attracting rodents or creating any health hazards. City Commissioners Meeting August 4, 1981 Page Three BRIARCLIFF DANCING APPLICATION CONTINUED: Mr. Earl Owne¥, of the Briarcliff agreed rodents have been there for some time due to excavation and surrounding water. He stated the running water fro~ their building was also from ice machine over- flow. Mrs. Benita Owens, who lives in the Condo and wanted to speak for Mr. & Mrs. Stewart about the noise level and parking situation on Pershing Street, and felt the value of their property had decreased due to this condition. Mr. Lambert ,stated he was in favor of the Briarcliff that it was a nice place to go and dance. Mr. Wayne Simkins, 4232 Kitsap Way, stated the condo owners knew about the noise level before they moved in. 1033 Mr. Wendell Arnold, 923 Pershing Avenue, stated he had gone over this before, that the Briarcliff building was not constructed for music purposes. Mayor Jarstad stated we have had lots of hearings and testimony in the past. Council had stated when we took away the cabaret license, that it was to take away the loud music, and he did not know what the difference would be between can music or live music and felt we would be back into the same situation they were in before if they granted this dancing license. It was his recommendation that council hold to the same position as before and deny the dancing permit license. Motion by Mayor Jarstad and Commissioner Stewart to deny the dancing p~-~-i~ license application, carried unanimously. 10:30 - 10:40 RECESS 1155 REPORT RE TQWING COMMISSION HEARING City Attorney-Terry McCluskey stated he had attended a special meeting on July 28, of the Towing Commission and he read from a letter that had been forwarded to the Chief of Police from the Commission, which reviewed their conclusions from that meeting. It was the recommendation of the Towing Commission that Bremerton Towing and HP Towing be classif- ied as a single towing business. Mr. Harry Penor, stated he had made a statement to abide by the recommendation of the Towing Commission but that he did not feel they had complied with all requirements fo~ making this determination. Officer Pratt, Department Representative for Towing Commission, stated that Mr. Penor was in compliance with state regulations of common yard, common dispatching, common drivers and help. It was his own personal observation of seeing same men on different trucks while being on call during their rotation. He felt this would possibly create a problem in an emergency, by finding themselves shorthanded. Mr. Gar~ Chre~ attorney representing Chico Towing, feels action taken by Towing Commission was appropriate. Motion by Commissioners Stewart and Swanson to instruct the Towing Commission to give a written answer to Mr. Penor's questions, carried unanimously.
