STREET FUND CASH FLOW Mr. Ross read a memo from City Treasurer stating that the Street Fund currently has a cash deficit of approximately $37,000, which has been caused by the fact that about 28% of their revenue is programmed to come from arterial street work which has not occurred yet. As of March 30, the Street Fund had expended 22% of their budget and had collected only 19% of their estimated revenues. To further compound their problem, the proposed arterial street work had not been approved by the State,if it does not get approved, the work will not commence until July. Approximatel~$20,000 of 1980 expenses were carried over and paid in 1981 as they had overexpended their 1980 budget. He was inquiring now into a possible amendment to the original Ordinance regarding Item C, Condition No. 5, in part, "the stands of large trees marked on the topographic and tree survey shown in Exhibit B shall be retained and so marked for rentention prior to any earth work being undertaken in the area." Mr. Ferguson of Quad Inc. had consulted him regarding these trees at present with the earth removal project being undertaken near them, had now created a safety hazard. Commissioner Swanson questioned the attorney if this can be amended without publication and also stated the clause was never put in if it was going to create a safety hazard. Attorney Ryan recommended that the Public Works Department send a representative out to look over the situation and report back to Council at next meeting as to whether this constitutes a hazardous condition. City Engineers are requested to contact Chuck Moore to send a Forester to make an independed determination and bring this back to Council. 10:20 to 10:30 - RECESS 10:30 - HEARING - VACATION OF RIGHT OF WAY/Mathwig/Lindsey/Fontana Tape 211Mr. Attebery presented Resolution No. 587 from the Bremerton Planning Side 2 Commission recontmending denial of the Vacation of Right-of-Way 0003 on Kitsap Way & Shorewood Drive, approximately 1,754 sq. ft - approx- imately a 15' wide area abutting these properties for the purpose of obtaining ownership to facilitate development of a gasoline sales area. Discussion centered on the necessity of retaining this land for possible intersection improvements in the future for a free-right hand turn lane onto Shorewood Drive and the costs involved to re-purchase this land from the property owners at a later date. It was suggested that an interim alternate solution would be to grant a street use permit, revocable by either party with six months notice. City Commissioners Meeting March 31, 1981 Page Six HEARING CONTINUED: Commissioner Swanson stated he had a couple of questions that he would like to have answered on this matter, and that he also Was in favor of giving the property back to the property owners and letting them develop it to a reasonable setting and for the money to come back into the system. Mr. Sal Fontana, asked why the Shorewood Drive area is being considered for a right hand turn lane when it is a deadend road? He stated this area of land in question inhibits parking in the front of his business and he expressed a request to the Council to come out and look over the situation as it presently exists before making a determination in this matter. James Strait, 6530 Harlow Drive, stated he realizes Shorewood Drive is a deadend road but land is there for a park and the only access to it would be on Shorewood Drive. Bill Parker, City Engineer, stated a new signal system is scheduled (680) for the intersection and favored the street use permit system a suitable interim measure to make, Mr. Sal Fontana stated that originally the on-ramp for the freeway had been planned to start at approximately the site of his business, but in actuality started past the intersection. Commissioner Stewart stated he did not want to vacate all of the land on the corner specifically, due to proposed intersection improve- ments, access onto Shorewood Drive, and the possibility of land condition use for a trade off for property necessary on Shorewood Drive. He stated that he would go out and look at the land in question. Mr. Ross stated that a street use permit on a lease basis would have 12% leasehold tax over a year. Feels it should be consistent to all (1016) businesses. Motion by Commissioners Stewart and Swanson to postpone this hearing for another two weeks, carried unanimously. MEMO RE KITSAP LAKE WATER QUALITY STANDARDS; INTERDISCIPLINARY TEAM Mr. Ross read to Council a memo from Ken Attebery and Bob Theroux stating the consultant selection process for the Kitsap Lake Water Quality Study is soon to get underway and suggest that an interdepart- ment advisory team be created, which could include a rep from Engineer- ing, Wastewater, Street, Water, Planning, Grants, a Health Dept. Rep, and a representative from Kitsap County, to work with the consultant. They also would like to have a neighborhood representative be involved in the consultant selection process and well as the study as a whole. Motion by Commissioners Stewart and Swanson to approve the proposal to include a member of the Kitsap Lake community as a member of the advisory team, carried unanimously. LEASEHOLD TAX Mr. ROSS stated that the denial for appeal for the square dance association is final and that the City cannot pay these taxes for them. Olympia, if we defer to them, will attempt collection efforts and he recommended one of the attorneys to check and see if We have any other alternative other than to terminate the lease and let the facilities stand idle. Commissioner Stewart stated the Community Theater will pay their tax (1188) even if they have to raise fees. Commissioner Swanson stated they have been given good facilities and a good deal from the City , tho it is unfortunate they received this tax, but he expects the square dance club could up their rates and pay for their tax as well. The Commissioners both stated they felt the community organizations as well as the City has had a good and fair deal. Adjourned at 11:20 A.M.
