and obsolete controller at that intersection; and (2) a logic
analyzer test instrument. This instrument will be used to trouble-
shoot microprocessor equipment such as used in current traffic
signal controllers. Both of these items are authorized in the 1981
Communications Department Capitol outlay budget.

for ~-~d calls, carried unanimously.

ments have been completed by the contractor, Moss Construction, on

accounts will have to be Specials unless something can be worked
out.

· ORDINANCE - CHARGING USER FOR EMERGENCY
MEDICAL TRANSPORT SERVICES
Clerk read, first reading, "AN ORDINANCE of the City of Bremerton,
Washington, relating to the charging to the user for emergency
medical transport service rendered by the Bremerton Fire Depart-
ment, providing for a special election, and declaring an
emergency."
Motion by Commissioners Swanson and Stewart to pass Ordinance
on the first reading. Under discussion: Fire Chief Meigs stated
he was opposed to the passage of this Ordinance since he had not
yet seen it and stated most Cities do not charge for this service.
Also, we were already successful with the voters to have the
$100,000 provided by the levy. Commissioner Stewart stated he
likes this because the public will be aware of what the costs
are. He stated most people would be happy to pay the Fire Depart-
ment. Mayor Jarstad questioned what direct costs are and how
they would be figured. He stated the public will not have a
clear picture of what it actually costs. He said only one trans-
port was made last year, why go to a vote of the people for one
transport, it could be done by Ordinance. Commissioner Swanson
stated the people will have another initiative if the Council
does not do this. He stated it just enables us to charge.
Mayor Jarstad stated that there is nothing now to prohibit us
from charging and this ballot would require charging. Discussion
followed regarding direct and indirect costs. Mayor Jarstad
stated that when something is submitted to the voters, it should
be substantive. We already have authority to transport and charge
any time we want.
Vote carried: Mayor Jarstad, no; Commissioner Stewart, yes;
Commissioner Swanson, yes.
City Attorney McCluske¥ stated that in order to call for a Special
Election, it has to be considered an emergency. The Ordinance
needs unanimous approval as an emergency ordinance, so it does not
pass. The Primary or General Election would not require an emergency
ordinance. Mayor Jarstad stated that the County Auditor has to
decide whether any of these ballot issues are emergencies and should
be placed for Special Election.
· ORDINANCE 3620 - SUBSIDIZING OF AMBULANCE
EMERGENCY MEDICAL SERVICES
Clerk read, first reading, "AN ORDINANCE of the City of Bremerton,
Washington, relating to subsidizing of ambulance emergency
medical services; providing for a special election and declaring
an emergency." Discussion followed by the Commissioners regarding
the wording that would be placed on the ballot where people vote
"no" and are actually voting "yes" City Attorney McCluskey stated
the word "Passage" will be used to check either "yes" or "no".
Discussion followed regarding the term "subsidy" and "contract for
services rendered". McCluskey stated that Black's Law Dictionary
states a subsidy is a grant of money made by Government in aid of
business. It has nothing to do with a contract for services. It
is the granting of money to keep a business going. He stated that
regarding the bills for Olympic Ambulance, it must be shown that
the City requested those services. Mayor Jarstad stated he wants to
make sure that we do not eliminate the possibility of contracting with
whoever is running the ambulance service to pay for police-requested
calls, and he does not want the public to be confused by this.
Motion by Commissioners Stewart and Swanson to pass Ordinance 3620,
~-~rst reading, carried as follows: Mayor Jarstad, yes; Commissioner
Stewart, yes; Commissioner Swanson, yes.

· COMMISSIONERS REPORT
Mayor Jarstad recognized the presence of former Public Works
Commissioner Schoneman.
Commissioner Swanson introduced Acting City Engineer, Bill Parker.
Swanson moved the Council adopt Guidelines for the City Attorney.
Seconded by Commissioner Stewart. Copies of the Guidelines were
not available for discussion. Commissioner Swanson made Motion
this item be on next weeks Council Agenda.
City Attorney McCluskey stated he has reviewed the provisions of
State statue regarding the use tax from hotels and motels. If
we wish to conform to the State wording we would have to amend
our Ordinance. We then have the option to use the money for
advertising. It is not mandatory. Commissioner Stewart discussed
limiting the amount of money available, and Mayor Jarstad felt the
Chamber of Commerce should present a proposal and no amount should
be limited by the Council. Commissioner Stewart agreed the Chamber
of Commerce should present a specific proposal and the Ordinances
could be changed at that time. Mayor Jarstad will write to the
Chamber informing them of the Council's position.
Mayor Jarstad stated the year-end report will be forthcoming and
fine things will be happening in 1981.
· BILLS
Clerk presented Vouchers 20742, 20744 thru 20749 inclusive in the
amount of $41,112.67 and Vouchers 20755 thru 20878 inclusive in the
amount of $144,695.87, audited by John Ross.
Motion by Commissioner Stewart and Mayor Jarstad to approve payment
of above vouchers, carried unanimously.
· BOATSHED RESTAURANT EXPANSION/
PAVING OF UPPER PARKING LOT
Ken Attebery stated that in March 1980 the City Council granted a
shoreline permit to the Boatshed Restaurant for building additions.
This permit contained a Council imposed condition that the Boatshed
pay 1/2 the cost of paving the parking area at the east end of the
Manette Bridge. The Boatshed has a sublease under the City's lease
from the State. The Boatshed has requested building permits for the
restaurant additions and has agreed to pay half the cost associated
with paving the lot. The Street Dept. estimates the paving alone
to be in the area of $3,000. Several options were discussed to allow
timely issuance of the building permit to the Boatshed yet not
violating the terms of the permit. If the City wished to drop the
requirement, it would require rehearing and submittal to the State
for their concurrence. Mayor Jarstad offered the solution to put
the Boatshed money in escrow until the City could determine the
source of their funds. Commissioner Stewart felt that for such a
small amount of money, he felt we should proceed with the project.
Motion by Commissioners Stewart and Swanson to proceed with the
rape 206 project with funds coming from the Street Department, carried
(B) 2329 unanimously.
Meeting adjourned 10:20 a.m.
