CONTRACT FOR SUPPLEMENTAL POLICE SERVICES
The Housing Authority of the City of Bremerton ("BRA") and the City of Bremerton
("City"), referred to collectively as the "Parties," enter into the following Agreement for
professional services:
I. Scope: The City agrees to perform the services more specifically described in the Scope
of Work, attached hereto as Exhibit A, which is incorporated by reference herein. The Scope of
Work may be modified only pursuant to Section IX.E. of this Agreement. If BRA desires
services not specified in the Scope of Work, then the parties, by letter agreement signed by both
parties, may add the additional services to the Scope of Work, and adjust the compensation, if
appropriate.
II. Term: This Agreement commences on October 1, 2005, and terminates on September
30, 2006 unless another date is substituted pursuant to Sections VIII or IX.E.
III. Compensation: In consideration of the services provided pursuant to this Agreement,
BRA shall pay City $59,745.26 ($4,978.77 x 12 months). BRA shall pay City an additional
$12,000.00 for extended supplemental services as outlined in Subsection 4 under the Section of
Illustrative Tasks in the Scope of Work.
City shall submit monthly billing statements. Upon receipt of a conforming monthly
billing statement, the BRA shall promptly process payment.
City shall not perform work beyond the Scope of Work, nor shall be compensated for
such work, unless the Scope of Work or amount of compensation is modified pursuant to this
Agreement. City shall only be compensated for additional services if requested pursuant to
Section I and, if not otherwise provided, such compensation shall be adjusted, if appropriate, and
specified by letter agreement signed by both parties.
If a billing statement does not conform to this Agreement, BRA may withhold payment
until the statement is reconciled. Such withholding does not relieve City of its obligations under
this Agreement.
IV. Relationship of Parties: City represents that it is skilled in the matters addressed in the
Scope of Work and is performing independent functions and responsibilities within its field of
expertise. City and its personnel are independent contractors and not employees of BRA. City
and its personnel have no authority to bind the BRA or to control the BRA's employees and
other Consultants. None of the benefits provided by BRA to its employees, including, but not
limited to, compensation, insurance, and unemployment insurance are available from BRA to the
employees, agents, representatives, or sub-Consultants of the City. City will be solely and
entirely responsible for its acts and for the acts of City's agents, employees, representatives, and
sub-Consultants during the performance of this Agreement.
BRA shall have the right, with reasonable cause, to have a different officer assigned to
the position. Reasonable cause shall be the failure to provide the level of service BRA
reasonably expects on all categories in the Scope of Work.
As an independent Consultant, Consultant is responsible for its own management. The
BHA's administration and enforcement of this Agreement shall not be deemed an exercise of
managerial control over City or its personnel.
City is responsible for payment of all taxes and licensing fees necessary to perform its
obligations under this Agreement. These taxes and fees include but are not limited to State
industrial insurance, Business & Occupation, State professional licensing, and City business
licensing. Failure of City to fully comply with tax and licensing requirements will be considered
a material breach of contract and at the option of BRA will be cause for such action as may be
available by law including termination of the contract.
V. Indemnification: BRA shall protect, defend, indemnify, and hold harmless the City, its
officers, officials, employees, and agents, from any and all claims, demands, suits, penalties,
losses, damages, judgments, attorneys' fees, and/or costs of any kind whatsoever, arising out of
or in any way resulting from acts or omissions of the BRA, its officers, employees, agents,
and/or subcontractors.
The City shall protect, defend, indemnify, and hold harmless BRA, its officers, officials,
employees, and agents, from any and all claims, demands, suits, penalties, losses, damages,
judgments, attorneys' fees, and/or costs of any kind whatsoever, arising out of or in any way
resulting from acts or omissions of the City, its officers, employees, agents, and/or
subcontractors.
If a claim is made that both parties are responsible for all or a portion of damages alleged
to have been sustained as a result of acts or omissions of the parties hereto, then the above
referenced indemnity and hold harmless provisions shall apply only to the extent of the
proportion of liability attributable to the indemnifying party. If liability is not or cannot be
apportioned, then the parties shall be responsible for their own costs and attorneys fees incurred
in the matter and shall indemnify and hold the other party harmless for one half of any amount
awarded by the Court or other decision making body with jurisdiction as a result of the alleged
acts or omissions.
Except for damages caused by the sole negligence of the City, the provisions of the
proceeding paragraph not withstanding, BRA's obligation under this section shall include, but
not be limited to, the duty to promptly accept tenders of defense and provide defense to the City
at BRA's expense.
VI. Insurance: Prior to the commencement date of this Agreement, City shall provide
Certificates of Insurance to the BRA's Risk Manager verifying the following coverage: I) a
professional liability policy ("E&O") providing coverage of $2,000,000 per occurrence for errors
and omissions committed by City while performing its obligations tmder this Agreement, and 2)
a comprehensive general liability ("CGL") policy providing coverage of at least $2,000,000 per
Page 2 of 11
occurrence and including bodily injury and property damage. Both policies shall remain in full
force and effect, and provide coverage for the full term of this Agreement. Insurer shall provide
the Risk Manager with 30 days' written notice of any cancellation or change of coverage of either
policy.
VII. Nondiscrimination: City shall not discriminate in employment or services to the public
on the basis of race, color, national origin, sex, religion, age, marital status, or disability, except
for employment actions based on bona fide occupational qualification.
VIII. Termination: This Agreement may be terminated, at will, by either Party upon sixty (60)
days notice to the other Party. This Agreement may be immediately terminated for cause by a
Party if the other Party substantially fails to perform through no fault of the terminating Party,
and the non-performing Party does not commence correction ofthe failure of performance within
thirty (30) days of the terminating Party's sending notice to the non-performing Party. Notice by
BHA shall include a report showing the status of all items listed in the Scope of Work current
through the termination date.
If BHA receives reimbursement by any federal, state, or other source for work described
in Section I herein, and that funding is withdrawn, reduced or limited in any way, or the project
is canceled or substantially reduced after the execution date of this Agreement and prior to the
completion of the work, BHA may summarily terminate this Agreement. Termination shall be
effective ten calendar days after City's receipt ofthe written notice by certified mail.
A. Excusable Delavs: The right of City to proceed shall not be terminated nor shall City
be charged with liquidated damages for any delays in the completion of the work due to: 1) any
acts of the federal government in controlling, restricting, or requisitioning materials, equipment,
tools, or labor by reason of war, national defense, or other national emergency~ 2) any acts of
BHA, its consultants, or other public agencies causing such delay; and 3) causes not reasonably
foreseeable by the parties at the time of the execution of the Agreement that are beyond the
control and without the fault or negligence of the City, including, but not restricted to, acts of
God, fires, floods, strikes, or weather of unusual severity. PROVIDED, HOWEVER, that the
City must promptly notify BHA within ten (10) calendar days in writing of the cause of the
delay. If, on the basis of the facts and the terms of this Agreement, the delay is properly
excusable, BHA shall, in writing, extend the time for completing the work for a period of time
commensurate with the period of excusable delay.
B. Rights Upon Termination: In the event of termination, BHA shall pay for all services
performed by the City to the effective date of termination, as described on a final invoice
submitted to BHA. Any such use not related to the project which City was contracted to perform
shall be without liability or legal exposure to the City.
IX. General Conditions:
A. Reports and Information: When requested by BHA, City shall furnish periodic reports
and documents on matters covered by this Agreement. The reports and documents shall be
Page 3 of 11
furnished in the time and form requested. City shall maintain accounting records in accordance
with Generally Accepted Accounting Principles (GAAP) to substantiate all billed amounts.
B. Work Performed at City's Risk: City shall take all precautions necessary and shall be
responsible for the safety of its employees, agents, and subconsultants in the performance of the
work hereunder and shall utilize all protection necessary for that purpose. All work shall be
done at City's own risk, and City shall be responsible for any loss of or damage to materials,
tools, or other articles used or held for use in connection with the work.
C. Place of Work: The Consultant shall perform the work authorized under this
Agreement at its office in the Westpark Community Center, 76 Russell Road, Bremerton,
Washington. Meetings with the City staff as described in Exhibit A, Scope of Work, shall take
place at the Westpark Community Center office, or at locations mutually agreed upon by the
parties.
D. Severability: Should any part of this Agreement be found void, the balance of the
Agreement shall remain in full force and effect.
E. Modification: This Agreement may only be modified by written instrument signed by
both Parties.
F. Written Notices: All communications regarding this Agreement shall be sent to the
parties at the addresses listed below by registered or 1st class mail, or by personal service, and
shall be deemed sufficiently given if sent to the addressee at the address stated in this Agreement

Current law enforcement baseline police services are defined, but may not be limited to, as the
ordinary and routine police services provided to the residents of public housing developments as
a result of the overall, city/county-wide deployment of police resources to respond to crime and
other public safety incidents, including 911 communications, processing of calls for services,
routine patrol, police officer response to calls for service, and investigative follow-up of criminal
activity. The actual or estimated time spent on supporting basic patrol and investigative services
by administrative and technical personnel may be included in baseline services.
The Westpark Officer will not be involved in baseline services unless available to assist the area
unit that provides the baseline services. The Westpark Officer will respond to Priority One and
Two calls (defined below) with the area unit and will assist in Priority Three, Four, and Five
calls when available.

PRIORITY 1: IMMEDIATE LIFE THREAT
Precedence is usually assigned when speed of arrival may be a matter of life or
death. To aid chances for suspect apprehension, it will also be assigned to
felony crimes or violent crimes involving a weapon that have occurred within
the past five minutes. It is not assigned lightly because in most cases, the
Page 10 of 11
responding field personnel are placing their lives in jeopardy in an emergency
lights-and-sirens run through the streets. It should be emphasized that the
decision to use lights-and-sirens shall be the responsibility of the responding
Public Safety Agency.
PRIORITY 2: POTENTIAL DANGER TO LIFE
Precedence usually includes those calls which demand immediate service, but
may not be sufficiently urgent to require emergency lights-and-sirens response.
A Priority 2 incident is often an incident that could become a Priority 1 if not
dealt with promptly.
PRIORITY 3: PROPERTY THREAT / NO LIFE THREAT
Precedence includes those calls that do not require a lights-and-siren response.
An expeditious response to this type of call could involve apprehending a
suspect of a less violent type of crime. This type of call does not put a life in
jeopardy but has the potential to damage property.
PRIORITY 4: INVESTIGATION / HARASSMENT
All other calls and radio transmissions relative to Public Safety Agencies. It
should be understood that the dispatch may be delayed.
PRIORITY 5: ROUTINE / CITIZEN
All other calls, other than Priority 1, 2, 3 or 4 are routine / citizen. It is
understood that a citizen request dispatch may be delayed.
The person receiving the call will make the original priority assignment as he/she is closest to the
source of available information. The person taking the call has the best opportunity to assess the
tone of the call. The original priority may be changed as new information and circumstances
become known. Such changes will be signed and justified in the comments section of the event.

COUNCIL SUMMARY
PACIFIC AVENUE BASIN CSO REDUCTION PHASE 1
HDPE PIPE PREPURCHASE
Purchase Summary
The Department of Public Works and Utilities is requesting the approval of the sole-
source purchase of 506 feet of large diameter HDPE pipe from Ferguson Enterprises.
The sole source purchase is allowed under BMC 2.76.090 ifthe materials are "subject to
special market conditions". The market for plastic pipe is very unstable at this time. Due
to the impacts of the recent hurricanes on raw material supply and damage to
manufacturing facilities, common plastic pipe materials are unavailable, prices are
inflated, and dates of resupply are unknown. This condition is exacerbated for special
purchase items like this HDPE pipe, which is only fabricated upon order. This purchase
will allow the City to be included with a previous pipe order with a guaranteed price and
guaranteed delivery date. The cost of the HDPE pipe including delivery is $88,294.20.
The pipe will be delivered at the end of November.
Fiscal Summary
The total 2005/2006 project budget is $1,075,000 for design and construction and is
being funded by an EP A Grant, a Public Works Trust Fund Loan, and two State
Revolving Fund Loans.

COUNCIL SUMMARY
INTERLOCAL AGREEMENT FOR 11th STREET BRIDGE INSPECTION
Summary
The Federal Highway Administration (FHWA) requires the City of Bremerton to
comply with the National Bridge Inspection Standards (NBIS). The NBIS
requires all local bridges to be load rated to determine their safe load carrying
capacity and the inventory and operating rating for reporting on the State of
Washington Inventory of Bridges and Structures (SWIBS) form. The City has
requested Kitsap County complete the required inspection and load and
operating ratings for the 11th Street Bridge located over Cambrian Avenue as
they have the expertise to perform this service.
This Interlocal Agreement will include all inspection, equipment, traffic control
and administrative support required to meet the requirements of the NBIS, and
submittal of said inspection to FHWA. Kitsap County will provide the City with a
copy of their submittal, which includes the operating rating and inventory report.
Two complete inspection and reporting cycles (2006 and 2008) are included in
this agreement. .
Fiscal Summary
The estimated cost of the Interlocal Agreement is $3,500.00 for both inspections
and is included in the Arterial Street fund budget.

BETWEEN KITSAP COUNTY AND
THE CITY OF BREMERTON
I. PREAMBLE
This Interlocal Agreement (hereafter "AGREEMENT") is by and between Kitsap County
(hereafter "COUNTY") whose principal offices are located at 614 Division Street, Port
Orchard, WA, 98366 and the City of Bremerton (hereafter "CITY") whose principal
offices are located at 3027 Olympus Drive, Bremerton, WA, 98337.
II. RECITALS
The Washington State Department of Transportation (WSDOT) requires that the CITY
comply with the National Bridge Inspection Standards (NBIS) as issued by the Federal
Highway Administration (FHWA). WSDOT requires all local bridges to be inspected a
minimum of every two years throughout their life spans by qualified personnel. The
inspection is to be performed in accordance with the requirements, and in the report
format, as defined in the Washington State Bridge Inspection Manual. Inspection
information supplied to the WSDOT will be utilized to calculate a sufficiency rating for
the bridge.
The sufficiency rating is used as a basis for establishing eligibility and priority for
replacement and rehabilitation of bridges with the FHWA. The CITY has requested that
the COUNTY complete the required inspection for the 11th Street bridge over Cambrian
Avenue for the purposes of meeting these WSDOT and FHWA inspection and
sufficiency rating requirements and the COUNTY is committed to providing that service.
The inspection data gathered by the County is not intended to warrant the structural or
load capacity, hydraulics, geometric configuration, seismic stability, life span, or identify
latent or dangerous conditions associated with the bridge and its associated features,
The COUNTY and CITY desire to enter into an AGREEMENT for performing these
tasks. The COUNTY will be reimbursed by the CITY for true costs incurred to perform
these services as provided below. The Interlocal Cooperation Act, R.C.W. 39.34,
further authorizes the parties hereto to enter into this AGREEMENT.
ACCORDINGLY, THE PARTIES AGREE AS FOLLOWS:
III. AGREEMENT

COUNCIL SUMMARY
INTERLOCAL AGREEMENT FOR LANDSCAPING DESIGN
Summary
In order to provide aesthetic and environmental improvements to the Navy Yard
Highway Phase of the SR 304 Transportation Improvement Project, the City has
negotiated an Interlocal Agreement with Washington State Department of Transportation
(WSDOT) to provide landscape design services.
Rather than the extensive landscaping completed with the other phases of the project,
the vision for this next section of roadway is to reduce Parks Department O&M costs
through use of drought resistant and low maintenance vegetation, as no irrigation
system is going to be provided. WSDOT has extensive expertise with this type of
landscape design.
Fiscal Summary
The estimated cost of the Interlocal Agreement is $30,023.~0. This includes providing
drawings, details, costs, quantities and specifications to be included into the plans,
specifications and estimates for the total project, and construction support while the
landscaping is incorporated into the project. The entire project has been funded by the
State of Washington through WSDOT using the nickel gas tax.

Re:
Summary of Changes from the Preliminary 2006 Budget to the Final 2006 Budget
Proposed for Adoption
Date:
November 29, 2005
Late in October, the preliminary 2006 budget was filed with the City Clerk tptaling $130,767,792
(all funds) and was then presented to the CitYt Council for review and consideration. City Council
and staff held workshops on November 1st, 8 h, and 15th, to review and disCt:Jss the proposed
budget. In addition, a Council subcommittee on Management Pay Review met on November 21st
and 22nd to consider the proposed management pay band adjustments included in the preliminary
2006 budget. From these workshops and subcommittee meetings the following changes were
noted and subsequently incorporated into the final 2006 budget proposed for adoption:
1) The Port Washington Trail capital project (fund 311) was removed from the proposed
budget - Reduction of $2,450,000.
2) The One Percent for the Arts (fund 117) budget was adjusted to reflect the removal of ttle
Port Washington Trail capital project - Reduction of $12,750.
3) The cost of living adjustment (2.31 %) for the Mayor, Municipal Court Judge, and those
employees covered under the "management, professional, confidential & fiduciary" pay
plans in the General Fund were redistributed from the set aside in the Miscellaneous
Non-Departmental Budget to the appropriate General Fund Departments -
Reclassification Within the General Fund Only - Zero $ Budget Effect.
4) Reclassification of the Economic Development Director to Redevelopment Projects
Administrator Pay Band 22, Rate 8 - effective January 1 ,2006. Reclassification from
General Fund Miscellaneous Non-Departmental set aside to the Economic Development
Department. Reclassification within the General Fund Only - Zero $ Budget Effect.
5) The Management Salary Plan and Professional, Confidential & Fiduciary Salary Plans
were updated to reflect the reclassification of the Economic Development Director as
noted in 4) above, the pay band adjustment for the Police Chief as described in a
separate agenda bill for Council Action (December y'h Consent Agenda Item) and to
remove all other proposed Management pay band changes as described in the
Preliminary Proposed 2006 Budget. The funding for remaining proposed management
pay band adjustments was left in the General Miscellaneous Non-Departmental set aside
budget - requiring future Council action to amend the budget and approve the payband
changes as deemed appropriate after the Management Pay Review Committee
concludes it's follow up work on this subject.
The following table summarizes these changes and reconciles the Preliminary Proposed
2006 Budget to the Final 2006 Budget Proposed for Adoption on December 7,2005.

Dear Ms. Grenier,
The Bremerton Symphony Association. has had a vested interesrin .the cultural

Gity of Bremenon for the past 63 years. Being the flagship arts performing arts
organization in our area we have' coiltinually offered orchestral eventS for our
community from the very youngest to our elder citizens.
To Ignore the efforts oft;he BSA is extremely shortsighted Of the City of
. Bremerton. We' reqUest that the city council and the' Lodging Tax Advisory
Committee rethink: the recommendations to include the Bretnerton Symphony
Associa, tion in the allocations of the Bremerton Lodging Tax. .
As James E. Carmichael, President and Chief Executive Officer of Kitsap: Bank
says . .
"As a Se<<son Sponsor, we at Kitsap Bank are proud tQ support this
worthwhile institution and invite you to join us with'your presence and

The BSA' s application is seeking support to attract a variety of tourist and outside
community" members to our region 'by using the funds for promotion of marketing
outside of Kitsap County. The funds Will be stipulated to support:
. Newly hired Marketing Director, JliDle Melin, to market the BSA, to be
responsible for public relations and promotions
. Newly hired Education Director, Gena Wales to nm our 7 education
programs often time geared toward low-income families, Education
(,.'Oncerts have seen the greatest rise in concert attendance
. Creation' of professional promotional information and materials
. Distribution of materials outside of Kitsap CO\Ulty
. Continue to develop collaborations with local business including hotellbed
and. breakfast packages and alerting travelers to other local opporl1mities
and events
. Establishing consistent media promotion on radio (KING FM, KUOW)
and television
We have also included information on our program to offer special packaging for
BSA tickets, lodging in area hotel/motelslbed and breakfast inns and restawant
passes.
Surely the City of Bremerton and the Council will recognize the value of the
BSA, as so many of our leading businesses in our area have~ by allocating funds
to the Bremerton Symphony Association. We are a viable. living and breathing
arts orgllnization that consistently performs for the pleasure and cultural health of
our community. The City Council and Lodging Tax Advisory Committee would
have it in their best interest to admit that fact to our community through this
support.

Subject: Proposed amendments to BMC Chapets 15.02 and 18.02
Mayor, City Council Members,
Today I found out that the City Council is planning on passing changes to
the Fire Code. I am disappointed that the city did not contact the industry
prior to submitting the proposal. We have worked cooperatively with the
Fire Districts to find workable solutions to the complex fire code related
issues, and wish we had had the opportunity to discuss the proposals prior
to submission to the City Council.
Having just found the proposal and briefly reviewing it, we have some
comments suggestions.
1. Page one, 2nd Whereas: Is it accurate that
"the City Council believes that it is in the best interests of the public as
well as occupants of residential units to have automatic sprinkler systems
installed in all residential units" ?
If the City Council does not believe this statement, it should be deleted!
If the City Council does believe this statement, where is the public
process? This whereas presumes mandatory sprinklers in all new residential
units and mandatory retrofit of existing units with sprinklers. We don't
believe that this public discussion has occurred, nor do we believe that
this is the only answer to fire safety.
2. The Home Builders Association does not have objection to the
proposed incentives for residential sprinklers, and support the city's
intent to allow residential sprinklers to use the potable water system of
the home when sprinklers are installed.
3. We recommend that the attached matrix, currently adopted by Kitsap
County for areas where fire flow is not available be modified

by the city to provide alternative means, in addition to sprinklers, to
enhance the fire resistance of structures as tools for innovative
development.
We look forward to future discussion with the City on issues important to
our industry.

Subject: revisions to BMC
Dear Council Members,
RE: Proposed ordinance amending Chapters 15.02 and 18.02 of the Bremerton
Municipal Code (BMC) to allow Integrated Fire Sprinkler Systems and Waiver
of Fees in new residential construction.
Following extensive deliberation among the fire service, the county Fire
Marshal, Realtors, Homebuilders, public water purveyors, and other
interested stakeholder groups, Kitsap County completed revisions to its
building and fire codes (Title 14). Two major issues of contention - fire
department access and fire flow (water supply) - were resolved through
consensus.
We recommend the convening of a similar stakeholders group to review staff's
proposed revisions to BMC Chapters 15.02 and 18.02 and the inclusion of fire
flow protection credits as alternatives to automatic fire sprinkler systems.
(Examples: ignition-resistant construction, monitored fire alarm systems,
targeted hazards, hydrant location, non-combustible roof covering, area
separations, defensible space, and ignition-resistant construction.)
Thank you for your consideration.
