Mayor Nelson stated since ~he City Attorney was not present' today, that she con- tact him in his office. She further stated she felt that this issue could wait until the November ballot and cited as basis, the cost she felt the election would run. She also felt that more guideline should be set out regarding expenses, duties and time- frame for project to those filing for the freeholders election. Commissioner Stewart stated that the freeholders expense guide- lines would be very stringently set out with the help of our City Auditor and he was confident there would be no extreme allowanc~ made. She questioned why the council would respondto the request of the Democratic Central Committee for a freeholders election, as they are partisan. She questioned how many of their members live in the city. CommiSsioner Stewart discussed with Mr. Denton other methods of taxation. Mayor Nelson stated that he had met with the members of the association to discuss the compromise on this ordinance, had sent for additional information from Edmonds, Wa. and if something could be done legally he would be willing to look into a compromise. #2542 Mary Lou Long, said she felt that everyone should be allowed to state their feelings and if being emotional over their patriotism was necessary, they should not feel threatened by the council to do so. Allan Kane, City Engineer, stated the costs are reduced since the first proposal and described the city's involvement in the project. He stated this was a high maintenance area and could see that savings would occur to the city after the first year of improvement, with the elimination of maintenance. #0286 Randy Jackson, resident, stated they were not even aware of costs of the LID when they made application, but he felt the costs came in twice what the residents had figured. The residents felt the cost would be lower as they thought the city would supply the equipment and labor and they would be financing the material. Commissioner Swanson stated that this was a practice applied by the city several years ago. He stated that it might apply in this case as the alley is heavily traveled and the cost. involved to the City for maintenance is high. Motion by Mayor Melson and Commissioner Swanson to continue the hearing for another two weeks to allow them time to obtain the necessary signatures .for the variance. Discussion: Commissioner Stewart stated this is for a variance to be obtained, and has nothing to do with a vacation of ROW. Commissioner Stewart did not feel that a t~me limit could be set on a petition to obtain signatures. Commissioner Swanson withdrew his second, and Mayor Nelson withdrew his motion. Mayor Nelson stated they would discuss the ROW. Mary Lou Long, felt they had covered their testimony at the first hearing but that request for ROW was to provide adequate parking for the residents of their duplexes. Commissioner Stewart stated that the vacation of the road would eliminate access to property owned by a local resident, there would be no emergency vehicle access to the area and that the variance should have been obtained in the beginning of the project. Commissioner Swanson stated there were several issues involved here, but he felt the area should be retained by the City for utility use. Motion by Mayor Nelson and Commissioner Swanson to deny the applica- tion for vacation of right-of-way, carried unanimously. Discussion followed regarding the irregularities of this project and allowing occupancy of the units without an occupancy permit. Commissioner Swanson stated the occupancy permit should be re- viewed bythe City Attorney and not at a public hearing. Commissioner Stewart stated he did not want any further structures. built on city property without prior city approval. He felt the wall could have been built further back to allow more use of the right of way. Motion by Commissioner Stewart that all structures of this type being built on city property, come before the council for approval. Discussion: Mayor Nelson stated he would want to check this type of wording out with the City attorney. Commissioner Swanson felt there were many facets to this issue that should be investigated further. Motion died for lack of a second.
