Any structure or land which has been used in violation of this ordinance shall be posted with a sign directing the vacation of the entire premises within ten (10) working days. Any person removing such sign without the permission of the Designated Enforcement Official shall be guilty of a misdemeanor. 4. A cease and desist order may be appealed by petitioning the Planning Commission. The petition for a hearing must be filed in writing with the Planning Department no less than fourteen (14) calendar days after issuance of the order. D. ~evocatipn 1. A. revocation may be brought by a Planning Director or the Designated Enforcement Official. It shall be issued and served on the owner by posting on the property and by mail. 2. The Planning Director or the Designated Enforcement Official may revoke a variance, administrative variance, special use permit, or an administrative speciai use perIni t. The City Council may revoke a contract unit development. The revocation shall be based on anyone or more of the following, grounds: a. That the approval of the application was obtained by fraud or misinformation; b. That the use for which an approval was granted has ceased to exist; or has been suspended or abandoned for one ( 1) year; or there has been additional modification, or change without approval; c. That the application granted is ;>eing used contrary to the terms or conditions of an approval; or in violation of this ordinance or law; d. That the use for which the approval was granted was so used as to be detrimental to the public health, safety, or welfare; or so as to constitute a nuisance. 3. Any revocation by the Planning Director or the Designated Enforcement Official shall be appealable to the City Council pursuant to Chapter 2.84 of the City Code.
