He discussed the pro- Ject being bid 75% under estimates and documents that indicate a "decision:to_put in many nicer things", as a result of lower bids. Bert Gergner discussed his concerns regarding lack of updates on downtown redevelopment project. Mr. Adrian discussed reporting on this issue by the Planning Director every two weeks. Planning Commission recommends denial. Ms McCluskey stated an error was made due to information provided the Clerk's office, and the agenda bill should reflect fezone from R-2 to B-2 instead of B-3. All Council members remained in attendance for this hearing~ and there were no objections from the p.ublic in response to Mr. ADderson's standard "appearance of fairness" question. Clerk McCluskey read letter from James and Bonnie Byrne, 3003 Wheaton Way voicing no opposition to the fezone. Kay Wilson, Asst. Planning Director, discussed the site and pro- posal to construct a ?536 sq. ft. two story office building. Ms Wilson discussed Planning Commission recommendation to deny. Proposed office building could have a major impact on Wheaton Way traffic flow. Business use at this site would be contrary to Bremerton Area Plan policies regarding containment of existing strip commercial development and concentrating business develop- ment together. Business use at this site could tend to set a precedent for further business zoning between Sylvan and Sheridan along Wheaton Way. No further business' development should be allowed on Wheaton Way unless a center turn lane is first provided. There is insufficient parking for higher intensity office uses. Discussion followed regarding spot zoning. Mr. Sturdivant dis- cussed the need to eliminate spot zoning, but felt it is not realistic to consider this spot zoning in that area, Discussion followed regarding only good use of the property as being business. Ms Wilson stated businesses in place at the time the, comprehen- sive plan was adopted could remain, but the comprehe~s~ye pla~'~ calls for concentrating business development together. Motion by B. Amo and R. Mosely to deny the fezone request, carried as follows: 5 afflrmat~ve, 4 opposed (ISturdiv~-~ Morning, Pachek and Adrian). #1285 #2087 City 'Council Meetix ~ugust 17, 1983 Page Three nutes HEARING - CHANGE IN LAND USE RESTRICTION/SUPER 8 MOTEL AB83-4313 This request is for change in lighting, fence height and landscap- ing restrictions. The site is located at Kitsap Way and Brentwood Dr. Planning Commission recommends approval of lighting and landscaping changes. No correspondence was received. Mr. Amo excused himself from this hearing upon Mr. Anderson's standard "appearance of fairness" question. There were no objec- tions from members of the public. Kay Wilson discussed background information and.site of the former Shorewood Motel. Ms Wilson discussed request by the developer to install 16 ft. height light standards in lie~ of 6 ft. Proposed 16 ft. standards will provide equal or better protection from light and glare to nearby residences. Ms Wilson discussed request to change 6 ft. fence requirement to 4 ft. Planning Commission felt 6 ft. fence is required to provide adequate screening to prevent views into windows of adjacent residence, and recommended denial. Ms Wilson discussed landscaping requirements north of the parking area. Due to slope of the land, landscaping would not effectively supplement the screening provided by the fence andexisting natural vegetation. Additional native vegetation would provide more effective screening. Ms Wilson discussed recommended restrictions in 0rd. 3682 be changed as follows: Prior to issuance of any building permits, the developer shall sub- mit plans showing: Detail for site lighting which: Indicates that parking area lighting north of the motel and office Will not exceed sixteen feet in height, and is shielded so as to prevent direct illumination of residential properties. Landscaping as follows: Along the north and northwest edges of the subject property abutting the residential property fronting on Brentwood Dr: An area no less than twenty feet wide, or no less than ten feet wide if agreeable to the abutting property owner(s), as evidenced by a signed statement to that effect; natural vegetation within said area shall be preserved and additional native trees, shrubs and ground cover planted where necessary to screen the subject development from the adjacent residential property. An attractive 6 ft. high solid wood fence shall be constructed along the southern edge of said natural area at the top of the bulkhead. David Huffman, Richeft & Assoc. rep. stated they have no problem with a 6 ft. fence atop the rockery wall, and they will plant natural vegetation in open areas where trees were removed during clearing of the land. Jim Strait, 6530 Hatlow, discussed 25 ft. greenbelt for screening which appeares to have been removed. Ms Wilson stated this was done in error, and she discussed a letter drafted by the City Attorney and Planning Director that no occupancy permit will be issued until this area is replanted. Calvin Johnson, adjacent homeowner, stated he is in agreement with 16 ft. light standards. He discussed settling problems of the fence height, and planting of trees in the open area to function as screening. Motion by E. Sturdivant and S.
