Mr. MacKenzie outlined the various items to be covered under the second change order presented frcm painting interior of Pump station #7 to temporary pumping, if required. Mr. Bert Gegner, 934 Washington, was concerned that all change orders previously presentedwere approved with little question. He felt that it only encourages the project engineers to make improv~nents without going over the percentage allow by the contingency fund. Ms. Mary Lou Long, asked for a clarification of the percentage factor and would it mean sewer rate increases next year. Council President Anderson stated that the percentage was determined by the over-all contract figure, and that the Change orders are paid out of the contingency account which now is only 3.7% of the total contract which is very low as c~mpared to other cities in the area of 10%. #0831 · M/S/C/U/(Drouin/Pachek) to approve Change Order No. 5 to Contract C-6 and Change Order No. 9 to Contract C-3. DCD has withdrawn the original application due date and that the contract amendment is designed to accept delivery of the Grant application and make payment in accordance with the DCD schedule. Mr. Don Pratt, Co~nunity Block Grant Coordinator, explained that payment would be frcm Block Grant Funds and he further explained loans and the history of the program being administered by the Phoenix Group. Councilman Homing asked if the City was asking Phoenix Group to ccntinue withMr. Pratt stating yes. He stated he was advised by the Kitsap Visitor's & Convention Bureau that there is two proposed reunions scheduled to be held in Bremerton; one for the crew of the USS Wasp and one for the crew of the USS Tennessee. It is projected that each will bring approximately 300-500 people into the area. He reported that he attended a meeting of the Economic Development Council with Planning Director Gero and people from Seattle. COUNCIL M~tBERS REPORTS #1513 CounciLman Johnson presented a request from the Audit committee to appoint Councilman Phil Drouin as an alternate. #1539 · M/S/C/U/(Johnson/Pachek) to approve the request for appointment, as an alter- nate, of Phil Drouin to the Audit C~¥~,~ttee. Councilman Arno expressed concern that Councilman did not suk~mit the names of those in their districts to serve as committeemen on the Cu'L~rehensive Plan/Map and Zoning Ordinance cor~nittee being newly formed. He asked if anyone had objection to this methodology with Councilman Johnson stating yes because he questioned the authority of either the Planning Director or Council to do this. Planning Director Gero stated that Assistant City Attorney Jane Kohler is preparing a response which City Attorney Broughton affirmed. Councilman Arno still felt that names should be provided now however Councilman Bz~rian asked when the legal opinion would be available with Broughton stating by the end of the week. Councilman Amo stated that, asst~ming Councilman John- son is advised by the end of the week, he would hope that Councilman could be prepared to sukmmit names by Tuesday of next week. Councilman Drouin noted the next Wastewater conmzittee meeting would be Decem- ber 20, 1984. He also reported the progress and ccmpetance of the new Accountant Ms. lacy Brunetti. He also stated that District #7 is supporting the YMCA Agreement before Council this evening. He said that the Golf Course Board met today and presently are working with the 1985 Budget. 6:30 p.m. recessed; 6:45 p.m. reconvened. KITSAP COUNTY YMCA CONCESSION A~R~MENT, ~AB84-590 Ms. McCluskey presented the revised Kitsap County YMCA Concession Agreement and noted that the total square footage, where left blank, is 19,000 sq. ft. The Agreement was prepared by the City Attorney and reviewed by the Parks Cc~mission in public session and unanimously endorsed after both the City and the YMCA agreed to delete references or indications that the YMCA would operate the Municipal Pool. The Agreement now before Council eliminates all references to the YMCA operating the Pool. It was rec~nended that the Council endorse unanimously as a kick-off to their Building Fund dirve. Mayor Dawkins stated many hours were spent developing the final Agreement. He then introduced Glenn Godfrey, Director of the YMCA who will speak. Councilman Sturdivant stated his concerns and that of his constituents were addressed by the revised document. City Attorney Broughton stated that patrons will be treated more fairly and noted changes made to include (Pg. 5, para 8a.) "Membership in the Kitsap Family YMCA will entitle an individual to non- instructional use of the City pool facility at no additional Charge. YMCA members will pay normal public fee cb~arges for any instructional swimming classes offered by City at City pool facility". Pg. 6 - added sentence under "perform- ing arts" Sec. c. and sentence added under "fee cc~mittee", Pg. 6, e. City Council Reg. Mtg. Minutes ~tPPROVED DRAFT December 12, 198 Page 4 of 7 Councilman Sturdivant requested tb~ first change to be more acceptable to the public and too that the YMCA will pay the City 20% of the member- ship fee, regardless if the mamber uses the Peel facility. Councilman Amc asked whether the most recent changes have affected the YMCA's posi- tion. Mr. Godfery responded that it is acceptable with his Board. Mr. Glenn Godfrey explained the history of the proposed agreement and stated this woul~d be a unique facility whereby the co0a/m~ity and YMCA were pooling resources. He apologized that the management of the pool did come up but felt the issue was resolved by the revised draft. He said that the YMCA is merely purchasing dead-time available in the Municipal Pool and should be able to off-set operating expenses for the City. He said that only 20 - 25 percent of the Y membership will actually used the pool however the Y has agreed to pay the city 20% per member fee for the use. Mr. Ed Sheldon, Chairman/Fund Raising Campaign, stated this will be the lar- gest charitable fund raising event ever held in this c~nity. The project is based on the "family" concept and if it were to fail, Mr. Sheldon thought it would be the last of a YMCA facility in the Bre~erton area. He then pre- sented an artist's conception of the proposed facility. He said the facility will be centrally located and cheaper to build new than atten~pt to repair the existing site. Ms. Linda Gleason,l127 Walnut, spoke in opposition of the proposed Agreement. Mr. Carl Cramer, YMCA Board Chairman, stated the citizens of Bremerton are the people to benefit. Ms. Marylou Long expressed concerns over costs for the public vs cost for YMCA members to use the Municipal Pool; question the possible conflict of interest because of the logo name "Young Men's Christian Association". Attorney Bill Broughton stated that he revie~d the Policies of the "Y", and the agreement clearly states the organization will not discriminate because of race, color or creed, etc., and the agreement is available for Ms. Long's perusal. Mr. Glenn Jarstad, Former Mayor/City of Bre~nerton, 2823 Hefner presented ~i?~ p~titions which emphasized that the citizens wanted the City to remain owner/operator of the MtaiicJpal Pool, however, since the last revision of the Agreement, he a satisfied that ~_he issue is resolved. He hoped that Council TAPE #202 will pursue future possibility of the City jc.J~t]y able to use the YMCA faci- lity for Parks purposes and closing stated he encouraged unanimous support. ~0079 · M/S/C/U/(Adrian/Sturdivant) to approved the proposed Kitsap County YMCA Con- cession Agreement, as revised, including Councilman Sturdivant's revision Pg. 5, line #19, "Membership in the Kitsap Family YMCA will entitle ~ indi- vidual to non-instructional use cf the City pool facility at no additional charge. YMCA n~nbers will pay normal public fee charges for any instructional swinl~J_ng classes offered by City at City Pool facility". Councilman Drouin was concerned whether, prior to construction, a site plan would be required with City Attorney stating it was covered in the Agreement. OPJDINANCE (1ST READING) AMENDING ORDINANCE #3709, SEC. 1, RELATING TO CON- D±'±'IONS IMPOSED ON THE (Anderson) REZONE, #AB84-598 Ms. McCluskey presented a request frc~ the Planning Department to amend the conditions imposed on Ordinance #3709. In fall of 1983 the Planning Cc~nission reccnn~nded approval of the rezone, with conditions; On December 28, 1984, the City Council approved such request. Before such action can be done and the special conditions to be met, Concomitant Zoning Agreement is required and attached. Planning staff recc~nended approval. Mr. Joe Gero, Planning Director, stated that the problem occurred when review- lng the document, it was found that several of the conditions were found add- ressed in the Zoning ordinance or other documents therefore not necessary. Since cc~mencing the new procedures, when approving rezones, the Anderson rezone is now back with new type of Conconmitant Zoning Agreement. Bob Duffy, Planner gave examples of those areas that would be deleted and those that will remain. Counci/men expressed several concerns that changing the document a year later may not make the document valid and that when approved originally in December of 1983, both the applicant and the City agree to the terms of the Agreement. City Attorney Broughton stated the pr~nent was not agreeable however it is now cleared up. It was also questio~,l~w could an ordinance that was passed never been written. Councilman Homing felt conditions were not lessened. City Council Reg Mtg. Mr. Bert Gegner concerned about action Council was entertaJ_ning. Does not understand after one year circumstance warrants a new ordirk~nce which may alter conditions. Councilman Anderson stated that the hearings were done and it is not the fault of the proponents. Councilman Arno not~ it was not the Agreement made a year age and what would happen if not passed tonight. City Attorney Broughton stated that there was a one-year moratori~ to reapply so they could reapply. Counci/man Arno urged fellow Councilmen to vote the ordinance down and ccme before a clean hearing. If voted down he would ask for a hearing reopening concerning the rezone. Councilman Horning stated he would support if voted down, only non-enforceable items. Mr. Jim Straight, 6530 Harlow, noted that if Council voted to place restrictions applicant can accept or reject, but Council either approves or disapproves. Mr. Charles Palmer, Representative for Property Owners, st~ted his clients have found a qualified buyer for the parcel and it needs to be a B-2 zoning with conditions. Councilman Adrian was concerned that we could not take public testimony with Attorney Bill Broughton stating he was correct, however, cannot go into merits of hearing. Mr. Broughton continued that Council would need to either reopen hearing or send property owner papers being sure an agreement was reached. Councilmen Homing (Motion) and Anderson (Second) both withdrew previous motion. #1465 · M/S/C/U/(Drouin/Pachek) to table Ordinance (lst Reading) a~nding ordinance #3709, Sec. 1, relating to conditions imposed on the Anderson rezone~ for two weeks for further review ORDINANCE (1ST READING) UNIFORM CONTROL OF GRADING & DRAINeR]E, #AB84-601 Ms. McCluskey presented an ordinance (lst Reading) providing for uniform control of grading & drainage. City Attorney Broughton gave the Council a smm~ry of the contents which included; Ptmrt~se, Compliance with Federal to local laws, Public benefit, Compliance by owner, Definitions, Drainage Control Plan, requirements, Review & Approval of Plans, Drainage Control Facilities and Containment Systems/Bonding, Inspections, Modifications, M~intenance, Deficiency & Correction, etc. Councilman Sturdivant suggested that there should be a Public Hearing or Study Session on such a complex Ordinance (24 pages) because he thought Council had not had the time to review such a lengthly document. Councilman Homing felt the ordinance, in it's presented draft, was difficult to understand. He went fur~er to say that anyone planning to build would have problems with ordinance. Councilman Johnson stated the ordinance should not get hung up on environmental issues. Councilman Anderson agrees that ordinance should be tabled.. Councilman Horning suggested the City Engineers and outside independent Engineers review and make reconmendation. #1957 · M/S/C/(Adrian/Sturdivant) to table and refer ordinance, providing for uniform control of grading and drainage, to the Planning Conmittee for study and review. VOTE: In favor (7); Amo Opposed ORDINANCE (1ST READING) MANAC~Sb~N~ BENEs'ITS, #AB84-602 City Clerk McCluskey presented an ordinance (lst Reading) setting forth a benefit plan for non-union management personnel. Personnel director Dave Hiestand stated that Senate Bill 843 has impacted the original ordinance which has caused a rewrite because of issues of Military Leave, Retirement payoff, etc. Councilman Adrian questioned pg. #1, pg. 5, "Physical" and who defines. Mr. Hiestand explained that it is a wellness physical which includes weight, heart, etc. Councilman Adrian felt that someone should set the standard such as the Personnel Director. Mr. Hiestar~ went ~f~er to state that the · . .r-or worx~ .~o, . physical, because the C~ty ms Self-Insured,/ms a pr~%~lvem~]ical program that should prevent sick leave abuse by addressing a proble~n in it's infancy. Councilman Anderson could not see the benefit of a City paid physical. Councilman Homing disagreed stating the affected employee,, with knowledge of a medical problem, may have a attitude change, less time loss, and certainly corrective measures would be required. Councilman Pachek asked if companies like Boeing, etc. have plans of this nature implemented wif~ Mr. Hiestand stating he had not done a survey of this type. Several ccmpanies do but he could not state which specifically. City Council Reg. Mtg. Minutes UNAPPROVED DRAFT December 12, 19F Page 6 of 7 Councilman Sturdivant had several concerns that verbiage was changed, added, deleted, etc. and requested justification. Mr. Hiestand clarified that the document before Council tonight is different than the previous doc%tnent to separate out the organization portion which Council agreed to review after the November election. Failure of that portion caused deletion of much of the verbiage. Under Sick Leave benefits, Administra- tion sensed discomfort with the 240 hours, therefore it was reduced to 200 hours, and he continued to explain the difference between active and set-aside accounts of accrual. Mr. Hiestand also explained the problem of several individuals who had up to 1000 hours banked and instead of getting into a cash payoff problem, it was handled in the ordinance draft. On page 5, January 20th instead of the 15th was due to the tin~ frame of ordinance passage, ass~ning the Council passed first reading this evening. Mr. Hiestand also addressed the issue of Military Leave as defined in RCW 38.30. 060 which states the e~ployee will earn his regular salary plus any military compensation which is also covered under Federal Title X. Mr. Hiestand expressed concern that, to enable computer set-u~implementation, consideration should be given tonight to pass first reading of the ordi- nance. Mr. Bert Gegner could not see where an e~ployee physical benefit anyone except the employee. He stated he felt it was a luxury. Ms. Judith Katsirubas, City Auditor, noted that when claims drop, so do #2002 insurance premiums paid for group coverage. #2017 · M/S/C/(Adrian/Johnson) to approve Ordinance, first reading, setting forth a benefit plan for non-union maD~gement personnel with two amendments; (1) Pg. 1, Footnote #1 - addendum verbiage "The scope to be defined by the Personnel Director". KITSAP PUBLIC SERVICES, INC. - REQUEST FOR RATE INCREASES - 1985, #AB84-600 Ms. McCluskey presented a request frcm Kitsap Public Services (KPS) for propcse~ rate increases for 1985. It was noted that the requested increases are similar or identical to those passed the previous week for Olympic Ambulance Company. Councilman Drouin asked if Mr. Pat Tucker, owner, would agree to inserting, under night charge, "£~cm 6:00 p.m. to 8:00 a.m." which Mr. Tucker said he was agreeable to. Ai~D to reduce the fee frc~n extra attendant, from $25.00 to $21.00, agaiD ~hich Mr. Tucker agreed. #2138 · M/S/(Drouin/Adrian) to approved the request frc~ Kitsap Publ2~ Services, Inc. for 1985 rate increases with two amendments; (1) Night Charge - ad~dendum of verbiage "6:00 p.m. to 8:00 a.m." and, (2) Extra Attendant - reducing ~he figure from $25.00 to $21.00. Mr. Bert Gegner, reco~ended that Council not approve because he understood that, according to ordinance and discussion last week, Olympic Ambulance met the time frame and Kitsap Public Ambulance did not. He felt also there was a collusion in the rates sutxaitted by the two Ambulance companies. MS. McCluskey defined the ordinance as revision one month before it is effective. Further the City agreed that it would provide a boat launch and park at Kitsap Lake as a pre- condition of accepting the Phase I grant regardless of whether the restoration was acutally completed at the lake. This resolution sets forth the intent of the City Council to effectuate that pc.rtion of the grant agrecment between the Department of Ecology and the City tc provide the boat launch and parks facilities. He said that the Grant will be matched funding and has bcc~n previously applied for by Parametrix who would make this application. Councilman Homing asked what would happen if we did not make this applica- #3205 tion with Mr. Gero responding that the State would probably take a dim view of future applications. He further stated the purpose of the Grant was to create water quality in Kitsap Lake.
