COUNCIL MEMBER REPORTS
Mr. Dawkins reported that the Naval Ships Museum - move is
underway and that it is now 40~ complete. With help from
the crew from the USS Snook, completion is scheduled for
Friday.
Mr. Collins addressed to upcoming "ELS" (Paramedic) Levy
which apparently is not clear to the citizenry. He has had
numerous calls and people are misunderstanding that this is
additional monies for a "911 Enhancement" voted on in the
November 1985 election. He requested that information be
made available on the Public Access Channel to better inform
the electorate. Ms. McCluskeV stated that announcements are
commencing tomorrow which should clarify the issue.
Ms. Lonq expressed her concern over the recently adopted
Resolution to place a Parks Bond Levy on the November
general ballot. She felt the priorities are misplaced,
especially when the Parks administration announces one week
later that major repairs and maintenance are needed for the
Municipal Pool. She felt the Athletic complex should be
dropped with more allocated to upgrading of Evergreen Park
and $250,000.00 be requested for Pool Repairs. Further
neithe~ the Resolution or proposed Ordinance indicates where
funds will be spent and she requested that this be announced
on the Public Access station.
Mr. Johnson (1) asked that Council start thinking about
outdoor activities on Kitsap Lake next spring and that they
be prepared to set some policies which will protect both the
home owners in the area and the fishermen who use the lake.
(2) He wanted Council to consider, in the near future,
addressinG the Parking issue wi~h regard to Holidays,
especially those in November and December. Will the City
again allow the merchants to off-set lost revenues for free
parking; does a policy need to be set in place and if so,
should be advertised on Channel #29. (3) He announced that
the Fixed Assets program has now been computerized and close
to completion. (4) Budget Hearings will begin late October
or early November with emphasis on ."Personnel" and "Capital
Improvements". (5) At Monday nights Study Session, the
Cable Committee will have a presentation and he asked that a
representative from Olympic Cable TV be there and when will
they begin to televised Channel #29.
Mr. Homing noted that in the Mayor absence, while out of
town, he has been handling any problems that arise.
PUBLIC RECOGNITION - None
UNION CONTRACT - BREMERTON POLICE OFFICER'S ASSOCIATION,
#AB86-352
In January of 1986, the Police officers of the City
conducted a representation election that ended their
Teamsters affiliation and established the Bremerton Police
Officer's Association with contract negotiations being done
by Mr. Will Aitchison, Attorney and Labor Specialist based
in Portland, Oregon. Mr. Dave Hiestand noted that after
months of negotiations, he is bringing a contract before
Council recommending ratification. The major changes are:
1. Salaries frozen for 1986.
2. Commencing January 1, 1987 - a 2.5% increase.
3. Commencing June 1, 1987 - another 2.5% increase.
4. Contract expiration June 30, 1987.
5. Recognition of Martin Luther King in the contract
AGreement - January of each year.
6. Inclusion of a LEOFF II Long-Term Disability coverage
program (Impact - Approx. $1,080.00 for the balance
of 1986).
7. Amendments to verbiage such as changing the word
"Teamsters" to "Association" throughout the contract
where applicable.
Basically the contract remains unchanged except for the
above. Mr. Hiestand stated he feels the officers negotiated
in good-faith and recommended approval.
#0574 · M/S/C/U/(Waibel/Dawkins) to approve the amended Teamsters
contract and ratification through June 30, 1987.
EASEMENT - HASELWOOD/CITY OF BREMERTON, #AB86-353
Mr. Chuck Haselwood has requested the City provide an
easement across it's property for the mutual benefit of both
parties. A road has been constructed and is presently in
use for which an easement has not been Granted-
Mr. Dave Baker noted that the agreement for use of the
property was because of the need to haul fill dirt from the
Silverdale bypass which Mr. Haselwood agree to accept. Mr.
Gary Kucinski, Representing Mr. Haselwood is a Land
Developing Engineer, and his understanding was that it was
used as a hauling road per a verbal agreement between then
Public Works Commissioner Tom Swanson and Mr. Haselwood. He
felt it would benefit both the city and' all adjacent
property owners if the City were to Grant the easement.
Contingent on the easement is an opportunity to relocate a
major Coca-Cola Bottling Distributorship. He has had to
postpone closing the land sale until this is resolved

because the Title Company cannot give clear title.
Opponent Mr. Jim Strait, 6530 Harlow Drive, objected to the
City granting the easement. He felt it would benefit the
City only if the property were annexed because it is
presently in the County. Questions were asked by several
Council members including; (1) What obligation does the City
have to grant the easement? (2) Who would be responsible for
maintenance and repairs of the road?; (3) Why has it
continued to be used for other than a hauling road? (4) Why
did the Office Engineer, Mr. Gerry Thornburgh address these
questions without answers prepared for the Agenda Bill? Mr.
Baker was unprepared to respond at this meeting however
would research.
Mr. Johnson requested that the record show that the City
Attorney is unavailable to advise.
Mr. Dawkins and Mr. Crutcher concurred with Mr. Thornburgh's
memo and recommended the request be tabled for one week
until there is clarification. Mr. Overson felt he could not
agree that it is beneficial to the City.
Mr. Tom Swanson gave background of the verbal agreement and
was surprised that the road is still in use. It was solely
for hauling the fill dirt which was requested by the State
Department of Transportation. Mr. Kucinski stated that Mr.
Haselwood would take responsibility for maintenance and
repair of the road but he urged Council to make a timely
decision however one week would not greatly impact the sale.
Longer would be a problem.
M/S/C/U/(Johnson/Dawkins) to table one-week with the direc-
tion to prepare the needed answers to the questions outline
above by the Engineering staff.
Mr. Broughton joined the meeting.
ASSIGNMENT OF LEASE - RAFFLES OYSTER BAY INN, #AB86-354
The City approved a lease with O'Bay, Inc. the owner of the
Oyster Bay Inn for use of City Right-of-Way in May of 1984.
O'Bay sold to EP Enterpirses therefore the assignment of the
right-of-way lease is to the new owner, EP Enterprises.
Mr. Waibel asked if the City can collect any outstanding
lease rental with City Attorney Bill Broughton stating yes
it would be like back rent. The Lease will be dated
today's date as long as the payments are current. Mr.
Johnson asked if there was an automatic lease review. Mr.
Broughton stated this was covered in the ROW Ordinance which
he brought before Council numerous times and never was
passed. Mrs. Long requested a copy of the document.
· M/S/C/U/(Waibel/Long) to approve the assignment of the Right
of Way Lease to EP Enterprises.

for installation of the new water transmission main in Gorst
to accommodate the State Department of Transportation
requires the Utility to provide inspection of the water main

at an estimated cost of $15,000.00. He stated that normal

the installation, should be inspected by a unbiased third
party. He recommended Council approve.
Mr. Waibel asked what was the length of the contract period
with Mr. Dully responding 120 days from execution of the
document. City Attorney Bill Brouqhton stated that his
office drafted the document and there are some areas that
cannot be covered, such as "errors and omissions" however he
feels the job being performed is mainly that of an observer
who will be writing reports. He/she will not be in a
position to advise or direct the contractor so it should not
be a problem. Mrs. Long asked who would be monitoring the
work of the "observer" with Mr. Duffy explaining that he
will report to him.
