Council recommendation to declare the property and equipment surplus to the Department will allow sale of equipment and property to commence. The department is asking for Council approval with funds transferred to the Wastewater Fund #451 by April 30, 1986, or place the property on the open market for sale. Ms. Judith Katsirubas, City Auditor, presented Staff report representing the Planning department, Planning Commission and Wastewater Utility. She gave a background history of the original acquisition of the parcel, what occurs if 'the utility is no longer needed, options for disposal and agencies she has contacted for the information. She noted TAPE #322 City Council Reg. Mtg. Minutes February 13, 1986 PaG'e 4 of 5 UNAPPROVED DRAFT that the acquisition was from the government for War needs and held in trust and that the Utility, serving areas outside the City proper, is separate from the City, therefore any funds received from disposal of the site should be deposited in the utility accounts. The parcel iS 2.9 acres, is zoned R-1 and cannot be rezoned until the property has been surplused and sold. She stated the Utility set the April 30th date to allow the General Fund to find a source of revenue to possibly purchase said parcel. In the event that the parcel is not surp/used, the Wastewater Utility will have an approximate I 1/2 - 2 1/2~ shortfall in its 1986 budget projections. The 1986 utility rates were contingent on surplusing this parcel. Those speaking in opposition to the sale and for the City to retain the parcel were as follows: Mr. Hank Clark, 129 Sheridan, who expressed concern about the City's liability, after sale of toxic-wastes; Mr. Glenn Jarstad, (former Mayor) 2823 Hernet, who noted that prime waterfront, abutting the Lyon's Field, is an asset the City cannot afford to sell. He suggested alternatives to find a funding source and transfer to the Parks department to be an extention of Lyon's Playground complex; Mr. Merle Percondane, 2539 E. Stephenson, complained of odors with the plant remaining in place and stated the neighbors have promoted L~on's field; Mr. Stan Christensen, 419 Plumb, felt the City should demolish existing plant and transfer over to the L~on's field complex; Mr. E.L.Sturdivant (former Council Member) 3231 Halvorson, said his position has favored recreational areas and retention of those in existance. He thought every attempt should be made to retain this parcel because once sold, prime waterfront is gone forever. He felt rather than commercial this parcel should be designated to Lyon's Field, as it is the major recreational facility in the area; Mr. Jim Lamb, 5363 Pineridge, 1st Vice-President of the local area Lyon's favored keeping this parcel and requested Council to "find a way to retain"; Mr. W.G.Warren, 2527 Stephensen, stated he is concerned about pollutants already in the area and understood Mr. MacKenzie, Wastewater Compliance Officer, wanted the property sold merely to establish a reserve fund for the utility which was not logical in his opinion; Mr. Pat Carey, suggested a committee be formed to include a representative from the Parks department, Wastewater utility, Sheridan Park Neighborhood, representative from the local Lyon's organization and Council member to decide on the best disposition of this parcel. Mrs. Long asked if the parcel has been tested for contaminents with Mr. MacKenzie stating no. He thought it could be done at the time of demolition to save costs. He stated that from past utility reports there is existing hazards and said the reports are available in his office. Mrs. Lonq felt that the Golf Course would not be a realistic source of revenue for the parcel and questioned whether the sale of the parcel could not be used to offset the utility costs. Ms. Katsirubas stated that the receipts from sale would have to be designated and held for Capital improvements to the utility and could not be used in any other way. TAPE #323 M/S/C/(Overson/Collins) to table surplusing parcel until a committee, as suggested by Mr. Carey, be established to field questions and provide facts in determining the best disposition of the site. VOTE: In favor: Overson, Dawkins, Crutcher, Collins & Long Opposed: Johnson and Homing Abstained: Waibel TAPE #323 City Council Reg. Mtg. Minutes February 13, 1986 Page 5 of 5 UNAPPROVED DRAFT Motion PASSED to table. Mr. Collins asked for reconsideration on the motion because of possible impact if action is not taken now. Discussion followed with clarification that to surplus does not mean automatic open sale but rather that the utility can dispose of the Building and equipment with further action on the parcel disposition at a later date. M/S/C/U/(Collins/Waibel) to reconsider the motion. M/S/C/U/(Waibel/Collins) to surplus the property, buildings, equipment, appoint a committee as Mr. Carey suggested, to review and make their recommendation prior to September 30, 1986. Mr. Dawkins was concerned as to why wait until September with Mr. MacKenzie responding that the utility budget is not in violation of the law as long as it is balanced, which it would not be by the end of the year. Mrs. Lonq stated it appears this is more serious than stated and was in favor of expediting the issue. Mr. Horning, stated that the committee will be appointed as soon as possible. With no further business, meeting adjourned at 8:10 p.m. KATHLEEN L.
