PUBLIC RECOGNITION
Mr. Jim Strait, 6530 Herlow Drive (Pres. Kitsap Lake
Neighborhood Assn.), objected to the previous weeks action
whereby Council overturned the recommendation of the
Planning Commission to deny a fezone at 292 South Callow.

meeting was a poor reason to approve.

Council endorse the School levy; (2) Said that Bremerton was
selected to stage a custom car show entitled "Ultra-Cruz -
'86" which will draw thousands into the community and

they have agreed. He requested time to present the program
to Council at the earliest possible study session to ask for

Mr. Dave Hanna, Planner, presented staff report and noted
there will be no access to subject site off Hatlow,
maintaining it's residential image. Mr. Jim Strait, noted

the Planning Commission meetings dealing with this

ORDINANCE AMENDMENT TO ZONING ORDINANCE -
CONFORMITIES CHAPTER, #AB86-033
Council President Horning asked the standard conflict
question with all Council remaining seated.
Don Pratt stated the previous Council had addressed the need
for (1) Parking Ordinance (approved), (2) Planned Unit
Development (PUD) ordinance (approved) and (3) Non-
Conformities Ordinance, before Council tonight. He deferred
staff report to John Dewhirst, Assistant Planning Director
who has been the project manager for this draft. Mr.
Dewhirst expressed the need for an up-to-date draft because
of the dense development occurring during the '40's. He
outlined the advantages of the proposed ordinance and stated
the Planning Commission approved the proposed draft per
Resolution #770, November 19, 1985. The decision was
unanimous with specific areas noted.
Mr. Field RVan, 2727 Marine Drive, spoke in favor of the
proposed ordinance, citing his particular problems due to
non-conformity.
Mr.Paul Scheyer, 2111 Madrona Point Drive, expressed
concern, citing examples of what would happen if the new
ordinance was approved. Planning staff stated they would
review his comments and address during next weeks meeting.
Mr. Johnson jdined the meeting at 8:02 p.m. and was advised
by City Attorney Broughton not to be seated as testimony has
commenced and he would not be able to offer input or vote on
the issues. Mr. Johnson left the meeting.
Mr. Horning stated he would encourage the Council to approve
this week and address Council concerns when the ordinance
returns for second reading. Mr. Scheyer agreed that with
modest changes the overall draft would be acceptable.
· M/S/C/U/(Collins/Waibel) to approve, first reading, ordi-
nance amending Ordinance No. 1792 relating to land use and
zoning by amending Chapter II of Title III in order to
update the provisions governing Non-conformities; repeal
Section 329 of Chapter II, Title II, and amend Section 328
of Chapter II, Title II (amended previously by Ordinance
3210, passed March 5, 1975, and Ordinance 3354 passed March
23, 1977); and amend Section 413 of Chapter. III of Title II
and address areas of confusion at second reading.
Mr. Collins commended the Planning Staff, Planning
Commission and citizens for their efforts to resolve a large
problem with the non-conformities issue.
