Mary Blowers, 2515- 2517 Fir Court, expressed her concern
with the condition of the street to her residence going into
the cul-de-sac and the cul-de-sac itself. Upon talking with
the Engineering Department, she was informed that work was
planned and $37,000.00 had been allotted for repair of
streets in that immediate area. Work commenced on August 12
on the opening of Fir Court and Mrs. Blowers was told that
repair would be done only to that initial opening area.
Mrs. Blowers requested clarification as to the area(s) where
the $37,000.00 would be spent and if anything could be done
to repair their streets leading into their homes.
President Horninq requested Ms. McCluskey, City Clerk, to
look into this matter and to provide a respond.
Adeline Stouffer, Fir Court, expressed her concern with the
conditions of streets leading into Fir Court and asked how
long did the residents have to wait before something will be
done.
Andrew Parypa, 1122 Hayward Avenue, presented Council with
pictures of areas in need of brush trimming, littering of
trash in yards, abandoned/junk vehicles, etc., and expressed
his desire and the need to help clean up Bremerton's
residential areas. He also expressed his concern that
Police officers on routine patrol should be more active in
turning in reports on abandoned vehicles/junk cars or other
conditions which would warrant City departmental action.

6A - RESOLUTION #2076 - SET DATE ~0R ANNEYa~TION ACTIONS RE:
ANDERSON CREEK UTILITY LAND ANNEXATION AND GOLD MT. GOLF
COURSE AND ADJACENT BREMERTON WATER UTILITY LAND ANNEXATION,
#AB87-223
The City, represented by Mayor Lobe's signature, is prepared
to petition the City Council for annexation of Water Utility
owned lands south of the City's boundaries. State law
requires that City Council: 1) accept a petition from owners
of 10% of the land value to commence annexation; 2) approve
a petition from owners of 75% of the land value to accept
annexation; and 3) approve first reading of the ordinance
implementing annexation.
Don Pratt, Director of Planning, described properties
included in the annexation process, noting that since the
City is the sole land owner in the petition the same debate
for all three processes would be the same, therefore, will
be presented for Council action on the same date under three
separate agenda bills. Proper public notification will be
given on each item.
M/S/C/U(Collins/Colvin) to approve setting September 2,
1987, at not earlier than 6:30 PM, at Bremerton City Hall
for the date and place for a meeting with the initiating
parties of the 10% Notice of Intent for Anderson Creek
Utility Land and Gold Mountain Golf Course and adjacent
Water Utilities property; and that we set the same date and
place for a hearing and first reading of the implementing
ordinance accepting the referenced annexation.
7A - PUBLIC HEARING - CHANGE IN LAND USE RESTRICTION RZ-8-87
ELIMINATION OF SOUTHERN CURB CUT, RETAINING THE NORTHERN
CURB AT 126 SO. CALLOW. APPLICANT: REGNELD ROBINSON, #AB87-
224
On June 16, 1987, the Planning Commission voted 5 to
recommending approval of the Change in Lane Use Restriction
RZ-8-87. The site was rezoned to B-2 with a restriction
requiring the elimination of the existing. northern curb cut,
allowing access only by the southern curb cut. (Ordinance
No. 4077). The applicant is now requesting the opposite,
that the northern curb cut be retained and the southern be
eliminated. This request, though rather simple, requires an
ordinance passed by the City Council to accomplish it. The
revised restriction as proposed will allow for flexible
future development while maintaining access via a single
curb cut.
President Horning asked the "Appearance of Fairness/Conflict
of Interest" question with all members being seated.
jack Allinqham, Planning Department, gave a brief history
of the previous fezone action and cited Ordinance #4077
which states that the ingress and egress shall be via the
southern curb cut and that the northern curb will be
retained. The recommendation before the Council incorporates
one other requirement or condition of Ordinance 4077, that
being "any portion of the building on the site shall require
a front yard setback of ten feet from the property line" -
this allows for future flexibility of the sites'
development and to circumvent having any other property
owners coming before the Council, the rest of the motion
would allow an administrative approval of this condition but
would still restrict one ingress and egress from this site
onto Callow.

Reqneld Robinson, 1412 17th Street, stated he did not feel
this was an issue that should come before Council but that
it is one that could be handled through the Planning
Department. His request is simply that he wishes to change
the curb cuts.
Jim Strait, 6530 Harlow Drive, spoke in opposition to the
request to change curb cut location and also expressed his
displeasure with the applicant for his choice of use for the
property, noting that it detracts from the surrounding
properties.
Mr. Colvin asked what impact this change in curb cut would
have overall. Mr. Allingham stated that no impacts are
identified and that there would be an improvement in
visibility in making a northern curb cut entrance and exits
to this property.
Mr. Overson questioned recommendation #3 which relates to
location of the curb cut subject to the Engineering
Department's approval...in what form would that be handled.
Mr. Allingham stated that it would require a Right-of-Way
permit to under go construction in the right-of-way. Mr.
Overson questioned if there is a time limit placed on
completing the curb cut. Mr. Allinqham stated that the
applicant would have to comply with the Ordinance before
occupancy would be permitted.
M/S/C/U(Collins/Colvin) to approve the change in land use
restriction subject to a concomitant zoning agreement
incorporating the following:
1. That any portion of any building construction on the
site shall require a front yard setback of 10 feet from the
property line.
2. That the site be allowed only one curb cut providing
ingress and egress via Callow Avenue, and to encourage
access via the adjacent alley.
3. That the location of the curb cut be subject to the
approval of the Engineering Department.
4. That the curb cut to be eliminated shall have the curb
gutter and sidewalk reconstructed to city standards subject
to Engineering Department's approval.
7B - PUBLIC HEARING - REZONE FROM R-! TO B-2 AT 3118 WHEATON
WAY AT DIBB STREET INTERSECTION. APPLICANT; REGNELD AND
PATRICIA ROBINSON, OWNER: ALAN H. ROBINSON, #AB87-225
On June 16, 1987, the Planning Commission voted 4--2 to
recommend that the City Council take no action on this
request fezone from R-1 to B-2, pending a more detailed
analysis of the general area, including nearby School
District property, and development of plans and policies to
guide future development. Further, the Commission found
that the request could not be approved because it (1) is
not consistent with the Comprehensive Plan, (2) there have
been no changes in circumstances that justify the change,
(3) the fezone could result in a number of adverse impacts,
(4) there is no public need, and (5) there is a need to
study the site and surrounding areas to ensure a coordinated
overall plan.
President Homing asked the "Appearance of Fairness/Conflict
of interest" question with all members present being seated.

Ron Houoh, Manager Long-range Planning, described location
of subject property and stated that the Comprehensive Plan
shows this as residential medium/high density area and the
area immediately across the highway from the property is
shown as low density. The Comprehensive Plan shows
surrounding school property as a combination of high density
residential and commercial as it is still a school site.
There are commercial zones to the north and south areas of
the subject property. There is no contiguous commercial
zoning at this time with this property. Property does have
access to all major utilities, however, this property would
drain to a storm water system on Dibb Street and that
system is currently beyond capacity. Planning Commission
recommendation was for Council not to take any action on
this request at this time or until an overall plan of
development of the surrounding area, including this
property, is provided.
Mr. Hough read into the record a letter received from Mrs.
C.L. Brownhill, 1109 Dibb Street, opposing the fezone due to
traffic safety.
Ms. McCluskey, City Clerk, read into the record a letter
received from C. W. Warham, 1111 Dibb, opposing the fezone
due to it being surrounded by school property, difficulty to
enter and exit, lack of sewer and it would create an
isolated business.
Regneld Robinson, 1412 17th Street, stated he believed that
all properties along Wheaton Way in this general area would
become commercial and that the School District would most
likely wish to get top dollar when they surplus the school
property. He stated that he did not believe strip
development was all bad and that businesses like to locate
where there is a high level of traffic.
Mr. Crutcher questioned how a commercial zone would affect
the surrounding residential areas...increase in taxes...and
the burden it may place on those on fixed incomes. Mr.
Robinson indicated that it would also increase the value of
property and there would be the possibility of greater
profit if they sold.
Mr. Overson questioned the Planning Commission's
recommendation that Council take no action considering the
lengthy documentation that necessary criteria are not met
and therefore should warrant a denial. Mr. Hough stated
that the Planning Commission would like to see a development
plan for the surrounding area, including the school
property, before any fezone decisions are made and by taking
"no action" it would allow for a proposal to be brought
before Council in one year.
Mr. Colvin questioned if the immediate property surrounding
the subject project is being used as residential. Mr. Hough
stated that adjacent properties are vacant lots and school
property.
Mr. Collins pointed out that there are 17 vacant business
properties along Wheaton Way between Sylvan Way and Sheridan
and does not warrant creating additional commercial areas at
this time.

analysis of the area bounded on the south by Sheridan Road,
