Mr. Horninq questioned if there was a well on the property. Mr. Duffy stated that there is an existing 12 inch casing with no pumping equipment and the City has been unable to obtain the restrictive covenants to use it as a domestic water supply but could provide a water source for a home. Since the North Perry Water District also serves that area it might be used more for irrigation purposes. Mr. Colvin questioned if the property had been advertised. Mr. Duffy stated that it had been placed in the hands of a realtor. M/S/C/U(Waibel/Dawkins) that the City approve the sale of the property described for the amount of $15,500.00 to Allan D. a~d Cheryl A. LOCATION APPROX. 1/2 MILE NORT['~ST OF PINE ROAD AND SYLAR WAY ACCESSED BY BRISTLECONE DRIVE AND MONTICOLA DRIVE; APPLICANT: HOLLY HOMES COMPANY, INC. #AB87-208 The ~'~ty approved the Preliminary Plat on june 13, 1984, for 27 single-family lots. On July 15, Council continued this item for three weeks to provide staff the opportunity to obtain all necessary documents relating to the final plat request. Ms. McCluskeV, City Clerk, raised point that some of the citizens were under the impression that the hearing would convene at 6:30 PM, and that they would have legal representation in attendance at that time. Mr. Homing stated that the recovening was not for public input but that Council members would have an opportunity to discuss and ask questions before making a decision. Council members agreed to hold the hearing at 6:30 p.m.. Ian Sievers, City Attorney, stated that the conditions that remained to be completed at last hearing have been satisfied, the Mylars and 'plat have been changed to reflect the different conditions, the bond required for off-site street improvements have been satisfied by actual construction and approved by the City and Title Report has been supplied and is satisfactory. Mr. johnson raised point as to City's ability to maintain the storm detention system. Bill DuffV, Utilities Director, stated they do not have a history to set rates on but will pattern it after other municipalities or municipal corporations. The County currently has an ordinance for maintenance of detention systems and they are charging $3.00 per month. After the first year of operating the system there will be a history of expenses and ad3ustments either below or above those costs would be made at that time. Mr. johnson asked which department would be responsible for TAPE #474 City Council Reg. Mtg. Minutes August 5, ~987 Page 4 of 5 #2145 tracking the costs. Mr. DuffV stated that the Street Department would set up project cost and tract throughout the year for maintenance. Billing would be done on the resident utility bill. Mr. Johnson asked for clarification of reference to "city wide assessments for storm water detention system". Mr. DuffV stated that it is a contingency clause when and if the City initiates a city- wide storm water detention plan. Mr. johnson stated that he did not see the value to the City to accept Tract A. ian Sievers, City Attorney, stated that if the area is kept open for public use and no fee is charged then there is no liability to the City. And, if the City did not accept it would be owned by a private individual, however, keeping Tract A as a public open space would help to break up the density in the area. Mrs. Long posed question relating to possible implementation of a city-wide storm water detention plan and how that would affect the residents of this development. Mr. DuffV stated that all storm water detention facilities would be incorporated into one with only one fee assessment for all residents. Mr. Johnson raised point that if it is Council's intent that the development consist of only single family dwellings why is it necessary to include the statement that allows for "Special Use Permit". Ian Sievers stated since a property owner would not have the normal rights to seek conditional uses and since this condition was imposed through the City process it could be amended later and not have it blocked by an individual plat owner. Mr. Johnson asked what other uses would the "special use permit" allow. Don Pratt, Planning Director, stated that special uses allowed are schools, parks, cemeteries, those types of activities that may be appropriate in that neighborhood. And, the Special Us~ Permit process requires that adjoining property owners be notified of any proposed action. Mrs. Long requested Ms. Cochran, attorney for the neighborhood group, to state her position regarding the "Special Use Permit" wording. Ms. Cochran stated that she, representinG the neighborhood residents, would prefer that it just stipulate single family dwellings. Ian Sievers stated that since the City has placed this restriction (single family dwellings) on the plat that the property owner have the right just as any other property owner in the city to request other uses they may wish to pursue that are allowable under the zoning designation. Don Pratt outlined the steps involved in a Special Use Permit proces~ and how the Planning Department would view the request. Mrs. Long requested that the Resolution be read into the record. M/S/C(Waibel/Collins) to approve the Holly Terrace Final Subdivision Plat subject to the condition that the plat be restricted to singe-family development, and as it meets City requirements.
