that proper safety precautions would be enforced.

take up only a 300 ft. area of the lake, which will allow
other types of activities on the lake and that the Shipyard

?A - CONTRACT EXTENSION - JANITORIAL SERVICES, #AB87-140
In May 1986, the 3anitorial services contract was awarded to
American Building Maintenance for a one year term. Twice
during the past five years, contracts with other firms were
canceled prior to term for cause, necessitating a rebid.
Because of the length of time needed to achieve full
performance compliant with specifications, intensive
monitoring and follow-up have been required for the first
4 - 5 contract' months, with continued emphasized monitoring
through the contract period.
American Building Maintenance achieved the required level of
performance in the later part of the second month. Since
then, monitoring by the City has been minimal due to the
level of competency demonstrated by ABM. Don Hock,
Facilities Supervisor, has reviewed contractor performance
for appropriate dep~rtments and determined that performance
levels meet or exceed specifications; further concluding
that the best interest of the City can be served by
extending the present contract through May 31, 1988. No
change in contract terms or conditions.
M/S/C/U(Colvin/Collins) that -the janitorial services
contract with American Building Maintenance be extended for
one (1) year ending May 31, 1988, contingent upon the City
Attorney's review and approval.

Mr.. Waibel questioned why the Attorney had not signed off on
this request. Ian Slavers, City Attorney, stated he had not
reviewed it .but it was requesting an extension of an
existing contract and .Council can make an extension if
desired. Ms. McCluskeV, Director of Administrative
Services, stated the old contract has all the standard
language and intent was to extend it for one year. Mr.
Sievers stated he would have an opportunity to review the
contract before it was signed.
Mrs. Lonq questioned if the City were required to put this
item out of for bid each year. Mr. Sievers, City Attorney,
stated bid action for this service was not required by law.
7B - 1987 JAIL CONTRACTS .BETWEEN THE CITY OF BREMERTON AND
POULSBO, PORT ORCHARD, SUQUAMISH TRIBE, #AB87-141
These contracts are before Council so that services rendered
can continue during 1987. The lateness of their
presentation is due to: (1) uncertainty in 1986 as to
what, if any, services Bremerton could provide, given
negotiations with the County ref; Jail services for
Bremerton prisoners; (2) rewriting of several sections of
the proposed contracts transpired between our City Attorney
and attorneys for the other cities involved.
Mr. Johnson questioned whether the City is charging enough
for services rendered and is the City utilizing jail space
for other cities prisoners as a priority over the City's
needs to house prisoners. Ian Sievers, City Attorney,
stated the City is operating within the regulations set
forth by the Jail Commission due to the fact the City
has contracted for future jail services with the County.
Ms. McCluskeV, City Clerk, pointed out that there were some
differences in contract language and charges and suggested
that Council approve identical contracts for all three
entities and new contract will be provided.
Motion by Mr. Waibel to approve all three contracts
utilizing the same language, using the Suquamish Tribe
contract as a model.
Mr. Johnson pointed out that the Suquamish Tr'ibe contract
cannot be used as model due to stipulations as to Tribal
rights, etc.
Motion died for lack of second.
M/S/C/U(Johnson/Long) to continue this item for two weeks.
7C BREMERTON COMITY ACCESS CHANNEL OPERATING RULES AND
PROCEDURES, #AB87-142

Coordinator. Considerable assistance has been received
from Dan Crockett Cable Manager, Jim Brontoli, Access
Coordinator and Lon Hurd, 3-H Cable Consultants.
Elliott Swanson, Cable Communications Advisory Committee
representative, was present to answer questions.
Mrs. Long questioned political advertising on access
channel, TCI's monitoring lengths of programming , Advisory
Committee screening and appeal process, need for more
specific rules. Elliott Swanson explained that the rules
stipulate no advertising shall be done on the access channel
at any time; the TCI and Advisory Committee will monitor
length of program to ensure interest to the greater
community; the appeals.. process is such that if a
satisfactory solution to an appeal is not reached through
the Advisory Committee, appeal may be brought before the
City Hearings Examiner and if further resolution is needed
an appeal may be brought before the City Council.
Mr. Collins asked for clarification as to "quality of
material broadcast" Mr. Swanson stated monitoring is
carried out to insure it can be talecast and watchable,
i.e., signal strength etc.
Mrs. Long questioned the fairness of operating rules being
changed without notice to the public (under Section IX
Waiver of Liability). Mr. Swanson explained that this is a
new venture and something could happen which had not been
foreseen. Ms. McCluskeV stated that operating rules could
not change without City Council approval at a public hearing
and suggested that the words "and operatinq rules" be
deleted from the first paragraph, second sentence of Section
IX.
Mrs. Lonq expressed her concern that the background music
being used on the access channel is the local radio station
which includes advertising and could this violate the "no
advertising" rule. Mr. Swanson stated that their
consultant advised them it is not in violation as it is not
being done as a production and does provide local news.
Mr. Johnson commended the Advisory Committee for the work
they have done in preparing the rules and regulations and
the progress made up to this point.
