Jack Allinqham, Planning Department, stated rezone is from R-1 to B-2. The major issues of this fezone was conformance to the objectives, Goals and policies of the Comprehensive Plan, satisfaction of rezone criteria and mitigation of potential environmental impacts. The Planning Commission recommended approval of rezone from R-1 to B-2, with conditions. Steve Ahlston, applicant, 13975 Interurban Avenue S., Seattle, Washington, described location and proximity to other businesses and School District property, proposed use as an office building, utilizing ,local contractor, and his agreement to conditions as recommended by Planning Commission. RoV MoselV, 2138E. l?th Street, opposed this rezone request because of increased traffic and potential hazard to children traveling to and from school property. Steve Ahlston, applicant, pointed out the addition of sidewalk construction which would provide a safe walking area and noted the School District was in favor of his proposal and their upper most concern for safety of pedestrian traffic near school facilities. Mr. Johnson expressed concern with traffic on and off Sylvan Way and the-adequate handling of storm drainage. Mr. Pratt, Planning Director, explained the issue of ingress and egress could be handled by the administration during the permit process and the Planning Commission did recommend that only ingress be allowed off of Sylvan Way. In regard to Engineering comments relating to storm drainage, the PlanninG Commission recommendation that applicant upgrade affected areas of the storm sewer would speak to that issue. Mr. Johnson asked what were the possible affected areas, does it include the down side piping and applicant assuminG cost to upGrade drainage? Mr. Pratt could not comment as this was not all dealt with at the PlanninG Commission HearinG. Mr. Dawkins recalled that an area in Olympic Manor area off 31st Street had a problem with floodinG during heavy rains from run off and asked if this problem had been corrected. Mr. DuffV, Utilities Manager, commented' that to his knowledge some improvement had been made to this area. Jack AllinCham, Planning Department, explained that City Council usually does not hear Special Use Permits, however cemeterys are provided for in R-1 zones.sub3ect to recommendation of Planning Commission to City Council for approval. This special use request pertains to an expansion on intensification of cemetery use but not platting cemetery lots with the construction of a storage shed to allow storage of equipment and materials. Planning Commission recommended approval of this request and the main issue was the impacts relating to aesthetics, dust and noise be- mitigated in conditions as recommended by the Commission. Jim Strait, 6530 Harlow Drive, President of Kitsap Lake Neighborhood Association, spoke in favor of the Special Use Permit noting that there was no public obaection at the Association meeting when brought up for discussion. Mr. Johnson was concerned that a buffer zone should be put around the building on all sides facing residential areas and should be included in the conditions noting buffering should be included around all areas abutting R-1 zoning. Mr. Waibel noted that Planning CommissiSn meeting minutes cited were not included in the information provided Council and suggested that agenda items not be submitted before Commission minutes are available. M/S/C/U(Johnson/Colvin) to approve SpeCial Use Permit with the following conditions: (1) This approval pertains to the construction of a 40' x 60' building to be used for cemetery-related storage of equipment and materials. Don Pratt, Director of Planning, stated it is the Council's responsibility to approve Substantial Develcpment Permits as ~be¥ do not go b,~f~?~ t!'_e P~sr~ning Commission. Mr. Pratt TAPE #441 City Council Reg. Mtg. Minutes April 8, 1987 Page 6 of 9 briefly described the proposed tower noting it would be handicapped accessible. The project was funded by two previous Council actions. He noted that the City is not the owner of the property. The State of Washington negotiating purchase of this property from the property owner and is standing ready to use condemnation authority if they need to exercise it iN °the procurement process. Under the Shoreline Management Plan this property has been designated Urban Commercial and its location is at a street end, with no parking planned in the proposal. Proposed use of site conforms to all the elements of the Comprehensive Plan Map and Policies. Planning staff recommends approval with one condition: that the developer coordinate construction with affected City departments in order to insure the protection to existing utility lines on the site. Primary existing utilities lines are described as water and sewer lines running along base of bank. #0449 Keith Redd, 400 Washington Avenue, representing individuals who do business at 400 Washington Avenue, expressed concern as to access to the parking area both during construction of the project and' after, if any, and any impact it will have on their future use of waterfront property. Mr. Pratt stated that more public would be attracted to the area and no security plan is proposed to keep people off private property and there may be some increased trespass. There will be design approval in the future and there could be some passive design consideration to keep people within a certain area. He stated that any development which is done under the Urban Renewal plan would be an enhancement to what already available in the area. Mr. Johnson asked if the City has to submit an application to the Corps of Engineers for a permit? Mr. Pratt stated yes, and that the application has already been submitted. Mr. Johnson pointed out that Mr. Redd's first question.may not have been totally answered and asked if he was referring to any restrictions to the parking area behind the 400 Washington building. Mr. Redd said it was. Mr. Pratt indicated that restriction to the parking area behind his building should not be a long-term problem, however, in the event a piece of equipment blocked the area it should only be for a short period of time as the construction site was at the end of the street. Mr. Overson suggested that the City garage was across the street and would provide parking in the event there was a delay or blockage of access to the parking area. M/S/C(Collins/Waibel) to approve this Shoreline Substantial Development Permit application (SL-1-87) with the following condition: that the developer coordinate construction with affected City Departments in order to ensure the protection of existing utilities on the site and that the rights of adjacent neighbors are also protect.ed. Mtg. Minutes April 8, 1987 Page 7 of 9 #0857 performing t.he functions necessary for preparation and monitoring the City budget under direction of the Treasurer. Also, the sensitive 'nature of the work performed is such that the position should properly be classified as management exempt. Rich Hanna, City Treasurer, briefly explained the intent to provide assistance in budget monitoring with the City Treasurer providing supervision for that position. Mr. Waibel questioned if the new job description conforms with the format and informational content of the James Study type 3ob description? Mr. Hiestand explained it was a Civil Service approved description developed just for this position. Mr. Waibel asked if the Civil Service Commission made any comments on this job description? Mr. Hiestand stated for clarification that the proposal is to make it an exempt position, however there are some procedural steps to take with the Union to accomplish this. He pointed out specific issues relating to knowledge of a broad spectrum relating to financial matters making this a position which should be exempt. Mr. Waibel asked if the Civil Service process for exempting the position has been started? Mr. Hiestand responded it had not pending Council action. Mr. Johnson stated that during the time the decision to not fill the Budget Analyst position was made the intent was that Director of Administrative Services and City Treasurer would carry out function. ! Ms. McCluskeV stated for clarification that a ~ accountant positio~ was budgeted in addition to the ~ accountant position they have, however, the current ~ accountant position is vacant due to an employee leaving the City and the new position would fill that vacancy. Mr. Johnson expressed his concern as to the number of layers between that position and Council and the workability of budget information. Ms. McCluskey stated this position would be a technical person, not a point person and the City Treasurer would be the person providing information requested by Council. M/S/C(Crutcher/Dawkins) to approve reclassification of the position from Accountant to Budget Specialist. Upon acceptance of this 10% petition, .the City Council authorizes the proponents to collect signatures of a 75% petition which must be presented to City Council for approval prior to annexation. Minutes April 8, 1987 Page 8 of 9 #1212 #n288 #1471 Ken Huqhes, Annexation Coordinator, reported that the Jensen Water District was formed in 1946 and has 97 customers, with water being purchased from the City of Bremerton along with assistance in billing and maintenance. Mr. Huqhes outlined briefly the efforts by the Jensen Water District Commissioners to have the City of Bremerton take over the operation. Previous efforts were delayed due to the City of Bremerton's request that their system had to be improved before it would be considered. Currently the required improvements have been completed. Mel Williams, 2007 Jacobson, Jensen Water Commissioner, spoke to the Commissions desire to have the district taken over and after improvement were completed they still had a problem due to the fact that they had outstanding Bond debt. Mr. Johnson questioned what affect the outstanding Bond debt would have on the City. Rich Hanna, City Treasurer, reported that the Water District has $85,000 of Water Revenue Bonds outstanding to mature serially through 2003. He noted that value in the plant and service plus fixed assets would cover the indebtedness of the District. Mrs. Lonq questioned if the water rates were the same as City's. Mr. Hanna reported that they are changed an outside rate with a surcharge and upon annexation the surcharge would be dropped. M/S/C/U(Colvin/Waibel) to accept the 10~ petition for annexation of the Jensen Water District Area and authorize submittal of a 75~ petition. 7A - ORDINANCE (FIRST READING) ANNEXATION - KITSAP LAKE DRIVE-IN PROPERTY, #ABS7-110 On February 18, 1987, after a Public Hearing, the City Council voted to approve acceptance of the Kitsap Lake Drive-In Property. Mr. Collins questioned the need for Council to be involved in the organizational structure of a department noting that Council has the opportunity through the Budget process to give direction. Mr. Johnson stated his concern that the City Council has not been supplied with a readable organizational document and that the Council can set generals guidelines for the major City Departments, giving it stability even if administrations change. M/S/C/U(Waibel/Colvin) to approve Ordinance #4104 on second reading repealing Ordinance #3556 Codified as BMC 2.15 relating to the Central Data Processing Department and repealing Ordinance #3291 Codified as BMC 2.10 relating to TAPE #441 City Council Reg.
