REPORT FROM MAYOR LOBE ON "STATE OF THE CITY", ~AB87-O13 Pulled for two weeks. CONTRACT WITH STATE OF WASHINGTON INTERAGENCY COI~4ITTEE FOR OUTDOOR RECREATION (IAC}; 4TH STREET BEACH ACCESS TOWERw #AB87-O14 City Council previously approved (AB86-359) the City applying for a $50,250 Aquatic Land Enhancement Account (ALEA) grant to develop a public beach access tower at the east end of 4th Street. The City's 53~ match ($56,750) consists of $49,750 in CDBG funds and a $7,000 in-kind contribution from Kiwanis. Subsequently the project was prioritized highest in the State and funded from the Department of Natural Resources. In Council's approval of allocating $49,750 of CDBG funds to this project (AB86-427). there was the stipulation that the "funds must be under contract by May i, 1987", which is not possible and the earliest the land could be acquired is October 1, 1987. Mr. Jack Maher, Waterfront Redevelopment Manager, requested Council authorize the Mayor to sign the contract with IAC and that the 1987 Block Grant program be amended. He further clarified the qualification process through various agencies noting that the City of Bremerton is now number one under consideration for this type of grant. Mr. Waibel expressed concern that the City Attorney had not signed off on the Agenda Bill. Ian Sievers, City Attorney, stated he quickly reviewed the document which looked TAPE #416 A City Council .g. Mtg. Minutes Janaury 14, 1987 Page 3 of 11 standard and saw no problems with the draft. Mr. Overson felt this was one of the initial steps in turning around the future downtown redevelopment and encouraged a do-pass. Mrs. Long expressed disappointment that initial develop is taking so long. Mr. Maher reiterated the reapplication process which finally got Bremerton to the top of the list. Further he explained that next will be an engineering permit which is issued from the Army Corps of Engineers which will take a minimum of 6 months, therefore the request to amend the CDBG FY87 for as late as November 30, 1987. He stated the City is anticipating commencing the building process in September. #0780 · M/S/C/U/(Overson/Dawkins) to (1) Authorize Mayor Lobe to sign the contract with the Interagency Committee for Outdoor Recreation (IAC) granting the City ALEA funds for a beach access structure at the east end of 4th Street on Bremerton's waterfront; (2) that the City's 1987 Block Grant program be amended to allow the City's match funds for this project (CDBG #87-014) to be committed as late as November 30, 1987, and (3) submittal of a budget adjustment request. LIBRARY BOND TAX LEVY~ #AB87-O16 The City's Annexation to the Library District was for maintenance and operation purposes only, according to a Department of Revenue interpretation. The City will save approximately $3?0,000 in 1987, as the Citizens will pay the Library District directly through property tax assessments. The Bond indebtedness must be handled separately. In 1987, the District owes $127,300 on an assessed value of $1,081,682,888. The City owes $37,359 on an assessed value of $2,585,330. Our assessment rate is .0434, the Library District's is .0314. In order to comply with the intent of the Library Annexation both the City and the County will be taxed at the lower rate, .0314 and the County Library District will pay the city the difference of $10,350 to meet our Bond indebtedness. Ms. McCluskey stated she never published the second ordinance therefore it need not be rescinded. She stated the intent was to preclude the City taxpayers from paying more than those who live in the County therefore the Library has agreed to pay the difference. Although the City Attorney has not reviewed, Ms. McCluskey stated Mr. Hugh Spitzer, the City's Bond Counsel has approved the concept. Mr. Johnson stated the Library District has been very cooperative in recent years resolving issues between the City and the district. TAPE #416 City Council ~.~g. Mtg. Mr. Waibel requested in future Council packets, a copy of affected ordinances be attached such as when rescinding, amending or appealing an ordinance. VACATION OF ALLEY AND STREET BY OPERATION OF LAW, #AB86-487 MS. Kimberly Karen Masters, owner of property on South Charleston, has requested that the north 1/2 of Porter Street and the South 1/2 of the alley abutting Lots 6, ?, 8, Block ?, of Port Orchard Addition, as per plat, be vacated by operation of law. The piat of Port Orchard was platted during the period of time from 1889 through 1894 and pursuant to the Laws of the State of Washington 1889-90, Chapter !9, Sec. 32, page 603, said property should be automatically vacated. Mr. Collins, Council Member representing this area, felt without knowing whether or not the City has used the property since 1889, Council is unable to make a decision without further research. #1272 s M/S/C/U/(Colvin/Waibei) table for two (2) weeks to allow the City Attorney to review the laws on the subject matter and develop procedures whereby ail departments and citizens have an opportunity to make comment especially City departments including, Planning, Engineering, Police, Fire, Street, Water and Parks which may be impacted. Mr. Collins noted that it is easy to vacate property but if the City would need in future years, the buy-back could be very expensive. FINAL PLAT CHELSEA SUBDIVISION - VERL LONG - RICKEY RD., #ABS?-OI? The proposed action is for final plat approval of the Chelsea Subdivision consisting of eight lots and dedication of Chelsea Lane. The applicant is posting a Letter-of- Credit in-lieu of constructing the roads and utilities in order to prevent the preliminary plat from lapsing. The Council must approve the final plat and direct the Mayor to sign and plat. Mr. Dave Hanna, Planner, stated the Preliminary Plat is scheduled for expiration on January 19, 1987. He stated the applicant has met all the conditions except #4H (pg. 49) which states..."The developer must improve Rickey Road to a two-lane 20' width to the north side of the proposal plat. All work to be in accordance with City specification". Mr. Hanna noted that the Engineering department has made the road improvements on Rickey Road but not at the request of the property owner, Mr. Long, and at this time Mr. Long requests that the City delete the condition because the City made the improvements prior to the final plat approval. Mr. Lon~ felt it was unfair that he would be assessed, based on the value of property abutting Rickey Rd., even undeveloped, but other established residents in the area are not being assessed their share for the improvements. In response to questioning by Mr. Dawkins, Mr. Dave Baker, City Engineer stated the primary reason the City decided to go ahead with the improvements was because of the flow of storm waters. There was no LID established therefore the work was accomplished from the Engineering budget. The TAPE #416 ~-' City Council ~.~g. Mtg. Minutes January 14, 1987 Page 5 of 11 original intent was to widened the Road from Sheridan Road to East 31st. Mr. Baker said the project was completed for the benefit of several property owners. Mr. 0verson felt the developer should pay his fair share ($2,500) with Mr. Homing, disagreeing. Mr. Homing cited the fact that the plat may never be developed however other area residents will obtain the use of the new improvements immediately and he added that the City has no agreement from the property owner that makes him obligated to pay at this time. Mr. Johnson felt that since the 6-Year Transportation Improvement Plan (TIP) is not followed, it becomes the responsibility of the developer to assume the costs which enhances his/her property. Mrs. Long reiterated that Mr. Baker could not explain whether a citizen complaint or action by the City precipitated the improvement and she requested this be researched before making a decision. City Attorney addressed the issue, stating it would be very unfair to require the developer to assume costs at the "preliminary plat" level and suggested that this could be a condition on final plat approval. TAPE #417 #0028 · M/S/C/(Waibel/Oolvin) to continue Agenda Bill #AB86-017 - Verl Long Preliminary Plat approval for two weeks. Mr. Waibel asked if this action stops the clock on the expiration date (1/19/87) with Mr. Hanna stating yes. VOTE: In favor: Overson, Dawkins, Crutcher, Waibei, Collins, Long, Colvin & Johnson Opposed: Homing Motion PASSED to continue for two weeks (1/28/87). ORDINANCE #4098 (EMERGENCY~ ADOPTION OF STATE'S SEATBELT LAW~ #AN87-018 An "emergency" ordinance is needed to' adopt the state's new seatbelt law so that Bremerton police officers may cite violators through Bremerton Municipal Court. The law was not included in the Model Traffic Ordinance and, therefore, unless the City specifically adopts it, the seatbelt law cannot be enforced through Bremerton Municipal Court. It is necessary for the health, safety and welfare of the citizens of Bremerton that the law be actively enforced in the City. City Attorney Ian Sievers was not sure this needs to be an emergency ordinance but emphasized that, only if adopted by the City of Bremerton, could violators be prosecuted through Municipal Court and this is a decision up to the City Council. He advised that the ordinance could be amended on the floor to require the two readings as most ordinances are presented. Mrs. Long felt there was a certain amount of emergency need to protect the citizen's welfare and if just one person "buckles-up" it may prevent serious injury or worse. Mr. Collins noted that the 1986 Legislature passed the Seatbelt law one year ago which allow local governments to inact their own laws to be consistent therefore he was not in favor of an "emergency" ordinance when this could have been done more timely. ORIGINAL MOTION: #0275 · M/S/(Collins/Colvin) to approve Ordinance #4098, first reading, amending Ordinance No. 3554, Section 2 (1979) to add a new subsection adopting the state seatbelt law to protect Health, Safety, and Welfare of the citizens of the City of Bremerton. Discussion continued with Mr. Waibei pointing out that the Press has taken the teeth out of this legislation by stating Seattle will not enforce this law. By passing as an emergency it will get the people to take action now. Mr. TAPE #417 City Council Reg. Mtg. Minutes January 14, 1987 Page 6 of 11 Crutcher adamantly opposed to any seatbelt law as he has read where it has been proven seatbelt can kill. He added that states formerly adoptinG such a law have since repealed their seatbelt legislation. Mr. Dawkins reminded Council that in !984 the State Safety Committee visited municipalities with a presentation favoring the adoption of this law. The City of Bremerton attempted to be the first in the State to adopt on the local level but efforts failed. Mr. Johnson stated, if unadopted, citizens ticketed will appear in District Court which also may cause more Court time for local officers out of their immediate area so there is a cost consideration. Mr. Colvin concurred and would support the seatbelt law. Mr. Horninq clarified that the motion is stated as a non-emergency. Mr. Overson felt it was an emergency nature and there is no intent to go through a long process. Mr. Horninq suggested a format, allowing discussion on each Resolution, with Council voting a recommendation to the state. Mr. Dawkins asked if Mr. Johnson could prepare an additional Resolution addressing support of the Ferry System and subsidization. He felt Kitsap County has the highest impact in the State because of the dependency on ferry transportation. Mr. Johnson concurred and would prepare the Resolution for the meeting of January 28, 1987. Mr. Waibel was not in favor of postponing the recommendations scheduled for this agenda noting Agenda Packets are available at the Public Libraries, and adequate advertisement has been done on Public Access Channel #29. Mr. Waibel commended the efforts of Mr. Johnson as this task was extensive. In conclusion to the Resolution presentation, Mr. Horninq commended Mr. Johnson's efforts and stated this was his methodology in his appointment of Mr. Johnson. He added that the City will be in a much better position to have the draft Resolutions FY88 in place when the State Legislature reconvenes for a new session. Mrs. Lonq noted that she attended the Association of Washington Cities Conference this past fall, and it is encouraging to see the Bremerton City Council becoming aware. She suggested the proposed Resolutions FY88 be available prior to the AWC fall convention instead of the first of the year. Mr. Crutcher qualified his opposition votes stating several of his constituents asked for a postponement for a week or two. Although he voted a blanket "NO" he was not against all the Resolutions. Mr. Colvin emphasized the need to get this paperwork in Olympia as soon as possible. With no further business, meeting adjourned at 8:25 p.m. KATHLEEN L.
