PUBLIC RECOGNITION
Kathleen McCluskev, City Clerk, read into the record a letter
received from Ellen M. Hawken, 712 Park #A, which included 69
signatures of individuals who are concerned over cruising in the
central business district, the impact of noise, litter, traffic
congestion that affect those individuals who live in or work in
the identified area. Those signing the petition requested that
something specific be done to curb the disturbances created by
cruisers and others, who are, especially at night, disregarding
the various laws of noise, littering, traffic and health codes.
Roy McInnis, 2711 Maple Street, stated he recently had the
opportunity to sit in during operation of Municipal Court and
commended the City's Municipal Judge for a job well done. He did
express concern that a number of the cases being heard had to be
thrown out of court due to inadequate or incomplete information
from the citing officer. He questioned if something could be
done to correct the situation by better training.

6B - BID AWARD RECOMMENDATION - HVAC RETROFIT - MUNICIPAL POOL,
#AB88-241
Request for bids for HVAC at Municipal Pool to correct heating
and ventilation deficiencies were prepared, advertised,
distributed and received in accordance with accepted call for bld
procedures.
Four (4) firms submitted bids. The firm submitting the lowest
bid was Ray's HVAC. The bid for services is within the adjusted
budget established for the construction portion of this project.
Kathleen McCluskev, City Clerk, stated the request included a
budget adjustment as the second bid was $20,000 above the
original budget and the department is requesting a $28,000 budget
adjustment that includes contingency costs.
Vicki Vanneman, Parks Department, briefly restated the need for
the project. She noted that the funds being allocated will
remain in the community as the low bidder is a local firm.
President Waibel stated that from Council direction the issue of
a budget adjustment would be addressed at a later date and a
motion would be forthcoming to approve the award of contract at
this time.
Mr. Dawkins questioned how long would the actual construction
take after awarding the contract and how many days will the
pool be closed? Ms. Vanneman stated construction is scheduled
for a maximum of 120 days with pool closure to be kept at
approximately 5 1/2 days (over a weekend).
Mr. Colvin questioned for clarification the Councii's position
of approving the contract without designating where the
additional funds would be obtained? President Waibel noted
that part of it may come from the 1989 budget. Mr. Horninq
stated if not noted funding would then be considered as General
Fund monies until City Council becomes more specific.
Mr. Johnson suggested setting a deadline on the review of funding
which could possibly include some unused prior Block Grant funds.
He suggested that this item be heard during the Council Study
Session on November 7. Mr. Overson questioned if considering
Block Grant funding at this time would not con~!ict with what is
planned. He stated the Fiscal and Budget Committee would be
reviewing this item at its meeting on October 25.
Mr. Overson questioned if there were certain guarantees in the
contract that the problem experienced since the pool was built
will be eliminated through this process? Ms. Vanneman stated
yes.

7A - ORDINANCE (FIRST READING) AMENDING THE CITY OF BREMERTON
1988 BUDGET, #AB88-243
Actions taken by the City, together with circumstances not
foreseen at the time of preparation of the budget require
additions and corrections in order that the Budget will continue
to accurately reflect the financial operating plan of the City.
Rich Hanna, City Treasurer, stated that with the exception of the
budget adjustment affecting the Risk Management budget, all the
items have been before Council for approval.
Roy Mclnnis, 2711 Maple Street, questioned the $193,465 in the
General Fund - what did it include? Mr. Hanna stated the
$193,465 is the sum of several actions taken by council which
included: $184,500 approved increasing the budget to provide
conditional sales agreement for the two new rescue vehicles;
increased appropriation of the Communications Department salary
and benefits as well as revenue line - having moved a personnel
position to that department; City Attorney's office - $10,000
increase for additional help, hiring of an attorney on a part
time basis and support annexation program needs. The additional
adjustments did not increase the bottom line of the budget.
Mr. Colvin noted that the current City Attorney had no
involvement in the claim for $52,000 because of a legal
technicality. Ian Sievers, City Attorney, stated there was a
procedural problem that brought it to a conclusion which created
the need for the budget adjustment.

7B - ORDINANCE (FIRST READING) WASTEWATER UTILITY RATE INCREASE,
#AB88-230
The Wastewater Utility, in response to its debt service
requirements and increased operation and maintenance expense, is
requesting an increase in Wastewater Utility rates.
Debt service payments have increased approximately 8 1/4~ over
the past two years. Additionally, the cost of maintenance and
operations has increased approximately 7 1/2~ based on the
Seattle C.P.I index.
The Utility therefore is recommending an increase of 8.25~ in the
capital portion of the rate structure per customer class and an
increase of 7.42~ in the operation and maintenance portion of the
rate structure per customer class.
The raze adjustment will increase the bimonthiy residential
billing by approximately $3.27 based on 1500 cu. ft. consumption.
Bill Duffy, Utilities Director, stated this item had been tabled
three weeks to provide additional information and the City
Attorney, City Treasurer and he were prepared to provide that
requested information.

President Waibel called an Executive Session
topic to be discussed "litigation".
at 6:20 p.m., the
City Council members returned to Council Chambers at 7:00 p.m.
Roy McInnis, 2711 Maple Street, stated he was opposed.. not so
opposed to the rate increase, but to the amount of the
increase. He also noted he would like someone to explain why the
Executive Session was called. President Waibel stated as
previously discussed the City is currently in negotiations with
some water districts as well as discussion on surcharges.
Mr. Johnson questioned if the average consumption was based on
summer or winter rates? Mr. Duffy stated it was calculated on
average water consumption for the winter months. If additional
water is used during the summer months the bill would only be
calculated on the winter usage. Wastewater bills as set up now
are April through October. Mr. Johnson questioned if staff is
working on a new ordinance that better distributes the charges
and rates, reconstructs rate structure for the whole city?
Mr. Duffy stated yes, approximately six months ago Council
approved a professional services contract to take a look at not
only the rate structure but the entire Municipal Codes as they
relate to utilities - to bring it up-to-date, including rates,
surcharges, assessments, operating conditions, public health
requirements, notification, etc. Mr. Johnson questioned when
would the new Ordinance be coming before Council? Mr. Duffy
stated he has a draft which is being refined while working with
other departments and he anticipates it coming to Council in
December of this year.
Mr. Overson expressed concern that the Council not be short
sighted and in any way jeopardize the good management and
maintenance and operation of the wastewater treatment plant.
Mrs. Horton stated she did not like a rate increase~,
however, effort has to be made to not let the treatment plant
deteriorate and experience what had been overcome with the
building of the new plant.
Mr. Collins stated he could not justify the increase due to the
fact that he felt he did not have enough information at this time
to make that judgement.
Mr. Hornina stated if the rates are increased at this time they
would not be raised again at the end of the year. What Mr. Duffy
is referring to is a better explanation of how the rates are
arrived at, how they are put out but would not result in a net
increase to the customers. Rate increases are inevitable, all
things cost more. Increased costs for operation and maintenance
coupled with the fact that the debt service was projected over a
number of years must be funded. And, continued effort to look
for other funding methods will be pursued.
President Waibel questioned the approximately $200,000 increase
in the debt service between now and 199i...the rates being
requested would only fund approximately $170,000..are we looking
at another increase next year, or year after that? Mr. Duffy
explained the proposed rate increase would carry approximately
two years. In that time, as the customer base increases, he
hopes to mitigate that service impact. If we do not get that
customer base or some of the activities currently being worked on
then it could be sooner than two years. Also, they will be
looking into the possibility if the financial market becomes
better there may be the possibility of refinancing at a lower
interest rate.

Mr. Johnson stated he would not support the rate increase at this
time, would not vote in favor of an increase until the new
ordinance is a reality which will restructure the rates
properly, unless surcharges are addressed, and equity in hook-up
charges is addressed.
Mr. Colvin questioned what was the probability of rates being
raised again in December? Mr. Duffy stated most of the ordinance
review will be associated with the assessment of new
connections, delinquent charges, etc. The rate classifications
are designated by Department Of Ecology - currently rates are
based on 400 cu. ft., plus a commodity charge. We will probably
eliminate the 400, reduce the commodity charge and base charge
and make the formula easier to calculate. This has been in
response to the public because they cannot understand their sewer
bills. Mr. Colvin asked what would the impact be if Council
waited two months to take action? Mr. Duffy explained that the
debt service schedule must be met from the revenues received each
month - ( 1/12 of the debt service requirement is set aside each
month). If these funds are postponed basically the percentage of
the amount goes up at a later date.
Mr. Overson stated he supported an increase at this time in order
to keep the percentage down and carrying it out over a longer
term.

7C - RESOLUTION #2230, SETTING DATE FOR PUBLIC HEARING FOR
VACATION OF RIGHT-OF-WAY, MAGNUSON COURT, #AB88-244
On August 21, 1984, the Bremerton Planning Commission recommended
approval of vacation of the Magnuson Court right-of-way. On
October 17, 1984, a motion was passed to approve said right-of-
way vacation. Council is now asked to set a public hearing for
such vacation in anticipation of an ordinance to that effect.
There has been a four year delay in obtaining final ordinance
approval. Additional public hearing is advisable due to the
failure of the applicant to purchase said property according to
conditions approved by Council on October 17, 1984.
Kathleen McCluskey, City Clerk, stated the applicant went through
all the proper approval stages but the applicant was not happy
with the appraised price of the property so he did not move
forward on it. Now, the applicant wants to finalize the
transaction and what will be presented at the hearing is updated
information that has been reviewed by staff.
