Minutes May II, 1988 Page 4 of 8 #1480 6D -- RESOLUTION #2212, WHEATON WAY - PROPOSED SPEED LIMIT CHANGE, #AB88~-090 The Traffic Safety Commission recommends the Speed Limit on Wheaton Way from Sylvan Way to Riddell Road be reduced to 30 mph. The speed limit in this area was set at 35 mph when there were low traffic volumes and little commercial development. Growth of commercial development and traffic volumes have been significant, resulting in the need for this requested change. This change would result in a 30 mph limit from the bridge to the north City limits. In 1973 the average week day traffic south of Riddell Road was 11,300 vehicles per day, in 1987 it was 28,900, in increase of 250%. In 1973 the traffic volumes were 14,700 vehicles per day north of Sylvan Way. In 1987 the count was 31,000, an increase of 211%. Dave Baker, City Engineer, stated that Council had discussed this proposal at their May Study Session. M/S/C/U(Dawkins/Colvin) to approve Resolution #2212, approving a lower speed limit of 30 mph as described in ROW 46.90.279(1) and submit it to the Washington State Department Of Transportation for approval as required by ROW 46.61.415(5) for changing the limits on a State Highway. 7A - PUBLIC HEARING - APPLICATION FOR SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT TO CONSTRUCT A SIDEWALK/CURB/GUTTER/FENCE ON SHORE DRIVE, (FILE SL-2-88) #AB88-124 The City Council, as the Shorelines Hearing Board of the City of Bremerton, is requested to approve a Shoreline Substantial Development Permit for the construction of a sidewalk 280 feet in length, five (5) feet wide with curb, gutter and fence. The proposed project is to be located within Shore Drive right-of-way between lOth and llth Street. Council action is required because the project is located within 200 feet of Port Washington Narrows in the shoreline jurisdiction. President Waibel asked the "Appearance Of Fairness/Conflict Of Interest" question with all Council members being seated. Ed Davis, Manager, Current Planning, Department Of Community Development, stated that approval must be based upon the following: '1) Consistency with the policies and procedures of the State Costal ManaGement Act. '2) Consistency with the Bremerton Shoreline Management Master ProCram (BSMMP). (3) Consistency with the Bremerton Comprehensive Plan and zoning. Mr. Davis stated that the proposal did meet all three criteria. Mr. Davis noted that several options were considered for replacement of the chain link fence with other suitable barriers to keep pedestrians from falling off the sidewalk onto the steep slope to the west of the sidewalk. TAPE #543 City Council Rag. Mtg. Minutes May 11, 1988 Page 5 of 8 The existing pipe railing north of the Manette Bridge on the west side of Wheaton Way was considered in place ~ the chain llnk fence, however, the double pipe railing does not comply with the existing required safety standards. When the railing was put in years ago, the safety requirements were not as strict. Another option was considered by the City Engineer, but when costs were considered, the aesthetic railing would have cost nearly as much as the construction of the curb, gutter and sidewalk as presently proposed. While aesthetically the proposed chain link fence does not compliment the neighborhood, the cost factor of the proposed fence does reflect a judicious use of public monies. The proposed project is in compliance with the City's BSMMP and staff recommends granting the requested application. Mr, Davis provided a slide presentation showing the proposed location and explained the enhancement of the area by the proposed project. Kathleen McCluskey, City Clerk, read a letter into the record from John Tracy, Attorney At Law, Tracy, Oden And McDanial, 2011 East llth Street, in which he supported the concept and recognized the need, however, he suggested that the neighborhood would be better served if the proposed project was more like a boardwalk with the addition of planter boxes, lighting, hangin~ plants, flags, etc. Mr. Tracy noted that local merchants would be willing to help with the cost and upkeep. Mr. Overson and Mrs. Horton expressed concern that the proposed southern end of the sidewalk would end, where the hair pin turn is required for vehicles going to the Boat Shed Restaurant, would present a Safety factor for pedestrians crossing this section of the street. Mr. Davis explained they did not view this as a high traffic area after conducting a review of traffic flow patterns. Mr. Overson stated his preference for the sidewalk ~o be placed on the east side of the street rather than west. Mr. Davis noted that currently the area on the east side of the street is being used for parking for businesses. Mr. Overson requested comment on Mr. Tracy's proposal. Dave Baker, City Engineer briefly explained the reason this proposal is being presented, noting that the residents from the apartment building desired to have a safe walking area to the shopping area at the east end of the Manette Bridge. The Engineering Department looked at both sides of the street to determine the best placement for the sidewalk and the Mayor supported keeping the parking on the east side of the street due to the businesses located there. Mr. Baker noted that vehicles making a hair pin turn to go to the Boat Shed Restaurant are making an illegal turn. Mr. Baker noted that residents from the apartment buildings had to cross the street at that point whether they use an upper street or walk along Shore Drive and the slope of the proposed sidewalk would be within safety guidelines. In response to the boardwalk proposal, Mr. Baker noted that a rough estimate for a boardwalk type project could be as much as $45,000 whereas the proposed project is estimated at $9,000.00; and Mr. Baker stated he had no objection to working with the local merchants in the area on a joint effort. TAPE #543 City Council Reg. Mtg. Minutes May 11, 1988 Page 6 of 8 Mr. Johnson pointed out that if the street is widened it would allow for parkinG on either side and felt that the sidewalk would be better located on the east side of the street. Mr. Baker stated that the street is not being widened, the proposal is to improve a small strip of land on the west side, turning it into sidewalk rather than Gravel and sand; and acknowledged that it could be used either as sidewalk area or parkinG. Mr. Overson questioned if the funds could be used for widening the road instead of for a sidewalk. Mr. Baker stated the funds were specifically for a sidewalk - not to widen the road. Mr. Collins questioned why the sidewalk has to be built on Shore Drive, suggestinG that it run up lOth and down Pitt. Mr. Baker stated had they recognized this would be a ShoreLine Permit application they may have suggested that idea. Mrs. Horton questioned if the funds would be available if the sidewalk were re-routed? Mr. Baker stated he was not sure and would have to check into the matter. Mr. Hornin~ expressed concern that the City may be missing an opportunity to make a statement within the Manetie community and supported the location of the sidewalk but would like to see more done. He did not think it would cost $35,000 additional funds to expand the project to include some of the suggestions made in Mr. Tracy's letter. Mr. Hornin~ questioned if Council could approve the Shoreline Permit at this point but not spend the money until a final design is developed. Mr. Baker stated as far as he knew yes...the Engineering Department would like to make something worthwhile of this project. President Waibel did not support the proposal for a chain link fence, noting that the area is visible from many parts of the City and that it would not be an enhancement to the shoreline. Mr. Davis stated for clarification that if Council approved the shoreline Permit at this time and changed more than 10% of the proposed project design it would have to come back for another Shoreline Permit. If Council approved the Shoreline Permit with a boardwalk design qoncept and aesthetically designed railing it would not have to come back for another Shoreline Permit. Mr. Hornin~ questioned if postponing a decision for an additional two weeks would hurt the project. Mr. Baker indicated it would not. #3200 ~PE #544 Mr. Dawkins stressed that Council should let the residents know that they are in support of a sidewalk in that area for the benefit of the people in the apartment buildings and are looking to further ideas for enhancement. Mr. Hornin~ again emphasized the importance of working with the local businesses on a 3oint effort. Mr. Davis pointed out that a letter from the Boat Shed Restaurant owner, included in the Council packet, also indicated he wished to participate in enhancing the area. M/S/C/U(Horning/Collins) to continue this item until June 8. 7B - PUBLIC HEARING - APPLICATION FOR SHORELINE SL~STA}]TIAL DEVELOPMENT PERMIT FOR DEVELOPMENT OF A BULFJ~D AT 924 SHOREWOOD DRIVE (FILE ~SL-1-88), #AB88-1125 TAPE #544 City Council Rag. Mtg. Minutes May ~ ~9~° Page ? of 8 The City Council, as the Shorelines Hearing Board of City of Bremerton, is requested to approve a Shoreline Substantial Development Permit for the construction of a rock bulkhead 160 feet in length and with a height of five (5) feet on the southwest shore of Oyster Bay at 924 Shorewood Drive, at the site known as Bayshore West Condominlums. President Waibel asked the "Appearance Of Fairness/Conflict Of Interest question with all Council members being seated. Ed Davis, Manager Current Planning, Department of Community Development, presented a conceptual drawing showing the location of the proposed bulkhead, noting the slope of the property and the receding shoreline and continued erosion problems if something is not done to hold the bank. Mr. Davis noted that the three criteria required for approval of a Shoreline Permit have been met, i.e., (1) consistent with policies and procedures of the State Coastal Management Act; (2) consistent with the Bremerton Shoreline Management Master Program (BSMMP); (3) consistent with the Bremerton Comprehensive Plan and zoning. Staff recommends approval of the application. Mr. Dawkins questioned the use of a rock wall rather than a permanent concrete structure which would hold back the wave action and further erosion. Mr. Davis pointed out that staff have made two recommendations relating to this: (I) the applicant/developer shall submit an engineered drawing to the Wastewater Utility of the City of Bremerton showing locations and depths of sewers, including a cross-section detail of the proposed bulkhead crossing the existing sewer line. The required drawing shall be submitted and approved for construction prior to any construction activity on site. Construction equipment, including bulk storage of rocks, shall not be placed directly on top of the existing sewer mains; (2) all sewer line locations shall be field-located by the appropriate City staff prior to construction, to assist the applicant/developer to comply with Condition 1. Mr. Johnson questioned if something happened to the Oyster Bay sewer line during construction is it possible to place the liability with the developer? Ian Slavers, City Attorney, stated the City could require a Bond be posted. Also Mr. Sievers stated that the City should follow up to make sure that the pro3ect is completed. Dave Baker, City Engineer, stated for clarification that the pressure sewer line is not on the same side as the proposed pro3ect. There is a gravity sewer line running along the shoreline which services the residences in the area. President Waibel questioned a reasonable amount of bonding to cover a potential liability? Mr. Baker stated the Director of Community Development recommended the amount be left to the City Attorney and Mr. Baker along with the developer. #0363 M/S/C/U(Dawkins/Colvin) to approve the Shoreline Substantial Development Permit for the development of a rock bulkhead 180 feet in length with a height of five (5) feet at 924 Shorewood Drive, with two conditions: (1) The applicant/developer shall submit an engineered drawing to the wastewater utility of the City of Bremerton showing locations and depths of sewers, including a cross- section detail of the proposed bulkhead crossing the existing sewer line. (2) All sewer line locations shall be field-located by the appropriate City staff prior to construction, to assist the applicant/developer to comply with Condition No. (3) That negotiations be handled through Mr. Slavers office in case any additional funding or bonding is determined necessary. President Waibel thanked the television crew for their attendance, noting that he has had a number of people comment on their being pleased with the visual affect of the City Council meetings.
