COUNCIL MEMBER REPORTS PUBLIC RECOGNITION Mrs. Horton reported she had been in contact with key players involved with the tentative purchase of the Admiral Theatre. There is a group of individuals who are working to get a corporation formed with non-profit status in order to carry out some restoration of the Admiral Theatre. The City Council wants that group to know their efforts are supported. Mrs. Horton noted the group is working on a business plan for the theatre and this issue will be heard in the Council committees within the next two weeks. Mr. Dawkins reported he artended a meeting in Olympia on Tuesday, November 14, where he represented the Ferry Riders Coalition and met with Legislative leaders and Governor's staff on Transportation for an informal type meeting. At that time, the Governor's staff presented the proposal for additional funding for transportation needs. Most of the Legislators seemed receptive but Mr. Dawkins was not sure what the total support might be but there was some indication that the Transportation budget issue might be taken care of prior to having to call a Special Session. Mr. Dawkins noted it would be nice for Bremerton to get the passenger only ferry service back as well as some improvements to existing service. Mr. Overson reported the Fiscal and Budget Committee, with the Council as a whole, are still meeting and working on the 1990 budget and will continue through November 20. And, the Executive Session scheduled for this date has been cancelled. 6A - BUDGET ADJUSTMENT FOR BUILDING DEPARTMENT ABATEMENT FUND, AB89-321 #0318 #0376 TAPE #693 City Council Reg. Mtg. Minutes November 15, 1989 Page 2 of 5 Even though the Building Department has had a high degree of success with voluntary abatement of dangerous buildings, there are a few structures the City must abate. The cost of removal of these structures is approximately $50,000. There is currently about $4,500 in that fund. A budget adjustment is necessary if the City is to abate these structures and remove dangerous rundown buildings from our neighborhoods. Dick Mumma, Building Official, stated what is being requested is to supplement funds so that the City can remove some of the structures which the City has had no success with through voluntary compliance from the homeowners. He has targeted four structures for removal by City funds and part of those structures will quality for matching funds identified through granting of Block Grant funds. One structure will be demolished before the end of 1989 and the other three will be demolished at the beginning of 1990 so that they do fall within the 1990 calendar year and qualify for matching Block Grant funds. The structure that will be demolished this year is located at 903 Pleasant Avenue and the work will be done by an outside contracture due to the City Engineering Department not having the equipment or expertise to remove a structure of that size. There will be some funds remaining, if the Budget Adjustment is approvedr and those funds will remain for emergency abatements and other functions that qualify under that line item...abatement of cars, title searches, etc. Rich Manna, City Treasurer, stated it is proposed that the $50,000 be transferred from the Cumulative Reserve Fund into the Building Department in order to supplement the abatement process. And, he anticipates having cash at the end of the current fiscal year of approximately $300,000, thereforer adequate monies are available to carry out this activity. Vice President Overson noted Fiscal and Budget Committee had reviewed this item and recommends approval. M/S/C/U(Collins/Horton) to approve the budget adjustment providing funds for removal of dangerous buildings from the City of Bremerton. 7A - ORDINANCE (FIRST READING) PUGET POWER FRANCHISE, AB89-322 The proposed franchise is the culmination of many months of discussion with Puget Power staff, City staff and Attorneys. We also reviewed franchise agreements from several other cities. In accordance with City Charter requirements, this ordinance was published one a week for two weeks prior to this hearing and 15 days must elapse between readings. Kathleen McCluskev, City Clerk, stated this issue was reviewed in detail by the City Council at their November 13th Study Session. Public comment invited - none received. M/S/C/U(Horton/Crutcher) to approve Ordinance, on first reading, granting Puget Sound Power & Light Company, a Washington corporation, its successors and its assigns, the right, privilege, authority and franchise to set, erect, construct, support, attach, connect, and stretch Facilities betweenr maintain, repair, replace, enlarge, operate, and use Facilities in, upon, over, under, along, across and through the Franchise area for purposes of transmission, distribution and sale of energy for power, heat, light and any other purpose for which energy can be used; and to charge and collect tolls, rates and compensations for such energy and such uses. PUBLIC RECOGNITION Ed Rollman, 626 Highland, thanked Councilman Marty Crutcher, who #0572 TAPE #693 City Council Reg. Mtg. Minutes November 15, 1989 Page 3 of 5 will be retiring from the Council soon, for always being available to his constituency and helping to resolve problems and concerns. He noted Mr. Crutcher is a true friend to the City's poor, elderly, youth, a man of great conscious and great compassion and solid common sense, someone who tries to heal rather than divided. And, he has never opposed progress in the City, he has instead championed the causes of the little guy, causes of rebirth and rejuvenation of downtown. Mr. Rollman wished other elected officials would heed Mr. Crutcher's calls for reform, lower bond rates, return the Police Patrol back where they belong in the downtown area, continue waging a war against drug dealing, etc. Mr. Rollman noted no investor and no common citizen in their right mind would want to go downtown and take a walk at night the way it is now. He urged the Council to listen to the common sense people like Marry Crutcher and Lon Overson and give the City back to the people. He urged the Council to put aside their differences of the past few weeks and work together to rebuild the downtown area. 7B - ORDINANCE (FIRST READING) CORRECTING THE ZONING OF A SINGLE PARCEL AT NORTHLAKE WAY FROM SF-3 TO MF, (MAUPIN ZONING REVIEW), AB89-323 The Maupin Zoning Review has been processed through the Zoning Review Committee and City council, in accordance with the "Correction Of Errors" process. On November 1, 1989, the City Council agreed with the Review Committee that an error had occurred in the zoning of the Maupin property and the Council passed a motion to correct the zoning from its present "Single-family Residential (SF-3" designation to "Multiple-family (MF)" This ordinance will correct the Zoning Map accordingly. Ron HouGh, Planning Manager, stated it was decided by the City Council that the most appropriate zoning for this property is Multiple Family and the applicant understands that the Multiple Family zone does not give him full zoning protection for his 8- units but he also understands he has the option coming back with a rezone application for a different zone, if desired. Public comment invited - none received. M/S/C/U(Horton/Collins) to approve Ordinance, on first reading, amending the official Zoning Map of the City of Bremerton to correct a zoning error on a single parcel fronting on Northlake Way, north of Kitsap Lake (Maupin Zoning Review). 7C - ORDINANCE #4250 (SECOND READING) AMENDING REGULATIONS FOR THE DEPOSIT AND REMOVAL OF REFUSE, AND AMENDING BREMERTON MUNICIPAL CODE CHAPTER 6.04 (GARBAGE AND REFUSE) AND REPEALING CHAPTER 6.20 (SANITATION), AB89-316 Elizabeth Buell, 1722 High Avenue, expressed concern that the "three day notice" would create a hardship for senior citizens and suggested extending the time to at least 10 days or one week Ian Sievers explained what is being referred to is under Section 6.04,062 (Section 3). Vice President Overson pointed out the 72 hours is the minimum time and the ordinance is directed towards sanitation and 72 hours would be important in getting a health hazard removed to protect the citizens. Mrs. Buell questioned what was the definition of sanitation? Mr. Sievers stated it would be an unhealthful condition caused by accumulation of refuse on property which would endanger the property owner or neighbors if it remained there. That is why the City requires proper disposal of refuse in containers and not allowed to accumulate. And, even though it states 72 hours it is not specific as to when the time states, i.e., at time of mailing or in person delivery and since it is not stated it is presumed that the 72 hours would commence after delivery of the notice. Mrs. Horton emphasized that Mr. Mumma, Building Official, is very #0754 #0796 TAPE #693 City Council Reg. Mtg. Minutes November 15, 1989 Page 4 of 5 good at his job and if there are extenuating circumstances she was sure he would not invoke the 72 hour limit. She noted Mr.Mumma works with the property owners or occupants to try to clear up the problem and if in fact they show good faith he allows more time for resolution of the problem. M/S/C/U(Crutcher/Dawkins) to pass Ordinance #4250, on second reading, amending regulations for the deposit and removal of refuse, and amending Bremerton Municipal Code Chapter 6.04 and repealing Chapter 6.20. 7D - ORDINANCE #4251 (SECOND READING) FOR APPLICATION FOR ZONING ORDINANCE TEXT AMENDMENT FROM (PUD) PLANNED UNIT DEVELOPMENT TO (A) ALLOWED PRINCIPLE USEUNDER (GB) GENERAL BUSINESS IN LAND USE TABLE NO. 5, APPLICANT: GARY SCHERFENBERG, AB89-318 Public comment invited - none received. M/S/C/U(Dawkins/Crutcher) to pass Ordinance #4251, on second reading, pertaining to the sale of cars, trucks, motorcycles and R.V.'s (new and used) which amends Ordinance #4172 (Bremerton Zoning Ordinance) by changing the permitted use as a P.U.D. to an allowed principle use in GB zones. 7E - RESOLUTION #2279, GEHRING/MILO SUBDIVISION (3 LOT PLAT) LOCATION: WEST SIDE OF MAPLE AVENUE, 125 FEET NORTH OF IVY ROAD, APPLICANT: DEAN GEHRING, AB89-324 The City Council approved the Preliminary Plat of Gehring's Addition, a three lot subdivision, on May 13, 1987. Exhibit #1 reviews the final plat approval process and the final plat's compliance with the conditions imposed upon the preliminary plat. Jack Allingham, Current Planning Division, provided a view graph showing the location of the subject property. He noted that even though it is only a three lot subdivision it has been required to under go the full preliminary and final plat review because it was originally a part of a 4-lot short plat which was given Administrative approval in 1985. The City's Short Plat Ordinance basically states if a short plat is platted and replatted within 5 years the additional platting has to under go final plat review. The preliminary plat was approved with two conditions, one being that a Surface Water Management Plan be designed and approved by the City Engineer and be implemented. That plan is completed and part of the supporting documentation and a letter of credit has been secured by the City to secure the implementation of the plan. Mr. Allingham noted it is his understanding that the developer will be constructing on the three proposed lots and the construction of the Surface Water Management Plan will be done in phases. Essentially the second condition was that the plat receive final plat review within three years from the date of approval and this application meets that three year time frame. The Planning staff recommends that this Final Plat be approved by Resolution as submitted. Allan Todd, Pazooki & McMeanamin, stated he represents the property owners and thanked the staff for their assistance towards making this a workable proposal. He noted he would be available to answer any questions Council may have regarding this issue. Public comment invited - none received. Mr. Dawkins stated it was nice to see someone going ahead with development in the City and a move in the right direction. Mr. Collins added to Mr. Dawkins comments that he sees it as #0966 #1187 TAPE #693 City Council Reg. Mtg. Minutes November 15, 1989 Page 5 of 5 something even more in that the way this proposal was originally presented it was not acceptable; and, the applicant and Planning Department staff got together and worked out some intricate details, along with the Engineering Department, that made it a workable project. And, he feels it is a very forward step for both parties - the applicant and the City. M/S/C/U(Dawkins/Collins) to approve Resolution #2279, accepting final plat of Gehring/Milo. 7F - RESOLUTION #2280, OPPOSING BURN BAN, #AB89-325 Mrs. Horton stated she sits on the Puget Sound Air Quality Control Board and on Thursday, November 16, they will be discussing enlarging the jurisdiction area of the Bremerton Burn Ban and what that essentially says is that burning of yard waste will not be allowed in certain areas of incorporated Bremerton and Kitsap County. One of the problems with this proposal is that boundaries are very irregular and would be difficult to enforce; secondly, there is no money for enforcement so it would fall directly on the City's Fire Department and right now we have difficulty enforcing when there is a burn ban due to air inversion problems and any furthering a ban on burning yard waste becomes very difficult to enforce. Also, while areas of King County have curbside recycling and composting for yard waste, Kitsap County and Bremerton do not have that program in place yet. Efforts have been put forth to extend the life of our landfill, we are very concerned about getting recycling underway per Washington State mandate and by approving any further restriction on burning of yard waste and having them go directly to our landfill is counter productive to our Solid Waste Management program at this time. Therefore, that is the reason Council is being requested to approve the Resolution to oppose the enlargement of the burning ban jurisdiction. Elizabeth Buell, 1722 High Avenue, stated she was not opposed to the proposed Resolution but questioned if branches could be burned if caterpillars were on them? Mr. Dawkins noted that the caterpillars are to be scraped off the branch and then burned. Mrs. Horton noted that right now if a permit is obtained from the Fire Department citizens can burn yard waste on their property. Mr. Dawkins noted he sat on the same board for five years and Seattle does have a problem, particularly south Seattle. However, Bremerton does not experience the same kind of air inversion problems. M/S/C/U(Crutcher/Horton) to pass Ordinance #2280, opposing ban on burning yard waste in the Bremerton Burn Ban Area. With no further business the meeting was adjourned at 6:10 p.m. APPR~D ' Cty of Brem~4 co: KATHLEEN L. MCCLUSKEY, CITY CLERK ~, C il President Normal Distribution File/Vault
