COUNCIL MEMBER REPORTS Mr. Johnson noted Spring is here and hydroplanes have returned to Kitsap Lake. He emphasized the fact there is a new ordinance in effect on Kitsap Lake, it will be enforced; and the Parks and Recreation Department will be implementing public education on the new ordinance. Mr. Johnson was contacted by AWC regarding the Solid Waste and Recycling Bill currently before the Legislature. He noted several concerns over this bill: what is the definition of management of solid waste by an urban area? When done by an urban area this does not necessarily mean a county or a city - some kind of government entity will act as manager. An amendment was being proposed to define an urban area by density and population, which would have provided zero flexibility for communities to deviate from to meet their local area. He did reach some legislators and encouraged them to vote for the bill as it came out of Committee. Secondly, franchise for garage collection - there would be some type of recycling and if there was already a contracted or franchised garbage collector the current carrier would have to be used for recycling for the next five years. Mr. Johnson noted this crosses the franchise end dates, may or may not be smart to do recycling with the same person who is doing garbage collection. Mr. johnson TAPE #627 City Council Reg. Mtg. Minutes April 12, 1989 Page 2 of 8 announced Council Intern Todd Corelli will be returning to work for the Council May 1. In reference to two Animal Control Ordinances - Mr. Johnson noted when the current Animal Control Ordinance was written it was developed by staff and a citizen committee and he desires to bring back together that committee to review the current ordinance and the proposed ordinances. On Tuesday, April 18, the collective Legislative bodies of Kitsap County (City Council members) will attend a dinner meeting to get better acquainted and discuss common issues. Also, the City of Vancouver will be joining the network of computer active Bulletin Boards. Lastly, Mr. Johnson stated a concern of Flagship's role in City government - he assured the public that no matter who else agrees on a proposal or issue, any and all organizations and individuals may come before the City Council. Mr. Colvin reported Spring Clean Up - April 15th through 23rd and introduced Stan Williams Coach of the Lions sponsored Softball team. Stan Williams briefly reviewed building pride in oneself and community by working together and he noted the Lions Team will be cleaning up Lions Field Monday, April 17 and Friday, April 21. Currently the Bremerton Central Lions Club is setting up a flea market for Saturday, April 15, at the Fairgrounds and Mr. Williams invited everyone to take part in this great event. Mr. Dawkins stated new ferry financing has brought about a lot of confusion, the State is in danger of loosing enough money to get the new passenger ferry. He suggested if anyone has comments they would like to make to their legislators regarding ferries to be sure and contact them via the Hotline. Mr. Dawkins announced Oceanfest will take place Friday evening, Saturday and Sunday at the Kitsap Pavilion. Mr. Overson reported Fiscal and Budget Committee had met with a budget adjustment request to come to Council soon. The 1990 budget presentation is already being looked at. He noted the budget process timing will be constricted so preplanning will need to be done to do it correctly. Mr. Overson noted Council needs to finalize plans for the annual Council Retreat. Mr. Overson and Mrs. Horton met with a member of the group doing the Fire Department Audit and based on that discussion he felt Council will get an excellent study that will be meaningful and useful. Mr. Crutcher reported on interest shown by the Tacoma Police Reserves to assist the City of Bremerton in patrol of Kitsap Lake during the summer. Mr. Crutcher stated he appreciated all the calls and support he has received regarding his position on the proposed Parking Plan. Mrs. Horton reported the Operations Committee met this date at which time members of the Electronics Department demonstrated a computerized traffic lighting controller which will be going on line relatively shortly. One stretch will be on Kitsap Way down to llth and High, another along Wheaton Way to Riddell and additional phase-in for the downtown business core. Mrs. Horton announced that Christa Little will be leaving the City's employment this Friday and she noted the Council and staff appreciation for her work while she was here. Mr. Waibel announced a number of citizens had called him on the burning ban and Kitsap County being part of the King/Pierce/Snohomish County Region and he is looking into what test were used and how Kitsap compares to those other counties and why we were included in " ' " n we are not the City's plan, which is not yet finalized, out-of-date. Mr. Waibel pointed out the merits of a newspaper insert developed by TAPE #627 City Council Reg. Mtg. Minutes April 12, 1989 Page 3 of 8 all of the newspapers in Pierce County (20 pages) which is an overview of the problems and possible solutions to recycling. He encouraged the local media to get together and do something of this type. Mr. Horninq stated he spent an eventful week. On Wednesday afternoon he spent a couple of hours with the Westpark Resident Council and he noted they were a delightful group and had several suggestions for him to bring back to the Council. PUBLIC RECOGNITION Louis Mentor, Marine Drive, announced the street clean up effort will be April 22 AM, followed by a lunch event at Sheridan Park Recreation Center at 12:30 p.m.. A garbage dumpster will be available at the center for deposit of litter collected. Mr. Mentor also mentioned that some of the empty stores are putting up community interest displays and posters to brighten up our downtown area. Clyde Strickland, President of Bremerton/Kitsap County Visitor & Convention Bureau, requested the City Council to authorize a grant application to the EDA for a project to continue the City's waterfront walkway/pier project from 2nd Street to 4th Street. The idea of the application would be to use the First to Second Street pier application which will be funded through Block Grant to leverage additional money through EDA to build the rest of it and to provide the access to the hopefully acquired historical ship to be put on the waterfront. The total project would involve the City's match, using Block Grant funds, of $164,000, the EDA Pier from Second Street down to 4th Street costing $247,000, with the possibility of the Port of Bremerton contributing an additional $90,000 and the possibility of $100,000 for parking acquisition for a total project of $501,000. #0987 M/S/C/U(Waibel/Collins) application for the grant well as the pier. that for the City Council approves the 2nd to 4th Street section as 6A - COMMUNITY SERVICES BUDGET ADJUSTMENT, #AB89-091 The U. S. HUD has determined that the Roosevelt Field Restroom project was ineligible for Block Grant Funding. To correct the problem, local monies will be substituted for federal monies on the Roosevelt Field project and the federal monies will be substituted for local monies on the Swimming Pool project, which is Block Grant eligible. Rich Hanna, City Treasurer, stated both of the projec~ are complete in terms of funding - what is being done is to change the budgeting and accounting records to address the problem identified by HUD in their last audit. This action will not have a net impact on either of the funds. Mr. Johnson stated he did not understand HUD's decision that this project was not eligible due to it being an enhancement to an urban area park. Don Pratt, Director of Community Development, stated he would still like to contest the HUD determination but did admit there was some record keeping and some review that was not up to the standards the City is getting today when this project was proposed two years ago. He noted resolution of the problem was easier than contesting HUD. Mr. Overson stated Fiscal and Budget Committee discussed this situation and an observation made by the Committee was - this logically represents a message to the City and other communities that HUD is watching actions taken, reviewing records to demonstrate usage of funds as stipulated. TAPE #627 City Council Reg. Mtg. Minutes April 12, 1989 Page 4 of 8 #1192 #1306 #1355 #1432 Mrs. Horton suggested sending a letter to HUD explaining the City's position on this denial. Mr. Pratt stated the City has disagreed formally through letters under the Mayor's signature as well as numerous discussions and it was determined that nothing would be gained to pursue the issue further. M/S/C/U(Crutcher/Dawkins) to approve budget adjustment. 6B - AN AGREEMENT FOR CONCESSION AT ROOSEVELT FIELD, #AB89-092 The Bremerton parks and Recreation Department has arranged for a concession agreement with P&L Concessions at the Roosevelt Field site. The concession will be beneficial to the recreationalists involved in the seasonal softball league, and tournament play. The City will receive 104 up to $10,000 gross sales and 154 in excess of $10,000 gross sales. Mr. Dawkins questioned amount of sales for previous years and what is me length of the concession season? Arvilla Ohlde, Parks Director, stated she did not have any record or history for the Roosevelt field site. Previously the grandstands were used and it was hard to correlate what was made under those circumstances. M/S/C/U(Crutcher/Horton) to authorize Mayor Lobe to sign Concession Agreement To P&L Concessions. 6C - PROFESSIONAL SERVICE AGREEMENT WITH PENINSULA UMPIRES ASSOCIATION, #AB89-093 Prior to 1989 the administration and management of the community softball program was the responsibility of the Bremerton Softball Association. The B.S.A. dissolved in the fall of 1988 and transferred all existing funds and equipment to the Bremerton Parks and Recreation Department. The Bremerton Parks and Recreation Department now has assumed sole responsibility for provision of the softball program in the Bremerton community. As a result the Department needs to enter into a Professional Services Agreement with Peninsula Umpires' Association to provide umpiring for slowpitch and fastpitch league and tournament play. Peninsula Umpires Association is the sole source of this service in our area. M/S/C/U(Johnson/Colvin) to approve Professional Agreement with Peninsula Umpires Association. Mtg. Minutes April 12, 1989 Page 6 of 8 new Zoning Ordinance and Map. The Zoning Review Committee reviewed the Ross properties on Nov. 29, 1988 and made its recommendation to the City Council. The City Council conducted a public hearing on March 22, 1989, determined that an error had been made, and decided that the Ross properties should be zoned General Business (GB) and not Single-Family (SF-3). The accompanying ordinance will complete that change on the Zoning Map. (Ross Zoning Review) 7H - ORDINANCE #4198 (SECOND READING) AMENDING ORD. #4008 SETTING THE SALARY OF THE MAYOR, #AB89-076 During the 1989 budget hearings, Council expressed a desire to adjust the rate of compensation for the Mayor. The current salary level was set in January 1986. The proposed Ordinance provides for a 104 adjustment effective January 1, 1989; an annual rate of change of 3.34 since the last adjustment. M/S/C/U(Waibel/Horton) reading, setting the Mayor's Ordinance #4008. to pass rate of Ordinance #4198, on second compensation and repealing 7I - ORDINANCE #4199 (SECOND READING) RIGHT-OF-WAY VACATION, KITSAP WAY SOUTH SIDE BETWEEN FOREST AND PERSHING AVE., APPLICANT: JAMES E. SKIRVING On August 10, 1988, the City Council approved the application for the Vacation of a portion of Kitsap Way located on the south side between Forest and Pershing Avenues (4200 block). As a condition of approval, the applicant has compensated the City for the Vacation in the sum of $20,500. The applicant is now requesting the City Council to pass an ordinance to finalize the requested Vacation. Ian Sievers, City Attorney, recommended a change to the ordinance as noted: Condition #3 under Section 2 and Section 3 - both of those to be omitted from the Ordinance. Condition #3 talks about landscaping a 10 ft. strip along Mr. Skirving's parcel...the problem with the condition leaves the Planning Director without much guidance on how to approve the landscaping. Mr. Sievers felt uneasy conditioning a property transaction on some unbridled discretion that will happen in the future. It also mentions a final building inspection but does not mention what type of building...this could be a remodel or new building. The reason this section does not need to be included, but still meet council's intent, is that when first addressed to the Planning Commission and City Council it was prior to having the new Zoning text in place which details landscaping requirements. And, for a non-residential property on an arterial there is now a requirement to put in 10 feet of landscaping along the entire property front whether it is a new building or a substantial remodel and it also details what that landscaping will be, including spacing of trees, percentage of the non-vegetative ground cover. Now the applicant is so much more aware of what is required and the applicant has waived Section #3, which requires that the City reimburse him for any landscaping. Mr. Sievers stated he also did not like Section #3 because it would be difficult to administer and also that in this one instance the City would be paying back a developer for landscaping which other developers are required to put in at their own expense...that seemed to be unconnected to vacation of right--way. If the Section remains in the ordinance, the applicant could require reimbursement for whatever he proposes which could essentially #2188 TAPE #627 City Council Reg. Mtg. Minutes April 12, 1989 Page 7 of 8 soak up the entire Vacation. of payment he would make to the City for the Mr. Waibel stated for clarification that these sections were not included in first reading of the ordinance. Mr. Sievers stated it was appropriate for second reading because there was no substantial change. Mr. Johnson questioned for clarification, no matter what type of landscaping/sidewalk requirements will be required under the new Zoning Ordinance? Mr. Houah stated the sidewalk is already in place and at present there is no plan for development on this particular site, however, if one came in landscaping would be limited to the area of the development not the full frontage of the property. Mr. Collins questioned .... without a definite need why is the land being vacated? President Morning explained the applicant requested the Vacation and it is also part of the highway that has been completed with the City taking what was needed and with the intent to get the remainder back on the tax rolls. Mr. Houah stated for clarification the original proposal was for a car wash and the applicant needed some additional room. Now, that portion has been identified as surplus for the City. Elizabeth Buell, 1722 High Avenue, questioned if the car wash is not going in why should the City do anything and leave it like it is? Mr. Sievers stated if the property is not needed for circulation then it is desirable to get back on the tax roll, relieve the City of maintenance and liability in that area, the applicant could remove trashy vehicles parked in front of some businesses he has responsibility for promoting .... if left as right-of-way anyone could park and create a visual nuisance, plus the City will receive $20,000.00. Mr. Overson stated for clarification - the $20,000 will be placed in Cumulative Reserve General 103 and will be held there until a specific project is approved by Council. M/S/C/U(Waibel/Horton) to pass Ordinance #4199, on second reading, to vacate portion of that street known as Kitsap Way located on the southern side between Forrest Avenue and Pershing Avenue. Horton Hackler, 1602 Naval Avenue, Chairman of the Seabrim Condominium Association and Manager, stated after 10 years of this condominium being in operation they are finding they are having some parking difficulties with the City. He provided Council with pictures showing parking problems ...on the west side of Naval Avenue south of 19th street. Presently the only thing on that side is a bus stop and people in the condominium with second vehicles have been parking along that strip. He stated he had no quarrel with vehicles being ticketed for parking the wrong way, etc., but he saw no reason why the people could not park on the strip without being ticketed. As noted in the pictures, from the bus stop north there is a 170 ft. strip and at the north end it is over 6 ft. in width and remainder 10 ft. width. From the bus stop south it is 280 ft., with an average of 10 ft. width. A year or so ago a sign was installed, that is 50 ft., north of the bus stop, saying "NO PARKING THIS SIDE". Mr. Hackler feels the citizens should have the right to use the parking strip and has talked to Mrs. Horton as well as a member of the Engineering Department staff and both agreed to look into the matter. He noted his tenants are being ticketed weekly and requested the Council to give some consideration to allow parking on this area. TAPE #627 City Council Reg. Mtg.
