COUNCIL MEMBER REPORTS Mr. Estes reported the Police chief's secretary is a super salesman and anyone stopping by the Chief's office should be prepared to purchase a D.AoR.E. tee shirt ($5.00). He encouraged everyone to get behind the D.A.R.E. program. And, recently he saw a tee shirt that read: "tough guys wear black tee shirts", and noted the City wants to be tough on drugs so support this program by wearing a "black" D.A.R.E. tee shirt. Mr. Waibel noted he will be making a summary report on the Bremerton Float activities for 1990 at next weeks City Council meeting. Mr. Johnson announced the Bremerton Solid Waste Committee would be meeting, August 16, where they will be hearing from Department Of Ecology representative, Peter Christianson. This Committee has scheduled a tour of the Kitsap County Landfill - August 23, 5:00 PM. Also, he reported KitSaD Countv has set UD tWO locations for TAPE #757 City Council Reg. Mtg. Minutes August 15, 1990 Page 2 of 6 the Hazard Waste Clean Up - September 20-21-22 at the Kitsap County Fairgrounds and September 25-26 at the Port Orchard Armory. He noted next year there will be a location for drop off of hazardous materials in Bremerton. Mr. Colvin stated he believes the Parking Advisory Parking Committee has done a good job, however, he felt there are areas in the new parking regulations that are not appropriate and actually detrimental to the citizens. He has received a number of calls from concerned citizens, some who are not able to physically attend City Council meetings and who wish to convey their concerns through Council representation. One of those citizens, Mr. Washington, Montgomery Street, has contacted the Council's Legislative Assistant and provided a statement of concern related to the newly instituted 2-hour - 24-hour enforcement parking in his neighborhood. Also, Mr. Colvin reported there was some discrepancy in the information listed in the Parking map and what is actually marked on the street. President Horton stated there is room for improvement in practically any plan in any situation. When the plan was developed it was stated clearly that there will be adjustments made when identified problems arise. Mr. Dawkins reported last Friday, August 10, the Mayor, Councilman Colvin and he attended an FHA briefing on FHA programs - federal level - on housing, rehabilitation, etc. He noted City staff is very knowledgeable of these programs and there are some programs that are used more on the east coast, which can be applied to housing needs in our area. Mrs. Horton reported on a situation in her District the past three week pertaining to repaving of 13th Street from Broadway to High Street. The Street Department had closed this area to all through traffic, however, people are using this route and are traveling at high speeds, which makes a very bad situation with heavy dust kicked up from the graveled roadway. She requested people who use this route on a regular basis to please take an alternate route until the street has been repaved. She also noted a number of road blocks have been knocked down by vehicles and requested if anyone observes this action continuing to please take the license number and call the City with that information. She hoped people would show a little consideration of the residents in that area. PUBLIC RECOGNITION Lorraine Sarver, Fair & Rodeo Court Advisor, introduced the 1990 Fair and Rodeo Court: Princess Debby Wells, Princess Shannon Evenson and Queen Tina Hillstrom and Miss Katy Kitsap - Stephany Trudeau. The members of the Court announced up coming events and extended an invitation to everyone to attend the 1990 Fair and Rodeo. TAPE #757 City Council Reg. Mtg. Minutes August 15, 1990 Page 3 of 6 Roy Mclnnis, 2711 Maple Street, stated he was saddened to have to come before the City Council and stated many people in the Black community believes there is discrimination actions and disrespect exhibited by some of Bremerton Police officers against black citizens. He was not speaking from hearsay but related an personal experience he had with a Police officer this past week. He felt the language used by the officer was offensive, i.e., illegal threats ..."I'll give you a ticket or I'll take your piece of equipment", addressing Mr. McInnis's son as a "punk" and describing the five people involved as "Mr. McInnis's gang". Mr. McInnis stated his "gang" was a little different from the terrorist type gangs, his "gang" was made up of members of the Sinclair Missionary Baptist Church. Usually on Sunday afternoons he has a number of church members gather at his residence and they often consist of his children, his grandchildren and his church family children. He wished that there were many others throughout the community that could be that type of a "gang". He questioned the procedure used by the officer in his not seeking out the responsible person at the residence rather than getting into a confrontation with a young person, Mr. McInnis's son. And, the fact that the officer did not acknowledge that once there was the presence of the Police that the reported "too loud music" had been shut off. Mr. McInnis stated somehow and some way the word has to get out that there are two sides to each story. Lastly, he took the opportunity to read the Police report on this incident and noted there were a number of lies, in his opinion, in that report. He questioned if any of the Council members had ever taken the time to read Police reports to get an idea what is happening out in the community in certain areas. President Horton directed the Legislative Assistant to report the incident to the Police Chief and that the Chief should contact Mr. McInnis and provide an update on this situation to Council. 6A - EMPLOYMENT CONTRACT - BUILDINGAND CODE ENFORCEMENT OFFICIAL - DAVID NELSON, #AB90-208 Two state wide recruitment sessions were conducted to fill this position, with a total of six candidates interviewed. In order to attract a qualified candidate it was necessary to adjust the range of the position to a new range of $34,715 - $46,965. After all the applicants were assessed, the position of Building and Code Official was offered to David Nelson from Utah, at a salary of $40,000/year. The employment agreement is submitted to Council for confirmation of the appointment and approval of the contract. Don Pratt, Director Of Community Development, noted this position was advertised twice and after both rounds of advertising and using a citizens panel, which included members who are familiar with the function and process of the Building Official, the Mayor has accepted their recommendation to negotiate with David Nelson and TAPE #757 City Council Reg. Mtg. Minutes August 15, 1990 Page 4 of 6 the contract before Council is the result of that negotiation process. Public comment - none. Mr. Overson stated Fiscal and Budget Committee had a question as to Mr. Nelson's ICBO Certification and questioned Mr. Pratt if he had checked into this matter? Mr_~_2[~t__tstated yes, a call was made to the International Conference Of Building Officials headquarters and asked what certifications they showed to Mr. Nelson. They confirmed that he is a Certified Building Inspector. Mr. Overson questioned if Mr. Pratt was of the opinion Mr. Nelson was fully qualified for the position. Mr. Pratt stated Mr. Nelson is certified as a Building Inspector and per the Committee and staff review it was felt that he was qualified as a Building Official. Mr. Estes stated several members had requested him to ask the following question: "is Mr. Nelson going to be a rubber stamp or truly a building official, a man who will get out and do the job? Mr. Pratt stated he, by law, is required to enforce the law of the City and it is expected he will do that. All the rest of the Managers in the City are asked the same things and in Mr. Nelson's case he has the responsibility of enforcement that are unlike most other managers. He stated he did not have a rubber stamp to pass on to Mr. Nelson, did not expect one and felt his office would function in the same way the Planning and Building office functioned previously. He did not consider the Building Official was a rubber stamp previously nor did he expect him to be a rubber stamp in the future. Mr. Estes pointed out abatement will be one of the major problems Mr. Nelson will have to deal with and it was Mr. Estes understanding that Mr. Nelson did not have experience in Abatement issues and questioned if he would receive special help in this area? Mr. Pratt stated Mr. Nelson had no experience in operating an abatement process, however, Mr. Nelson did have to respond to questions relating to abatement and did understand the process. Secondly, there is an abatement process operating today, although it is short manpower, two employees in the Building program area operating the program with several buildings under abatement and several that have gone to demolition. Mr. Estes stated it was his understanding that Mr. Nelson made comments during the interview about some of the junkie buildings in the City and he questioned if Mr. Pratt would support him in that? Mr. Pratt stated yes. Mr. Waibel noted Council did get a second copy of the contract that did include the EEO/Affirmative Action clause and he questioned if it would be appropriate to change the word "sex" in Section 10G to "gender"? Deila Mills, Acting City Attorney, stated yes, it would be appropriate. TAPE #757 City Council Reg. Mtg. Minutes August 15, 1990 Page 5 of 6 Mr. Colvin questioned what enforcement responsibilities would Mr. Nelson have? Mr. Pratt stated the Building Official is responsible for administering enforcement under Building Codes and he alone, aside from the Mayor, had signature authority to implement the Building Code because of technical complexities. In addition, the Building Department, under the direction of the Building Official, to manage what is called "Code Compliance", which include the Zoning code after the initial interpretation is made by the Zoning Office, the complaint or action is then turned over to the Building Department. And, additionally, the Building Department operation does the enforcement for the Nuisance Code, which includes rubbish and garbage situations. Mr. Nelson will be responsible for managing those portions of the code. Mr. Colvin noted Mr. Nelson had no experience in Municipal Government and questioned if this was a correct statement? Mr. Pratt stated Mr. Nelson's current position was Construction Manager for Bringham Young University and as that he was responsible for bringing college buildings up to code. In that responsibility, he brought enforcement into the college by asking them to upgrade their building quality. However, that is different from dealing across the counter with constituents and because of that Mr. Pratt asked some additional questions in the community of Provo as to how he dealt with people on a personal basis, how he was able to be firm yet fair. People spoke highly of Mr. Nelson's inter personal skills and their confidence in him and in his ability to deal with both unknowledgeable people that were caught in the complexities of a law or belligerent people who did not want to be caught in complexities of the law. Even though there appeared to be a "soft spot" in his resume, the interview process along with other comments from other people gave staff and the interview board confidence he could do the job. #1185 M/S/C(Collins/Overson) to approve the Employment Contract, including the change to Section 10G changing the word "sex" to "gender" and authorize the Mayor to execute said agreement, subject to administrative policy.
