Minutes November 28, 1990 Page 3 of 7 6A-INTERLOCAL AGREEMENT FOR CENCOM SERVICES, #AB90-292 The proposed interlocal Agreement is between Kitsap County and the City of Bremerton. In consideration of monthly allocated payments from Bremerton, the County shall equip, operate and maintain facilities necessary to provide efficient emergency communications to Bremerton. The County would receive emergency and assistance calls, dispatch emergency units, maintain copies of records and dispatch such information as needed. Ian Sievers, City Attorney, pointed out several changes to the agreement: (1) correct the ambiguity of where the term "Board" was used because the agreement did incorporate the CENCOM Board as well as an operations board consisting of Police Chiefs. And, in this section the "from County" was deleted since direction should come from one authority, the Board of Directors. (2) The areas that this board addresses were more within the functions of the Board of Directors than the CENCOM Director, therefore, the Board was made the advisory group to the Board of Directors as well as the CENCOM Director. Public comment - none. President Horton noted if this agreement was approved, she requested that a cover letter, under his signature, be included covering the changes he outlined. Mr. Waibel questioned what was the effect of making those changes, if approved by Council but not agreed to by CENCOM? Mr. Sievers stated that would mean continuing the negotiation process. #0568 M/S/C/U(Waibel/Colvin) to approve the interlocal Agreement between City of Bremerton and Kitsap County. 6b- AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT- JOHN KENNEDY OF BURGES, KENNEDY, AND FITZER, #AB00-293 The attached agreement amends the Professional Services Agreement for retained counsel in in Gosselin, et. al. v. Heistand, et. al, by extending the expiration date to December 31, 1991, and the maximum fee to $60,000.00. The two changes allow continuity of representation through trial currently set for March 1991. Ian Sievers, City Attorney, pointed out the need to make one change, that being the hourly trial rate at $105.00/per hour for actual trial work. Public comment - none TAPE #874 City Council Reg. Mtg. CHAPTERS 10.08, 10.09, AND 10.11 RELATING TO PARKING, #AB90-289 Kathleen McCluskey, City Clerk, stated an error had been made under Section 3, which repeated Section 1 regarding Visitor Permits but provided for short term Visitor Permits. The intent was to provide lone-term Visitor Permits to everyone who had a Residential Parking Permit, thereby eliminating the short-term permit. Public Comment - none. #0932 M/S/C/U(Waibei/Coivin) to pass Ordinance #4297, on second reading, amending times of parking zone enforcement, visitor permits, service vehicle exemptions, overtime parking and procedures for declaring a nuisance for failure to respond to notices of infraction and vehicle impound; and amending Chapters 10.08, 10.09 and i0.11 of the Bremerton Municipal Code. 8C- RESOLUTION #2328, RELATING TO ESSB 6358, SECTION 206, LOCAL OPTION VEHICLE LICENSE FEE, #AB90-295 Section 206 of the Transportation funding package regarding the $15 vehicle license fee can only be adopted by the County. Proceeds will be distributed to cities to be used for transportation purposes only. The City will receive approximately $400,000 annually. The Kitsap County Commissioners will hold a hearing on Monday, December 3rd regarding the adoption of this fee and have asked the City for TAPE #874 City Council Rego Mtg. Minutes November 28, 1990 Page 6 of 7 their endorsement. Kathleen McCluskey, City Clerk, read the Resolution into the record for the benefit of the public. Mayor Louis Mentor stated this was something that could help the City and County with transportation needs. Public comment - none. #1053 M/S/C(Estes/Coivin) to pass Resolution #2328, supporting ESSB 6358, Section 206, Local Option Vehicle License Fees. President Horton emphasized the County's public hearing on this issue - December 3, 10:30 AM, at the Kitsap County Courthouse. Mr. Colvin pointed out this measure would help the City to improve streets. Mr. Horning stressed this is a tax and he was not totally supportive of the proposal and believed there were other ways to fund street improvement. He would not stand up publicly and strongly against it, but would let the citizens make some choices. He pointed out King County withdrew their support of this proposal. He noted his intent was to vote no on this proposal. He urged the public to let the Kitsap County Commissioners know their position on this proposed tax issue. Mr. Overson stated he felt one of the functions of a legislator was to be a leader and to recognize needs and solutions. He noted it may be unpopular, but would not have a significant financial impact. He urged the Council to be a leader and support this issue. Mr. Dawkins stated there were many counties within the State that did not face the growth problems as those in the Puget Sound area. Counties who had no growth could take the option of not adopting the tax. Mr. Collins stated the county had growth but the City boundaries had remained constant. There was a gas tax increase to be applied toward road improvements and he felt this was just a second tax. It was estimated that the amount of money the City would receive would overhaul about eight blocks of street per year. He stated he could not support this issue. Mr. Colvin noted even though the boundaries of the City may have remained constant, the streets had not. He pointed out the County could approve this tax without a Council vote. TAPE #874 City Council Reg. Mtg. Minutes November 28, 1990 Page 7 of 7 President Horton explained this tax could be repealed by the State, County and the citizens. Mr. Waibel stated this was a complex issue and he did not have enough time to study the issue, therefore, he would abstain from voting on the issue. President Horton stated she was reluctant to increase taxes, however, she believed in growth management the emphasis needed to be placed on the user. People who use vehicles must reaiize the usage of those vehicles comes at a very dear price. Vote on the motion: In Favor: Dawkins, Coivin, Overson, Estes, Horton Opposed: Horning Abstain: Collins, Waibel With no further business meeting adjourned at 6:18 p.m. KATHLEEN L.
