During this meeting, it became apparent that a few people were panicking and they were cautioned to not panic as something would be developed to help those in need. President TAPE #883 City Council Reg. Mtg. Minutes January 16, 1991 Page 2 of 6 Horton thanked Mr. Estes for attending this meeting upon short notice. Mr. Morning exclaimed God bless American and allied troops in the Middle East and wished them the very best and prayed for a speedy end to the war. Mr. Waibel reported he attended the Mayor's Ball, which was even better than last year's. He also hoped that the war would be concluded quickly and a successful conclusion. Mr. Johnson stated our prayers and thoughts are with men and women who are serving in Desert Storm. Mr. Colvin stated he concurred with his fellow Council members' comments concerning the war. He thanked Mr. Estes for inviting him to attend a Youth In Government meeting and he was impressed with the young people involved in the program. He encouraged the young people to contact President Horton and Kathleen McCluskey to learn more about careers in government. Mr. Dawkins noted issues that Council had to take under consideration were very small in comparison with recently declared war actions. Mrs. Morton reported she attended the Puget Sound Air Pollution Control Agency (PSAPCA) meeting on January 10. She was pleased to report that the PSAPCA staff proposed not pursuing the ban on burning yard debris and grass clippings due to problems with recycling and alternate forms of disposal. Discussion was held on wood stoves and linking those to urban growth areas. This may not help the City of Bremerton, however, if they are talking about linking them to urban growth areas maybe they could be pushed farther to consider "affected urban growth areas". Mrs. Horton reported there was a vacancy on the PSAPCA Advisory Committee and she encouraged anyone interested in filling that position to please contact her through the City Council office. PUBLIC RECOGNITION MaYor Louis Mentor reported on the Martin Luther King, Jr. Day celebration held at Olympic College on Sunday, January 13. He noted this was a very nice observance in recognition of Martin Luther King's birthday. He also echoed the sentiments of the Council members regarding the recent declaration of war. He was sure it was everyone's wish that the war would end quickly. Teresa Dimbioer expressed concern over the difficulty she experienced in getting a copy of a police report of an incident in which she was a victim. She requested justification for the officer' lack of response in writing a timely report and was TAPE #883 City Council Reg. Mtg. Minutes January 16, 1991 Page 3 of 6 concerned that the individuals who attempted to attack her were still at large and a threat to the public. She requested that a special award be given to the cab driver, William Wright of Trole Taxicab, who assisted her at the time of the incident. President Hotton requested Kathleen McCluskey, City Clerk, to follow up Ms. Dimbicer's concern with Mayor Mentor. 6A - INTERLOCAL AGREEMENT TO PURCHASE ONE JD71OC JOHN DEERE NEW WHEEL TRACTOR W/BACKHOE AND BUCKET LOADER ATTACHMENTS, #AB91-013 The Street Department requests approval to enter into an Interlocal Agreement with Kittitas County, Washington and the City of Bremerton for the purchase of one JD71OC John Deere new wheel tractor with backhoe and bucket loader attachments. Cost of this equipment was included in the 1991 Street Department budget. Ken Brees, Street Superintendent, stated by using the Interlocal Agreement the City would save approximately $4,000 due to price increases. Public comment - none. #0497 M/S/C(Overson/Horning) to authorize the Mayor to enter into an Interlocal Agreement between the City of Bremerton and Kittitas County for the purchase of a JD71OC John Deere new wheel tractor with backhoe and bucket loader attachments. Vote: In Favor: Abstain: Overson, Estes, Horning, Horton, Collins, Dawkins, Colvin, Johnson Waibel 6B - STATE OF WASHINGTON/GRANT APPLICATION FOR "KITSAP COUNTY SUBSTANCE ABUSE PREVENTION/EARLY INTERVENTION", #AB91-014 The Bremerton Police Department has been awarded $10,000, as its portion of a State Grant for Substance Abuse Prevention/Early Intervention. The purpose of the grant is to develop a program that compliments the DARE Program. Kitsap County is the administrator of the grant funds, and has prepared the Interlocal Agreement for the City of Bremerton and City Council approval. Pollce Chief De1 McNeal explained this was a joint effort with Kitsap County and initial paperwork was started in October 1990, and was included in the City's 1991 budget. The City was required to participate in two training sessions with parents in the school areas and those have been scheduled. Public comment - none. #0634 TAPE #883 City Council Reg. Mtg. Minutes January 16, 1991 Page 4 of 6 Mr. Johnson questioned who was responsible for the delay in getting the program started? Chief McNeal stated this program had not started yet, however, they were aware it would be available in October. He was not sure what caused the delay in receiving the Interlocal Agreement from the County. He noted the City could go back and recover the cost for one training session for an officer who did attend. Mr. Johnson expressed his displeasure over items coming to Council for approval that were already partially complete. President Hortonquestioned if the Chief would have sent his officer to the training session if grant funds had not been available? Chief McNeal stated probably not without the assurance of the grant funding. M/S/C/U(Waibel/Horning) to approve the dating of the Mayor's signature on the already signed Interlocal Agreement. President Morton called a short recess of the meeting at 6:00 PM, allowing Council members to view President Bush's television address to the Nation on the declaration of war in the Middle East. City Council meeting resumed at 6:27 PM. 7A - ORDINANCE NO. 4305 (SECOND READING) ADOPTING THE MANAGEMENT AND PROFESSIONAL STAFF COMPENSATION PROGRAM (BEMEFIT8 SECTION), #AB91-009 Mayor Louis Mentor reviewed the changes requested by Council during the first reading of the ordinance: (1) addition of a new chapters 2.50, 2.50.010 and 2.50,020; (2) clarifies Mayor's ability to grant 20 days vacation for new hires; (3) deleted a paragraph after item 2 (page 6) and deleted original item 3 and renumbered remaining items; deleted item referencing grandfathering; and under item 5(page 8) added words in second sentence: "Shorter period of absence due to any of the reasons provided below are administered by the Mayor under .... "; (4) under Chapter 2.50.090 added Section 2 to clarify starting date. Ian Sievers, City Attorney, stated as a result of Councilman Overson's observations of two retroactive effect problems, he suggested removing one program on implementing for current managers on sick leave. The reason was that adopted sick leave balances were as of December 31. At this point, all managers now had to a greater or lesser extent, more sick leave and that implementation date would actually remove some invested sick leave. Therefore, implementation for existing managers was removed and he added a sentence under Section 2 of Chapter 2.50,090, stating that for sick leave accruals those two sections on the rate and maximum would not go into effect until January 1992. Addressing the Council's motion on first reading, Mr. Sievers proposed a change to Section .020(a) (page 2)... instead of #1007 TAPE #883 City Council Reg. Mtg. Minutes January 16, 1991 Page 5 of 6 adoption of a list of managers covered by the chapter by reference he proposed the following language: "Applicability. The provisions of the ProGram, adopted by this Chapter, shall only apply to salaried management and professional appointive positions listed below; provided, however, for the City Auditor the responsibilities of the Mayor shall be exercised by the Audit Committee and for the City Attorney, Mayoral approval shall be forwarded to the Council and may be modified by the Council President: (list of mangers would be included at this point). Public comment - none. Mr. Colvin questioned if a "second reading" of the ordinance was appropriate at this time due to the number of suggested changes? President Hotton stated yes, the changes noted by Mayor Mentor and Mr. Sievers were approved at the time of first reading but had not been included in the ordinance for second reading. Mr. Colvin questioned if the medical benefits section approved for management would apply to the non-uniform employees? Mr. Sievers stated no, however, they had been offered the same proposal but it was not accepted. Mr. Johnson thanked Mr. Sievers for developing the ordinance as requested by the Council. He noted his concern to exact wording of intent was based on the fact that Ordinances could be in effect for many years and he did not want to leave any room for misinterpretation. M/S/C(Johnson/Colvin) to pass Ordinance #4305, on second reading, including the changes addressed by Mayor Mentor and City Attorney, repealing Chapter 2.50 of the Bremerton Municipal Code and adopting a new Chapter providing a Management and Professional Staff Compensation Program. Vote: In Favor: Abstain: Overson, Estes, Horning, Horton, Collins, Dawkins, Colvin, Johnson Waibel 7B - ORDINANCE (FIRST READING) AUTHORIZING A TAXANTICIPATION NOTE, #AB91-015 As indicated in the attached projection, the City's General Fund operates in a deficit cash position for several months during the year. These deficits are due to timing differences between the fund's revenues and expenditures and the small overage cash balance compared to the monthly cash flow. Issuance of a tax anticipation note is recommended as the most advantageous method of financing this cash flow. Rich Hanna, City Treasurer, gave a brief review of the need for the subject ordinance, with the major reason being the property tax #1189 TAPE #883 City Council Reg. Mtg. Minutes January 16, 1991 Page 6 of 6 revenues being almost "0" to the General fund until the first half collections at the end of April. Because of the unique situation provided by the Federal Income Tax Law, it was possible for the City to borrow the funds at a rate lower than it was able to invest surplus funds. For that reason, the Tax Anticipation Note has been sized to the greatest extent possible, under Federal IRS law. It was Mr. Hanna's intention to present this item as an information item this date and request an "emergency reading" on January 23. However, if Council desired to take action on an emergency basis at this time it would be helpful to staff in terms of being able to conclude the transaction. Public comment - none. Mr. Colvin questioned the amount of the proposed tax anticipation note? Mr. Hanna stated it would be in the amount of $1,750,000. M/S/C/U(Johnson/Waibel) to approve Ordinance #4306, on Emergency reading, including an appropriate change by the City Clerk to Section 12, authorizing the issuance of tax anticipation notes for the purpose of paying City expenses pending the receipt of general City taxes; creating a note redemption fund; providing for the sale of those notes to Seattle-First National Bank of Seattle, Washington; and, because of its urgency, providing that this ordinance shall take effect immediately. With no further business meeting adjourned at 6:44 p.m. KATHLEEN L. MCCLUSKEY, CITY CLERK APPROVED ~RTON, Council President City of Bremerton KLM/LH/me cc: Normal Distribution File/Vault
