COUNCIL MEMBER REPORTS Mr. Johnson reported on a recent letter from the Department Of Corrections stating they are considering placement of a 40-bed Work Release facility in downtown Bremerton. He felt this would be totally disastrous if it came about considering the last of job opportunities, particularly in the Shipyard. He felt it would be something that should not happen when redevelopment is just starting in the downtown area. He hoped TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 2 of 10 the public would speak against this issue impacting the downtown area negatively. The answer may be to continue to look for some reasonable sites for a Pre-Release Facility. President Hotton emphasized the letter stated Bremerton-Kitsap County area and did not specifically cite downtown Bremerton. Mr. Dawkins reported on the success of the Armed Forces Day Parade. The Bremerton Central Lions Club had a very successful Pancake Breakfast event. Mr. Overson stated Mr. Johnson was on point for the potential Corrections facility and it was interesting that the "City of Bainbridge Island" was not cited considering the fact it is located closer to more available jobs in the Seattle area. He supported pursuing this issue pointing out to the Department of Corrections that they could make a better decision with more and new information. He displayed a neon-pink flyer that promotes the City's Housing Rehabilitation Loan Program. This program provides money on a loan basis to individuals qualifying at very low rates, i.e., 3% and up to $20,000. He noted there are stringentqualifications and anyone interested may contract the Community Development Department (478-5379). Mr. Neville reported he attended his first Cable Communications Advisory Committee meeting. He introduced Ed Bachmann, Chairman of that Committee, who had a special presentation to make. Mr. Bachmann, Lorraine Inabinette and Lucy Hockstein displayed a Plaque Of Appreciation honoring Jim Brontoli, the first coordinator for the cable access program and who was important in its formation. They expounded on Jim's vision to bring into being a well organized and functioning cable access program within Bremerton and Kitsap County. President Hotton extended the City Council's appreciation of Jim's efforts and thanks to him Council has several thousand citizens watching weekly Council meetings, which she believes lends to the democratic process. Mr. Dawkins stated Jim's vision was perfect and Council is very appreciative of the many volunteers who assist in this program. Mrs. Fits reported she, along with several other Council members, attended the Council Coalition Dinner meeting on May 19 at Bainbridge Island. The guest speaker for that meeting was Mike Phillips who spoke on "Open Space". She urged everyone in the public to take the opportunity to hear discussions on this topic and to attend one of the many public meetings planned for Kitsap County. Mr. Waibel announced there was still time, by May 22, to TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 ra~ 3 '~ I0 obtain a "Brick" for the Centennial Plaza. He reported the first event in the newly refurbished Roxy Theater will May 25, 2:00 P.M., a Jazz Band Concert by a touring band from South Dakota. Proceeds from that event will be used to finance banners for the boardwalk. Mrs. Hotton reported she was part of a group from the City that toured the vault and investment areas of Seafirst Bank/Seattle. She found this to be very informative and following the tour they had the opportunity to talk with several Vice Presidents and conveyed to them the need for bank financing in the City of Bremerton for various projects, including the City's Bremerton Lumber site. Council will be hearing more about the Bremer Lumber site within the next two weeks. On Tuesday, May 19, she and Council's Legislative Assistant Merilynn Erhart toured and talked with City of Seattle Police Offices involved in the Community Police Team Program. That program is a "grass roots" program where Police Officers interact with various neighborhood Council's and work hand-in-hand with Patrol Officers on repeat type problems. This Police Team works with the various community organizations to become proactive and develop solutions to situations so additional funds do not have to be spent after problems have developed. This is a popular program in Seattle and research is underway to discover if other cities of a similar size to Bremerton have started such programs. On May 30, 11:00 AM - 6:00 PM Sub Area Citizens Advisory Committees Of The Kitsap County's Transportation Study will meet at Kitsap Mall in Silverdale. The public will have the opportunity to pick up information on this Study as well as make comments. On Sunday, May 17, she and several others served as judges at a Dog Show at the Farmer's Market. They also judged a "people howling contest" during that event. PUBLIC RECOGNITION Russ Johnson, Mayor Pro Tem, read the following Proclamation: 1. National Public Works Week - May 17 - 23, 1992. Mr. Johnson also wanted to comment on the contribution made by Jim Brontoli, past Cable TV Access Channel Coordinator. He noted Jim was the person who started the program for the City and other cities are anxious to get their cable access systems in place and look to Bremerton as the success of such an effort. It is hoped that Kitsap County will be successful in negotiating some type of cable access program within their franchise because that would allow inter- connection of programs and services between cities, county and other public agencies. And, as Mayor Protem he proclaimed May 21, 1992, as "JIM BRONTOLI DAY" in the City of Bremerton. TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 4 of 10 In reference to areas experiencing water shortage, he expressed "thanks" to City forefathers and present City management for their long-term effort to provide an adequate water supply for the City. He noted the City's reservoir is not dependent upon the snow pack as those cities on the east side of the Sound. The City also has a number of wells that provide water resource as well. He noted this year appears to be a "dry" year and he encouraged people to conserve water usage and felt some of the conservation ideas being advertised on TV were just good common sense. Lastly, he noted the Armed Forces Parade was excellent and well attended. President Hotton reported a clerical error caused the Council's 1991 budget to go over-budget. Due to that same problem, Council's 1992 budget has also been over-budget each month so far this year and now that the error has been discovered, Council should be well within its spending limits. The clerical error was the continued funding withdrawal for an employee who no longer works within the City Council office. Once this error was discovered, appropriate funds were transferred back into Council 1992 budget. Debbie Goodell, Animal Control/Parking Supervisor, presented Councilman Richard Neville the "Dogie Do Right Award" and Council President Horton the "Golden Leash Award" in recognition of their judging the Canine Competition and Games. Betsy Harris, Animal Control Officer presented the "Pet Of The Week", "Penny", a half persian cat. Penny is not spayed so there is a $25.00 spaying deposit required. Don Larson, 135 Rainier Avenue, expressed concern that many people were using the waterways as a "trash cans". The purpose of the organized clean ups of Sinclair Inlet and Dyes Inlet is to change the attitude that it is ok to dump debris in the Sound. He encouraged people to please use legal dumps for getting rid of unwanted materials. He announced Coast Weeks Event will happen during the month of September - an appreciation of our waters and shorelines. He hoped some organization within the City of Bremerton would get involved during this month long event. He provided the following phone number and address for anyone interested in obtaining additional information: (206) 943-3642; 1325 Westbay Drive NW, Olympia, WA 98502. APPOINTMENT TO THE PLANNING COMMISSION: KELLY KI~UTSCHEID, #AB92-131 #1133 TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 5 of 10 There is currently a vacancy on the Planning Commission due to the resignation of Ron Barrington whose term would have not expired until 4/1/93. I am recommending the unexpired term be filled by Kelly J. Krautscheid. Don Pratt, Director Of Community Development, stated the Mayor requested him to propose the appointment of Kelly Krautscheid to replace Ron Barrington, who had to resign. Kelly had indicated her interest in serving on a City committee/commission in 1990. He noted Kelly is employed at Kitsap Physician Service as an Accountant and resides in the downtown area of Bremerton. Mr. Overson noted Ms. Krautscheid lives in the downtown district and has an excellent prospective on that section of Bremerton. Public comment - none. Mr. Johnson noted he felt the Mayor has made an excellent nomination and believed Kelly represents the "new breed" of resident expected to reside in the central area of Bremerton. M/S/C/U(Waibel/Overson) to confirm the appointment of Kelly J. Krautscheid to the Planning Commission. Kelly Krautscheid thanked the Mayor and Council for appointing her to this position. She has resided in Bremerton for 2 1/2 years and believes Bremerton has a lot of potential and has already seen changes within that time period. She looked forward to serving the City. 6B - MUNICIPAL COURT ORGANIZATION - REOUEST TO HIRE LEGAL TECHNICIAN III, #AB92-132 The Judge and Administrative Services Director have reviewed the staffing needs of the Municipal Court and concur that the Legal Technician III classification provides the level of experience and technical expertise necessary to assist the Court Services Manger. This position will act as Office Supervisor in the absence of the Court Services Manager, assumes some of the record and reporting activities performed by the previous position of Assistant Director and provide back-up for all positions in the Department. This change will result in a savings of $12,477 in 1992 and $20,833 in 1993. Kathleen McCluskey, City Clerk, stated Penny Hill has been appointed as provisional Court Services Manager, at the TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 6 of 10 request of Judge Martin. Judge Martin has approved this organizational proposal and the Legal Technician III position takes the place of the previous Assistant Director. As of June, the Court Office will be losing a position and if the requested position was not filled, then that department would be down two positions. Because of the expertise needed, they are proposing the position at a higher level. Mr. Overson questioned if the workload was up in the Court office to further motivate the need for filling the position? Ms. McCluskey stated yes and the revenue was "up', as well. Public comment - none. Mr. Johnson pointed out one of the things done to allow this type of consolidation was the automation systems installed. He acknowledged the "good job" Ms. Hill has done since assuming the new position and responsibilities. #1324 M/S/C/U(Johnson/Dawkins) motion to approve deletion of Assistant Director Municipal Court, and addition of Legal Technician III. 6C - BREM-AIR CONTRACT AMENDMENTS, #AB92-133 The following amendments are proposed to the Brem-Air contract: 1. New Definition: "CommercialDwelling" means a building or group of buildings designed, intended or, or used for any purpose other than single-family or duplex residences and shall include office buildings. Any building or group of buildings where combined residence and business is practiced, where such business is advertized by a sign of any type on the premises and/or listed in the telephone directory as a business shall be classified as commercial. 4.16. "Residence" as used in this contract, residence shall mean a living space individually rented, leased, or owned whether a free standing single-family residence or a portion of a multi family rcsidcncc structurc or othcr building duplex, but shall not mean residential structures containing three or more units. 5.2.2. Non-Residential Service. Collection at all other buildings, places of business, commercial dwellings, or premises where solid waste is accumulated or generated within the CITY limits shall be made as frequently as may be necessary in the opinion of the CONTRACTOR to avoid the creation of a nuisance or the violation of any ordinance, TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 7 of 10 regulation, or law, but in no event less than once a week, nor more than six times a week with at least 24 hours between collections, provided, however, that any customer dissatisfied with the number of containers required to be provided bv the contractor or with the frequency of collection determined pursuant to the terms of this contract. 2. Adoption of new rate for 60 gallon Dura Cans of $14.48 collections and hauling and $7.70 disposal. This is the same as the two can rate. 3. Amendment to the Tag-a-bag Program as follows: 5.3.4. Delete 5.4.2. Amended as follows: The Contractor may refuse to collect wastes not placed inside of containers. Provided, however, that the Contractor shall collect extra waste placed outside of containers when said waste has been neatly placed in a suitable collection container. 7.2.7. Amended as follows: Extra solid waste. The rate for collection of extra solid waste placed outside of a collection container shall be $3.75 for each extra container of up to 33 gallons volume. (Note: the original contract at a cost of $5.00 cost for each additional bag.) Kathleen MoCluskey, City Clerk, stated Brem-Air Disposal did agree to the changes as outlined. Mr. Johnson pointed out the Tag-A-Bag program was tried, it didn't set well with the citizens and did not accomplish the promotion of recycling but rather encouraged people to use higher levels of service. He questioned if an extra trash can is set out will the garbage company take the trash and can as well? Ms. MoCluskey stated it was her understanding that the can would be dumped and then left at the residence. Mr. Overson questioned the amount of garbage allowed for "extra" garbage pickup? Ms. MoCluske~ stated only up to 33 gallons. Mr. Overson questioned if the new term "Commercial Dwelling" was listed in the City's Zoning Ordinance or any other City ordinances? Mr. Johnson explained during the process of developing the City's new garbage contract, samples of other cities' garbage contracts and ordinances as well as information from private haulers were reviewed. The term "Commercial Dwelling" may have come from that resource of data. TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 8 of 10 Mrs. Fit~ stated she believes the citizens of Bremerton can be grateful that Brem-Air and the City are still able to fine tune the contract after it was adopted, which speaks well for both the City and the hauler. President Hotton stated citizens have expressed their concerns as well and she appreciated their input and help in developing a more workable document. She hoped if other problems arise, citizens will continue to inform the City so an attempt can be made to resolve them as well. Jim Adrian, 621 Washington Avenue, stated in his particular situation relating to multi-family, the new language proposed seems to help in that area. He expressed concern that there is no place in kitsap County for people to dispose of paint cans. King County and Pierce County both had disposal sites for such cans but would require a fee for those living outside of those areas. He was concerned over the "progressive billing" structure that penalizes people with multi-family dwellings. Currently, the rate structure is one can-S12.00 and 2-cans-S25.00. He recently met with Brem-Air and set up 15 additional accounts in order to get around this additional cost. He understands that the Dura Can rate would be addressed on the Progressive Rate Schedule, but he did not feel it worked for multi-family. In the long run, it will result in thousands of dollars of additional billing and accounting costs for Brem-Air and additional cost for the property owner. By setting up the 15 individual accounts rather than using four accounts he will save approximately $500.00 per year. On the issue of "education", he questioned who would take the lead on providing recycling education for the public, the City or Brem-Air7 and when will it start? He questioned if someone will address the Progressive Billing issue or was that issue locked in for the next 10 years? Russ Houge, Attorney representing Brem-Air Disposal Inc. stated it was his understanding that prior to his arrival at this meeting there was discussion of the rates for collection and hauling for standard trash cans basically as used by commercial property owners/multi-family and the comment was that it costs more for each additional so what is the incentive to do that and why not just bill the individual accounts. Brem-Air sought to address that in the contract amendments. In Table "B" of the amended contract (Collection And Hauling Rate Table For Contractor Provided Containers) a new level of service was added - Dura Cans are now being offered to commercial customers primarily and that rate does allow or provide the rational in that if someone has a multi- family resident and if there are more than one Dura Cans they would not be penalized with the charge. For instance, the #2081 TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 9 of 10 cost of the first Dura Can would be $14.48/weekly pickup and for each additional one picked up weekly the charge would only be $12.16. That figure was arrived at as follows: that is the same proportion they have used in years past for the other contractor provided containers such as dumpsters. It is hoped this will answer the concerns for people like Mr. Adrian. Johnson referenced the instance of a multi-family facility set up for elderly residents where it makes sense to have mini or regular size cans near the units because of the type of people who live there. He questioned could more than one can be counted as single cans even though it would be single billed? President Hotton stated she believed that was an area that needed to be further explored and suggested City staff talk with Brem-Air about that issue. Mr. Hough stated he understands what the City is concerned about and that is what they have attempted to do with the Dura Can level of service and does fill a need that may have been overlooked in the original scheme in years past. They hope that with the structure currently provided they can accommodate the situation described by Mr. Johnson and other commercial dwellings without further contract amendment. Mr. Adrian stated from the multi-family standpoint he felt Mr. Houge's explanation would resolve the majority of problems. He felt strongly that information must be brought out so the public is aware of the process. He suggested additional notification be given to new customers about the use of mini CanS. Mr. Johnson stated in response to the question on recycling education, it will be the City's responsibility to be the lead, along with assistance from the contractor. The City will also be working with the County in that area. M/S/C/U(Fitz/Johnson) motion to approve amendments to Brem- Air contract; including the charge of $3.75 for pick up of additional garbage (33-gallons container). Mr. Overson commended Ms. McCluskey, Councilman Johnson and Brem-Air for again coming to the aid of the City. President Hotton requested if further clarification was needed on the issue of multi-family billing structure she would like a report back to Council within two weeks. 6D - AUTHORIZATION TO FILL POSITION OF UTILITY COMPUTER OPERATOR, #AB92-134 City Council Resolution #2383 provides for formal approval for filling vacant positions. #2190 TAPE #1025 City Council Reg. Mtg. Minutes May 20, 1992 Page 10 of 10 The Utility is requesting formal approval to fill the position of Utility Computer Operator. The position is currently vacant as a result of the recent demise of the former incumbent. This position is necessary for the operation of the Utility in providing utility services to the community. Bill Duff~, Utilities Director, stated this was an unexpected vacancy and in order to get utility bills out and keep the process going he needs to fill this position immediately. Mr. Overson stated this item was reviewed by the Operations Committee and they recommend approval. Public comment - none. M/S/C/U(Johnson/Dawkins) to approve the Utility's request to fill the position of Utility Computer Operator and authorize the Utility to proceed subject to City Administrative Policies and Procedures.
