Caroline Marshall, Personnel Director, stated the Agenda Bill outlined the general agreement and noted there was only one change, that being a salary increase commensurate with that received by the rank and file members of 6%, effective January 1, 1992. Public comment - none. %0647 M/S/C(Waibel/Estes) to approve the Labor Agreement by and between the City of Bremerton and the International Association Of Fire Fighters Local 437 Chief Officers for the period January 1, 1992 through December 31, 1992. Mtg. Minutes January 22, 1992 Page 4 of 8 confidential nature of the work performed. For this reason, the Payroll Specialist position needs to be covered by an individual employee contract. Caroline Marshall, Personnel Director, stated this action will add the Payroll Specialist position to the confidential group, which is excluded from the bargaining unit for purposes of collective bargaining. Salaries are set under the ordinance by contract with each of the individuals listed under that ordinance because they are not covered under a labor agreement. Public comment - none. Mr. Estes pointed out this position is not a new person but is an established position under a different classification. Ms. Marshall stated it took some time to establish and reach agreement with the Teamsters Union that it is appropriate to exclude this position from the bargaining unit. This is not a new position and is moving it from one compensation system to another with no change in salary. Councilman Collins left the Council Chambers at 6:58 P.M. 90753 M/S/C/U(Colvin/Estes) to approve Ordinance, on first reading, providing salary adjustment and other benefits of the position of Payroll Specialist, and amending Ordinance No. 4231. Councilman Collins returned to Council Chambers at 6:00 P.M. 7B - ORDINANCE (FIRST READING) ~%MENDING THE 1992 BUDGET. AMENDING ORDINANCE NO. 4351 AND REPEALING ORDINANCE NO. 4298. # 92-018 Several contractual and organizational changes have taken place since the final presentation of the 1992 budget to City .Council. While these changes do not affect the authorized expenditure levels, they still need to be incorporated into the budget document in order that it continues to accurately represent the City's operating plan. Mayor Louis Mentor stated this ordinance includes compensation settlements with the Teamsters Union representing the non- unformed employees; the non-represented confidential employees, the managers and professional staff; and the Mayor. Public comment - none. %0866 M/S/C(Waibel/Fitz) to approve Ordinance, on first reading, amending the 1992 budget making certain organizational TAPE %987 City Council Reg. Mtg. Vote: In Favor: Overson, Estes, Fitz, Waibel, Dawkins, Collins, Colvin Abstain: Johnson RESOLUTION NO. 2373~ ADOPTING 1992 CITY COUNCIL STATEMENTS OF LEGISLATIVE INTENT~ ~AB92-019 The attached Resolution, prepared by the City Council, expresses the direction and intent of the Council pursuant to concerns related to adoption of the 1992 Budget. Public comment - none. Mr. Overson stated this proposal summarizes discussions during Budget review to provide some items Council would like included in annual activity. Generally, this will provide for some studies and/or reports at Council Study Sessions. This year the listing was categorized by "month" to make it easier to track. He pointed out only one SLI was classified as "quarterly". Mr. Collins expressed concern over the wording in SLI item %7, addressing the City Treasurer. He requested that the last two sentences of that paragraph be deleted. He feels those two sentences restrict the study Council requested the Mayor to undertake on the "City Treasurer" organizational reporting line. Mr. Waibel stated he desires to have Council give some direction with the SLI's and in fact give some direct interpretation to the Mayor as he goes through his study of the Treasurer function. He requested deleting the word "not" in the last sentence of Item %7, and to direct the Mayor to review the alignment in terms of Council's interpretation of the Charter that it does intend for the City Treasurer to report directly to the Mayor. The reasons behind his request are as follows: (1) in deciding the intent of any legislative action the history needs to be reviewed. (Mr. Waibel related prior to the change in government, the Treasurer reported directly to the Commissioner Of Finance. During the period prior to that, the Commissioner of Finance fired two treasurers because he disagreed with their advice and did not like the fact they did not want to refinance the parking garage every year or that he wanted to turn down Federal grants, etc. Before hiring the replacement for those fired Treasurers, he demoted the treasurer to come under the TAPE #987 City Council Reg. Mtg. Minutes January 22, 1992 Page 6 of 8 jurisdiction of the City Clerk, who was also an elected official at that time. In redrawing the Charter, the intent was to correct some of the things that took place under the Commissioner form of government and one of those was to put the top managers back to direct reporting to the elected officials. The history of the Charter itself does indicate an intent to put the Treasurer directly under the Mayor. (2) Quotes from the City Auditor were contained in some documentation stating that he did not think the word "receive" in the Charter means that the Treasurer actually had to physically receive all funds, but that he has the responsibility for all collections of money. In order to be responsible for all collections, if in fact people are to report to other people than the Treasurer, the Treasurer has to have the authority equal to those other top level managers. (3) The City Treasurer is one of the few special positions listed in the Charter, indicating by the very nature of being listed they are intended to be top level managers. (4) We need to make a separation between the function that disburses money and the function that collects money. That cannot be done when the person who collects money answers to the person responsible for the disbursing of money. It is the City Council's charge to uphold and interpret the Charter. He believes Council needed to uphold that function of interpretation in this case and felt it was good business, as well as the intent of the Charter, to do it this way. He provided a handout to each Council member showing eight other cities all of who have direct, top level reporting by their Treasurer. In one case the Treasurer is an elected official. Therefore, for those reasons he wanted to only change the SLI's to indicate that we, as a Council, do interpret the Charter to intend for the Treasurer'to report directly to the Mayor. Kathleen McCluske¥, City Clerk, stated she needed to correct .one grave mistatement by Mr. Waibel; and in fact there were several mistatements. The most important one is that the City Treasurer was not placed under the Administrative Services or City Clerk at the time the Commissioner of Finance was in office or when the City Clerk was elected. The Treasurer's department was placed under Administrative Services by this elected Council in 1985, two years after the change in City government was established. It had nothing to do with the Commissioner of Finance nor people he fired, etc., it had to do with the desire of the new form of government to consolidate multiple departments under Directors so that the Mayor had a smaller number of people reporting to him. The problem was, when the form of government was changed, there were 17 different departments with 17 different individuals TAPE #987 City Council Reg. Mtg. Minutes January 22, 1992 Page 7 of 8 reporting to the Mayor. This was unwieldy and did not follow good sense in management and it was the original City Council, by ordinance, who established Administrative Services and consolidated multiple departments within different areas. She felt this was an important distinction because the whole scenario given by Mr. Waibel about the Finance Commissioner is inaccurate. She was not sure where Mr. Waibel obtained that information. There were other things she could go into, but would not at this time. She did not have the courtesy of Mr. Waibel discussing this with her prior to this meeting, and as the Administrator of that division there were a number of things she would like to respond to. Mr. Colvin pointed out there are other things wrong with the City Charter and felt Council should take on review of the whole Charter. He did not support this "piecemeal" approach. He supported amending the SLI's as suggested by Mr. Collins and review the Charter later. 1223 M/S/(Waibel/...) to approve Resolution #2373, with the deletion of the word "not" in the last sentence of Item #7. Motion died for lack of second. ~1339 M/S/C(Overson/Estes) to approve Resolution #2373 and Statements Of Legislative Intent as presented. #1343 M/S/F(Collins/Colvin) an amendment to the main motion to adopt Resolution #2373, with the amendment of Item #7, striking the last two sentences. Mr. Johnson stated in reference to the amendment, he did not object to taking the two sentences out, but he did not want to sent the wrong signal to the Mayor. If the Charter is studied, he believed it would indicate the Treasurer did not have to directly work with everyone who physically received -money. The Charter is also somewhat vague on exactly how it reports, and frankly, over the years, a lot of specific positions have been deleted from the Charter by a vote of the people and placed in Administrative Ordinances. He did not want to shut the door on what is smart and makes sense financially within the City. If it makes sense to have the Treasurer perform a duel role as in an advisory role to the Mayor so that he could directly provide information, that is ok. He would like to have the Mayor have the flexibility to look at this issue and come back with a recommendation that makes the best corporate sense. For the record, he indicated Council was not saying it has to go a specific direction. Mr. Overson stated he did not support the amendment for the TAPE #987 city Council Reg. Mtg. Minutes January 22, 1992 Page 8 of 8 same reasons as Mr. Johnson. Because there has been so much discussion of the subject, he felt it was pertinent to state up front that if there is an intended change, it needs to be fully demonstrated. By passing Item 7 of the SLits, Council is not giving a signal saying to make some big changes.
