Council members present were Lon Overson, Richard Neville, Lynn Horton, Morrie Dawkins, A1 Colvin. Councilmen Hank Waibel, C. R. "Tiny" Collins and Russ Johnson were absent. Also present were Assistant City Attorney Jim McNamara and City Clerk, Kathleen McCluskey. The meeting opened with the Pledge of Allegiance led by Council President Fitz and Invocation given by Carl Johnson, Business Manager of Peninsula Bible Fellowship. President Fitz announced Council would hold an Executive Session on "personnel" following the Council meeting. CONSENT AGENDA A. Minutes Of Meeting - March 3, 1993, #AB93-054 M/S/C/U(Horton/Colvin) to approve presented. Consent Agenda as CLAIMS/WARRANT REGISTERS Vouchers audited and certified by the auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing that had been made available to the Council. M/S/C/U(Colvin/Dawkins) on March 31, 1993 the Council does approve for payment those vouchers included and further described as follows: 165097, 165,098, 165100 through 165247 in the total amount of $457,434.88; and Retiree's Payroll for the period ending March 31, 1993, in the amount of $94,858.67. COUNCIL MEMBER REPORTS Mr. Neville stated he hoped everyone was getting use to the new Cable Channel line up for TCI and Falcon T.V. He was pleased to see the "Drug Free Zone" signs go up around all the schools. Mrs. Horton reported she participated in the "Drug Free Zones" #0173 TAPE #1097 City Council Reg. Mtg. Minutes March 31, 1993 Page 2 of 9 march and rally. On Tuesday, March 30, an "Emergency Preparedness" presentation was made to District #6 residents by Phyllis Mann, Assistant Director of Emergency Services in Kitsap County, and Lori Jones, Fire Prevention Officer for the City. She was pleased to report that this event was fairly well attended even though the wrong date was printed on the City water bills announcing the event. As a precaution, Phyllis and Lori will be at the Bremerton High School on the evening of March 31 in the event someone shows up thinking that was the correct date of the presentation. The content of that presentation was to try and prepare not only people in their homes but in their neighborhoods in the event of an emergency like an earthquake or sever storm. She highly recommended other Council Districts or individual neighborhoods to consider scheduling a presentation of this topic. She will be setting up several smaller neighborhood meetings (25-30 households) in her District, helping to spread this information throughout the District. Lastly, she referenced an issue that was brought up by Mr. Olwell at the previous Council meeting, having to do with an appeal before the Planning Commission in which he, as the appellant, was unable to attend because of a medical emergency. Subsequently, in discussions with the City Attorney and Director Of Community Development, it appears the by-laws of the Planning Commission are void of any kind of policy direction as to what to do in the case of an "emergency". M/S/C/U(Horton/Colvin) to ask Don Pratt, Director of Community Development and the Planning Commission to review their policies and by-laws in order to make exceptions for those kinds of emergencies, such as medical emergencies, death in the family, etc., for either the appellant or proponent, that there is latitude given by the Planning Commission to table that agenda item until they are ready to attend. This is in no way to be construed as a delaying tactic by either side. Additionally, this would not affect Mr. Olwell's appeal because it would be "after the fact". Mrs. Hotton stated she would also be sending a memo to Mr. Pratt encouraging him, even in instances where there may not be a legal requirement, to hold a neighborhood meeting on issues that do affect the neighborhood that he rules on administratively. She viewed this practice as a way to prevent appeals or create tension between the neighborhood and a developer, etc. She believes the City needs to bring the neighborhood, neighbors and the people proposing changes together to air out issues and concerns. Many times people just want to be informed. TAPE #1097 City Council Reg. Mtg. Minutes March 31, 1993 Page 3 of 9 Mr. Colvin announced District #1 will hold a District Coalition Meeting on April 15, 7:00 P.M., at the Sheridan Park Recreation Center. Don Pratt, Director Of Community Development, will be the principal speaker followed by guest speaker - Spencer Horning, developer and former Council member. Mr. Colvin stressed this meeting is open to the public and everyone is welcome to attend. Mr. Dawkins reported he also participated in the march for "Drug Free Zones" and was impressed by the variety of ages who turned out for that event. He apologized to the motorist who may have been blocked in for approximately 30 minutes when the streets were closed off for the march. Mrs. Fitz displayed her "Drug Free Zone" tee shirt and shared the march and rally was an exciting event for her because she has been interested in the drug free zones for some time. She was especially pleased that it was students from Bremerton High School who brought the issue forward. She stressed everyone in the community needs to fight for a drug free city. A luncheon was held prior to the march and at that event there was a representative from Washington D.C., who is head of the Drug Coalition for the Clinton Administration and Governor Mike Lowery's Drug Coalition Coordinator for the State of Washington. Those individual were there to ask questions and see what was happening in this area. She extended a special "thank you" to the Street Department for cleaning up the area along the llth Street overpass. She reported the Ad Hoc Committee for the change in government will present their report and recommendation as an Informational Item on the April 14th City Council Agenda. Following the Committee's presentation, anyone in the audience wishing to speak on that issue will be given the opportunity to do so. A public hearing on this same subject will be held at the April 28th City Council meeting. Between April 14 and 28, any citizen interested in reviewing the report may pick up a copy at the City Council Office. PUBLIC RECOGNITION Mayor Louis Mentor reported on the progress of the mitigation project - by this evening work on the bulkhead should be completed. The replacement of the beach itself will not be finished until April 7-8 due to the need for low tides. He does anticipate some cost overruns due to the sloughing off of the bank that necessitated hauling out more dirt and bringing in additional rock to stabilize the bank area. He announced the City will have a Spring Clean up - April 20-27, and will operate from 11:00 AM to 7:00 PM. The longer evening hours will allow people the opportunity to bring their yard waste to TAPE #1097 City Council Reg. Mtg. Minutes March 31, 1993 Page 4 of 9 Evergreen Park for disposal. The landfill will be accepting couches and larger items at 1/2 the cost for disposal from Bremerton residents (proof of residency will be required). Mayor Mentor read a Proclamation whereby he proclaimed the month of April as Child Abuse Prevention Month in the City of Bremerton. Carl Johnson, Chairman of the Board of Project Family, accepted the proclamation on behalf of Mary Serbousek and the board. He thanked Mayor Mentor and City Council members for supporting Project Family and their particular role in being the child abuse prevention agency for the County. He shared the following "alarming" statistics: 4% of all children in the U.S. are victims of maltreatment, which is an increase of 43% since 1986; 4 children every day die from abuse or neglect in the U.S. Mr. Johnson stressed that any effort, individually and collectively, can lend to dealing with this increasing problem and will be much appreciated. Mayor Mentor pointed out a few months ago the City patched the holes in the side of the old Water Department/Engineering building on Warren Avenue. He noted Bremerton is hosting more and more regional conferences and on March 26 he welcomed a group of counselors for people with chemical dependencies. It pleases him that people within the community are proud to offer their City/community as a place to hold a state-wide meeting. He also thought the anti-drug march was great. Lastly, he introduced the Armed Forces candidates: TinaLouise Arciaga, Bremerton High School senior, sponsored by Lewis Chapel; Jennifer Lynn Bradley, Bremerton High School Senior, sponsored by National Bank of Bremerton; Jennifer Lynn Carter, Bremerton High School senior, sponsored by Clarke's RX Drugs; Christina M. Daluria, Olympic College student, sponsored by Land Title Company Of Kitsap County; Erika Eklof, Olympic High School senior, sponsored by KPS Health Plans; Monica Tamera Euwing, Central Kitsap High School senior, sponsored by Kitsap Optical Inc., Nikkole Kimberly Karl, Bremerton High School Senior, sponsored by Today Chevrolet; Tawnya Diane Howard, Bremerton High School senior, sponsored by State Farm Insurance; Rebecca Ann Merrill, Bremerton High School senior, sponsored by A to Z Stationers; and Katherine M. Smith, Central Kitsap High School senior, sponsored by Hayward Insurance. The candidates invited everyone to attend the Armed Forces Pageant on May 10, at the Bremerton High School Performing Arts Center. Bill Hilton, member Homes Builders Association Of Kitsap County, read into the record a letter from Housing Trend Committee, Kitsap County Consolidated Housing Authority, Economic Development Council, Home Builders of Kitsap County TAPE #1097 City Council Reg. Mtg. Minutes March 31, 1993 Page 5 of 9 and Kitsap County Board Of Realtors, encouraging the City to seriously consider the concept of shot gun houses (development of narrow lot developments). Don Larson, 135 Rainier Avenue, reported Senate Bill 5332, relating to underwater parks, passed the House Natural Resources Committee with a slight amendment adding a requirement that the Commission bring to the Legislature an estimate of fees to be charged for underwater park uses and a plan for collecting those fees prior to implementation of the program. They also want to establish that the Commission will not be liable for unintentional injuries to users of underwater parks. The next step for the Senate Bill will be the House Floor and Mr. Larson was hopeful that it would be passed at that level as well. He thanked Mayor Mentor and City Council for their assistance in getting broken windows in an abandoned house boarded up as well as junk vehicles and litter cleaned up from the 100 block of Montgomery. He attended the Parks Commission meeting on Tuesday, March 30, where he talked with them about expansion of Evergreen Park. He is hopeful that the lot at Pacific Avenue and Sheldon Boulevard could be cleaned up and possibly used as a park area for the public. He realizes that site is owned by an out-of- town owner, but he is also concerned that it is used as a dumping ground for garbage. In the past, volunteer clean up crews have cleaned that lot area and he was willing to so again this year if he could get some assistance from the City. He suggested that effort be made to clean up that lot, plant some grass on it and let the public enjoy it until it is sold. He reminded everyone of a clean up event on April 24 - Count DownTo Earth Day, First Street Dock, 11:30 A.M. He announced the Underwater Archaeological Society Of British Columbia will hold a Shipwrecks 1993 conference in Vancouver, B.C. on May 8, 1993. Brochures on that event will be available in the City Council office. Glenn Jarstad, 2823 Hefner, stated he has been following the discussion on the new route into Bremerton and believes the biggest bottleneck is the roadway from the City's sewer plant south towards Gorst. His solution to alleviating that problem area is to have the railroad overpass extended at least 8 feet, which would then allow three lanes of traffic to flow in each direction. He did not support the idea of having movable dividers along that section of the roadway. In reference to the City's utility, he encouraged the formation of a Utility Commission so that the City can retain people that have served in the Utility and their expertise can be of benefit to the City. #1486 #1563 TAPE #1097 City Council Reg. AND ORDINANCE {FIRST READING} TO REZONE FROM "FM" TO "PS"~ LOCATIONS: PENDERGAST PARK. SOUTH OF WERNER ROAD. WEST OF UNION AVENDEI APPLICANT: BREMERTON PARKS & RECREATION DEPARTMENT. #AB93-058 The Bremerton Parks & Recreation Department is in the process of obtaining a lease for a 50 acre parcel from the Utilities, and intends to construct a regional sports complex at the site. In order to receive land use approval for the park, the underlying zoning should appropriately be zoned "Parks and Schools". To facilitate this rezone, the site should have a Comprehensive Plan Map Designation of "Parks and Open Space". The purpose of this requested Plan Amendment and Rezone is to allow the property to be developed as a public park. The Plan TAPE #1097 City Council Reg. Mtg. Minutes March 31, 1993 Page 8 of 9 amendment and zoning will further protect and preserve the site for future park needs. President Fits asked the "Appearance Of Fairness/Conflict Of Interest" question with all Council members present being seated. Jaok A11ingham, Current Planning, stated the action before Council is to rezone a 50 acre site, located just to the west of Union Avenue and south of Werner Road. The Comprehensive Plan Map designation is "Forest Management" and the request is to amend the Comprehensive Plan to "Parks And Open Space". The current zoning of the site is also a "Forest Management" zoning designation and the proposed fezone is to "Parks And Schools" zone. This will further enable the Parks Department to develop the Pendergast Regional Park complex that consists of six ball fields, two soccer fields and accessory parking for approximately 500 automobiles. In order for this complex to be built, the zoning has to be in place and in order for the zoning to be approved the Comprehensive Plan Map should reflect the zoning. The Bremerton Planning Commission held a public hearing on March 16 and unanimously recommends to the City Council the Comprehensive Plan Map Amendment and the Rezone. Margaret E. Pelot, 748 Eden Road, questioned if Eden Road will be the main access to the sports complex? Vicki Vanneman, Director of Parks and Recreation Department, stated no, and that question was also resolved with five of her neighbors who were asked to serve on the design committee. Mrs. Pelot questioned if Frances street would be improved? Ms. Vanneman stated no, the plan is to use Lynden Street. Roy McInnis, 2711 Maple Street, requested clarification of the location of the sports complex. Mr. Allingham used a view graph to slow the location of the subject site. He stated it is his understanding that the proposed access to the site is Lynden Street, which cuts across the National Guard property. Mr. Dawkins reported about three months ago a work party transplanted hundreds of trees for future reuse in the Complex's landscaping. He questioned if any widening of Werner Road was being considered? Ms. Vanneman stated she believed improvements to Werner Road may be part of future consideration. There may be the need the make some improvements to Union Street, assuming Lynden is the access choice. #2065 #2077 TAPE #1097 City Council Reg. Mtg.
