She congratulated the people of Bremerton, who stepped up and passed the School Bond Levy. PUBLIC RECOGNITION Mayor Lynn Horton reported she did receive a letter from the person TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 3 of 9 who contacted her last week about the City~s recycling program and they did define more clearly her questions and concerns. Her response to that inquirywill be given at the May llth City Council meeting. At the previous meeting Roy McInnis brought up a concern about a blighted property in the Auto Center way area. The price tag for cleaning up that site, above ground, is somewhere in the range of $80,00 - 100,000. That estimate did not include funding for what might be found underground due to a number of stored vehicles, however, Department Of Ecology has indicated they feel there isn't as much underground contamination as that above ground She will be presenting a proposal to the Council along with other abatement issues within the next 1-2 months. This specific site has been talked about as an urban renewal area and along that line of discussion, she contacted Bill Mahan, Director Of Economic Development District (EDD) for the Puget Sound area, on some possible grant funding to be used not just for the clean up but for the urban renew area, which would include some street and infrastructure upgrades. She emphasized this particular blighted property shows what can happen if issues are not addressed when they are just beginning. This date Mayor Horton and Councilman Huff-Menees attended the Kitsap Regional Planning Meeting. At that meeting, they received new brochures for the K-Prep Program, one having to do with a business training program. Over the next several months they will be conducting training at'a cost of $50.00 for business orientation per business and Safety Team training for $25.00 per person. Also, there will be a K-Prep training program for Neighborhood Captains. The immediate goal is to identify Block Captains similar to the Neighborhood Block Watch program. She emphasized K-Prep is a voluntary program, but it is a conduit to obtain training. During her term as Mayor, she will be working proactively to get people signed up for Captains for the K-Prep program and the Neighborhood Block Watch program. One of her goals is to implement one Block Watch program and one K-Prep Program each week. She has calculated it will take approximately seven years to get everyone under these programs if her goal can be reached. Additionally, three City staff members (Kathleen McCluskey, Eddy Chu, Captain Craig Rogers) were sent to a FEMA program in Maryland, which was funded by FEMA. Reports back on that program have been excellent and effort will be made over the next quarter to work on the City~s internal preparedness program and then reach out into the community with that program. Mayor Horton was pleased to report on a very successful Christmas In April program, which involved four homes being repaired, painted, landscaped, etc. The homeowners of the four homes are all senior aged women and were very grateful for the work that was accomplished by the many volunteers. An ad will be placed in The TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 4 of 9 Sun thanking everyone for their participation in that worthwhile effort. Just prior to this meeting, she interviewed three candidates for the Rotary's Mayor's Award For Community Service and the winner of that award will be announced on May 11. She was very impressed with the commitment these young people made'to their community through volunteering their services. Up coming events include: (1) Teen Dance, May 7, 8:00 P.M - 12:00, at the Sheridan Park and Recreation Center, admission is $5.00; (2) Vanguard Military Picnic, May 14, (3) TCI Queens Pageant, May 16, 7:00 P.M. Vicki Vanneman, Director of Parks and Recreation, and Arvilla Ohlde, Former Bremerton Parks and Recreation Director, presented an award from Washington RecreationAnd Parks Association (WRPA) to S. P. "Pat" Carey, a Parks and Recreation Commission member for the past 34 years. This award is given annually for a citizen who has made a significant contribution to their profession. Ms. Vanneman and Ms. Ohlde agreed to jointly submit an application to nominate Mr. Carey for the award. Ms. Vanneman read into the record the following statement: Mr. S. P. "Pat" Carey, a Bremerton Park and Recreation Commissioner for the past 34 years, could provide inspiration to anyone of us in the Parks and Recreation field. A retired Puget Sound Naval Shipyard worker, Pat has committed thousands and thousands of volunteer hours to the acquisition, protection and preservation of parks 'and open space in the Bremerton community and throughout the Puget Sound area. Whether it was leading the fight to preserve Blake Island for a state park, convincing Mayor Jarstad to buy up surplus government property in Bremerton for parks and open space purposes, or gathering thousands of:signatures on initiative 215 petitions 30 years ago this year, Pat has set a shining example for us all". Recently, Pat has fallen victim to the debilitating 'affects of Parkinson's disease and unable to personally accept the award, however, his wife Margaret accepted it on his behalf. Ms. Ohlde gave a brief rundown of the many contributions Pat and Margaret Carey have made not only to this community, but through out the State. Mim Heiss Krabler, Director of the Bremerton/Kitsap Visitor And Convention Bureau, acknowledged to the City that this is NATIONAL TOURISM WEEK and the month of May is acknowledged as NATIONAL TOURISM MONTH. She encouraged everyone to get out and travel about in our own area or visit other parts of the State of Washington. Kal Leichtman reminded everyone that on May 10th he and Brian Mueller will hold a debate with Mayor Horton and Larry Stone on whether or not the City of Bremerton should be disincorporated. This program will be televised live on Access Channel 12 and TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 5 of 9 rebroadcast at a later date. Lon Howard, member of the Bremerton Central Lions Club, expressed a public "thank you" to the public for the help given during their club's recent Radio-thon held in March. Two of their major fund raising efforts are the "White Cane Days" and Radio-Thon campaign and he reminded everyone that theWhite Cane Days were coming up on Friday and Saturday (May 6 and 7). Armadeus Davidson, Magnuson Alternative School student, invited everyone to attend the grand opening of the Cracked Egg Gallery located at 245 4th Street, on May 10, 7:00 P.M. This gallery has been established to display the art works/poetry created by students of the Magnuson school. Mr. Davidson expressed his appreciation to the many businesses and individuals who contributed materials/funds to renovate the gallery facility. Mayor Horton stated she was very impressed with the amountof work accomplished by the young people in their setting up the gallery and their works of art. She hoped the public would support this endeavor by stopping by and viewing the creativity of these talented youth. There has been some concern that the City is renting space in competition with other businesses, however, she wanted to assure the public that the City is providing the space for the Cracked Egg Gallery on a short of loan program. Larry Stone, member of the Bremerton Central Lions Club, stated the Lions Club will be raising over $200,000 inthe Bremerton area this year and the majority-of those funds are seeded back into the community. One of their major projects is the Sight Conservation Foundation, which was founded in 1969. He hoped people would Support the "White Cane Days" because it is such a worthwhile endeavor. Gordy Byrd reported at last he'wi11 be receiving a $500.00 check from the Bremerton School District, the proceeds from a benefit .dance that was held by Bremerton High School students to benefit his shelter for the homeless that he is trying to put together. Recently, he attended a Mariner's Game in Seattle where he observed kids doing a better job of not'littering than many adults. Roy McInnis, 2711 Maple Street, thanked Mayor Horton for the information she provided on the blighted property located in the Auto Center Way area and adjacent to the Sinclair Baptist Church. He announced Sinclair Baptist Church would hold their annual Revival meetings starting on Monday, May 9through May 13, starting at 7:00 P.M. This program is open to the public. Mary Lou Long, Baymont.Place, asked if she understood correctly a prior statement by the City that the State has mandated that the TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 6 of 9 City provide a Stormwater Management Plan by July 19947 President Fits stated Mrs. Long was correct. Mrs. Long stated she would like to know what the Stormwater Management project consists of, if there is a staff member working on it, or has it been contracted out to another agency or consultant, where the City stands on providing an overall stormwater management plan to come into compliance with what is being mandated by the State? The City has already initiated a $4.00/per month per household unit stormwater fee on a partial capture of finances for this particular endeavor. The City has also indicated in the past that the stormwater that runs off the streets will have to be treated, so that means there will have to be some kind of collection system and treatment centers/locations that will extract the contaminates from the water prior to it entering Puget Sound. She questioned: (1) how many of these treatment centers will be built and how much they will cost; (2) once the stormwater separation is done how will that water be detained until it has been treated; (3) how much will the detention tanks cost; (4) how much will the over all project finally cost the citizens of Bremerton? If this will be a major project, how will the City go about charging citizens? She referenced a document from the City of Seattle on their services and fees concerning surface water management. Seattle's process collects $36.57 per single family or duplex parcel on property taxes annually. According to the City's present charges for a single family residence, more will be collected than what is being collected in the City of Seattle. She referenced B.M.C. 15.06.040, which states: "... Flows for summer usage for residential customers shall be determined based on the previous six month average winter domestic water usage by a customer provided the account was in effect and active for at least two billing periods of the preceding Six months. Calculation periods shall be determined by the Utility based on the usage and billing cycles". She pointed out that some residents choose to leave Bremerton during the winter months and spend that time in warmer climates, which results in their having very low water consumption during those periods. This means when they come back to the City of Bremerton and use their water/wastewater service at a maximum they are possibly getting a cut rate. She questioned how many citizens of Bremerton fall into this category? Mr. Neville pointed out to Mrs. Long that the Utility Department has a hotline where she could get many of her questions answered immediately rather than waiting a week. 6A - APPOINTMENT OF AL DUKE TO THE POSITION OF ASSISTANT FIRE CHIEF/AUTHORIZATION TO BE PLACED AT MANAGEMENT STEP-LEVEL ~AB94-08S The City has the authority, under BMC 250.032(a), to authorize the starting salary of an individual promoted to accurately reflect his/her tenure and experience. #1974 #2160 TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 7 of 9 Fire Chief Mick McKinley stated Mr. Duke has served in the capacity as both Deputy Chief, which has been eliminated in the City, and now as the Acting Assistant Chief for well over 1-1/2 years fulfilling the duties at a much lower rate of pay. Mr. LaW pointed out because this is a Civil Service position, the only area the Council. is required. to vote on is the salary level. This is another example of an outstanding Civil Service system that will have the people qualified promoted to the level they are qualified to handle. Public comment - none. M/S/C(Law/Neville) to position of Assistant In Favor: Abstain: approve the appointment of A1 Duke to the Fire Chief and set at pay level "step 5". Farr, Law, Huff-Menees, Dawkins, Colvin, Winters, Neville, Fitz Overson Motion carried. Mayor Lynn Hotton administered the Oath Of Office to Assistant Fire Chief A1 Duke. Asst. Fire Chief Duke thanked the members of the Bremerton Fire Department, his wife Amy and his parents for their support. 7A - ORDINANCE NO. 4459 (SECOND READING) APPROVING WEST HILL8 ANNEXATION I ANDFIXING THE EFFECTIVE DATE OF ANNEXATION, ~:AB94-085 Councilman Morrie Dawkins stepped down from this issue due to an appearance of fairness/conflict of interest. Public comment - none. M/S/C/U(Colvin/Huff-Menees) to pass Ordinance No. 4459, on second reading, annexing approximately 58 acres known as the West Hills Annexation I, which lies west of Cottman Avenue and is bordered by the boundaries of the City on the north, west, and most of the southern side to the City of Bremerton, and fixing the effective date of the annexation. Councilman Dawkins returned to the City Council 'Chambers at 6:44 P.M. 8A - PUBLIC HEARING ANDFIRSTREADING OF ORDINANCE TO ESTABLISH THE LID FOR SEWER EXTENSION IN A PORTION OF MEATON WAY (LID #AB94-090 The City has received a petition requesting formation of a Local Improvement District (LID) to fund construction of a sewer TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 8 of 9 extension along portions of Wheaton Way. Attached is a LID boundary map. On April 11, 1994, City staff met with property owners in the District to discuss the project. On April 13, 1994, City Council passed Resolution No. 2464 establishing May 4, 1994 as the hearing date on formulation of the LID. The estimated total project costs are $95,850. The estimate assessment per front foot will be $89.57. President Fitz stepped down from this issue due to a conflict of interest and Councilman Morris Dawkins assumed the Council President role. Tim Riohard, Senior Engineer, described the LID boundary'- along Wheaton Way, beginning approximately 600 feet southeast of the intersection of Campbell way and Wheaton Way and continues to the vicinity of Magnuson Way and Wheaton Way. It consists of those parcels between Wheaton Way and the Port Washington Narrows. The project itself will consist of const.ruction of sanitary sewer to the existing sanitary sewer, which is approximately 100 feet northwest of the project boundary to the end of the LID boundary near Magnuson Way (1170 feet in length with a S-inch sanitary sewer line). Petitions were received requesting the LID and a meeting with the property owners was held on April 11, to discuss and explain the LID. The percentage of petitions received for formation of the LID is 67.8% by area and 69.2% by front footage. The total estimated cost of the project is $95,850 and the ordinance incorporates the recently passed City policy on LID's with the City's contribution being the design and Administration. costs at an estimated value of $9,150.00 and the estimated LID cost born by the LID is $86,700.00, amounting to approximately $81.02 per front foot. The original estimate of that cost was $89.57, and the reduced amount is brought about because of the City's contribution. Mr. Neville asked if there had been an update made to the map of the LID boundary area in Lot #6? Mr. Richard states yes, the ordinance as written and originally conceived did not include the two parcels. Each of the two parcels are 30 feet wide, do not have any frontage on Wheaton Way and are approximately 100 feet away from the Wheaton Way right-of-way. Those parcels were not to be included in the LID and to his knowledge they could never be developed. Mr. Dawklns asked if they were separate tax lot numbers? Mr. Riohar~ states yes. Public comment - none. Mr. Overson asked Mr. Richard to explain the difference of front footage cost between the map in the Agenda packet and the one Mr. Richard handed out. Mr. Richard explained there is no difference #2639 TAPE #1198 City Council Mtg. Minutes May 4, 1994 Page 9 of 9 in front footage costs between the two maps. The original intent was not to include those parcels in the LID and they do not have any front footage on Wheaton Way. Mr. Overson stated then the real intent of the owners of.those parcels is to not include them as part of the LID. Mr. Richard stated that was correct. Mr. Dawkins questioned if the owner of the two lots ever wanted to build on them and connected to the sewer, would they have to join the LID at that time and be assessed a fee? Mr. Richard stated yes. Mr. Overson questioned if there were any unbuildable lots included in the Kitsap Lake LID project? Mr. Riahard stated no, the only unbuildable lot that he was aware of at that location was the City's lot, which was excluded from the LID due to the easements running through it. Mr. Colvin questioned if one of the other current owners purchased those two lots, would there be an increase to their LID assessment? Mr. Richard pointed out if someone purchased the two lots there would be no increase to the front footage, thereby not making any change to the identified assessment. Mr. Neville asked a procedural question: "are the actions of the City Council still legal and binding even though they did not ask if anyone from the public felt any 'member of the City Council should step down under the appearance of fairness/conflict of interest question? Ian Sievers, City Attorney, explained asking the"appearance of fairness/conflict of interest" question is not an absolute requirement but rather a safeguard; and nothing illegal was taking place by not asking that question. It is primarily an extra protection. By State law, Council members are obligated to raise it ontheir own and asking the question Just reminds them of any declaration that needs to be made. M/S/C/U(Huff-Menees/Colvin) approve ordinance, on first reading, establishing the Wheaton Way Sewer Extension Local Improvement District (LID #328). With no further ' meeting adjourned at buslne~~ KATHLEEN L. Mc~~CLUKEY, 6:54 P.M. City Clerk City of Bremerton KLM/EF/me cc: Normal Distribution File/Vault
